ORAL COMMUNICATIONS In consideration of the current Coronavirus/COVID-19 Pandemic and pursuant to California Governor Newsom's Executive Orders, Planning Commissioners may participate via teleconference. Any person wishing to discuss any item not appearing on the agenda may address the Architectural Review Commission via the Zoom session at this point by giving his/her name and address for the record. Remarks shall be limited to a maximum of three (3) minutes unless the Commission authorizes additional time. Because the Brown Act does not allow the Commission to take action on items not on the Agenda, members will not enter into discussion with speakers but may briefly respond or instead refer the matter to staff for a report and recommendation at a future Commission meeting. Options for Public Participation: Public comment may be received by email or voicemail from the time the agenda is posted up until one (1) hour prior to the posted time of ineeting convening (11:30 a.m.). Commissioner Levin moved to, by Minute Motion, recommend to the Planning Commission approval of Case No. PP/CUP 20-0006, subject to the following: 1) Staff to work with the applicant and Burrtec concerning a trash enclosure or receptacle for the proposed project, and 2) the conditions of approval. The motion was seconded by Commissioner McAuliffe and carried by a 6-0-1 vote (AYES: Lambell, Levin, McAuliffe, Mclntosh, Schmid, and Van Vliet; NOES: None; ABSENT: None; ABSTAINED: Vuksic). C. MISCELLANEOUS: 1. INFORMATIONAL REPORT on outdoor dining decks by Principal Planner Eric Ceja. Principal Planner Eric Ceja provided an informational report on outdoor dining decks and displayed pictures of various decks on EI Paseo and Highway 111. Director of Community Development Ryan Stendell stated that under normal operation and outside of the pandemic, the Architectural Review Commission (ARC) would review outdoor dining decks. However, the City Council requested that the Planning Division approve the dining decks as soon as possible. Mr. Ceja added that there are no established design guidelines; therefore, there are various dining deck designs. When the City starts looking more into long-term outdoor dining decks, staff would solicit feedback from the ARC for design guidelines. The Commission agreed it is a good opportunity for a study on how outdoor dining could improve the street scene. The Commission also noted that some decks look better than others do. Staff commented that the road closed signs at Lupine Lane and safety cones for the Farmers Market on San Pablo Avenue are not aesthetically enhancing; however, they are required for safety. There were also budget constraints to enhance the Lupine Lane street closure. VI. COMMENTS None VII. The project includes the following. • Converting the bay garage doors to fixed and operable glass • Repainting the exterior (cream, light grey, and dark grey) • Removing the existing driveway along Cabrillo Avenue • Modifying the parking area • A new five-foot-high decorative fence featuring pressed concrete breeze block, wrought iron, and landscaping along the west and north property lines • New landscaping At the September 22, 2020, ARC meeting, the Commission requested that the applicant modify the wall design around the perimeter of the property for a more aesthetic design. Zoninq Ordinance Summary The property is zoned Downtown Core Overlay District (DO), which allows for retail and showrooms. The exterior modifications require approval from the ARC. The proposed decorative five-foot-high fence is 10 feet from the curb. Typically, in a residential zone, the setback for a five-foot fence is 15 feet from the curb. Since the property is zoned DO, the fence setback requirements do not apply. Staff Recommendation Staff recommends approval of the proposed remodel and new five-foot-high decorative fence. Upon reviewing the plans and presentations submitted by staff, and by the applicant, the Architectural Review Commission continued Case MISC 20-0019 subject to: 1) restudy the wall material and show more consistency; 2) choose a material more appropriate for the level of design; 3) restudy landscape choices; and 3) ensure that air conditioning units are below the parapet. Date of Action: September 22, 2020 Vote: Motion carried 5-0-2, with Commissioners McAuliffe and Mclntosh absent (An appeal of the above action may be made in writing to the City Clerk of the City of Palm Desert within fifteen (15) days of the date of the decision. Any amendments to this approved plan would need to be re-submitted to Commission for approval.) This sign was approved in August 2020. Following are the changes: • Number— The sign is now two-sided, with the sign copy on both edges of the corner facing the adjacent streets. � Construction — The previous sign was mounted onto a rail, which contained the electrical components. The new version will be mounted directly to the wall. The sign will be located at the southwest corner of Via Tuscany and Portola Avenue near the main entrance of the community. The applicant designed the monument sign in a contemporary style incorporating the same finishes and materials used on the apartment buildings, and features extensive plantings of desert native shrubs around the base. The sign program will establish signage design standards for 13 tenant suites in the three existing buildings located along EI Paseo. This program establishes design standards for multiple types of exterior signage, including the following: • Cabinet signs, with push-through letters mounted directly to the fascia • Cabinet signs, which are suspended and hanging from the building eave • Blade signs • Channel letters (including those used with backer panels) • Awning signage The signage standards are generally consistent with the general signage standards established by the Palm Desert Zoning Ordinance under Chapter 25.56 Signage. Zoninq Ordinance Summary A comprehensive sign program is required for all multi-tenant buildings with three (3) or more tenant spaces per Palm Desert Municipal Code (PDMC) Section 25.56.100. The Architectural Review Commission (ARC) is the approval authority for comprehensive sign programs per PDMC Section 25.68.060 (C). The sign program establishes general standards for a range of wide signage types. While this can be positive in promoting variation among signage to create a unique character to the downtown district, staff is concerned that the current proposal leaves some design guidelines too open. For example, sign Type 2, as shown on page 10 of the program, lists a specific cabinet height, and requires the width to be no larger than 75% of the frontage width. One option may be to set a specific maximum width for all the signs of this type to ensure the cabinets are all visually proportionate to each other, even if the finishes differ. Additionally, staff would recommend that the owner develop a palette of allowed signage colors for copy colors to ensure future signage is consistent with the cabinet and building color. Typically, the language for color restrictions may include an exception for national tenants. The Commission should provide direction on the use of backer panels for the exterior wall signage. Backer panels are generally prohibited unless they are incorporated into the signage design and with ARC approval. Historically, rectangular backers have been prohibited.
