Recommendation

landscape architecture and design services for the CV Link Painters Path
Spur Improvement (Bump and Grind to El Paseo) Project.
2. Authorize the Mayor to execute the Agreement.
Funds for this project are available in Account No. 2314670-5000202, New Construction Tax.
Strategic Plan
The CV Link Painters Path Spur Improvement (Bump and Grind to El Paseo) fulfill priorities
identified in the City's Strategic Plan, including the following:
• Tourism and Marketing — Priority 1: "Improve access to Palm Desert and its attractions
to enhance the ease of lifestyle."
• Transportation — Priority 1: "Create walkable neighborhoods and areas within Palm
Desert that would include residential, retail, services and employment centers, and
parks, recreation and open space to reduce the use of low occupancy vehicles."
• Transportation — Priority 3: "De-emphasize single/low-occupancy vehicles and
optimize modes of travel (bus, carpool, golf -cart, bicycle and pedestrian)."
• Land Use - Priority 4: "Create a mixed -use city core integrating shopping, dining,
lodging, and housing."
Backqround Analysis
The CV Link regional bikeway through Palm Desert will follow an alignment along Painters
Path, Park View Drive, Monterey Avenue, and Magnesia Falls Drive. The on -street project is
being designed and funded through CVAG and constructed by the City. The overall CV Link
alignment in Palm Desert is depicted in the attached Vicinity Map.

The City's CV Link project will commence construction in July, 2020, and is anticipated to be
completed in 2021. In addition, the City started in 2019 the phased construction of the San
Pablo Streetscape Improvements project from Highway 111 to Magnesia Falls Drive, which
incorporates bicycle/pedestrian improvements to further the connectivity from the City Center
to the CV Link project. These improvements are also anticipated to be completed by the end
of 2021.
The City desires to provide better bicycle and golf cart connectivity between the CV Link and
San Pablo Avenue corridors and the City Center, which includes the El Paseo shopping
district, the retail and residential neighborhood between Highway 111 and Fred Waring Drive,
and the Civic Center municipal campus at Fred Waring Drive and San Pablo Avenue. Through
its 2016 General Plan update, the City envisions a network of pedestrian, bike and golf cart
connectivity connecting these signature areas of the community. Recognizing this need, the
City Council approved an initial amount of funding for the project in the City's FY19/20 Capital
Improvements Budget.
The Consultant will be first tasked to conduct alternatives analysis for a network of bike and
golf cart facilities connecting El Paseo, the CV Link and San Pablo Avenue corridor. The
boundary of the study area includes Painters Path, El Paseo, Portola Avenue and Magnesia
Falls, as depicted in the attached Vicinity Map. The analysis will look at alternative linkages
to existing and proposed bike and golf cart facilities. While early concepts by the City envision
improvements within existing right-of-way, the Consultant will explore alignments that may
include commercial properties, considering economic development and business retention
opportunities. The Consultant will conduct data collection and analyze alternative alignments
considering factors including, among others, the following:
• Condition and availability of existing infrastructure, right-of-way and public easements
• Safety history of roadways and intersections along potential alignments
• Service to users of the bikeway facility
• Benefit to adjacent businesses
• Construction feasibility
• Impacts to roadway capacity and intersection level of service
• Multi -way stop and traffic signal warrants
• Potential environmental impacts (CEQA)
• Bikeway bridge feasibility/suitability over the Palm Valley Channel
• Construction priorities and phasing
• Access control
• Conceptual costs
• Suitability for grant funding
The Consultant will plan for public involvement meetings and presentations to Planning
Commission and City Council for input and direction on preferred alternatives during the first
stage of the project development.

Following acceptance of preferred alternatives, staff will then refine the work tasks and
authorize the Consultant to proceed with Preliminary Engineering and Environmental
Documents. The Consultant will continue to engage the public, Planning Commission, Art in
Public Places Commission and the City Council during this phase. During this phase, the
Consultant will also develop a project phasing plan, preliminary schedules for construction
projects, and grant applications in collaboration with staff.
Following completion of the Preliminary Engineering and Environmental Documents, the
Consultant will then be authorized to proceed with Final Engineering, permits, right-of-way
and easement legal descriptions and plats. The Consultant will also be expected to support
bidding and construction engineering.
Staff and the Consultant estimate the feasibility, preliminary engineering and environmental
documentation to take up to 15 months to complete, if the City determines bridge construction
will be necessary during the initial alternatives analysis stage; if no bridge construction is
determined to be needed, then this schedule will likely shrink. Completion of detailed plans
for construction bidding is estimated to take approximately six months to complete after
completion of the preliminary engineering and environmental documentation.
A Request for Proposals (RFP) for construction management services was appropriately
advertised, and on March 31, 2020, three (3) proposals were received:

The internal selection committee, comprised of representatives from the Community
Development and Public Works departments met on April 21, 2020 and reviewed the
qualifications, experience, key personnel, and proposed costs. The committee recommends
awarding the contract to KOA Corporation in the amount of $720,431.00.
Fiscal Analvsis
The City Council budgeted a total of $1,500,000 in the New Construction Tax Fund for this
project. Estimated construction costs will be provided as the project is developed, giving the
City Council opportunity to plan and budget for construction costs in future years, if additional
City funding is needed. The City will also pursue state and regional grant opportunities, such
as Active Transportation Plan funding to offset the project cost to the City.
The project(s) that are generated by the scoping analysis and design performed by KOA will
include aspects of the current CV -Link project as well as determination of the adequacy of the
existing bridge over the drainage channel. Construction cost estimates are dependent upon
the projects selected and designed to meet the needs of extending the network of bike and
golf cart facilities connecting El Paseo, the CV Link and San Pablo Avenue corridor.

Construction costs will be better identified as the scoping and design proceed and corridors
for those facilities are selected. Construction costs can be generally estimated to be between
$2 million and $12 million, depending on the need for new bridge structures, alignment
selected, length of segments, and endpoints are identified. As previously stated, the scoping
and design work includes seeking funding opportunities for construction.

PROFESSIONAL SERVICES AGREEMENT

PARTIES AND DATE.
This Agreement is made and entered into this 28th day of May, 2020, by and between the
City of Palm Desert, a municipal corporation organized under the laws of the State of California
with its principal place of business at 73-510 Fred Waring Drive, Palm Desert, California 92260-
2578, County of Riverside, State of California ("City") and KOA Corporation, a California
Corporation, with its principal place of business at 1100 Corporate Center Drive Suite 201,
Monterey Park, CA 91754 ("Consultant"). City and Consultant are sometimes individually referred
to herein as "Party" and collectively as "Parties."
2. RECITALS.
2.1 Project.
The City is a public agency of the State of California and is in need of professional
engineering, landscape architecture and design services for the CV Link Painters Path Spur
(Bump and Grind to El Paseo) project (hereinafter referred to as "the Project").
2.2 Consultant.
Consultant desires to perform and assume responsibility for the provision of certain
professional services required by the City on the terms and conditions set forth in this Agreement.
Consultant is duly licensed and has the necessary qualifications to provide such services.
3. TERMS.
3.1 Scope of Services and Term.
3.1.1 General Scope of Services. Consultant promises and agrees to furnish to
the City all labor, materials, tools, equipment, services, and incidental and customary work
necessary to fully and adequately supply the services necessary for the Project ("Services"). The
Services are more particularly described in Exhibit "A" attached hereto and incorporated herein
by reference. All Services shall be subject to, and performed in accordance with, this Agreement,
the exhibit attached hereto and incorporated herein by reference, and all applicable local, state
and federal laws, rules and regulations.
3.1.2 Term. The term of this Agreement shall be from May 28, 2020 to December
31, 2023, unless earlier terminated as provided herein. Consultant shall complete the Services
within the term of this Agreement, and shall meet any other established schedules and deadlines.
3.2 Responsibilities of Consultant.
3.2.1 Independent Contractor: Control and Pavment of Subordinates. The
Services shall be performed by Consultant or under its supervision. Consultant will determine the
means, methods and details of performing the Services subject to the requirements of this
Agreement. City retains Consultant on an independent contractor basis and not as an employee.
Any personnel performing the Services shall not be employees of City and shall at all times be
under Consultant's exclusive direction and control. Consultant shall pay all wages, salaries, and
other amounts due such personnel in connection with their performance of Services under this
Agreement and as required by law. Consultant shall be responsible for all reports and obligations
respecting such additional personnel, including, but not limited to: social security taxes, income
tax withholding, unemployment insurance, disability insurance, and workers' compensation
insurance.

3.2.2 Schedule of Services. Consultant shall perform the Services in a prompt
and timely manner in accordance with the Schedule of Services set forth in Exhibit "A" attached
hereto and incorporated herein by reference. Consultant represents that it has the professional
and technical personnel required to perform the Services expeditiously. Upon request of City,
Consultant shall provide a more detailed schedule of anticipated performance to meet the
Schedule of Services.
3.2.3 Conformance to Applicable Requirements. All work prepared by
Consultant shall be subject to the approval of City.
3.2.4 Substitution of Kev Personnel. Consultant has represented to City that
certain key personnel will perform and coordinate the Services. Should one or more of such
personnel become unavailable, Consultant may substitute other personnel of at least equal
competence upon written approval of City. In the event that City and Consultant cannot agree as
to the substitution of key personnel, City shall be entitled to terminate this Agreement for cause.
The key personnel for performance of this Agreement are as follows: Jimmy Lin, Management
Executive.
3.2.5 Citv's Representative. The City hereby designates Randy Bowman,
Project Manager, or his/her designee, to act as its representative in all matters pertaining to the
administration and performance of this Agreement ("City's Representative"). City's
Representative shall have the power to act on behalf of the City for review and approval of all
products submitted by Consultant but not the authority to enlarge the scope of Services or change
the total compensation due to Consultant under this Agreement. The City Manager shall be
authorized to act on City's behalf and to execute all necessary documents which enlarge the
scope of services or change the Consultant's total compensation subject to the provisions
contained in Section 3.3 of this Agreement. Consultant shall not accept direction or orders from
any person other than the City Manager, City's Representative or his/her designee.
3.2.6 Consultant's Representative. Consultant hereby designates Jimmy Lin,
Management Executive, or his/her designee, to act as its representative for the performance of
this Agreement ("Consultant's Representative"). Consultant's Representative shall have full
authority to represent and act on behalf of the Consultant for all purposes under this Agreement.
The Consultant's Representative shall supervise and direct the Services, using his/her best skill
and attention, and shall be responsible for all means, methods, techniques, sequences, and
procedures and for the satisfactory coordination of all portions of the Services under this
Agreement.
3.2.7 Coordination of Services. Consultant agrees to work closely with City staff
in the performance of Services and shall be available to City's staff, consultants and other staff at
all reasonable times.
3.2.8 Standard of Care: Performance of Employees. Consultant shall perform all
Services under this Agreement in a skillful and competent manner, consistent with the standards
generally recognized as being employed by professionals in the same discipline in the State of
California. Consultant represents and maintains that it is skilled in the professional calling
necessary to perform the Services. Consultant warrants that all employees and subconsultants
shall have sufficient skill and experience to perform the Services assigned to them. Consultant
represents that it, its employees and subconsultants have all licenses, permits, qualifications and
approvals of whatever nature that are legally required to perform the Services, and that such
licenses and approvals shall be maintained throughout the term of this Agreement. Consultant
shall perform, at its own cost and expense and without reimbursement from the City, any services
necessary to correct errors or omissions which are caused by the Consultant's failure to comply

with the standard of care provided herein. Any employee of the Consultant or its sub -consultants
who is determined by the City to be uncooperative, incompetent, a threat to the adequate or timely
completion of the Project, a threat to the safety of persons or property, or any employee who fails
or refuses to perform the Services in a manner acceptable to the City, shall be promptly removed
from the Project by the Consultant and shall not be re-employed to perform any of the Services
or to work on the Project.
3.2.9 Period of Performance. Consultant shall perform and complete all Services
under this Agreement within the term set forth in Section 3.1.2 above ("Performance Time").
Consultant shall also perform the Services in strict accordance with any completion schedule or
Project milestones described in Exhibit "A" attached hereto, or which may be separately agreed
upon in writing by the City and Consultant ("Performance Milestones"). Consultant agrees that if
the Services are not completed within the aforementioned Performance Time and/or pursuant to
any such Performance Milestones developed pursuant to provisions of this Agreement, it is
understood, acknowledged and agreed that the City will suffer damage.
3.2.10 Laws and Regulations; Emplovee/Labor Certification. Consultant shall
keep itself fully informed of and in compliance with all local, state and federal laws, rules and
regulations in any manner affecting the performance of the Project or the Services, and shall give
all notices required by law. Consultant shall be liable for all violations of such laws and regulations
in connection with the Services and this Agreement. All violations of such laws and regulations
shall be grounds for the City to terminate the Agreement for cause.
3.2.10.1 Emplovment Eliqibilitv; Consultant. Consultant certifies that
it fully complies with all requirements and restrictions of state and federal law respecting the
employment of undocumented aliens, including, but not limited to, the Immigration Reform and
Control Act of 1986, as may be amended from time to time and shall require all subconsultants
and sub-subconsultants to comply with the same. Consultant certifies that it has not committed
a violation of any such law within the five (5) years immediately preceding the date of execution
of this Agreement, and shall not violate any such law at any time during the term of the Agreement.
3.2.10.2 Equal Opportunity Emplovment. Consultant represents that
it is an equal opportunity employer and it shall not discriminate against any subconsultant,
employee or applicant for employment because of race, religion, color, national origin, handicap,
ancestry, sex or age. Such non-discrimination shall include, but not be limited to, all activities
related to initial employment, upgrading, demotion, transfer, recruitment or recruitment
advertising, layoff or termination. Consultant shall also comply with all relevant provisions of City's
Minority Business Enterprise program, Affirmative Action Plan or other related programs or
guidelines currently in effect or hereinafter enacted.
3.2.10.4 Safety. Consultant shall execute and maintain its work so
as to avoid injury or damage to any person or property. In carrying out its Services, the Consultant
shall at all times be in compliance with all applicable local, state and federal laws, rules and
regulations, and shall exercise all necessary precautions for the safety of employees appropriate
to the nature of the work and the conditions under which the work is to be performed.
3.2.11 Insurance.
3.2.11.1 Minimum Requirements. Without limiting Consultant's
indemnification of City, and prior to commencement of the Services, Consultant shall obtain,
provide and maintain at its own expense during the term of this Agreement, policies of insurance
of the type and amounts described below and in a form that is satisfactory to City.
(A) General Liabilitv Insurance. Consultant shall maintain

commercial general liability insurance with coverage at least as broad as Insurance Services
Office form CG 00 01, in an amount not less than $1,000,000 per occurrence, $2,000,000 general
aggregate, for bodily injury, personal injury, and property damage. The policy must include
contractual liability that has not been amended. Any endorsement restricting standard ISO
"insured contract" language will not be accepted.
(B) Automobile Liabilitv Insurance. Consultant shall maintain
automobile insurance at least as broad as Insurance Services Office form CA 00 01 covering
bodily injury and property damage for all activities of the Consultant arising out of or in connection
with Work to be performed under this Agreement, including coverage for any owned, hired, non -
owned or rented vehicles, in an amount not less than $1,000,000 combined single limit for each
accident. The City's Risk Manger may modify this requirement if it is determined that Consultant
will not be utilizing a vehicle in the performance of his/her duties under this Agreement.
(C) Professional Liabilitv (Errors & Omissions) Insurance.
Consultant shall maintain professional liability insurance that covers the Services to be performed
in connection with this Agreement, in the minimum amount of $1,000,000 per claim and in the
aggregate. Any policy inception date, continuity date, or retroactive date must be before the
effective date of this Agreement and Consultant agrees to maintain continuous coverage through
a period no less than three years after completion of the Services required by this Agreement.
(D) Workers' Compensation Insurance. Consultant shall
maintain Workers' Compensation Insurance (Statutory Limits) and Employer's Liability Insurance
(with limits of at least $1,000,000). Consultant shall submit to City, along with the certificate of
insurance, a Waiver of Subrogation endorsement in favor of the City, its officers, agents,
employees and volunteers.
(E) Umbrella or Excess Liabilitv Insurance. Consultant may opt
to utilize umbrella or excess liability insurance in meeting insurance requirements. In such
circumstances, Consultant shall obtain and maintain an umbrella or excess liability insurance
policy with limits that will provide bodily injury, personal injury and property damage liability
coverage at least as broad as the primary coverages set forth above, including commercial
general liability and employer's liability. Such policy or policies shall include the following terms
and conditions:
(1) A drop down feature requiring the policy to respond if
any primary insurance that would otherwise have
applied proves to be uncollectible in whole or in part for
any reason;
(2) Pay on behalf of wording as opposed to reimbursement;
(3) Concurrency of effective dates with primary policies;
and
(4) Policies shall "follow form" to the underlying primary
policies.
(5) Insureds under primary policies shall also be insureds
under the umbrella or excess policies.
If coverage is maintained on a claims -made basis, Consultant shall maintain such
coverage for an additional period of three (3) years following termination of the Agreement.

3.2.11.2 Other Provisions or Requirements.
(A) Proof of Insurance. Consultant shall provide certificates of
insurance to City as evidence of the insurance coverage required herein, along with a waiver of
subrogation endorsement for workers' compensation. Insurance certificates and endorsements
must be approved by City's Risk Manager prior to commencement of performance. Current
certification of insurance shall be kept on file with City at all times during the term of this
Agreement. City reserves the right to require complete, certified copies of all required insurance
policies, at any time.
(B) Duration of Coverage. Consultant shall procure and
maintain for the duration of the Agreement insurance against claims for injuries to persons or
damages to property, which may arise from or in connection with the performance of the Services
hereunder by Consultant, his/her agents, representatives, employees or subconsultants.
(C) Primarv/Non-Contributinq. Coverage provided by
Consultant shall be primary and any insurance or self-insurance procured or maintained by City
shall not be required to contribute with it. The limits of insurance required herein may be satisfied
by a combination of primary and umbrella or excess insurance. Any umbrella or excess insurance
shall contain or be endorsed to contain a provision that such coverage shall also apply on a
primary and non-contributory basis for the benefit of City before the City's own insurance or self-
insurance shall be called upon to protect it as a named insured.
(D) City's Riqhts of Enforcement. In the event any policy of
insurance required under this Agreement does not comply with these specifications, or is
canceled and not replaced, City has the right, but not the duty, to obtain the insurance it deems
necessary and any premium paid by City will be promptly reimbursed by Consultant, or City will
withhold amounts sufficient to pay premium from Consultant payments. In the alternative, City
may terminate this Agreement.
(E) Acceptable Insurers. All insurance policies shall be issued
by an insurance company currently authorized by the Insurance Commissioner to transact
business of insurance or is on the List of Approved Surplus Line Insurers in the State of California,
with an assigned policyholders' Rating of A- (or higher) and Financial Size Category Class VII (or
larger) in accordance with the latest edition of Best's Key Rating Guide, unless otherwise
approved by the City's Risk Manager.
(F) Waiver of Subrogation. All insurance coverage maintained
or procured pursuant to this agreement shall be endorsed to waive subrogation against the City,
its elected or appointed officers, agents, officials, employees and volunteers, or shall specifically
allow Consultant or others providing insurance evidence in compliance with these specifications
to waive their right of recovery prior to a loss. Consultant hereby waives its own right of recovery
against the City, its elected or appointed officers, agents, officials, employees and volunteers, and
shall require similar written express waivers and insurance clauses from each of its
subconsultants.
(G) Enforcement of Contract Provisions (non estoppel).
Consultant acknowledges and agrees that any actual or alleged failure on the part of the City to
inform Consultant of non-compliance with any requirement imposes no additional obligations on
the City nor does it waive any rights hereunder.
(H) Requirements Not Limitinq. Requirements of specific
coverage features or limits contained in this Section are not intended as a limitation on coverage,

limits or other requirements, or a waiver of any coverage normally provided by any insurance.
Specific reference to a given coverage feature is for purposes of clarification only as it pertains to
a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of
other coverage, or a waiver of any type. If the Consultant maintains higher limits than the
minimums shown above, the City requires and shall be entitled to coverage for the higher limits
maintained by the Consultant. Any available insurance proceeds in excess of the specified
minimum limits of insurance and coverage shall be available to the City.
(1) Notice of Cancellation. Consultant agrees to oblige its
insurance agent or broker and insurers to provide to City with a thirty (30) day notice of
cancellation (except for nonpayment for which a ten (10) day notice is required) or nonrenewal of
coverage for each required coverage.
(J) Additional Insured Status. General liability, automobile
liability, and if applicable, pollution liability and cyber liability, policies shall provide or be endorsed
to provide that the City and its officers, officials, employees, agents, and volunteers shall be
additional insureds with regard to liability and defense of suits or claims arising out of the
performance of the Agreement, under such policies. This provision shall also apply to any
excess/umbrella liability policies.
(K) Prohibition of Undisclosed Coveraae Limitations. None of
the coverages required herein will be in compliance with these requirements if they include any
limiting endorsement of any kind that has not been first submitted to City and approved of in
writing.
(L) Separation of Insureds. A severability of interests provision
must apply for all additional insureds ensuring that Consultant's insurance shall apply separately
to each insured against whom claim is made or suit is brought, except with respect to the insurer's
limits of liability. The policy(ies) shall not contain any cross -liability exclusions.
(M) Pass Throuah Clause. Consultant agrees to ensure that its
subconsultants, subcontractors, and any other party involved with the Project who is brought onto
or involved in the Project by Consultant, provide the same minimum insurance coverage and
endorsements required of Consultant. Consultant agrees to monitor and review all such coverage
and assumes all responsibility for ensuring that such coverage is provided in conformity with the
requirements of this section. Consultant agrees that upon request, all agreements with
subconsultants, subcontractors, and others engaged in the Project will be submitted to City for
review.
(N) Citv's Riqht to Revise Specifications. The City and Risk
Manager reserve the right at any time during the term of the Agreement to change the amounts
and types of insurance required by giving the Consultant ninety (90) days advance written notice
of such change. If such change results in additional cost to the Consultant, the City and Consultant
may renegotiate Consultant's compensation. If the City reduces the insurance requirements, the
change shall go into effect immediately and require no advanced written notice.
(0) Self -Insured Retentions. Any self -insured retentions must
be declared to and approved by City. City reserves the right to require that self -insured retentions
be eliminated, lowered, or replaced by a deductible. Self-insurance will not be considered to
comply with these specifications unless approved by City.
(P) Timely Notice of Claims. Consultant shall give City prompt
and timely notice of claims made or suits instituted that arise out of or result from Consultant's

performance under this Agreement, and that involve or may involve coverage under any of the
required liability policies.
(Q) Additional Insurance. Consultant shall also procure and
maintain, at its own cost and expense, any additional kinds of insurance, which in its own
judgment may be necessary for its proper protection and prosecution of the Services.
3.2.12 Water Qualitv Management and Compliance. Consultant shall keep itself
and all subcontractors, staff, and employees fully informed of and in compliance with all local,
state and federal laws, rules and regulations that may impact, or be implicated by the performance
of the Services including, without limitation, all applicable provisions of the City's ordinances
regulating water quality and storm water; the Federal Water Pollution Control Act (33 U.S.C.
§ 1251, et seq.); the California Porter -Cologne Water Quality Control Act (Water Code § 13000
et seq.); and any and all regulations, policies, or permits issued pursuant to any such authority.
Consultant must comply with the lawful requirements of the City, and any other municipality,
drainage district, or other local agency with jurisdiction over the location where the Services are
to be conducted, regulating water quality and storm water discharges. Failure to comply with
laws, regulations, and ordinances listed in this Section is a violation of federal and state law.
Consultant warrants that all employees and subcontractors shall have sufficient skill and
experience to perform the work assigned to them without impacting water quality in violation of
the laws, regulations and policies of this Section.
3.3 Fees and Payments.
3.3.1 Compensation. Consultant shall receive compensation, including
authorized reimbursements, for all Services rendered under this Agreement at the rates set forth
in Exhibit "A" attached hereto and incorporated herein by reference. The total compensation shall
not exceed Seven Hundred Twenty Thousand and Four Hundred Thirty One Dollars
($720,431.00) without written approval of the City Council or City Manager, as applicable.
3.3.2 Payment of Compensation. Consultant shall submit to City monthly
invoices which provide a detailed description of the Services and hours rendered by Consultant.
City shall, within 30 days of receiving such invoice, review the invoice and pay all non -disputed
and approved charges. If the City disputes any of Consultant's fees, the City shall give written
notice to Consultant within thirty (30) days of receipt of an invoice of any disputed fees set forth
therein. Consultant shall submit its final invoice to City within thirty (30) days from the last date
of provided Services or termination of this Agreement and failure by the Consultant to submit a
timely invoice may constitute a waiver of its right to final payment. Payment shall not constitute
acceptance of any Services completed by Consultant. The making of final payment shall not
constitute a waiver of any claims by the City for any reason whatsoever.
3.3.3 Reimbursement for Expenses. Consultant shall not be reimbursed for any
expenses unless authorized in writing by City, or included in Exhibit "A" of this Agreement.
3.3.4 Extra Work. At any time during the term of this Agreement, City may
request that Consultant perform Extra Work. As used herein, "Extra Work" means any work which
is determined by City to be necessary for the proper completion of the Project, but which the
Parties did not reasonably anticipate would be necessary at the execution of this Agreement.
Consultant shall not perform, nor be compensated for, Extra Work without written authorization
from the City.

3.4 Labor Code Requirements.
3.4.1 Prevailing Wages. Consultant is aware of the requirements of California
Labor Code Section 1720, et seq., and 1770, et seq., as well as California Code of Regulations,
Title 8, Section 16000, et seq., ("Prevailing Wage Laws"), which require the payment of prevailing
wage rates and the performance of other requirements on "public works" and "maintenance"
projects. If the Services are being performed as part of an applicable "public works" or
"maintenance" project, as defined by the Prevailing Wage Laws, Consultant agrees to fully comply
with such Prevailing Wage Laws. City shall provide Consultant with a copy of the prevailing rates
of per diem wages in effect at the commencement of this Agreement. Consultant shall make
copies of the prevailing rates of per diem wages for each craft, classification or type of worker
needed to execute the Services available to interested parties upon request, and shall post copies
at the Consultant's principal place of business and at the project site. It is the intent of the parties
to effectuate the requirements of sections 1771, 1774, 1775, 1776, 1777.5, 1813, and 1815 of the
Labor Code within this Agreement, and Consultant shall therefore comply with such Labor Code
sections to the fullest extent required by law. Consultant shall defend, indemnify and hold the
City, its officials, officers, employees, agents, and volunteers free and harmless from any claim
or liability arising out of any failure or alleged failure to comply with the Prevailing Wage Laws.
3.4.2 Registration/DIR Compliance. If the Services are being performed on a
public works project of over $25,000 when the project is for construction, alteration, demolition,
installation, or repair work, or a public works project of over $15,000 when the project is for
maintenance work, in addition to the foregoing, then pursuant to Labor Code sections 1725.5 and
1771.1, the Consultant and all subconsultants must be registered with the Department of
Industrial Relations ("DIR"). Consultant shall maintain registration for the duration of the Project
and require the same of any subconsultants. This Project may also be subject to compliance
monitoring and enforcement by the DIR. It shall be Consultant's sole responsibility to comply with
all applicable registration and labor compliance requirements, including the submission of payroll
records directly to the DIR. Any stop orders issued by the DIR against Consultant or any
subconsultant that affect Consultant's performance of Services, including any delay, shall be
Consultant's sole responsibility. Any delay arising out of or resulting from such stop orders shall
be considered Consultant caused delay and shall not be compensable by the City. Consultant
shall defend, indemnify and hold the City, its officials, officers, employees and agents free and
harmless from any claim or liability arising out of stop orders issued by the DIR against Consultant
or any subconsultant.
3.4.3 Labor Certification. By its signature hereunder, Consultant certifies that it
is aware of the provisions of Section 3700 of the California Labor Code which require every
employer to be insured against liability for Worker's Compensation or to undertake self-insurance
in accordance with the provisions of that Code, and agrees to comply with such provisions before
commencing the performance of the Services.
3.5 Accounting Records.
3.5.1 Maintenance and Inspection. Consultant shall maintain complete and
accurate records with respect to all costs and expenses incurred under this Agreement. All such
records shall be clearly identifiable. Consultant shall allow a representative of City during normal
business hours to examine, audit, and make transcripts or copies of such records and any other
documents created pursuant to this Agreement. Consultant shall allow inspection of all work, data,
documents, proceedings, and activities related to the Agreement for a period of three (3) years
from the date of final payment under this Agreement.

3.6 General Provisions.
3.6.1 Termination of Agreement.
3.6.1.1 Grounds for Termination. City may, by written notice to
Consultant, terminate the whole or any part of this Agreement at any time and without cause by
giving written notice to Consultant of such termination, and specifying the effective date thereof,
at least seven (7) days before the effective date of such termination. Upon termination, Consultant
shall be compensated only for those Services which have been adequately rendered to City, and
Consultant shall be entitled to no further compensation. Consultant may not terminate this
Agreement except for cause.
3.6.1.2 Effect of Termination. If this Agreement is terminated as
provided herein, City may require Consultant to provide all finished or unfinished Documents and
Data and other information of any kind prepared by Consultant in connection with the performance
of Services under this Agreement. Consultant shall be required to provide such document and
other information within fifteen (15) days of the request.
3.6.1.3 Additional Services. In the event this Agreement is terminated
in whole or in part as provided herein, City may procure, upon such terms and in such manner as
it may determine appropriate, services similar to those terminated.
3.6.2 Delivery of Notices. All notices permitted or required under this Agreement
shall be given to the respective parties at the following address, or at such other address as the
respective parties may provide in writing for this purpose:

Such notice shall be deemed made when personally delivered or when mailed, forty-eight (48)
hours after deposit in the U.S. Mail, first class postage prepaid and addressed to the party at its
applicable address. Actual notice shall be deemed adequate notice on the date actual notice
occurred, regardless of the method of service.
3.6.3 Ownership of Materials and Confidentiality.
3.6.3.1 Documents & Data: Licensinq of Intellectual Property. This
Agreement creates a non-exclusive and perpetual license for City to copy, use, modify, reuse, or
sublicense any and all copyrights, designs, and other intellectual property embodied in plans,
specifications, studies, drawings, estimates, and other documents or works of authorship fixed in
any tangible medium of expression, including but not limited to, physical drawings or data
magnetically or otherwise recorded on computer diskettes, which are prepared or caused to be
prepared by Consultant under this Agreement ("Documents & Data"). All Documents & Data shall
be and remain the property of City, and shall not be used in whole or in substantial part by
Consultant on other projects without the City's express written permission. Within thirty (30) days
following the completion, suspension, abandonment or termination of this Agreement, Consultant

shall provide to City reproducible copies of all Documents & Data, in a form and amount required
by City. City reserves the right to select the method of document reproduction and to establish
where the reproduction will be accomplished. The reproduction expense shall be borne by City
at the actual cost of duplication. In the event of a dispute regarding the amount of compensation
to which the Consultant is entitled under the termination provisions of this Agreement, Consultant
shall provide all Documents & Data to City upon payment of the undisputed amount. Consultant
shall have no right to retain or fail to provide to City any such documents pending resolution of
the dispute. In addition, Consultant shall retain copies of all Documents & Data on file for a
minimum of fifteen (15) years following completion of the Project, and shall make copies available
to City upon the payment of actual reasonable duplication costs. Before destroying the
Documents & Data following this retention period, Consultant shall make a reasonable effort to
notify City and provide City with the opportunity to obtain the documents.
3.6.3.2 Subconsultants. Consultant shall require all subconsultants to
agree in writing that City is granted a non-exclusive and perpetual license for any Documents &
Data the subconsultant prepares under this Agreement. Consultant represents and warrants that
Consultant has the legal right to license any and all Documents & Data. Consultant makes no
such representation and warranty in regard to Documents & Data which were prepared by
professionals other than Consultant or its subconsultants, or those provided to Consultant by the
City.
3.6.3.3 Riaht to Use. City shall not be limited in any way in its use or
reuse of the Documents and Data or any part of them at any time for purposes of this Project or
another project, provided that any such use not within the purposes intended by this Agreement
or on a project other than this Project without employing the services of Consultant shall be at
City's sole risk. If City uses or reuses the Documents & Data on any project other than this Project,
it shall remove the Consultant's seal from the Documents & Data and indemnify and hold harmless
Consultant and its officers, directors, agents and employees from claims arising out of the
negligent use or re -use of the Documents & Data on such other project. Consultant shall be
responsible and liable for its Documents & Data, pursuant to the terms of this Agreement, only
with respect to the condition of the Documents & Data at the time they are provided to the City
upon completion, suspension, abandonment or termination. Consultant shall not be responsible
or liable for any revisions to the Documents & Data made by any party other than Consultant, a
party for whom the Consultant is legally responsible or liable, or anyone approved by the
Consultant.
3.6.3.4 Indemnification — Documents and Data. Consultant shall
defend, indemnify and hold the City, its directors, officials, officers, employees, volunteers and
agents free and harmless, pursuant to the indemnification provisions of this Agreement, for any
alleged infringement of any patent, copyright, trade secret, trade name, trademark, or any other
proprietary right of any person or entity in consequence of the use on the Project by City of the
Documents & Data, including any method, process, product, or concept specified or depicted.
3.6.3.5 Confidentialitv. All ideas, memoranda, specifications, plans,
procedures, drawings, descriptions, computer program data, input record data, written
information, and other Documents & Data either created by or provided to Consultant in
connection with the performance of this Agreement shall be held confidential by Consultant. Such
materials shall not, without the prior written consent of City, be used by Consultant for any
purposes other than the performance of the Services. Nor shall such materials be disclosed to
any person or entity not connected with the performance of the Services or the Project. Nothing
furnished to Consultant which is otherwise known to Consultant or is generally known, or has
become known, to the related industry shall be deemed confidential. Consultant shall not use
City's name or insignia, photographs of the Project, or any publicity pertaining to the Services or

the Project in any magazine, trade paper, newspaper, television or radio production or other
similar medium without the prior written consent of City.
3.6.3.6 Confidential Information. The City shall refrain from releasing
Consultant's proprietary information ("Proprietary Information") unless the City's legal counsel
determines that the release of the Proprietary Information is required by the California Public
Records Act or other applicable state or federal law, or order of a court of competent jurisdiction,
in which case the City shall notify Consultant of its intention to release Proprietary Information.
Consultant shall have five (5) working days after receipt of the release notice to give City written
notice of Consultant's objection to the City's release of Proprietary Information. Consultant shall
indemnify, defend and hold harmless the City, and its officers, directors, employees, and agents
from and against all liability, loss, cost or expense (including attorney's fees) arising out of a legal
action brought to compel the release of Proprietary Information. City shall not release the
Proprietary Information after receipt of an objection notice unless either: (1) Consultant fails to
fully indemnify, defend (with City's choice of legal counsel), and hold City harmless from any legal
action brought to compel such release; and/or (2) a final and non -appealable order by a court of
competent jurisdiction requires that City release such information.
3.6.4 Cooperation; Further Acts. The Parties shall fully cooperate with one
another, and shall take any additional acts or sign any additional documents as may be necessary,
appropriate or convenient to attain the purposes of this Agreement.
3.6.5 f Reservedl
3.6.6 Indemnification.
3.6.6.1 To the fullest extent permitted by law, Consultant shall defend
(with counsel of City's choosing), indemnify and hold the City, its officials, officers, employees,
volunteers, and agents free and harmless from any and all claims, demands, causes of action,
costs, expenses, liability, loss, damage or injury of any kind, in law or equity, to property or
persons, including wrongful death, in any manner arising out of, pertaining to, or incident to any
acts, errors or omissions, or willful misconduct of Consultant, its officials, officers, employees,
subconsultants or agents in connection with the performance of the Consultant's Services, the
Project or this Agreement, including without limitation the payment of all expert witness fees,
,attorney's fees and other related costs and expenses except such loss or damage caused by the
sole negligence or willful misconduct of the City. Consultant's obligation to indemnify shall survive
expiration or termination of this Agreement and shall not be restricted to insurance proceeds, if
any, received by Consultant, the City, its officials, officers, employees, agents, or volunteers.
3.6.6.2 If Consultant's obligation to defend, indemnify, and/or hold
harmless arises out of Consultant's performance as a "design professional" (as that term is
defined under Civil Code section 2782.8), then, and only to the extent required by Civil Code
section 2782.8, which is fully incorporated herein, Consultant's indemnification obligation shall be
limited to claims that arise out of, pertain to, or relate to the negligence, recklessness, or willful
misconduct of the Consultant, and, upon Consultant obtaining a final adjudication by a court of
competent jurisdiction, Consultant's liability for such claim, including the cost to defend, shall not
exceed the Consultant's proportionate percentage of fault.
3.6.7 Entire Agreement. This Agreement contains the entire agreement of the
Parties with respect to the subject matter hereof, and supersedes all prior negotiations,
understandings or agreements.
3.6.8 Governina Law. This Agreement shall be governed by the laws of the

State of California. Venue shall be in Riverside County.
3.6.9 Time of Essence. Time is of the essence for each and every provision of
this Agreement.
3.6.10 City's Riqht to Employ Other Consultants. City reserves right to employ
other consultants in connection with this Project.
3.6.11 Successors and Assigns. This Agreement shall be binding on the
successors and assigns of the Parties.
3.6.12 Assiqnment; Subcontracting. Consultant shall not assign, sublet, or
transfer this Agreement or any rights under or interest in this Agreement without the written
consent of the City, which may be withheld for any reason. Any attempt to so assign or so transfer
without such consent shall be void and without legal effect and shall constitute grounds for
termination. Consultant shall not subcontract any portion of the Services required by this
Agreement, except as expressly stated herein, without prior written approval of City.
Subcontracts, if any, shall contain a provision making them subject to all provisions stipulated in
this Agreement.
3.6.13 Construction; References; Captions. Since the Parties or their agents have
participated fully in the preparation of this Agreement, the language of this Agreement shall be
construed simply, according to its fair meaning, and not strictly for or against any Party. Any term
referencing time, days or period for performance shall be deemed calendar days and not work
days. All references to Consultant include all personnel, employees, agents, and subconsultants
of Consultant, except as otherwise specified in this Agreement. All references to City include its
elected officials, officers, employees, agents, and volunteers except as otherwise specified in this
Agreement. The captions of the various articles and paragraphs are for convenience and ease
of reference only, and do not define, limit, augment, or describe the scope, content, or intent of
this Agreement.
3.6.14 Amendment; Modification. No supplement, modification, or amendment of
this Agreement shall be binding unless executed in writing and signed by both Parties.
3.6.15 Waiver. No waiver of any default shall constitute a waiver of any other
default or breach, whether of the same or other covenant or condition. No waiver, benefit,
privilege, or service voluntarily given or performed by a Party shall give the other Party any
contractual rights by custom, estoppel, or otherwise.
3.6.16 No Third -Party Beneficiaries. There are no intended third party
beneficiaries of any right or obligation assumed by the Parties.
3.6.17 Invalidity; Severability. If any portion of this Agreement is declared invalid,
illegal, or otherwise unenforceable by a court of competent jurisdiction, the remaining provisions
shall continue in full force and effect.
3.6.18 Prohibited Interests. Consultant maintains and warrants that it has not
employed nor retained any company or person, other than a bona fide employee working solely
for Consultant, to solicit or secure this Agreement. Further, Consultant warrants that it has not
paid nor has it agreed to pay any company or person, other than a bona fide employee working
solely for Consultant, any fee, commission, percentage, brokerage fee, gift or other consideration
contingent upon or resulting from the award or making of this Agreement. For breach or violation
of this warranty, City shall have the right to rescind this Agreement without liability. For the term
of this Agreement, no member, officer or employee of City, during the term of his or her service

with City, shall have any direct interest in this Agreement, or obtain any present or anticipated
material benefit arising therefrom.
3.6.19 Authoritv to Enter Aareement. Consultant has all requisite power and
authority to conduct its business and to execute, deliver, and perform the Agreement. Each Party
warrants that the individuals who have signed this Agreement have the legal power, right, and
authority to make this Agreement and bind each respective Party.
3.6.20 Counterparts. This Agreement may be signed in counterparts, each of
which shall constitute an original.
3.6.21 Survival. All rights and obligations hereunder that by their nature are to
continue after any expiration or termination of this Agreement, including, but not limited to, the
indemnification obligations, shall survive any such expiration or termination.

KOA 'S ROLE AND EXPERIENCE
In 2009, KOA took the initiative to assist the City of
Long Beach to prepare their citywide ATP Master Plan.
Subsequently, KOA provided design for all the new
bikeway systems in the City of Long Beach. Some of the
design features were submitted to MUTCD to be adopted
as the new national standard for bikeway design and
traffic control. Since then, KOA Corporation has earned a

During the past 11 years, KOA has assisted a very large
number of public agencies to apply for ATP funding and
grants, to prepare master plans and engineering design

to El Segundo, and from Santa Clarita to San Diego.

PROPOSED METHOD TO ACCOMPLISH THE WORK
TECHNICAL APPROACH/WORK PLAN
The Coachella Valley Association of Governments
(CVAG) adopted a new concept of active and alternative
transportation to combine pedestrians, bicyclists, and
low -speed electric vehicles (including golf carts) on a SO
mile dual pathway (CVAG CV/Link) to connect the cities
throughout the Coachella Valley Region. A segment of
the CV Link that goes through the City of Palm Desert,
referenced as "Palm Desert CV Link", is being designed
and funded by CVAG. It is anticipated to be constructed
by the City in late 2020 and completed by the end of 2021.
The Palm Desert CV Link consists of 7,650 feet of on -street
Class 1 and Class 4 bikeway improvements along Painters
Path, Park View Drive, Monterey Avenue, Magnesia Falls
Drive, and a connection frm Magnesia Falls Drive to
Hovley Lane East in Palm Desert.
Meanwhile, the City of Palm Desert started the
construction of San Pablo Streetscape Corridor
Improvement Phase 1 (Highway 111 to Fred Waring Drive),
This will be followed by the construction of San Pablo
Streetscape Phase 2 (Fred Waring Drive to Magnesia Falls)
project, which is anticipated to be completed by the end
of 2021. The mile -tong complete street corridor of San
Pablo will reduce traffic lanes and add bicycle lanes, wider
sidewalks, and parking and buffer zones. It is envisioned
to be the downtown/city center that connects shopping,
restaurants, and other commercial uss with residential
neighborhoods and civic uses. It is the City's desire to
design the extension of Palm Desert CV Link on Painters
Path to connect with El Paseo in two phases. In addition to
that, it's the City's desire to develop, analyze, and design a
bicycle/goff cart alternative corridors network to connect
the Palm Desert CV Link, its extension, San Pablo Avenue
with the City Center including El paseo shopping district,
the retail and residential neighborhood between Highway
111 and Fred Waring Drive and the Civic Center municipal
carnpus at Fred Waring Drive and San Pablo Avenue.

This project, once completed, will reveal an innovative
interconnected network of bicycle and golf cart corridors
throughout the Palm Desert City Central District, designed
to connect the CV Link, its extension to EI Paseo and San
Pablo Avenue, with several other active transportation
corridors within the study area. These bicycle/golf cart

corridors will be designed with colorful landscaping,
hardscaping features, lighting, and public art fixtures along
its length, thus creating a safe, compelling environment
for pedestrians, bicyclists, and golf cart users. This project
will include a monument to incorporate public art into the
bridge across the Palm Valley Channel. Development of
construction plans and specifications to extend the "Palm
Desert CV Link" will be prepared in two phases: Phase 1
from Bump and Grind Trail to Palm Valley Channel and
Painters Path spur and Phase 2 from Palm Valley Channel to
El Paseo Street.
The City's main goal and vision is to develop, analyze,
and design innovative bicycle/golf carts and multi -modal
alternative corridors throughout the City Central District to
connect to the Palm Desert CV Link, its new extension, and
the San Pablo Avenue corridor. These alternative corridors
will create a spine of interconnected active transportation
networks that will serve;
• College of the Desert (COD),
• El Paseo Shopping and Restaurant District
• Retail and Residential Neighborhood between
Highway Ill and Fred Waring Drive
• Family YMCA along San Pablo
• Civic Center Park by City Hal
• Palm Desert Aquatic Center along Magnesia Falls
• Street Fair at COD
• Potential Transit Hub at the North-West Corner of
Monterey Avenue and Highway 111
To begin with, we will identify any design challenges of
connecting the bikeways and golf carts across Highway
111 and provide the recommended mitigations, especially
at the six major intersections with Highway 111 at Painters
Path, Fred Waring Drive, Town Center Driveway, Monterey,
San Pablo, and Portola Avenues. The initial alternative
concepts will consider improvements within the existing
right-of-way; however, KOA will explore innovative
and effective alignments that may include commercial
properties.
We will compile collision data, conduct peak hour
multimodal traffic counts, traffic signal warrant analysis,
and traffic signal operational analysis for the study
alternatives. We will also conduct public outreach for the
duration of the project. KOA will work closely with City
staff to prepare for public meetings, presentations to
the City's Planning Commission, the Art in Public Places
Commission, and the City Council. We understand that

this project will be developed in phases as shown in the
flowchart above.
The strategy in developing the alternatives will be
discussed and presented to the City's project manager,
project development team, and members of the public. We
anticipate developing up to three combined alternatives
within the study area for initial staff and public review. A
set of criteria will be developed and analyzed to generate
these alternatives. KOA will gather the information required
to analyze the alternatives. KOA will study and analyze all
factors that may impact this project for each alternative.

the alternative strategies and result in the recommendation
and selection of the preferred alternative are'

The alternatives will then be refined to incorporate any
comments received from City staff and the public. KOA
will also arrange for a presentation to the City's Planning
Commission with recommendations for a preferred
corridor alignment. Croce the preferred corridor alignment
is approved and the authorization to proceed to the
next phase is granted, we will start the preparation of
the preliminary design plans. However, the KOA team
will further explore the cross-section alternatives of the
preferred corridor during the concept development
phase of the project. Due to the fact that the City will
only apply for state -only grant funds for this project,
the Caltrans' environmental document required for this
project wou�d be the California Environmental Quality Act
(CEQA) document. The CEQA document will determine and
include any potential environmental impact to this project
within the study area. The preliminary engineering phase
will result in a bicycle/golf cart alignment that consists of
several projects. Upon completion of this phase, the City
will negotiate and authorize the projects that will move
forward to the final engineering design phase of the
project. The construction of such projects will be subject
to the available budget. Following the final engineering
design, KOA will provide the City with bidding support and
construction engineering services as required by the City.

will coordinate with City staff, the existing local bicycle
groups, "Coachella Valley Bicycle Coalition", "Friends of CV
Link" Groups, stakeholders, and members of the public
throughout this project. We will maintain a record of all
contacts and a log of all correspondence and promptly
make them available to the City's PM on a regular basis.

Planning Commission, Art in Public Spaces Commission,
and the City Council for the project's durati in. Our

QUALITY ASSURANCE
KOA has a formal quality assurance program in place for
all of our projects. Formal quality control checklists will
be employed and will be provided to the City for review
upon request. The project -designated QAIQC Manager,
Mr. Jimmy Lin, PE is responsible for the quality control of
the project, from inception to the completion of the final
design, including the preparation of the PS&E and the
construction bid documents.
We are committed to generating quality work products
and strive to producing error -free plans. We have staff
experienced in active transportation and traffic engineering,
as well as civil engineering design_ Our Quality Assurance
and Quality Control (QAIQC) process involves having plans
go through a minimum of two stages of internal review
before submitting to the City for plan review and approval.
The first stage of internal review involves a peer review by an

experienced design engineer. The second stage of internal
review involves another round of reviews by one or more
senior -level registered engineers. This approach has led to a
high level of quality in our engineering plans, and we believe
our firm is establishing a strong reputation with a number of
agencies for producing high quality work products.
TASK 2: FEASIBILITY AND ALTERNATIVE
ANALYSIS
Initially, KOA will confirm the proposed geographic
boundary of the study area with the City's project manager.
We recommend that it goes beyond Painters Path, El
Paseo, Portola Avenue, and Magnesia Falls to include:
1. The Corridor Segment South of El Paseo (along
Shadow Mountain Drive from El Paseo to Portola
Avenue)
2. Extend San Pasqual Avenue Further East on
Rutledge Avenue then Curve North to Connect with
Magnesia Falls Drive.
Our strategy in developing the initial three bicycle/golf cart
alternative corridors is to explore all possible routes within
the study area for potential connectivity with the Palm
Desert CV Link and San Pablo Avenue. This will include major
thoroughfares, local roads through residential areas, and
roads serving commercial and business areas (see Potential
Alternative Corridors map). Based on our knowledge of
the area, the KOA team will then propose a combination of
alternative routes that would qualify as potential corridors.
This initial selection of the alternative alignments will
consist of the following roads and most importantly will
ensure connectivity to the CV Link, San Pablo Avenue,
and the major attraction activities within the study area.
The proposed alternative alignments will consider
connectivity to any existing bikeways within the study
area for consistency purposes, as well as the connection
to the future expansion of the City of Palm Desert CV Link
throughout the City_ As for utilizing innovative ways to use
commercial properties, KOA is considering Hahn Road,
running through the back of the commercial property of
Westfield Mall as a potential route connecting Monterey
Avenue with Town Center Way. KOA will also review the
potential of utilizing the service roads along Highway 111
as alternative corridor in the analysis.

An overview of assessing potential alternative corridors is
depicted in the flow chart graphic below. The evaluation
of the potential alternative routes will be premised on a
statement of purpose and need. An important element for
establishing a purpose and need for corridor feasibility will
be the assessment of existing conditions. We will obtain
and review existing documents and reports relevant to this
project and will coordinate with the CV Link and San Pablo
Avenue design consultants in relation to their respective
projects. We will also conduct a multimodal corridor audit
consistent with the FHWA guidelines for a road safety audit
(RSA) for vehicles, bicycles, pedestrians, and transit. The

evaluating the alternative alignment corridors is engaging
the community throughout this process. This will empower
residents to participate in developing the alternative
alignments so they can take ownership of the project
which, consequently, will help with consensus -building and

staff, and law enforcement staff to gather information on

and residential areas, ease/smooth connectivity between
the critical elements within the study area, safe crossing of
roads, potential impact to existing utilities, ROW, impact
to the environment, feasibility of construction, conceptual
cost, suitability for grant funding, and most importantly, the
safety of pedestrians, cyclists, and golf cart users. KOA will
prepare conceptual cst estimates for each of the analyzed
alternatives to include design, construction, right-of-way,
traffic signals, and utility relocation, if applicable.
KOA will develop a matrix comparing the three alternatives
then summarizing the advantages and disadvantages for
each of the proposed combination of alternatives. We will
conduct a meeting with City staff, local bicycle groups,
residents and leaders of the community, and stakeholders
to discuss the findings of comparing the alternatives and
discuss the reasons and importance of each of the factors.
Suggestions/ideas will be considered in revising the
alternatives accordingly. We will present the findings
to the Palm Desert City Planning Commission and
City Council, illustrating the study alternatives and the
preferred alternative. Upon the direction obtained during
those meetings, we will then finalize the selection of the
preferred alternative.
TASK 3: PRELIMINARY ENGINEERING AND
FNViPONMENTAL
The preliminary/concept design is a critical phase whereas
significant elements of the conceptual design will identify
opportunities and constraints within the project limits. In
this case, it will define the most feasible corridor alignment
for this project based on cost, time, and other significant
factors discussed below.
In evaluating the combination of the potential alignment
corridors discussed in the previous section, KOA will
prepare an initial concept design for the preferred
alternatives. The following are crucial factors to be

The KOA team will1identify several cross-section options
for the design of the preferred alternative corridors. The
potential ATP treatments are shown in the figure on the
following page.
KOA will identify design challenges in connecting
the bikeways and golf carts across Highway 111 and
recommend mitigations, especially at the six intersections
with Highway 111 at Painters Path, Fred Waring Drive, Town
Center Driveway, Monterey, San Pablo, and Portola Avenues.
We will also develop a conceptual plan to illustrate/identify
any impacts to the existing infrastructure that may result
due to the implementation of the selected alternative. The
concept design plans will include conceptual landscape/
hardscape and art features for the project.
Nationally and in California, injury and fatality accidents
involving ATP facilities and users have substantially risen
in recent years, partially caused by the increase of activity
and lack of safety concerns in the design. In 2018, 19
pedestrian fatalities were reported in the Valley. During
the first 6 months of 2019, the number of fatalities has
already surpassed 12. Safety in bikeways and pedestrian
paths needs to be a vital technical consideration in the
design process. Since our inception in 1987, KOA has
been actively participating in the traffic safety design
advancement program; we are one of a few experts in the
traffic safety field.

KOA will conduct traffic counts and evaluate speed limits,
level -of -service, and traffic operations (using Synchro
and Sim/Traffic software) for critical intersections. Delay
and queuing analysis will be conducted, particularly near

Palm Desert CV Link and its extension to El Paseo
terminates at an uncontrolled intersection where Town
Center Way intersects El Paseo_ This may present major
concern since, in addition to creating an unsafe and
uncomfortable terminus for cyclists/golf cart users, it's also
lacks connectivity with a continuous path across the City.
The same issue exists with the San Pablo Avenue complete
street, where it only connects to the Palm Desert CV Link,
but lacks connectivity to the other parts of the study area.
As a part of this study we will review the feasibility of

KOA will prepare a Traffic Management Plan during the
construction phase. It will include traffic control plans,
detours, signing, striping, and lighting during the different

TASK 5: PUBLIC INVOLVEMENT
Engaging the public in this planning process and
listening to their needs and challenges is vital to the final
selection of a preferred alternative. KOA, in coordination
with City staff, will develop a public involvement plan
and conduct various community outreach activities to
accomplish that. Initially, KOA staff will conduct a meeting
with the two local bicycle groups, City staff, and law
enforcement staff to collect data and gather information
on the issues, challenges, and concepts that will help
develop the alternatives. Once the alternative alignments
are developed, KOA will conduct a public outreach
presentation to the two local bicycle groups, stakeholders,
law enforcement staff, businesses, residents, and leaders
of the community to discuss the alternatives.

TASK 6: RIGHT-OF-WAY
The KOA team will review the right-of-way (ROW) data
for each alternative to identify potential ROW impacts
during this phase of the preliminary concept design and
determine if property acquisition is required. Where it is
practical, alternatives will be proposed within the existing
ROW; however, innovative and effective alignments may
encroach commercial properties.
KOA will follow Caltrans' process for state -funded projects
for potential state funding. All encroachments onto
adjacent private/commercial property will be shown on
the ROW plan map. The final plans will show the existing
ROW limits and the ultimate ROW limits. Temporary
construction easements required to construct the
improvements will also be indicated on the plans_

KOA will submit utility location map requests to all utility
companies. The City shall provide KOA with the contact
information of all the utilities in the area. KOA will compile
a utility contact matrix to track when utility companies are

the existing utility with the utility owners. Preliminary and

Field surveys will be conducted for mapping elevations
against National Mapping Accuracy Standards. This work
will include sending field crews to the project area and
surveying topographic information to develop one -foot
contour base maps of the project area. AutoCAD plans will

will include street centerline and ROW information and
survey monuments. Forty scale planimetric aerial mapping

PUBLIC ART
The KOA teams public artist, Robin Brailsford, is a desert
dweller and a big thinker, The white light, prickly heat and
vast desert void all contribute to the drama of her work. The
Palm Desert challenge intrigues her as an artist for all of
these reasons. She sees the potential for shade, wayfinding,
resbits, green energy, and iconic new ideas about climate
change and individual responsibility for a city already known
for its public art collection. With Brailsford's monolithic
glass mosaics, she sees the bike paths with glow -in -the dark
designs, tilt -up buildings, and walls for shade and solitude.
She sees the bridge (rich in metaphor) as an opportunity to
add sculptural tall wind spires to identify the site, weather
and stars and to generate electricity for neon, lighting, or
water courses. On the team, on -site, with citizens, and staff,
her exact inspirations will manifest. Brailsford's work will
promise that her work will come in on -time, within budget,
and to the highest aesthetic and technical standards. Her
involvement will commence at the conceptual stage after
the alternatives are developed. After the initial concept is
embraced by the public and the stakeholder, a more concise
design concept will be prepared during the preliminary
design and refined for the final design.

Environmental approval is always a critical path in the
design of a public facility in California. Although most

of the studied/analyzed corridors will be constructed
within or adjoining the public right-of-way, we expect
environmental studies will be required. Based on our prior
experience in the Coachella Valley, we do not anticipate
that any major hurdle or fatal flaw wilt be encountered.
Nevertheless, it takes time to conduct and complete the
environmental study. It will be a critical path of the whole
production schedule. The following describes the approach
the KOA team will take in completing initial studies and
EIRs. It provides typical project tasks associated with the
environmental review of this project. It is based on our
understanding of state law and regulations and the desire
of the community to efficiently and effectively evaluate,
select, and build multimodal connectors in the planning
area. We will work diligently to conduct CEQA analysis
hand -in -glove with City staff and to complete documents
in an expeditious time frame. our early and ongoing
involvement will help resolve potential environmental
issues through early design adjustments and refinements,
thereby simplifying the environmental document and its

TASK 12: STRUCTURAL ENGINEERIN(
The proposed trail on Painters Path will cross the
Palm Valley Stormwater Channel. There is an existing
prefabricated steel through truss -girder pedestrian
bridge in place. It is envisioned that existing bridge may
not be wide enough to accommodate two-way golf
carts. Therefore, considerations will include constructing
a separate prefabricated one-way bikeway bridge and
keep the existing bridg� in place or constructing a new
prefabricated two-way bikeway bridge in place of the
existing structure. The new bikeway bridge will span the
existing channel without any middle piers. The bridge is
estimated to be approximately 75 feet long and will be
about 14 feet in net width to accommodate two-way golf
cart, pedestrian, and bicycle traffic safely. A fence/railing
will be placed on both sides of the bridge.
Since the proposed bridge will carry only bicycle traffic,
golf carts, or pedestrians, the design loads will be based
on AASHTO LRFD Pedestrian Loads which are much
smaller than a vehicular bridge. However, when a bridge
width exceeds 8 feet, the structural loads must include
an eight -ton truck load for maintenance or emergency
vehicles_ Light prefabricated steel bridges, such as steel
arch truss or steel through truss bridges, can all be
considered. The prefabricated bridge will be fabricated in
the shop and transported in segments or the entire bridge
to the job site for erection. A sample prefabricated steel
arch bridge picture is shown in Figure 1. Viable structure
types for the light steel truss bridges are shown in Figure

DEVELOPMENT
KOA staff will explore the availability of any potential
state or local grants (CVAG/RCTQ determine eligibility
and suitability of such grants for the construction, and/or
other phases of this project such as public art. KOA staff

tATP) - Cycle 5 funding which is anticipated to be released
by April or May of 20 0. Cycle 5 is expected to include
about $440M in ATP Ifunding made up of federal funding,
state SBl and State Highway Account (SHA) funding. The
funding/programming years are expected to include
21122, 22/23, 23/24 and 24125 fiscal years. This will be a
great opportunity to submit a grant application for the
construction and public art of this project. KOA staff, in
collaboration with City staff, will prepare a compelling
narrative and compile all the documents required for a
successful and high -scoring grant application. This will
include the application form, scope of work, project
timeline, third -party in -kind valuation plan (if applicable), a
map of the project study area, letters of support, graphics•,
safety data, travel mode data, and other data to indicate
the potential for reducing VMT and GHG.

completion of this phase, the City will negotiate and
authorize the project(s) that will move forward to the final

be subject to available budget.

FNGINFERING
Once the final plans, specifications and estimates (PS&E)
are submitted by KOA and approved by the City, KOA
will provide a Mylar copy of the final approved plans, an
electronic copy of the final plans in both AutoCAD and
PDF files, and an electronic copy of the specifications
in both Microsoft Word format and PDF format. The
KOA team will assist the City in organizing the pre -bid
meeting, preparing bid addenda, and attending the bid
opening and the pre -construction meetings. KOA will have
a marginal role in assisting the City during the bid and
construction phase. In the event that any items require
interpretation in the drawings or specifications, KOA will
analyze and submit corrective actions, as advised by the
City, in the form of an addendum issued by the City. KOA,
if authorized by City, will furnish all necessary drawings
for corrections, requests for information (RFI), and change
orders. The original tracing(s) of the drawings and contract
warding for change orders will be submitted for City
duplication and distribution.

of this Agreement and shall not be restricted to insurance proceeds, if any, received by Consultant, the City, its officials,

RELE ANT EXPERIENCE
Escondido Creek Bikeway Missing Link Project, Escondido, CA
Project Manager. KOA assisted the City of Escondido in the design of
the Escondido Creek Bikeway Missing Link Project. The project involved
construction of 2200 feet of missing section of the Escondido Creek Bikeway
between the Escondido Transit Center, Escondido's historic downtown and
Grape Day Park. The path will provide a connection between the east end of
the Inland flail Trail that connects Escondido with the beaches of Oceanside,
and the eastward continuation of the Escondido Creek Bikeway to Dixon Lake,
El Cabalio Park, and the Daily Ranch Regional Park in the northeast corner
of the City. Design services include preparation of plans, specifications and
estimates new bikeway construction, a bridge across Escondido Creek, traffic
signal modifications, and bikeway delineation of the two way Class I and Class
IV bikeway. KOA integrated the bikeway design with three NCTD bus stops. The
total project cost was $lmillion funded through an ATP grant.
La Canada Flintridge Foothill Boulevard Bike Lanes, La Canada Flintridge,
CA
Project Manager. KOA provided professional engineering services for the
Foothill Boulevard Link Bikeway between Leata Lane and the Glendale Freeway
[SR-2] ramps at Hillard Avenue. The intent of the project was to maintain
the eastbound and westbound an -street Class II bike lanes and to create
an off-street eastbound Class I bikeway and sidewalk in a greenbelt area.
Our objective was to define a viable alternative for achieving these features,
and to obtain CEQA and NEPA environmental clearances for the proposed
improvements. The creation of the greenbelt will be created by narrowing
the traffic lanes on Foothill Boulevard and eliminating the existing eastbound
on -street Class II bike lane. In addition, the curb on the north side of Foothill
Boulevard will be extended to contain a parkway strip between the sidewalk
and the curb. The existing center turn lane of the roadway will be modified to
create a landscaped median.

Township of Seeley Sidewalks And Bicycle Lane Design On Rio Vista Avenue, Seeley, CA
Imperial County received grant funding through the Congestion Mitigation and Air Quality (CMAQ) program to enhance
active transportation infrastructure adjacent to and serving the Seeley Elementary School. A recently conducted Safe
Routes to School Master Plan identified the need to provide sidewalk and bicycle accommodations along Rio Vista
Avenue to improve walking and biking accessibility to the school. KOA prepared design plans to pave the south shoulder
area and construct curb and gutter and sidewalk on the south side of the street and to provide a dedicated bicycle lane.
KOA services included a Survey and Base Map, an Hydrology Study, Design Plans, PS&E, and bid phase support. The
project included a 130-foot long, 12•foot wide pre -fabricated steel bridge spanning over the Arroyo Simi Channel. This
required extremely close coordination with the design team and contractors to install the bridge above the FIMA base
flood elevation.
County of Los Angeles East Avenue 0 Bike Lane Project, Los Angeles County, CA
Project Manager. KOA provided engineering services to the County of Los Angeles Department of Public Works for
a roadway improvement project involving roadway widening and installation of Class II bike lanes on East Avenue O
from 150th Street East to 165th Street East. The project was located within the unincorporated area of Lake Los Angeles
in the County of Los Angeles (Supervisorial District 5). KOA conducted research, field reviews, and an engineering
site assessment, and subsequently prepared a Project esign Concept Report to determine and address design and
construction issues, define the project schedule, estimate design and construction costs, and identify the funding sdurces
to design and construct the project.
Carson Street Master Plan Improvements, Carson, CA
Project Manager_ KOA produced roadway and traffic signal designs for this streetscape project within the City of
Carson. KOA monitored the civil engineering issues related to street profiles, traffic, drainage and constructability
during all design phases of the project. The project design concepts included expanded sidewalk areas, pedestrian -
focused intersection treatments, and new bicycle facilities. The project traffic analysis included an analysis of potential
intersection approach lane changes due to corridor improvements, and reorientation of commercial center traffic due to
the installation of raised medians. A traditional level of service analysis was conducted, to make sure significant impacts
would not occur. The project incorporated Green Street Technology concepts, such as utilization of alternative drainage
systems, bio-swales and plantings.
Culver City Pedestrian Improvements at Intersections, Culver City, CA
Project Manager. The City of Culver City proposed to construct pedestrian improvements at the following eight (8)
intersections; Washington Boulevard at National Boulevard, Robertson Boulevard, Landmark Street, Washington Place,
Centineia Avenue, and Inglewood Avenue; and Sepulveda Boulevard at Washington Boulevard and Sawtelle Boulevard.
The goal of the project was to improve safety and aesthetics along major arterials with a high transit and pedestrian
activity. The improvements included ADA curb ramps, crosswalk pavement treatments (brick pavers, custom delineated/
pavement markings), or ADA push buttons. KOA provided PS&E for the project which included all necessary engineering
and applicable administrative tasks.
North -South [Daisy to Myrtle] Bicycle Boulevard PS&E Design, Long Beach, CA
Project Engineer. KOA is in the process of developing a 10-mile bike boulevard facility along the Daisy/Linden/Myrtle
corridor in the City of Long Beach, which includes both Class II and Class III bike lanes along with other innovative
intersection treatments. KOA has integrated four sub -consultants into this project to provide meaningful SBE
participation in the design opportunity. A grant obtained through the Safe Routes to School program was used to help
finance this project, and will provide 2,000 students in five congressional districts with improved opportunities for biking
to school. Treatments such as roundabouts, traffic circles, median refuges, bike boxes, traffic signals with bike detection,
and other greenway improvements will be included in developing a bike -friendly corridor.

Principal -in -Charge. As a subconsultant to CNS, KOA provided traffic planning
and engineering support for this improvement project. The project involved
the replacement of the existing South Palm Canyon Drive bridge that crossed
the Tahquitz Creek Channel. $66,150. Completed.
Port of Long Beach Pier J Bike/Ped Path PS&E, Long Beach, CA
KOA Project Manager, The KOA team helped the Port design their first bike
path, which ran adjacent to various tourist attractions_ A combination of
Class I, II, and III bike lanes; innovative bike facilities; landscapes; wayfinding
signs; public art/display boards; and three crescent piers were provided
for pedestrians and bicyclists along the south shore ocean -front area that
included access to the hotels, the Harbor Light Yacht Club, the Reef Restaurant,
Harry Bridges Memorial Park, Catalina Express charter services, the Russian
Submarine Scorpion, the RMS Queen Mary, Carnival Cruise Lines terminal,
Island Express Helicopters, and the recreational fishing area along the
riprap lining the east shoreline of Pier J. Ms. Zhou managed KOA staff and
five other firms for this project_ She provided project oversight and was the
liaison between the project team, the Port of Long Beach, and the project

subconsultants for this project due to SBE requirements. A grant obtained via an SR2S application prepared by KOA was
used for this project, due to an SR2S element of the corridor, which had the capacity to serve 2,000 students and five
congressional districts throughout the area. Treatments such as roundabout, traffic circle, traffic signal, bicycle detector,
and other greenway improvements were provided at the concept design stage of the project. Ms. Zhou managed the
project and was the liaison between the consultant team, the City of Long Beach, and the project stakeholders.
City of Wildomar Grand Avenue Bike Improvements & Multi -Purpose Trail Improvements Projects, Wildomar, CA
KOA Project Manager. KOA is leading a team to improve bicycle facilities for the City of Wildomar along a five -mile span
of Grand Avenue and Clinton Keith Road. Street widening and trail improvements include the incorporation of Class 1,
Class II, and Class III facilities for bicyclists and other non -motorized forms of transportation, The improvements will
accommodate students attending a middle school on Grand Avenue and the local bicycling community. The work, which
consists of three separate projects with different funding sources, is being completed concurrently as a single unit.
Financing is being provided by local sources and state and federal grants. The team's services include traffic engineering,
utility research, surveying, hydrology, geotechnical engineering, and right-of-way analysis. KOA is providing conceptual
plans and alignments, bicycle safety and awareness education, traffic calming design, street crossing designs for bicycle
and pedestrian uses, and designs for incorporating ADA access. KOA is involved in public meetings to obtain the
community's input and to educate locals about safe bicycling practices.
City of Moreno Valley Aqueduct Trail System Including Missing Segments and Street Crossings - Preliminary
Alignment and Environmental Document, Moreno Valley, CA
Principal -in -Charge. The project will upgrade and complete the entire Aqueduct Trail system across the City, connecting
to the Lake Perris State Recreational Area. The study examines the entire alignment, including users, trails, street
crossings, and connections, and develops recommendations for typical cross sections, alignments, street crossing
treatments, materials, wayfinding and landscaping, and connections, to maximize use and benefit of the trail for the
public. We are malting recommendations for follow-up work in the phased implementation of plans and specifications for
actual construction development of the trail system. The trail alignment is fairly unique, in that it cuts through the heart
of the City, providing a convenient corridor for transit and recreational uses to City residents_

Project Manager, Mr, Lin is providing the Coachella Valley Association of
Governments (CVAG) with a Transportation Project Prioritization Study [TPPS]
and a Regional Arterial Cost Estimate (RACE) 2005 and 2010 Updates. The
TPPS updates the list of Regional Arterial Projects located in the Riverside
County sub region and nine incorporated cities. The project includes a ranking
system for evaluating the need for improvements. The TPPS identifies factors
which over time may alter recommended priorities, and develops a continuing
monitoring program which will allow CVAG to address changing conditions
over time. The RACE will assist in reviewing the CVAG Regional Arterial
Financial Plan and Expenditure Program and provide recommendations on the
need for revisions or updates.
City of Long Beach City-wide ATP Master Plan & Engineering Design,

Project Manager. KOA prepared a City wide bikeway master plan for the city
of Long Beach in 2009 which was used as a blue print for the design and
implementation of the bikeway network in the City. Mr_ Lin was involved in
the preparation of the Master Plan and the initial implementation of several

SANDAG ATP Bikeway corridor design for SANDAG (11.6 miles), San
Diego, CA
Principal -in -Charge. Mr. Lin was the PIC for an 11.6-mile ATP bikeway design in

Rosemead Boulevard Safety Enhancements Design/Study, Temple City, CA
Principal -in -Charge. KOA produced conceptual geometrical layouts for Rosemead Boulevard from Callita Street near the
northern City boundary to the railroad grade separation at the southern City boundary, approximately 2 miles. The plan
identified locations for proposed curb lines, bulb -outs, center raised medians and verified the feasibility of providing
adequate lane widths, transitions, and on -street parking lanes. KOA also conducted traffic impact and parking analyses
for the project. KOA worked with the City to define two project design alternatives, and produced final design plans. The
final design plans included preparation of signing & striping plans and traffic signal modifications plans to accommodate
the proposed bulb -outs and installation of Class II bike lanes, as well as upgrade of traffic signal equipment to include
count down pedestrian signal indications and push buttons to conform to MUTCD and ADA requirements. We also
prepared street lighting and decorative pedestrian lighting plans along the route to enhance pedestrian safety. A unique
feature of this project is the separated (buffered) bike lanes, or cycle tracks, situated between the parking lanes and
sidewalks. This project received a 2014 Merit Award in Urban Design from the AIA California Council, won the ASLA
Southern California Chapter "Quality of Life" award (2014), and was selected for a "Best 10 new bike lanes of 2014"
recognition from the PeopleforBikes organization.
East San Fernando Valley Transit Corridor Alternative Analysis (AA) and EIR/EIS, East San Fernando Valley, Los
Angeles CA (2012-2014)
Project Manager. Mr. Lin is the Project Manager for this major transit �orridor study (�46 million) for KOA Corporation,
retained by LAC Metro to environmentally dear and prepare conceptual engineering work for a transit project on the Van
Nuys Boulevard Corridor, The Corridor extends approximately 11 mites along Van Nuys Boulevard from Ventura Boulevard
at the south end to the San Fernando Metrolink station on the north end. The project is in the eastern San Fernando
Valley, within the Cities of Los Angeles and San Fernando, extending through the communities of Sherman Oaks, Van
Nuys, Panorama City, Arleta, Pacoima, and Lake View Terrace. The KOA team is evaluating a number of alternatives as
part of this process, including a Transportation Systems Management (TSM) Alternative, a Bus Rapid Transit Alternative
with dedicated bus lanes, a Light Rail Transit Alternative, and a Street Car Alternative. Each of the 4 build alternatives has
been carried through the conceptual design. The KOA team is preparing an environmental clearance through a combined
Alternatives Analysis/Draft Environmental Impact Statement/Draft Environmental Impact Report (AA/DEIS/DEIR), for
all four build alternatives and is finalizing the Conceptual Engineering (CE), in preparation for eventual preliminary
engineering.
City of Coachella ST-68 Traffic Signal Synchronization Project (TSSP), Coachella, CA
Project Manager. KOA is providing ITS and signal design services for the Traffic Signal Synchronization and ITS
Infrastructure Please I Deployment of the City's ITS Master Plan. The scope includes complete PS&E for controller
upgrades, ITS hardware & software upgrades, new 72 single mode fiber optic interconnect of all City intersections,
redundant wireless interconnect and the PS&E to construct a new Traffic Management Center (TMC). Signal
synchronization and timing Implementation for 16 City traffic signals is included, as well as timing implementation
and training for City staff for TMC operation. KOA is providing field inspection of the signal controller, fiber optic cable
installation, and the construction of the new traffic management center of the project.

Project Manager. KOA is finalizing the SLAG Go Human Inland Empire Tactical
Urbanism Project. Over the latter half of 2018, KOA has worked with SLAG to
plan, design, and implement four demonstration events in the Inland Empire
cities of Ontario, Chino, Lake Elsinore, and Riverside. Event elements were
tailored to each City, but all included temporary active transportation elements
such as: bicycle lanes, cycle tracks, parklets, curb extensions, and high visibility
crosswalks. The events were used to showcase the benefits of installing active
transportation infrastructure and show how those could be incorporated onto
existing street facilities. KOA also worked with each City and local community -
based organizations to incorporate educational programming at each event.
League cycling instructors (LCIs) led bicycle tours and educational trainings
while KOA staff described to event attendees the function of installed elements
and their benefits. Finally, each event was evaluated and documented through
the collection of surveys (English and Spanish), photos, videos, with participant
testimonials.
City of Wildomar Grand Avenue Bike Improvements & Multi -Purpose Trail
Improvements Projects & ATP Cycle 3 Grant Application, Wildomar, CA
Outreach Planner. KOA led a team to improve bicycle facilities for the City
of Wildomar along a five -mile span of Grand Avenue and Clinton Keith
Road. Street widening and trail improvements included the incorporation of
Class 1, Class II, and Class III facilities for bicyclists and other non motorized
forms of transportation. The improvements, which were since constructed,

sources and state and federal grants. The team's services included traffic engineering, utility research, surveying,
hydrology, geotechnical engineering, and right-of-way analysis. KOA provided conceptual plans and alignments, bicycle
safety and awareness education, traffic calming design, street crossing designs for bicycle and pedestrian uses, and
designs for incorporating ADA access. KOA was involved in public meetings to obtain the community's input and to
educate locals about safe bicycling practices.
Cesar Chavez Road Realignment & Improvement Project, Calexico, CA
Project Planner. This was a federally -funded street widening project that required NEPA Clearance from Caltrans District
11. This project was required to meet the new Port of Entry that was planned to be constructed in the city in 2016. The
project required roadway improvements including three intersection modifications with traffic signal design. One of the
intersections needed coordination with Caltrans District 11, white the intersection at Cesar Chavez and Grant Street had a
UPRR at -grade crossing, so extensive coordination and approval with UPRR was necessary.
California / Baja California Pedestrian and Bicycle Transportation Access Study, CA -Mexico Border
Outreach Task Manager. KOA, in collaboration with the Imperial County Transportation Commission and Caltrans,
conducted a study in order to improve travel experiences for people walking or bicycling across the Califor is and Baja
California border. The study recommended w4ys to make walking and biking trips safer, easier, and more comfortable
around the six ports of entries. Mr. Pelayo and his team conducted intercept surveys at five ports of entry to gather ideas
on improvements from border travelers, community groups, and public agencies. The team brought the outreach to the
field by going to each port of entry and speaking with the daily users in Spanish to docurnent their concerns and obtain a
clear understanding of the constraints and possible opportunities.
Town of Apple Valley Safe Routes to School Master Plan, Apple Valley, CA
Outreach Task Manager. The Town obtained a Caltrans Sustainable Transportation Planning Program grant to develop a
town -wide Safe Routes to School (SRTS) Master Plan, which would serve a population of more than 70,000 people. Mr.
Pelayo and his team of outreach specialist conducted events at 12 schools. Outreach material was produced in English
and Spanish and meetings were conducted in both languages concurrently in order to promote a greater community
interaction. More than 5,000 surveys were collected as part of this project. More than 200 participants attended the
events.
SBCTA Safe Route to School Phase I1 Project, San Bernardino County, CA
Outreach Task Manager, As part of a multi -modal transportation system effort. SBCTA currently maintains a regional
non -motorized transportation plan (NMTP) that is traditionally bicycle -focused. KOA is helping SBCTA expand the
NMTP's focus to include pedestrian and safe routes to school components. This Safe Route to School Plan Phase II study
is intended to establish a data collection methodology for local jurisdiction and school district uses. As part of this
effort, KOA is conducting walk/bike audits for the most -needed schools and providing feasible and grant application -
ready improvement recommendations and cost estimates. The ultimate goal is to promote walking and cycling to
school by providing safer and better pedestrian and bicycle programs and to improve the overall health and economic
development of the students and community. Mr. Pelayo developed an outreach and logistics plan in order to be able
to plan for and conduct 55 school event meetings within a one-year period. Outreach material that included fact sheets,
fliers, banners, and email scripts were developed as part of the outreach plan.

Principal -In -Charge. The purpose of the West Creek Trail Head Project was
to Construct of a horse trailer parking facility at the intersection of McKean
Parkway and Copper Hill Drive in the City of Santa Clarita as part of the
Newhall land development. The driveway to the parking facility became the
fourth leg of an existing T-intersection and needed to consider the future
extension of McBea n Parkway. KOA first helped by providing conceptual
design drawings to show the traffic signage and pavement delineation to
accommodate the new driveway. The design concept was approved and KOA
proceeded to prepare construction drawings consisting of signing & striping
plans and a traffic signal plan. To support the design, KDA acquired daily traffic
and turning movement counts. The plans were prepared to the satisfaction of
the City of Santa Clarita and County of Los Angeles.
Irvine Avenue/University Drive Bike Path, Newport Beach, CA
Project Engineer. Mr. Yeh prepared plans for traffic signing & striping
associated with modifications to 5,700 feet of a Class I bike path on Irvine
Avenue. He completed one traffic signal plan for the Irvine Avenue/University
Drive/Del Mar intersection as part of efforts to widen the road. The signing &
striping was provided for both the installation of the bike path alone and for
the street -bikeway interface_

Project Manager. The Beverly Hills Triangle was a new prime shopping area in Beverly Hills bounded by Wilshire Boulevard
and Rodeo Drive. The City of Beverly Hills undertook a streetscape improvement program to beautify the neighborhood
and promote ease of use by pedestrians. Mr. Yeh provided traffic engineering services for the project including 22 traffic
signal modification plans, signing & striping, special decorative street lighting, and worksite traffic control.
Safe Routes to School Traffic Calming, Thousand Oaks, CA
Project Manager. KOA provided engineering services to the City of Thousand Oaks, California for a Safe Routes to School
Project. Services included preparing PS&E for the installation of various traffic calming devices to enhance the safety
of school children crossing local roadways. KOA prepared geometric concept designs for traffic bulb -outs at several
intersections to decrease the distance for children crossing the public street. In addition, traffic calming device designs
for Ithe intersections of Gainsborough Road/Dover Avenue and �ainsborough Road/Windsor Drive included in -roadway
crosswalk warning lights and a wireless flashing beacon advance warning system. The traffic calming device designs for
the intersection of Oberlin Avenue/Queensbury Street included a raised crosswalk with bulb -outs and bollards to keep
pedestrians directed to the crosswalk.
Lynn Road Equestrian Crossing, Thousand Oaks, CA
Project Manager. Mr. Yeh prepared equestrian crossing advance warning signal plans for the east and west intersections
of Lynn Road and Dos Vientos Parkway. The AutoScope Detection advance warning signals are activated by an
observation system that detects horses and riders along the trails. The system activates a flashing signal directed towards
motorists to warn them of the presence of equestrian traffic at the crossing. Mr. Yeh also specified controller logic,
provided layouts of the signal detection equipment and warning signs, and established electrical service locations.
Design Services for City of Thousand Oaks — The Smart Crosswalk Design (2 Locations) for School Crossings,
Thousand Oaks, CA
Project Manager_ Mr, Yeh prepared PS&E for an in -roadway school crosswalk warning system to provide additional safety
for crossing guards and school -age pedestrians for schools in the City of Thousand Oaks. The design included in -roadway
warning lights, LED active pedestrian crossing signs and push buttons to activate the warning system. Mr. Yeh served as
Project Manager for this project which also included design and modification to the existing curb ramps in compliance
with ADA requirements. Highway safety lighting systems and crosswalk pavement markings were also enhanced at the
crosswalk in conjunction with the in -roadway warning system.
The Smart Crosswalk Design (5 Locations) for School Crossings, City of Lancaster, CA
Project Manager. KOA designed "SMART" crosswalk flashing yellow beacons at non -signalized marked school crossings
to provide additional safety for crossing guards and school -age pedestrians for 5 locations in the City of Lancaster. The
designs included overhead flashers located in advance of the crosswalk, plus school crossing warning signs and pavement
marking designs for advance warning. An infrared detector was used at the crosswalk to activate the flashing yellow
beacons when pedestrians are present. The project also included design of new sidewalks, curb ramps and modifications
to the existing curb ramps in compliance with ADA requirements. Lighting was also enhanced at the crosswalk in
conjunction with the overhead beacon system. Mr. Yeh was the project manager.

Lead Design Engineer. Ms. Guan was responsible for preparation of plans,

in Colton. KOA was recently retained by the City to provide professional
engineering services for the project. This project also includes design of block
walls and driveway profiles at various locations along the south side of the
street due to existing uneven roadway surface. An entering and exiting sight
distance study will be prepared for the driveway designs as well.
Cholla Drive Widening and Dry Well Design on Pierson Boulevard, Desert
Hot Springs, CA
Lead Design Engineer. KOA was recently selected by the City of Desert Hot
Springs to provide engineering services for miscellaneous street improvements
in the city including completion of 3,000 feet of street widening on Cholla
Drive adjacent to Desert Hot Springs High School, It also includes utilities stub
out design along Cholla Drive and drywell design on Pierson Boulevard in the

SBCTA Metrolink Station Accessibility Improvement Project PS&E,

design of three squash boxes to avoid existing utilities and the design of an
outlet structure to the Whitewater River_
Zone 2 Storm Drain Improvements, Eastvale, CA
Project Manager. Matt led the S1 million Zone 2 storm drain project for City of
Eastvale. The project included the design of seven local storm drain systems
scattered across the City, including hydrology, hydraulics and obtaining
encroachment permits from the County Flood Control District.
County of San Bernardino West State Street Channel, San Bernardino
County, CA
Project Manager. Matt led the S20-million West State Street Channel project
for the San Bernardino County Flood Control District. The project involves the
preliminary and final design of over 2.5 miles of concrete rectangular channel.
The design was complicated by severe horizontal and vertical constraints plus
the fact that 80 percent of the flow must be diverted to an adjacent detention
basin, due to the complicated hydraulics to the project, a physical model was
required to refine the proposed flow splitting structure.
City of Chino Roadway Improvements, Chino, CA
Project Manager. Matt led the design of over 1.2 miles of arterial highway
widening in the City of Chino. The improvements were distributed over three
different roadways and included roadway, storm drain, sound wall, traffic
signal, and landscape/irrigation improvements. The recommended roadway

intercepting the upstream -most culvert that outlets onto private property; collects runoff on an interim basis from the
adjacent drainage basin; and takes advantage of the existing downstream culverts which outlet directly to the beach.
The project included a hydrologic and hydraulic analysis of the Jasmine Drainage Basin as well as the adjacent easterly
and westerly drainage basins. Pipe jacking was required across Coast Highway to minimize traffic disruptions and an
Encroachment Permit was required from Caltrans.
Orange County Transportation Authority (OCTA) LOSSAN Slope Stabilization Project, Orange County, CA
Project Manager. Matt led the analysis and design of seven areas adjacent to the LOSSAN Corridor in Orange County.
The projects include close coordination with the Cities of Irvine, Lake Forest, Mission Viejo and San Juan Capistrano. The
project includes hydrologic/hydraulic analyses, sedimentation analysis, and recommending permanent drainage solutions
to several miles of closed conduits and open channel facilities that are eroding adjacent to the railroad tracks.

inspection of 15,000 feet of storm drain, pump station evaluation, hydrologic and hydraulic analyses and the identification
and prioritization of future Capital Improvement Projects. All of the data was incorporated into the City's GIS.

Avenue 50 Improvements, Coachella, CA
Survey Project Manager, As a subcontractor to KOA, WLG provided surveying,
mapping, and right-of-way engineering services in support of the preliminary
engineering, engineer's report, environmental document services, and PS&E
for the Improvement of Avenue 50 from Calhoun Street to Harrison Street in
the City of Coachella, CA. The project proposed to construct a new concrete
curb and gutter and place asphalt pavement to join the existing edge of street
on Avenue 50. This finished project will widen Avenue 50 to three traffic lanes
in each direction and includes pedestrian, bicycle, and neighborhood electric

2020.
Vista China Low -Water Crossing Bridge Replacement, City of Palm
Springs, CA
Project Manager, responsible for PA&ED, and final design PS&E of the project
to replace a low-water crossing with a new 19-span and 2,300-foot long
bridge over Whitewater River in Coachella Valley. The proposed bridge will
accommodate Q100 PLUS Flood of 4,700 cfs. The proposed bridge requires
relocation of 30 SCE power poles. The total project cost is $95 million, The
project has received NEPA CE ciearance in 2016 and is in final design phase.
Raman Road Bridge, City of Palm Springs, CA:
Project Manager, responsible for Project Study Report, PA&ED, and PS&E
for the widening of a 1,143-foot long, 15-span, precast concrete bridge over
Whitewater River. The roadway will be widened from 4 to 6 lanes including
two left turn lanes at two intersections. The channel improvement includes
constructing scour countermeasure involving a concrete apron and cutoff
walls. The project is in 100% PS&E phase. The environmental document is IS/CE
leading to MND/CE. The total project cost is estimated about $42 million.

Washington Boulevard & I-5 FWY, Commerce, CA
Principal -in -charge. Washington Boulevard is a major transportation corridor
for the city of Commerce. The I-5 bridge was an unsightly eastern terminus for
the newly renovated street. Relying on old maintenance agreements regarding
the bridge appearance, city staff undertook a creative approach with Caltrans
that resulted in a transformation of the bridge aesthetic and beautiful new
landscape improvements for 3 acres of street edge Caltrans right of way.
Harbor Boulevard Bike Trail, Costa Mesa, CA
Principal -in -charge. Harbor Boulevard in the city of Costa Mesa is a busy six -
lane roadway. Between Fair Drive and Merrimac Way, an attractive bike trail
runs alongside this wide boulevard. The landscape improvements along this
meandering pathway make a bike ride or stroll an inviting experience. The old
asphalt bike trail was dilapidated and unsafe, constructed with long swaths of
turf grass on either side. It was not much to look at, nor was it indicative of the
vibrant streetscape of the new Harbor Boulevard improvements_

Right of Way Project Manager_ The City of Rancho Mirage is preparing to
construct an all-weather crossing on Frank Sinatra Drive over the Whitewater
River. This bridge will provide accessibility during major floods. Epic is the sole
right of way services subconsultant to the design engineer, AECOM. To date,

Valley Water district, Agua Caliente, CA
Right of Way Project Manager. The Coachella Valley Water District requires
right of way acquisition services to obtain flooding easements for a portion
of the Whitewater River Stormwater Channel owned in trust by the Bureau
of Indian Affairs (BIA) and BIA allottees. Kari is working directly with the
BIA and allottees to renew CVWD flood easement rights agreements on 12
property tracts. The scope of work includes identifying all ownership interests,
coordinating MAI appraisal reports, acquisition and escrow coordination, and

SR-79 Realignment Project (PA/ED), Riverside County Transportation Commission, Hemet and Winchester, CA
Right of Way Analyst. Epic prepared Right -of -Way Data Sheets and a Draft Relocation Impact Report for the SR-79
Realignment project. Three alternatives were studied at the beginning of the project. Once a preferred alternative
was selected Epic prepared updated and Final Right -of -Way Data Sheets and a Final Relocation Impact Report. Epic
performed a thorough review of over tag parcels and analyzed the property impacts anticipated. The parcels identified
covered a variety of property types including residential, business, industrial, agricultural, outdoor advertising signs, an
outdoor marketplace and a mobile -home -park.
US-395 Widening Phase I, San Bernardino County Transportation Authority, Adelanto and Victorville, CA
Right of Way Acquisition Lead. Karl provided comprehensive right of way services for this partially federally funded and
Caltrans on -system project involving 62 parcel acquisitions, two billboard relocations, and coordination of 200 utility
fa0ity relocations. Kari coordinated community outreach, appraisals, title and escrow, acquisition negotiations, property
management, and Caltrans right of way certification. Most notably, Kari coordinated with property owners, Caltrans
District 8, and local agency staff to conduct District Condemnation Evaluation Hearings.
Cajalco Road Widening, County of Riverside Transportation Department, Corona and Riverside, CA
Right of Way Project Manager, For this road widening project, Epic supported the design engineer by developing
the Draft Relocation Impact Report (DRIR). This report assessed the residential and commercial relocations for three
design alternatives to widen Cajalco Road through the Cities of Corona and Riverside and the Gavilan Hills area. Epic
submitted the first draft to Caltrans in 2017. Caltrans approved the DRIR in July 2017, however updates must be provided
periodically. Epic submitted an update in July 2018.
I-10 Mt. Vernon Interchange PA/ED, San Bernardino County Transportation Authority, Colton, CA
Right of Way Project Manager: Kari developed the Rough Magnitude Cost Estimate for two alternatives evaluating build
and no -build alternatives to address operational deficiencies of the interchange_
Foothill Boulevard Improvements, Hemlock Avenue to Almeria Avenue, City of Fontana, CA
Right of Way Lead. The City of Fontana is widening Foothill Boulevard from Hemlock Avenue to Almeria Avenue to add
traffic lanes, add Class II bike lanes, and install a raised landscape median. The project replaces the existing historic
Malaga Bridge, which is a pedestrian bridge spanning aver Foothill Boulevard that connects the Pacific Electric Trail
through Fontana. 39 parcels are in conflict with the project right of way. Kari is providing cost estimates, Caltrans Right of
Way Data Sheets, title clearance, and negotiations to acquire partial rights and temporary construction easements from
29 total private property owners.

As a public artist, Robin Brailsford sees her role as recognizing the potential
in people, places, and things, then realizing that potential. Recently, she has
been examining the public art process itself, to make it more inspired and
interconnected for the citizens who are its owners. She examines the life and
place of an overlooked site within our contemporary culture, to create works
that are revolutionary - linking ideas, materials, scale, cities, funders, politicians
and museums.
RELEVANT EXPERIENCE
Walter Munk Ocean Institute, La Jolla, CA
Lead Artist. It is a great honor to have worked with world-renowned
oceanographer Walter Munk, on The Grand Canyons of La Jolla. The 2,450-foot
plaza is the largest single LithoMosaic installation to date. Based on Walter's
ground -breaking 1944 paper, the Grand Canyons of La Jolla, this work follows
the footsteps of Robin's undersea work for Long Beach Transit to bring the
deep sea experience to life. One hundred life-sized sea creatures (including an
11-foot mola mola and 13-foot great white) a 16-level bathyscaphe, and every
department at Scripps Institute of Oceanography are depicted. Installed at La
Jolla Shores Beach. S1,000,000, 2017 - 2020 Just installed,

Lead Artist. Robin is well into a multi -year project of designing, proposing, and
building important exterior public art for six museums in northern climates_
The six are the Corning, Tacoma and Toledo glass museums, as well as the
Everson, Peabody Essex and CCAE art museums. Robin is reexamining and
reinventing the relationship between museums, public artists, community,
5010s, mayors, and public art staff; applying the lessons learned from one
city and museum and sharing it with the others. The first of six, Threshold
Tessellation, has been installed at the CCAE, Art Museum. It was a collaboration
with Doris Bittar and Wick Alexander. It is a beauty, based on a proposal for the
US Embassy in Beirut. All the Cold Call projects will be in LithoMosaic, the first
time mosaic at this scale has been cast in severe freeze/thaw environments.
The overall budget, all to be fund -raised, is about $2M. CCAE was all donated
for a budget of $60,000. 2016 — 2020.
Long Reach Transit, Long Beach, CA
Lead Artist. Robin was commissioned to design and build the landmark Battery
Energized bus station and charging facility at the Long Beach Convention
Center. The art explores the CO2 benefits of a kelp forest through steel
sculptural modules to be found at each BEB stop and the bioluminescence of
life in California's five deep ocean trenches in LithoMosaic $' rondels. $24,060
design fee, 2014 — 201T S150,000 to fabricate and oversee installation. 2018.

opportunities for SeaReach and the USFS, as the Arts Interpretive Specialist for the 312,000 proposed Kyle Canyon Visitors
Center. She lived on -site, hiked every trail, brainstormed with Las Vegas arts professionals and community members. The
USFS created a unique opportunity for a design team to craft expansive conceptual thinking and consider, for the first
time, public art as an integral element of an American national forest. 2008 - 2009. Currently reworking the Green:Lee
aspects of the project with Newton Harrison from the Center for the Force Majeure, William L. Fox of the Nevada Museum

Lead Artist. Robin completed and gained unanimous approval from the Arts Board for a 40 page, 15 station, 20 mile

Corridor features extensive research of the full history of cultural innovators at the crossroads that is Albuquerque. The
UNM station design is a 13' x 140' geological reap of the region and the ART route through it_ A quadrant of downtown
