Approve and accept the donation of John Richen's sculpture to the City's permanent Public Art collection from Ms. Pat Kopp; 2. Authorize Mayor to sign Deed of Gift to City of Palm Desert Form; and 3. Authorize expenditures up to $1,500.00 for costs associated with installation of the sculpture. Funds are available in Account Number 4364650-4400100. Commission Recommendation At its regularly scheduled February 12, 2020 meeting, the Art in Public Places Commission recommended with a vote of 6-0-1, with Commissioner Darby absent, to accept Ms. Pat Kopp's donation John Richen's sculpture to be included in the City's permanent public art collection. The Commission further recommended that the sculpture should be installed on the east facing wall of the North Wing building at Palm Desert City Hall. Strategic Plan Objective Palm Desert's public art program creates a better community for residents and visitors to Palm Desert. This concept is in line with the Arts & Culture Mini -Vision of the 2013-2033 Strategic Plan, Envision Palm Desert — Forward Togetherwhich states: "Arts and culture give a community its soul. Palm Desert is the cultural core of the Coachella Valley. Cultural tourism drives economic growth in Palm Desert. The community is host to internationally recognized cultural events that bring significant economic benefits to the City. Palm Desert is a leader in arts education, ensuring a well-rounded population that possesses high levels of creativity and critical thinking skills." Discussion Ms. Sheri Herrick recently contacted staff on behalf of her mother, Pat Kopp, with an offer to donate a 70" x 46" bronze/steel/capper sculpture by artist John Richen to the City of Palm Desert's permanent public art collection. Ms. Herrick's parents, Pat and Tony Kopp, who were residents of the Vintage Country Club for 15 years, commissioned the sculpture, which depicts mountain/canyon vistas with a small band of traveling Native Americans. Ms. Herrick does not March 26, 2020 - Staff Report Donation of John Richen's Sculpture Page 2 of 2 know the exact title or date of the work, however, she recalls her parents referring to the sculpture as Two Moons, which could be interpreted as traveling two moon cycles. Staff is in the process of working with Lisa Dempton of A Gallery in Palm Desert who represents the artist to obtain the exact title and meaning of the sculpture. Additionally, with regard to approximate value of the sculpture, Ms. Dempton indicated that it looks like one of the artist's older works and it could be valued at approximately $60,000. Staff proposed three different locations to the Art in Public Places Commission for installation of the sculpture if the City Council approved the donation. Of the three locations, the Commissioners recommended that the sculpture be installed on the east facing wall of the North Wing building at Palm Desert City Hall. Installing in this location could serve as a beacon for the Visitors Services office and the Palm Desert Community Art Gallery. Upon consolation with the City's public art maintenance contractor, staff was advised that installation and maintenance in this location would not be an issue. It should be noted that artist John Richen has two sculptures included in Palm Desert's permanent collection (i.e., Messengers located at 73775 Deep Canyon Road and Levi Man located at Tucson Circle and Washington Street), and he has also been a participant in several El Paseo Sculpture Exhibitions. Fiscal Analvsis If the sculpture is accepted into the collection, Ms. Herrick indicated that she would arrange for its transport to Palm Desert. Therefore, the City would only be responsible for costs associated with installing the artwork, lighting, and signage, which is estimated not to exceed $1,500. The signed Deed of Gift establishes and governs the legal relationship between the DONOR and CITY and the legal status of the materials. 1. DONOR hereby donates to CITY materials entitled: 2. The following is a complete description of the donation, including the: 3. This donation has been received by CITY as a gift. DONOR acknowledges that he/she is the owner of the above materials and hereby transfers physical custody and intellectual and literary property rights of said materials to CITY. This includes any copyright over the materials, as well as the right to reproduction and the right to republication of the materials in any format, except as specified below: 4. CITY recognizes and respects all forms of intellectual property and will make every effort to ensure credit and acknowledgement of the author and creator of such materials. 5. Title to the Property shall pass to CITY upon delivery to the CITY. At any time thereafter, the DONOR shall be permitted to examine any of the Papers during the regular business hours of the Archives. 6. In consideration of mutual benefits, DONOR enters into this agreement with CITY for access, use, disposition, and ownership of these donated materials. CITY shall have ownership of these materials upon receipt, store these materials according to accepted standards, process them and maintain the artwork against the ravages of time, vandalism and elements. The following conditions apply to this gift(s) to CITY: • It is understood that this gift is outright and unconditional unless otherwise noted upon this Agreement. • The DONOR agrees that there are no restrictions on access and use of the artwork described unless otherwise noted upon this Agreement. • This Deed of Gift represents the entire agreement of the parties with regard to the matters set herein, and it may be amended only by written agreement accepted and signed by the DONOR (or legal representative) and a designated representative of CITY . • It is understood that artwork may be reprinted in whole or in part and may be used in whole or in part for any use determined by CITY in its sole discretion. • CITY makes no representation as to the value of the donated property and cannot and does not appraise or assign a value to the gift and provides only the description of the property donated as set forth in this Deed. • CITY agrees to indemnify DONOR from all losses, costs, claims or expenses arising out of CITY's acceptance and use of the Gift.
