Recommendation By Minute Motion, waive further reading and pass to second reading Ordinance No. 1369 revising Chapter 2.68 of the Palm Desert Municipal Code relative to the Art in Public Places Commission. Committee Recommendation The preliminary changes to the Art in Public Places (AIPP) Commission bylaws were taken to the AIPP Commission meeting of August 11, 2021, to include the change to the Commission's name. There were no objections to the changes. Background The Mayor and Mayor Pro Tem have been meeting with City staff to review the City's committees and commissions general make-up to include membership and bylaws. One modification that was proposed is to change the name of the Art in Public Places (AIPP) Commission to Cultural Arts Committee. Additionally, upon review of the AIPP bylaws, it was suggested that they be clarified to indicate what is specifically under the Commission's purview. An additional suggestion was for the Commission to provide ideas for more expansive City -sponsored art opportunities with a broadened scope of art mediums. With regard to clarifying the Commission's purview, the following is a list of projects that would be considered covered under the revised bylaws: — Art projects paid for with developer impact fees — i.e., developer public art projects on private property reimbursed with public art funds such as the upcoming Chandi and DSRT Surf projects Public Art projects in the public right of way or City -owned property paid for with Public Art or City funds Public Art Acquisitions or Donations Staff Report Ordinance revising Chapter 2.68 of the Palm Desert Municipal Code September 30, 2021 While the Commission would not have jurisdiction over art on private property or with regional projects, the bylaws would position the Commission to work with City departments to ensure that art is incorporated into the initial planning of public projects. As such, staff has consulted with the Public Works Department on their Capital Improvement Project Plan and has identified that the Commission can assist with integration of public art for the following projects as they come up over the next several years: - Dinah Shore Park (North Sphere) Palm Desert Visitor Center - North Sphere Fire Station — Lupine Plaza San Pablo Street Improvements Phase I and II As for the first four, staff will maintain communication with Public Works to ensure that the Commission is apprised of the schedule and ways that the Commission can get involved with integrating public art into the projects. With regard to the latter, staff is currently working with the Commission and Public Works on ideas for these projects and others as they come up. City staff plans to work on annual plans to coincide with the budget that will include funding to integrate public art into prioritized projects to include projected revenue stream base on development impact fees. The City Council of the City of Palm Desert, DOES HEREBY ORDAIN, as follows: Section 2.68 of the Code of the City of Palm Desert, California, is hereby amended to read as follows: 2.68 Cultural Arts Committee 2.68.10 Cultural Arts Committee mission and duties. A. Cultural Arts Committee purpose. To guide the Art in Public Places Program, and beyond that specific program, to provide ideas to the City Council for more expansive City -sponsored art opportunities. Art includes but is not limited to murals, sculpture, memorials, earthwork, community art, digital media, and performances and festivals. B. Commission Responsibilities. 1. Advocate for inclusion of culture and cultural policy in myriad aspects of the City and the lives of its citizens; 2. Advise the City on issues relating to cultural policy for the arts; 3. Recommend policies and procedures for the Art in Public Places Program; 4. Recommend new public art projects; 5. Position the art program within the City to work with other City departments to ensure art is incorporated into the initial planning of public and private projects as they pertain to the Art in Public Places percent for art fee requirements or City funded projects; 6. Review and forward recommendations to the City Council regarding public and private art projects which utilize Art in Public Places or City funds; 7. Review and forward recommendations to the City Council regarding City public art acquisitions which utilize Art in Public Places or City funds; 8. Review and forward recommendations to the City Council regarding donation of artworks to the City; 9. Serve as stewards of the public art collection of the City; 10 Serve as goodwill ambassadors of the Art in Public Places Program and City to the community at large. ORDINANCE NO. 1369 C. Recommendation and Action. All review and recommendations utilizing Art in Public Places funding shall be made and forwarded to the City Council which shall be the final determining body of all actions recommended from the Cultural Arts Committee. 2.68.020 Membership A. Seven members shall be appointed from the community at large. In addition, there shall be two nonvoting liaison members, one each to be selected by their committee or commission from the architectural review committee and the planning commission. B. Membership may be comprised of people recognized as having expertise in the visual arts, construction, or technical field necessary for acquisition, fabrication, site preparation, installation, or display of artwork. Nominations for membership may be recommended by members of the committee or any other group or individual. C. Appointments shall be made by the City Council. The mayor shall appoint a council liasionto the commission and the community arts manager shall serve as staff liaison, both to serve as ex officio members. D. At all times the cultural arts committee shall strive to maintain a membership that includes at least one: 1. Professional Artist; 2. Architect; 3. Landscape Architect/Designer; And may include but is not limited to: 4. Museum Professionals; 5. Art Educators; 6. Art Historians; 7. Art Conservators; 8. Designers; 9. Development Industry; 10. Construction Trade;s 11. Engineers; 12. Gallery Professionals. 2.68.040 Meetings Regular meetings shall be conducted monthly at a time to be determined by the committee. ORDINANCE NO. 1369 2.68.070 The committee shall confine its objectives regarding art placement to the corporate limits of the community; however, it shall have no restraints on the areas where it may seek sources of art or financing.
