REQUEST: Adopt Resolution 2020-Vacating a Portion of a Drainage Easement
Located Within Parcel A of Parcel Map Waiver 14-069.
Recommendation
By minute motion, adopt Resolution 2020-16 vacating a portion of a drainage
easement located within Parcel A of Parcel Map Waiver 14-069.
Strategic Plan
This action does not affect the strategic plan.
Background
Parcel A was created through parcel map waiver 14-069. A condition of approval for the
waiver was for the owner to construct drainage improvements on their parcel to facilitate
street flows within the 15' drainage easement. The proposed drainage easement allowed
flows from Technology Drive, onto the drainage easement, and ultimately into the channel
behind the parcel.
Parcel map 36792 was recorded in 2015. A Specific Plan for this area was approved by
Planning Commission in 2015. The Specific Plan and subsequent final map revised the
design of Technology Drive. The Specific Plan extends Technology Drive and accounts
for drainage flows that otherwise would have flowed through Parcel A. The new design
negates the need for the drainage easement. Additionally, La Quinta Brewing Company
is now developing Parcel A. In order to construct their building without a conflict with the
drainage easement, the easement must be vacated.

There is no fiscal impact associated with this action.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING THE PARTIAL VACATION OF A
15' DRAINAGE EASEMENT, DEDICATED TO THE CITY OF PALM
DESERT AND RECORDED AS DOCUMENT NUMBER 2014-0170216,
LOCATED WITHIN A PORTION OF PARCEL A OF CERTIFICATE OF
COMPLIANCE, WAIVER OF PARCEL MAP, PMW14-069, RECORDED
AS DOCUMENT NUMBER 2014-0170212, OFFICIAL RECORDS OF
RIVERSIDE COUNTY.
WHEREAS, the subject vacation is made pursuant to the requirements of the
California Streets and Highways Code, Division 9, Part 3, Chapter 4; and
WHEREAS, the City Council of the City of Palm Desert considered such matter
and finds from the evidence submitted that the easement described in Exhibit "A" and
depicted in Exhibit "B", attached hereto and made a part hereof, is in excess and is
unnecessary for present or prospective public purposes and that there are no in -place
public facilities within the described area.
BE IT HEREBY RESOLVED, by the City Council of the City of Palm Desert,
California, as follows:
(1) That the 15' drainage easement dedicated to the City of Palm Desert and
recorded as Document Number 2014-0170216, located within a portion of
Parcel A of certificate of compliance, waiver of parcel map, PMW 14-069,
recorded as Document Number 2014-0170212, Official Records of
Riverside County be vacated as described and as set forth in Exhibits "A"
and "B", attached hereto; and
(2) That the City Clerk of the City of Palm Desert, California shall cause a
certified copy of the Resolution and order to be recorded in the Office of
the County Recorded of Riverside County, California; and
(3) That from and after the date that this Resolution is recorded, the subject
portion of the drainage easement will no longer constitute a public service
easement.

Desert, California, on this day of 2020, by the following
