Recommendation 1. Open a public hearing and accept public comment related to the collection of the solid waste charges for individually billed residences for FY 20-21 on the County of Riverside Assessor's Property Tax Roll, and related items stipulated therein; and following public testimony, close the public hearing. 2. Waive further reading and adopt Resolution No. 2020 — 48, approving adjusted rates in Exhibits 3A, 3B, 3C, and 3D for Burrtec under Contract No. C27410; and requesting the County of Riverside to collect the associated costs for individually billed residences on the Tax Assessor's Property Tax Roll for FY 20-21. 3. Authorize the City Manager to execute any documents necessary to effectuate the actions taken herewith. Strateqic Plan The proposed action has no impact on the Strategic Plan. Backqround Analvsis The City of Palm Desert contracts with Burrtec for integrated solid waste management services through a Franchise Agreement (C27410) dated May 28, 2015. Each year this agreement allows Burrtec to request a rate adjustment for their services based on an increase in the Producer's Price Index (PPI) for Furnished Goods, and pass through increases in disposal costs. For FY 2020-21 Burrtec has requested a rate increase based on both PPI and disposal cost increases. The rate adjustments for residential, commercial, and roll -off box rates are calculated using formulas established in the Franchise Agreement. The percentage increase in PPI from December 2018 to December 2019 is 1.93%. For FY 2020-21 Edom Hill Transfer May 28, 2020 - Staff Report Resolution Approving Adjusted Rates for Burrtec and Requesting Tax Roll Billing for Individually Billed Residences Page 2 of 4 Station is increasing the Refuse Tipping Fee by 2.91 %, from $48.97 to $50.40 per ton; and increasing the Green Waste Tipping Fee by 9.10%, from $48 to $52.37 per ton. The amount of the rate increase for these factors is calculated by multiplying the percent change in each of these components by the percentage of revenue associated with them, creating a weighted rate adjustment for each. The total weighted rate adjustment for residential rates for FY 2020-21 amounts to 2.48% (1.43% for the service component based on PPI plus 1.05% for the disposal component based on increases in the disposal tipping fees). A detailed listing of the current and proposed residential rates is included in Exhibit 3A. Below is an example of the increase in terms of dollars: Residential Rate Example For Automated Cart Collection Weighted Weighted Service Type Current Service Rate Disposal Rate Rate Increase Increase (1.43%) (1.05%) Residential Trash $12.98 $0.19 $0.13 Service: 96-gallon bin serviced one time per week Residential Trash and $14.38 $0.20 $0.15 Green Waste: 96-gallon bins serviced one time per week Proposed Rate $13.30 $14.73 Note: Customers with manual curbside collection or higher service demands will pay a higher fee. Residential recycling service continues to be provided at no cost. The total weighted rate adjustment for commercial bin rates for FY 2020-21 amounts to 2.183% (1.424% for the service component based on PPI plus 0.759% for the disposal component based on increases in disposal tipping fees). A detailed listing of the current and the proposed commercial bin rates is included in Exhibit 3B. Below is an example of the increase in terms of dollars: May 28, 2020 - Staff Report Resolution Approving Adjusted Rates for Burrtec and Requesting Tax Roll Billing for Individually Billed Residences Page 3 of 4 Commercial -Rate Example Weighted Weighted Service Type Current Service Rate Disposal Proposed Rate Increase Rate Increase Rate (1.424%) (0.759%) Commercial Trash Service: $117.43 $1.67 $0.89 $119.99 3-yard bin serviced one time per week Commercial Recycle $95.79 $1.36 $0.73 $97.88 Service: 3-yard bin serviced three times per week Note: Customers with higher service demands will pay a higher fee. The proposed roll off service rates are calculated by increasing the current service rates by the PPI increase amount of 1.93%. A detailed listing of the current and the proposed roll off service rates is included in Exhibit 3C. The City implemented a Commercial Foodwaste/Organics Program in FY 2017-18 to comply with Assembly Bill 1826, which requires certain businesses to recycle their organic waste. A breakdown of how the fees are calculated is included in Exhibit 3D. The proposed commercial foodwaste rates for FY 2020-21 are adjusted by an increase in both the PPI (1.93%), applied to the recycling collection component of the rate, and an increase in the disposal tipping fee (7.69%), applied to the service collection component of the rate. Below is an example of the increase in terms of dollars: Service Size Current New Rate Rate One 64-Gallon Cart: serviced one time per week $67.74 $70.84 Two 64-Gallon Carts: serviced one time per week $120.70 $126.57 Note: Customers with higher service demands will pay a higher fee. On April 23, 2015, the City Council approved the implementation of billing residential services for all individually billed (non -master billed) residences through the County of Riverside Tax Assessor's Property Tax Rolls. This does not include any master billed residences, where a homeowner association pays the costs for its residents. A copy of the written report containing the listing of all the parcels included in this billing and the associated charges is available for public review in the Office of the City Clerk. In order to continue this process, the County Tax Assessor requires the City Council to adopt a resolution annually requesting the solid waste charges to be placed on the tax rolls. The City is also required to hold a public hearing each year to allow impacted residential May 28, 2020 - Staff Report Resolution Approving Adjusted Rates for Burrtec and Requesting Tax Roll Billing for Individually Billed Residences Page 4 of 4 property owners an opportunity to voice their concerns regarding the placement of this billing on the tax roll. As the request is authorized by the current Franchise Agreement, staff recommends approving the adjusted rates as shown in Exhibit 3A, 3B, 3C, and 3D; and adopting the proposed resolution authorizing tax roll billing. Fiscal Analvsis Approval of the rate increases will not directly impact the City's General Fund. Authorizing tax roll billing for individually billed residences allows the City to continue to collect revenue per the Franchise Agreement, through a tax roll billing credit of $1.06 per customer enrolled ($0.73 to the Recycle Fund and $0.33 to the General Fund). This amounts to approximately $55,000 a year to the General Fund. LEGAL REVIEW N/A DEPT. REVIEW FINANCIAL REVIEW ya*vet ". "'Ovu Robert W. Hargreaves Tom Garcia, P.E. Janet M.
