ORAL COMMUNICATIONS None IV. APPROVAL OF MINUTES A. MINUTES of the Architectural Review Commission meeting of July 13, 2021. Rec: Approve as presented. Upon a motion by Commissioner Vuksic, seconded by Commissioner Mireles, and a 7-0 vote of the Architectural Review Commission, the minutes for July 13, 2021 were approved as presented. (AYES: Lambell, Latkovic, McAuliffe, McIntosh, Mireles, Van Vliet and Vuksic; NOES: None; ABSENT: None). MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 27, 2021 V. CASES It should be noted, associated staff reports, memos, attachments and discussion on the following items can be viewed by visiting the Architectural Review Commission Information Center website at, hops://www.citvofpalmdesert.org/our-citv/committees- and-commissions/architectural-review-commission-information-center. A. FINAL DRAWINGS At the request of the applicant and with Commission approval, the first discussion item was Case No. PP 19-0006, listed under Preliminary Plans, followed by "Outdoor Dining Deck Design Guidelines," under Final Drawings. The agenda resumed as listed for the remainder of the meeting. 1. Outdoor Dining Deck Design Guidelines NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of approval and adoption of the Outdoor Dining Deck Design Guidelines Manual which will provide uniform design and safety guidelines for temporary dining decks throughout the City of Palm Desert. APPLICANT AND ADDRESS: City of Palm Desert LOCATION: City-wide ZONE: N/A Commissioner Vuksic was recused from this item due to a conflict of interest as his firm provided the proposed dining deck guidelines manual and he will be presenting the item. Associate Planner, Kevin Swartz, provided a brief presentation on the item including a summary of the background for the implementation of the Dining Deck program and an overview of the current safety and design guidelines. Mr. Swartz turned the presentation over to John Vuksic, applicant, who provided a detailed presentation of the proposed outdoor dining deck guidelines manual. Mr. Swartz advised should the Architectural Review Commission (ARC) adopt the proposed guidelines, City staff will mail out a letter to restaurant owners with existing dining decks advising they will need to make any necessary modifications to conform to the newly established safety and design guidelines by mid -October or November. Failure to comply with the new guidelines could lead to the revocation of their temporary use permit (TUP). Planning staff will be revisiting this item with City Council at the end of the year to reassess the current situation and any changes to the law which would impact the use and/or design of dining decks. Discussion on the item ensued with Commissioners providing comments and questions regarding the design guidelines. Mr. Swartz advised the adopted guidelines would be used by City staff for the review and approval of dining deck submittals. Applicant submittals will be reviewed by all necessary departments including Planning, Building and Safety, and Public Works. 2 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 27, 2021 Upon a motion by Vice Chair Lambell, seconded by Commissioner Latkovic, and a 6-0-1 vote of the Architectural Review Commission, the Dining Deck Design Guidelines were approved subject to the following: 1) Consider including additional temporary design options for flooring and revisit images to ensure they reflect permissible options; 2) Paragraph layout for "Drainage Design" should be revised to allow for easier review; and 3) Applicant submittals should include the signature of a licensed Architect or Engineer. (AYES: Lambell, Latkovic, McAuliffe, McIntosh, Mireles, and Van Vliet; NOES: None; ABSTAIN: Vuksic ABSENT: None). B. PRELIMINARY PLANS 1. CASE NO: PP 19-0006 NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of a recommendation to the Planning Commission to approve a new single -story, 3,452 square -foot residential duplex. APPLICANT AND ADDRESS: Kola Olatunbosun, Palm Desert, CA 92260 LOCATION: 73721 San Nicholas Way ZONE: R-2 Associate Planner, Nick Melloni, presented the item. Mr. Melloni noted the Commission reviewed this item at the ARC meeting held July 13, 2021. Discussion on the item ensued with Commissioners providing comments and concerns for the project. Upon a motion by Commissioner Vuksic, seconded by Commissioner Mireles, and a 7-0 vote of the Architectural Review Commission, Case No. PP 19-0006, was approved subject to the following: 1) Carport eyebrow should be thicker to accommodate the addition of an interior roof drain and roof tiles on carport should be flush with the north and south side fascia's; 2) Entry tower should be reverted back to previous design with no roof overhang; 3) Plans and elevations shall be coordinated to be consistent and accurate; and 4) The applicant shall submit a color and material board, which includes a sample of the proposed roof tile, to Planning staff. (AYES: Lambell, Latkovic, McAuliffe, McIntosh, Mireles, Van Vliet and Vuksic; NOES: None; ABSENT: None). C. MISCELLANEOUS ITEMS 1. SELECTION of Ad -Hoc Subcommittee Member for Lupine Plaza. Associate Planner, Kevin Swartz, provided a brief summary of this item noting City Council has authorized staff to solicit proposals for the purpose of permanently transforming Lupine Lane to create an outdoor plaza area and also authorized the creation of an Ad Hoc Subcommittee. The subcommittee will provide input for conceptual plans which will be presented to City Council tentatively by the end of the year. 3 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 27, 2021 Chair Van Vliet addressed the Commission and asked if there were any interested Commissioners. Commissioner McAuliffe volunteered for the Ad Hoc Subcommittee. Vice Chair Lambell moved to, by minute motion, appoint Commissioner McAuliffe to the Ad Hoc Subcommittee. The motion was seconded by Commissioner Vuksic, and carried with a 7-0 vote. (AYES: Lambell, Latkovic, McAuliffe, McIntosh, Mireles, Van Vliet and Vuksic; NOES: None; ABSENT: None). VI. COMMENTS Vice Chair Lambell inquired about Avenida Palm Desert, located on Portola Avenue, and what the status was regarding the exposed roof equipment and ladder. Associate Planner, Kevin Swartz, advised they recently submitted renderings for the screening of the roof top equipment. Based on the renderings the applicant was advised they would need to go to the ARC for approval. The applicant is preparing a packet and anticipates going before the ARC in August. Senior Planner, Rosie Lua, addressed the Commission and stated she has considered comments made by Commissioners and staff regarding ARC meetings and will be working on ways to enhance and focus the ARC meetings and cases presented. Ms. Lua encouraged Commissioners to provide her with any additional comments and ideas which would assist with this goal and to request any trainings they feel may be beneficial. VII.
