Any person wishing to discuss any item not appearing on the agenda may address the Architectural Review Commission via the Zoom session at this point by giving his/her name and address for the record. Remarks shall be limited to a maximum of three (3) minutes unless the Architectural Review Commission authorizes additional time. Because the Brown Act does not allow the Architectural Review Commission to take action on items not on the Agenda, members will not enter into discussion with speakers but may briefly respond or instead refer the matter to staff for a report and recommendation at a future Architectural Review Commission meeting. Upon a motion by Commissioner Mclntosh, seconded by Vice Chair Lambell, and a 7-0 vote of the Architectural Review Commission, Case No. MISC 21-0017, was continued subject to the following: 1) Provide a more detailed plan and rendering which accurately reflect proposed materials and overall request; 2) Redesign the wall to incorporate more design interest through the inclusion of materials which are compatible with the existing home, increase the undulation to break up the plane of the wall, and potentially add a decorative wall cap; and 3) Consider options to increase the wall setback from the curb face such as modifying the pool size, and shape to allow for more conformance to requirements of the Fence and Wall Ordinance (Palm Desert Municipal Code 25.40.080). Mr. Melloni noted this item started as a code compliance case as the owner did not obtain a permit or City approval for modifications made to the awning to accommodate an expansion of the restaurant. Discussion on the item ensued with Commissioners providing comments and concerns for the project. Upon a motion by Vice Chair Lambell, seconded by Commissioner Mclntosh, and a 7-0 vote of the Architectural Review Commission, Case No. SARC 21-0008, was continued subject to the following: 1) Break up the awning length, avoid a single uninterrupted length of awning; 2) Explore other options for awning including material, style and design; 3) Revisit neon sign and consider options which incorporate a more artful design; and 4) Provide more detailed plans and renderings. Mr. Swartz introduced the applicant who provided a detailed presentation for the project. Discussion on the item ensued with Commissioners providing comments and concerns for the project. Upon a motion by Vice Chair Lambell, seconded by Commissioner Vuksic, and a 7-0 vote of the Architectural Review Commission, Case No. MISC 21- 0019, was continued subject to the following: 1) Windows for all plans should be recessed; 2) Avoid the use of elevated landscaping; 3) Pot shelves should not be used in place of architecture; 4) Enhanced features should be provided for all street exposed lots; 5) Revisit material for fascia detail, avoiding the use of wood; 6) Walls for porches and Recreation Center should be thicker; 7) 4 PRELIMINARY MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 13, 2021 Consider a change in plane between top and bottom of home for Desert Prairie plan; 8) Revisit brick elements throughout all plans; 9) Provide illustration which includes venting and solar panels to demonstrate how they interact with proposed roof's architecture; 10) Revisit color palette, specifically "Stark White"; and 11) Tree selection should be mature and durable enough to withstand high wind exposure. The project includes a Change of Zone from five (5) dwelling units per acre to twelve (12) dwelling units per acre, a General Plan Amendment, a Precise Plan application, Tentative Parcel Map 38033, and a Mitigated Negative Declaration for environmental purposes. Commissioner McAuliffe advised the Commission he would be recusing himself due to a conflict of interest as he is a part of the advisory team for this item. Associate Planner, Kevin Swartz, presented the item. Mr. Swartz noted this item was brought before the Commission at the Architectural Review Commission meeting held May 25, 2021. Discussion on the item ensued with Commissioners providing comments and concerns for the project. Upon a motion by Commissioner Vuksic, seconded by Commissioner Mireles, and a 5-0 vote of the Architectural Review Commission, Case No. PP 20-0010/TPM 38033/CZ and GPA 20-0002, was approved subject to the following: 1) Consider extending parapet ends 18 to 24 inches on two-story roof plan. (AYES: Lambell, Latkovic, Mireles, Van Vliet and Vuksic; NOES: None; ABSENT: McAuliffe, Mclntosh). 3. CASE NO: PP 19-0006 NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of a recommendation to the Planning Commission to approve a new single-story, 3,452 square-foot residential duplex. APPLICANT AND ADDRESS: Kola Olatunbosun, Palm Desert, CA 92260 5 PRELIMINARY MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 13, 2021 LOCATION: 73721 San Nicholas Way ZONE: R-2 Associate Planner, Nick Melloni, presented the item. Mr. Melloni noted this will be the commission's third review of this item. Mr. Melloni stated the project is a significant improvement to the previously proposed plan and is overall a good design, therefore, staff recommended approval of the project as presented. Discussion on the item ensued with Commissioners providing comments and concerns for the project. Upon a motion by Vice Chair Lambell, seconded by Commissioner Vuksic, and a 6-0 vote of the Architectural Review Commission, Case No. PP 19-0006, was continued subject to the following: 1) Consider adding and/or extending overhangs to avoid runoff along the building walls; 2) Chimney on elevation should be revised to reflect the rendering; 3) An interior roof drain should be added for drainage on eyebrows; 3) All windows on the north elevation should be recessed; 4) Replace the existing east and west fences with a new fence or wall material which is permitted by the Palm Desert Municipal Code. (AYES: Lambell, Latkovic, McAuliffe, Mireles, Van Vliet and Vuksic; NOES: None; ABSENT: Mclntosh). C. MISCELLANEOUS ITEMS 1. SELECTION of Ad-Hoc Subcommittee Member for Lupine Plaza. Associate Planner, Kevin Swartz, advised the Commission, during the pandemic, City Council authorized the temporary closure of a portion of Lupine Lane to allow the setup of tables and chairs for public use. City Council has directed staff to solicit proposals for the purpose of permanently closing this portion of Lupine Lane to create an outdoor plaza area. The Request for Proposals (RFP), is requesting services for Architecture, Engineering and Landscaping. City Council has authorized the City to create an Ad Hoc Subcommittee once the RFP has been awarded. The subcommittee will be comprise of a member from City Council, Parks and Recreation Commission, Art in Public Places, City Staff, Architectural Review Commission, Planning Commission, and members of the public from surrounding businesses. Deputy Director of Development Services, Eric Ceja, advised it is anticipated the subcommittee will meet approximately three times to provide comments on design and be champions for the project. At the request of several Commissioners this item was deferred to the next meeting to allow Commissioners time to consider volunteering for the subcommittee. 2. Member Update Form and Ethics Training for Commissioners Recording Secretary, Melinda Gonzalez, advised the Commission they were provided an annual Member Update Form which requests their most current contact information. Commissioners were requested to complete and return these forms to the recording secretary at the next meeting or by email. Additionally, Mrs. Gonzalez advised Commissioners are required to complete ethics training and will be receiving an email from the recording secretary with 6 PRELIMINARY MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 13, 2021 a link to complete the required two hour minimum ethics training. At the conclusion of the ethics training, Commissioners will receive a certificate of completion. Commissioners were requested to print, sign and provide the certificate of completion to the recording secretary at the next meeting or by email. VI. COMMENTS Former ARC Commissioner, Allan Levin, took an opportunity to say a proper goodbye after twelve years on the Commission. All Commissioners thanked Mr. Levin for his time as an ARC Commissioner. Mr. Levin also commented cases such as Lennar on today's agenda, which require substantial time, should have their own meeting. Commissioner Vuksic requested City staff try to avoid allowing incomplete and/or inaccurate submittals to be presented to the Commission. VII. Some of these procedures included restriction or closure of indoor activities, limited capacity in closed buildings and the introduction of more outdoor dining. Many cities were faced with varying challenges, including the need to dedicate public space for the use of outdoor activities. The City of Palm Desert has taken an approach that allows outdoor dining through their "Outdoor Dining Deck" program. These extensions of the walkway allow for enhancement of the pedestrian environment which can help make the street feel safer and more comfortable for people shopping, running errands, and accessing services in the City. Typically, a Dining Deck is a built platform that extends out from the sidewalk to the width of the adjacent parking space. These decks can be used for an expanded dining area or an area to re-route pedestrian travel around expanded outdoor dining in the public sidewalk. These guidelines are intended to be a "living document" due to the rapid development of this program. The City of Palm Desert is focused on safety, accessibility and drainage in the design of these decks. As new regulations and developments occur, this guideline will undergo periodic revisions. 2.0 APPROVAL AND REVIEW STANDARDS All dining decks must submit a Temporary Use Permit (TUP) Application for review and approval with the City's Development Services Department. Applicants shall submit drawings, construction methods, site plans, and identify materials used in their dining deck design. Once received, City staff will review the TUP application and submitted materials, for compliance with these Dining Deck Guidelines. Page 3 '"� DRAFT - Outdoor Dining Deck Design Guidelines . � Pl�L11�1 DE�t I�I July 27, 2021 t'�Ifi . � 3.0 SAFETY CRITERIA Many factors go into selecting whether or not a business can implement a Dining Deck; however, these factors are routed in the general public's welfare and safety while maintaining the ability for safe and efficient motoring. In addition, accessibility and drainage are two other key considerations. As time progresses, the City of Palm Desert maintains a progressive approach as to how to implement this program. This section documents what businesses can take advantage of the Dining Deck program. The City intends to allow this to continue beyond the COVID-19 restrictions and going forward into the future. Many aspects have to be reviewed, as there are many departments of the City that must be involved. Planninq The Planning Division implements the policies and objectives of the community that are set forth in the City of Palm Desert's General Plan, Zoning Ordinance, and Specific Plans. The Planning Division also reviews new development proposals to ensure that the City's design and development standards, and goals and policies, are executed in the development of the City. Buildinq and Safetv The Building and Safety Division is dedicated to providing the highest level of code compliance, inspection services, and plan review to every architect, engineer, developer, contractor, business, and property owner that resides or works within our community. The Division strives to demonstrate fairness, equality, and the highest standard of professional ethics in providing our services while enforcing state construction laws and local ordinances that protect our citizens. The City of Palm Desert adopted its first building code in 1973. Public Works The Public Works Department is responsible for the planning, design, construction, operation, and maintenance of the City's infrastructure including streets, sidewalks, storm drains, traffic signals, and landscaping. The department also oversees graffiti removal, engineering review of land development plans, and implementation of City-funded improvement projects. Each of the above listed departments has a vested interested in the development of the Dining Decks. Each business much submit a Temporary Use Permit application should they wish to participate the program, and a copy of the permit has been attached in the appendices of this document. In addition, this application can be obtained from the City of Palm Desert's website Page 4 '"� DRAFT - Outdoor Dining Deck Design Guidelines . � Pl�L11�1 DE�t I�I July 27, 2021 t'�Ifi . � 3.1 Street Desiqn Criteria—Where are Dininq Decks Allowed In order to maintain safety of both the pedestrian as well as the motoring public, the City of Palm Desert has determined certain criteria on which they will allow dining decks. Below is a summary of the minimum requirements. TEE X INTERSECTION) Parking Lane of 8' or X More Parking Lane under 8' X Angled Parking Stalls X 3.2 Barrier Desiqn The City of Palm Desert has committed to the safety of its pedestrians and motoring traffic, and for this reason, Dining Decks shall be protected using standard K-Rail available from construction supply businesses. These barriers can be composed of concrete or durable plastic materials intended to be filled with water provide a solid barrier between the vehicular traffic and the dining decks. K-Rail are sometimes referred to as Jersey Barriers At a minimum, barriers must be: 36-42 inches high; not easily moved, altered, or stolen; stable and sturdy enough not to fall over or be pushed over (must withstand 250 Ibs of force). Parallel to the travel lanes, between the deck and the travel lane, a solid K- Rail barrier shall be provided. On the departure side of the deck, a single K-Rail shall be placed in order to prevent cars backing up during a parking maneuver from colliding with the deck. As an additional safeguard, a parking wheel stop shall be provided, 4-feet from the last k-rail to further protect the dining deck from someone backing up into a parking stall. It is also an option to provide this on the approach side of the dining deck. 3.2.2 Anqled Parkinq Area Protection Similar to the parallel parking area Dining Deck, the use of K-Rail shall be implemented to protect Dining Decks placed in angled parking stalls. Since these areas tend to have a greater depth, the decks should be placed at the end of the stall and outside of the traveled way. A conceptual layout has been provided in Figure 1. The aesthetic and construction guidelines are outlining a minimum standard, and are not intended to stifle creativity. All submittals will be reviewed on a case by case basis, and will be deemed acceptable (or not acceptable) based on architectural merit, safety, and compliance with these design guidelines. Dining decks are meant to provide additional outdoor seating options for patrons and add another layer of interest to the street scene. 4.1 DECK CONSTRUCTION STANDARDS Decks may use one of the following construction methods: OPTION 1 2x4, 2x6, or 2x8 pressure treated wood covered with a 5/8" min marine grade plywood subfloor. The plywood is to be screwed, not nailed, into the 2x members. The finish may be a non-slip tile or an outdoor carpet. An adequate street drainage system needs to be provided adjacent to the curb. This could be either an open space or metal tube below the deck, or wood framing adjacent to the curb could be raised off the street high enough to allow for storm water to pass underneath it. The top of the brick pavers are to be flush with the top of the curb. The edges of the deck, other than on the curb side, are to be finished with a steel angle or plate. Corners of the steel edging may be connected with steel angles (on the inside) and bolts. The visqueen should extend up the inside vertical face of the edges, except on the curb side. Street drainage is to be provided with a plate steel tube adjacent to the curb. The top of the tube is to be flush with the top of the pavers and the top of the curb. This can also be designed so that the top piece is removable plate steel that drops into place. These barriers shall be covered with acceptable materials so that they are not visible. Acceptable cover materials include, but are not limited to metal, ceramic tile, stone, cementitious products, etc. Some of these materials may be applied over a boxed out sub- frame that fits over the k-rail, or water-filled barriers. See Diagram 5. Unlike Diagram 5 however, it is preferred that the entire barrier is covered with the finish material. The acceptability of any material is subject to review. This is because different materials have various levels of quality and attractiveness. They also can be applied in a variety of ways, some of which may be more attractive than others. The following vertical barrier materials would generally not be deemed acceptable: Vinyl pickets or lattice work, painted wood pickets, plastic sheets, fabrics. This item was previously reviewed by the Architectural Review Commission (ARC)at the meeting of July 13, 2021. The ARC commended the applicant for the design changes and continued the item with direction for the applicant to address the following items: 1. Provide a detail of a method to prevent runoff from the sloped roof directly onto the vertical surfaces of the building fascia; a. The Commission voiced that the detail would be important to preserve the clean lines of the new design by avoiding large flashing. 2. Revise the elevation drawings to match the chimney detail shown in the three- dimensional renderings. 3. Provide an interior roof drain for the eyebrow over the main building entrance. 4. Recess all windows on the north elevation. 5. Replace the existing east and west property fences with a new fence or wall to meet requirements of the Palm Desert Municipal Code. In response to these items, the applicant has made the following design changes: 1. Revised the design of the roof over the entry to feature a 12-inch overhang to prevent runoff directly onto the vertical surfaces. a. Refer to the elevations of Sheet P4 and preliminary roof plan on Sheet P5. 2. Revised the elevations to show the chimney design preferred by the ARC. 3. Provided a 3-inch diameter roof drain on the entry eyebrow element. The drain is located inside the front wall of the duplex near the entrance to Unit B. a. Refer to the floor plan shown on Sheet P3 and roof plan on Sheet P5. 4. Recessed the windows and entry doors on the north elevation by 3 inches. a. Refer to sheet P3. PP 19-0006 — San Nicholas Way Duplex Page 2 of 2 July 27, 2021 5. Provided a new 42-inch block wall along the side property lines in the front yard, which will transition to an existing 6-foot high wood fence along the side property lines. Zoning Ordinance Summary The project is required to receive design review approval by the ARC prior to proceeding to the Planning Commission in accordance with Palm Desert Municipal Code (PDMC) Section 25.68.020. Required findings for the ARC are contained in PDMC Section 25.68.040. Staff Recommendation The applicant has generally responded to the comments provided by the ARC at the July 13, 2021 meeting. The applicant has responded to comments #2 through #4 by amending the design. For item #1, the applicant has chosen to use a 12-inch overhang to divert runoff away from the building at the entry tower on the north elevation. This design revision avoids the use of large flashing and prevents issue of streaking along the vertical fascia of the building. No changes are shown for the carport, which may have similar issues for streaking. The applicant did not believe the carport would face the same issues due to the size of the fascia. Staff recommends conditioning the applicant to implement a design to address drainage on the carport for staff approval and asking it be shown to the ARC with the final plans. For item #5, the applicant shows a new block wall in the front yard, which transitions to the existing wooden fence along the side yards.
