Conference with Legal Counsel regarding significant exposure to litigation pursuant to Government Code Section 54956.9(d)(2): Potential cases: 2 RECONVENE THE CITY COUNCIL, SUCCESSOR AGENCY, AND HOUSING AUTHORITY MEETING – 4:00 P.M. a) Roll Call b) Pledge of Allegiance to the Flag – Councilmember Sabby Jonathan c) Inspiration/Invocation – Councilmember Karina Quintanilla REPORT ON ACTION FROM CLOSED SESSION None AWARDS, PRESENTATIONS, AND APPOINTMENTS None MAYOR/COUNCILMEMBER REPORTS AND REQUESTS FOR ACTION Councilmember Jonathan: Reported the Committee and Commission meetings have resumed after the summer break and noted it is refreshing to see so many new members participating in the meetings. Mayor Pro Tem Harnik: Noted the success of the Palm Desert Plates program and thanked the participants for their involvement. She also acknowledged the construction at President’s Plaza and said she has received positive comments from the business owners in the area as the difficult project continues. Lastly, she highlighted her work with Southern California Association of Governments on their greenprint tool, which is a source of information that shows where the parks, conservation and open space is to assist developers in locating project space. Councilmember Quintanilla: Art in Public Places Commission had a vibrant discussion about how to incorporate public feedback. DRAFT MINUTES – FOR DISCUSSION PURPOSES ONLY SEPTEMBER 9, 2021 City Council, Successor Agency to the Palm Desert Redevelopment Agency, and Housing Authority Meeting 3 Mayor Kelly: Request for Action: Include on a future agenda as a discussion item whether the Council wishes to place a question on the 2022 ballot whether there should be a change in the election district system to potentially five districts. Mayor Pro Tem Harnik and Councilmember Quintanilla supported the request. Councilmember Jonathan expressed disappointment in how this item was handled and he asked that this item be agendized in closed session prior to open session at a later date. NON-AGENDA PUBLIC COMMENTS None CONSENT CALENDAR All matters listed on the Consent Calendar are considered to be routine and may be approved by one (1) Minute Motion. 1. APPROVE CLAIMS AND DEMANDS WARRANTS – City: 7/2/2021, 7/22/2021, 7/23/2021, 7/26/2021, 8/9/2021, 8/13/2021; Successor Agency: 8/6/2021 and 8/20/2021; City and Housing Authority: 7/30/2021, 8/6/2021, and 8/20/2021. Rec: Approve as presented. 2. PARKS AND RECREATION COMMISSION MINUTES for the meetings of March 2, 2021, and May 4, 2021 (CC). Rec: Receive and file. 3. RESOLUTION NO. 2021-58 - a resolution of the City Council of the City of Palm Desert, California, setting forth its findings and authorizing the destruction of records that have been digitally imaged from the Department of Development Services – Code Compliance Division, to rely on the electronic record as the official record (CC). Rec: Waive further reading and adopt. 4. REQUEST FOR APPROVAL of Addendum No. 2 to the Third Amendment and Restatement of the Joint Powers Agreement of the Coachella Valley Association of Governments, which establishes the Twenty-Nine Palms Band of Mission Indians as a member of the Coachella Valley Association of Governments (C003653) (CC). Rec: By Minute Motion, approve Addendum No. 2 to the Third Amendment and Restatement of the Coachella Valley Association of Governments Joint Powers Agreement, which establishes the Twenty-Nine Palms Band of Mission Indians as formal members of the Coachella Valley Association of Governments. REQUEST FOR AUTHORIZATION to reappoint David Fletcher, Elyssa Goldberg, Susan Stauber, and Christine Stein for a four-year term beginning July 1, 2021, through June 30, 2025, to the El Paseo Parking & Business Improvement District Board of Directors (CC). Rec: By Minute Motion, reappoint David Fletcher, Elyssa Goldberg, Susan Stauber, and Christine Stein for a four-year term beginning July 1, 2021, through June 30, 2025, to the El Paseo Parking & Business Improvement District (EPPBID) Board of Directors. 6. REQUEST FOR APPROVAL of the 2021 Palm Desert Golf Cart Parade (CC). Rec: By Minute Motion, approve 1) The Palm Desert Golf Cart Parade scheduled for Sunday, October 31, 2021; 2) Road closures on El Paseo between Highway 74 and Portola Avenue; 3) Consumption/possession of alcoholic beverages on public property pursuant to Palm Desert Municipal Code 9.58.040; and 4) Sponsorship of in-kind Public Works services. 7. REQUEST FOR ACCEPTANCE OF WORK for Contract No. C41560 with Westcon Construction Group, Inc. of Indio, California for the 2021 Curb Ramp Modification Project as complete and authorize the City Clerk to file the Notice of Completion (Project No. 753- 19) (CC). Rec: By Minute Motion, 1) Accept the 2021 Curb Ramp Modification Project as complete; and 2) Authorize the City Clerk to file the Notice of Completion. 8. RECEIVE AND FILE INFORMATIONAL UPDATE on the City’s Support of FIND Food Bank’s Campaign to Make September Hunger Awareness Month (CC). Rec: Receive and file. Upon motion by Quintanilla, second by Nestande and 5-0 vote of the City Council, the remainder of the Consent Calendar was approved as presented. (AYES: Harnik, Jonathan, Nestande, Quintanilla, and Kelly; NOES: None). REQUEST FOR APPROVAL of a $1,000 Donation to the 9/11 Promise Scholarship Program in honor of the 20-year Anniversary of 9/11 (CC). Mayor Pro Tem Harnik moved to, by Minute Motion, approve a $1,000 donation to the 9/11 Promise Scholarship Program to support the children of first responders and veterans. Motion was seconded by Quintanilla and approved by a 5-0 vote (AYES: Harnik, Jonathan, Nestande, Quintanilla and Kelly; NOES: None).
