Subject: City Council Agenda (October 14, 2021)
Below you will find questions received from the Mayor and/or Councilmembers and answers provided
by City staff regarding tonight’s Council meeting agenda.
Consent Calendar – Item 3:
• Question: In an AIPP Commission meeting it was discussed that the Commission would not
recommend approving a reimbursement for a mural that does not reflect the rendering
that was approved by the Commission. Is this addressed in the bylaws?
o Answer: In the AIPP Bylaws it states the Commission will “review and forward
recommendations to the City Council regarding public and private art projects which
utilize Art in Public Places or City funds”. While there is nothing specifically included in
the bylaws addressing reimbursements, the process for approving artworks and
reimbursements is included in Resolution 2018-28 (Public Art Guidelines), which is
attached for reference. Staff plans to meet with the property owner to discuss the AIPP
Commission’s concerns about the mural and see if they will have the artist resolve it.
The property owner can either change the artwork to make it more in line with what
was originally proposed or request the reimbursement to go forward as is. If the
property owner chooses the latter, staff will inform them that the AIPP Commission’s
recommendation not to reimburse will be included in the staff report and the City
Council may opt to side with the AIPP Commission.
Consent Calendar – Item 7:
• Question: The lease to Palm Desert RC Raceway is for $1 a year. Can you provide more
information on this company and why the $1 a year lease is warranted? Are they a non-profit
or community partner? How much revenue do they generate yearly? Do they generate sales
beyond the service?
o Answer: Palm Desert RC Raceway is not a non-profit, however they run this business
as a hobby for the benefit of race enthusiasts in our community. They are a community
partner with the 29 Palms Marine Corp and hold toy and clothing drives for them
periodically. The Raceway has been closed the last 18 months due to COVID, but prior
to this they were open Friday through Sunday, and reported income of around $600 a

month generated from a $10 per entry fee. The monthly expenses for this business are
around the same amount. The lease states that the City can request financials from the
business at any time to review.
• Question: Have there been any complaints from neighboring tenants regarding dust?
o Answer: Staff is not aware of any complaints from neighboring tenants regarding dust.
The track is irrigated to mitigate any dust generated from racing.
