STAFF REPORT CITY OF PALM DESERT COMMUNITY DEVELOPMENT DEPARTMENT MEETING DATE: April 16, 2020 PREPARED BY: Ryan Stendell, Director of Community Development REQUEST: Provide direction to staff regarding two Councilmember Requests for Action related to Desert Community Energy. Recommendation By Minute Motion: 1. Authorize staff to take any and all actions necessary to enroll municipal accounts with Desert Community Energy (DCE) in 2021, and select one of the power supply options, either: a. Carbon Free Rate b. Desert Saver Rate 2. Provide notice to Desert Community Energy of the City's intent to withdraw subject to Article 6 of the approved Joint Powers Agreement (JPA). 3. Authorize the Mayor to execute any documentation necessary to implement the selected action. Strateqic Plan Energy and Sustainability Priority 2: Promote greater usage of more sustainable materials. One of the most advantageous goals of existing Community Choice Aggregations agencies (CCA) such as Desert Community Energy is the purchase of bulk power from more sustainable power providers, which meets the intent of the above -mentioned strategic plan goal. April 16, 2020 - Staff Report Desert Community Energy Page 2 of 5 Background Analysis At its meeting of June 27, 2019, Councilmember Jonathan requested that DCE be placed on a future agenda and that the City consider enrolling all of its municipal accounts in the Carbon Free (100% green) rate offered by DCE. Subsequent Councilmember questions were posed that lead to staff hosting a study session on January 9, 2020. Questions addressed at the study session ranged from the fiscal impact of enrolling municipal accounts to how would the City exit the JPA if it so desired. Staff was subsequently directed to prepare an analysis of DCE versus SCE green rates to be presented at the budget study sessions. At its meeting of March 26, 2020, Councilmember Weber requested that exiting the DCE be placed on a future agenda. Staff has prepared this staff report in an effort to address both Councilmember requests for action. Discussion Enrolling Municipal Accounts: In order to serve Palm Desert municipal accounts in 2021, DCE must include the energy usage associated with City accounts in their annual load forecast. This year, the load forecast is due to the CPUC by April 20, 2020. As a result of a process put in place by the CPUC in February 2018, CCAs and investor owned utilities must indicate their intent to serve customers a year ahead of an actual start date. This would mean that Palm Desert would need to commit to enrolling municipal accounts this month in order to begin DCE service in 2021. Municipal accounts can be enrolled without enrolling any other customers in Palm Desert at this time. Another factor that could delay the enrollment of City municipal accounts is SCE plans to upgrade their billing software in spring of 2021. As a result, SCE is recommending fall 2021 as the best time for any CCAs planning to launch new customers due to expected enrollment challenges and potential billing delays. Based on past Councilmember requests for action the following analysis has been prepared to address questions that staff believes still exist: To complete this analysis, staff provided a spreadsheet with City accounts, electricity usage, and bill amounts to DCE. The Energy Authority, DCE's non-profit advisor and procurement partner, calculated the cost of enrolling municipal accounts into both of the options offered by DCE, Carbon Free or Desert Saver. The City has 387 municipal accounts and a total annual usage or load of 7,209,714 kilowatt-hours (kWh). Approximately 80% of this load can be attributed to the top 26 accounts. The total bill for the last 12 months was $1,137,618. 1. What would be the cost implications to enroll municipal accounts into DCE: April 16, 2020 - Staff Report Desert Community Energy Page 3 of 5 a. Carbon Free Rafe: Enrolling municipal accounts in the Carbon Free would result in an annual additional cost of $97,157. b. Desert Saver Rate: Enrolling municipal accounts in the Desert Saver would result in an estimated annual savings to the City of $5,266. 2. What are the Savings to the City if we enrolled our municipal accounts into the DCE, Carbon Free Rate versus Southern California Edison's 100% Green Rate: According to the anaylsis prepared by CVAG's energy consultant, enrolling municipal accounts in DCE's Carbon Free plan would save the City an additional $108,339 compared to the 100% Green Rate offered by SCE. 3. What is the projected impact on the environment by enrolling municipal accounts into DCE: Choosing the 100% Carbon Free option results in a slight premium for carbon -free electricity which would help achieve greenhouse gas reduction goals and contribute to cleaner energy sources. The greenhouse gas reduction resulting by choosing 100% Carbon Free is equal to taking 266 cars off the road or consuming 139,000 fewer gallons of gasoline or the cutting the emissions from 209 homes' electricity use. Palm Desert's carbon footprint in 2013 for municipal facilities and activities was 9,800 metric tons of greenhouse gas emissions based on the 2013 GHG greenhouse gas inventory (inclusive of CVWD activities in Palm Desert). Palm Desert municipal buildings and facilities represent 16% of total municipal greenhouse gas emissions. Switching municipal accounts to 100% Carbon Free would result in an approximate 13% reduction on cumulative emissions generated by the City. The DCE Carbon Free choice offers these environmental benefits at a lower cost than if municipal accounts were enrolled in SCE's Green Rate. DCE also offers local control with opportunities for investment in local jobs and community programs. Municipal Emissions 2013 hvfGc Ms fWVWVO tMINC S April 16, 2020 - Staff Report Desert Community Energy Page 4 of 5 Update on Utility Discount Program (CARE/FERA): On January 1, 2020, DCE launched the Utility Discount enrollment program in partnership with Lift to Rise and SCE to enroll income qualified customers in the California Alternate Rates for Energy (CARE), Family Electrical Rate Assistance (FERA) and Medical Baseline programs. Since January, there have been 56 new enrollments submitted through DCE/Lift to Rise efforts. To date, seven enrollments have been approved in Palm Desert, with 27 in Cathedral City and 22 in Palm Springs. For the CARE customers who receive a 30% discount on their electric bill, the savings would amount to $864 annually for gas and electricity per household. In order to abide by the important COVID 19 safety restrictions, outreach for CARE/FERA is now focusing on outreach by telephone and social media. The outreach team is reaching out over the next several weeks by phone. As described at the study session in January this program is offered at no cost to member cities. It is also available to SCE cutomers who do not elect to enroll in DCE. The CARE/FERA program is an example of a local program that could become better subscribed within member cities as DCE grows. Exiting the DCE: If the City Council wishes to exit the DCE they would need to authorize staff to exercise Article 6 of the JPA, as reflected in Recommendation #2 of this staff report. Under the terms of Section 6.1.1 of the DCE JPA, the City must give a six month written notice of its intent to withdraw. If the City withdraws from DCE they would be a full voting member of the DCE Board until the effective date. They would still be able to participate in DCE programs until -the date of their withdrawal. The City would remain a member until then and could continue to participate in the CARE/FERA Utility Discount enrollment program. Funds Remaining: One question that continues to come up is how remaining surplus monies would be allocated if a member left the JPA. The JPA did not anticipate that all but one entity would exit the DCE, and does not clearly spell out the disposition of assets and adjustment in weighted voting shares in such an instance. The DCE Board would be tasked with reaching consensus on a termination strategy. Most residents of this beautiful city, including myself, were very excited to hear about the development of DCE as an alternative to the profit driven privately owned corporations that are fighting the transition to clean renewable energy. The price per kilowatt hour (KWH) for electricity being charged by SCE is now 20 cents or higher, which is several times what it is in other cities in other regions. There is no legitimate justification for these extremely high prices, especially where people depend on air conditioning as an absolute necessity, other than the fact that we are being ripped off by a greedy for profit monopoly. The cost of photovoltaic solar has come down dramatically and is currently significantly less expensive than either coal or even natural gas per kilowatt hour, especially when taking into account the negative externalities of increased costs associated with carbon emissions and other pollution and health related costs. Large scale solar projects with various methods of energy storage, distributed rooftop solar, and wind farms can and should be developed to a much greater extent. We are very late in the creation of this type of more beneficial alternative to the way we provide electricity. Let's not unnecessarily delay or deny the people DCE any longer. Adopt DCE and eventually municipally owned renewable energy as quickly as possible. Palm ❑esert's staff report describes Desert Saver and Carbon Free rates offered by DCE. ❑CE rates parallel SCE's rate structure to lessen customer confusion such that each SCE generation rate is adjusted by a fixed percentage. The cost implications shown in the staff report will adjust as a result of a Southern California Edison rate increase effective April 13, 2026. While this SCE rate change was anticipated, the Advice Letter that reports the SCE rate information was just published on April 6. Enrolling municipal accounts in the Carbon Free plan would result in an annual additional cost of $91,283, $5,874 less than the $97,157 reported in the staff report. b. Desert Saver Rate: Annual savings of $16,565. Enrolling municipal accounts in the Desert Saver plan would result in an annual savings to the City of $16,565, an $11,299 increase above the $5,266 reported in the staff report. One way considered was through expanded promotion of existing utility discount programs, specifically the California Alternative Rates for Energy (CARE) and Family Electric Rate Assistance (FERA) programs. These programs offer qualified low- income customers a reduction in energy bills of about 30% for CARE customers and 18% for FERA customers. The CARE and FERA programs are legislatively authorized and implemented and managed by California's investor owned utilities (IOUs) including Southern California Edison (SCE). Non-CARE/FERA utility customers pay the cost of these subsides through surcharges as authorized by the California Public Utilities Commission (CPUC). After researching these programs, it was determined that there are a significant number of eligible local households that are not enrolled in either the CARE or FERA program. In Palm Desert, for example, CARE participation rate is 58.4% and FERA participation is 6.4%. Lift To Rise, ❑CE's non-profit partner, has Io- date received over 1,000 calls from families suffering impacts from the COVID 19 pandemic. They have reported that the majority of calls are from Hispanic families and that about 113 of all calls received are from within DCE's service territory. The DCE Utility Discount Awareness Program is providing help to those who need assistance understanding, enrolling and completing the application process. Based on data from National Demographics Corporation (NDC), 23% of Palm Desert's population is Hispanic and 43% of all household incomes are less than $50,000. The census tracts where disadvantaged communities occur are particularly concentrated in the center of Palm Desert according to data from American Community Survey completed in 2016. These areas are the primary focus for DCE and Lift To Rise outreach efforts to further enroll eligible households in Palm Desert. Though there is a great need to address the Hispanic community in Palm Desert, outreach will also focus on senior citizens and others in need. The DCE CAREIFERA program serves a critical need in the City of Palm Desert and other DCE communities, at no cost to the City. The DCE/Lift to Rise efforts represent a significant step up in outreach to potential CARE/FERA households. According to reports from SCE, in the past several years there have only been two active capitation contractors servicing the Coachella Valley - Desert Arc and Senior Advocates of the Desert. Since 2013 these two agencies have a combined total of only 9 new enrollments. As part of the DCE program, other non -profits have been trained to help enroll eligible households. As noted in the staff report, outreach efforts have been re -focused on telephone contact with significant further outreach effort occurring during the coming weeks.
