PlanSTAFF REPORT CITY OF PALM DESERT CITY MANAGER DEPARTMENT MEETING DATE: May 28, 2020 PREPARED BY: Christopher Gerry, Management Analyst Jessica Gonzales, Senior Management Analyst REQUEST: Hold a public hearing and adopt a resolution authorizing various actions regarding the Permanent Local Housing Allocation (PLHA) Program, including the submission of an application for, and receipt of, PLHA funds, and adoption and approval of a Five -Year Plan. Recommendation By Minute Motion: 1) Conduct a public hearing and accept public comment related to the Permanent Local Housing Allocation Program (PLHA) Plan for funding award and related items stipulated therein; 2) Adopt City Resolution No. 2020-49, a resolution of the City Council of the City of Palm Desert authorizing the submittal of an application for, and receipt of, PLHA Program grant funds to the California Department of Housing and Community Development in order to seek funding for the Homelessness Assistance Program; 3) Adopt and approve a Five -Year Plan (PLHA Plan), and authorize the services and expenditure of PLHA funds included in the PLHA Plan; 4) Authorize the Director of Finance to appropriate the PLHA funds upon receipt of the allocation for the Homelessness Assistance Program; and 5) Authorize the Mayor and City Manager to execute any necessary documents to facilitate the application or award, and any actions taken herein. Background Permanent Local Housing Allocation Program History In September 2017, the California Legislature approved Senate Bill 2 (SB 2), known as the Building Homes and Jobs Act (Act), which established a $75 recording fee on real estate documents to increase the supply of affordable housing. The Act established the Permanent Local Housing Allocation (PLHA) Program administered by the California Department of Housing and Community Development (HCD). The PLHA Program provides financial May 28, 2020 — Staff Report PLHA Program Page 2 of 3 assistance to local governments for eligible housing -related projects and programs to assist in addressing the unmet housing needs of their local communities. Notice of Fundinq Availabilitv HCD released its first Notice of Funding Availability for these funds on February 26, 2020. PLHA funding is provided through formula grants to entitlement jurisdictions based upon the formula prescribed under federal law for the Community Development Block Grant (CDBG) Program over a five-year funding period, as well as through a competitive grant program to non -entitlement jurisdictions. The City is an entitlement jurisdiction and is eligible to receive an estimated $171,306 in Fiscal Year 2019-20, or approximately $1,027,836 over the five- year funding period. Please note the funding amounts are estimates since PLHA funds are generated through a fee on real estate transactions, which may fluctuate annually. One of the eligible activities in the PLHA Program Final Guidelines (October 2019) includes: Section 301(a)(6): Assisting persons who are experiencing or at risk of homelessness, including, but not limited to, providing rapid rehousing, rental assistance, supportive/case management services that allow people to obtain and retain housing, operating and capital costs for navigation centers and emergency shelters, and the new construction, rehabilitation, and preservation of permanent and transitional housing. Homelessness Assistance Proqram In Fiscal Year 2019-20, the City began a Homelessness Assistance Program in partnership with the Riverside University Health System (RUHS). This program is based upon the Housing First Model, which includes stably housing homeless individuals and providing the appropriate wraparound (i.e., supportive) services. To explain program operations, two full- time RUHS staff members conduct daily street outreach and offer supportive services to homeless individuals in Palm Desert. The program's outreach conducted and services provided are typically in a collaborative effort involving various stakeholders, including County and City departments, nonprofit organizations, residents and businesses. It is through this process that homeless individuals are successfully and sustainably housed at their own pace. The existing scope of services for the Homelessness Assistance Program can be found as Attachment A. Furthermore, the City recently entered into an agreement with Path of Life Ministries to provide a temporary housing unit. The concept is Path of Life assists with the lease and payment of the housing unit and RUHS staff provides the wraparound services. Proqram Budqet The Homelessness Assistance Program budget aligns with the PLHA formula allocation. The City's budget for the Homelessness Assistance Program is approximately $169,000 annually, including the agreements with RUHS ($144,000 in General Fund revenue) and May 28, 2020 — Staff Report PLHA Program Page 3 of 3 Path of Life ($25,000 in CDBG funds). This grant opportunity consolidates activities under one revenue stream and ensures the continuation of the program for the next five years. Application Process In order to receive funding, the City must submit a resolution (Attachment B), PLHA Plan and application (Attachment C) to HCD by July 27, 2020. A notice of public hearing was published twice in the local newspaper for public comment on the PLHA Plan. Furthermore, the PLHA Plan was made available upon request for review. COUNTY RESPONSIBILITIES 1.1. County staff will assign one (1) full-time Behavioral Health Specialist II/III and one (1) full-time Mental Health Peer Support Specialist as defined by the County Personnel Code to provide Services. 1.2. County staff will work directly with City staff, including police personnel (Sheriff), to provide behavioral health resource knowledge and experience. 1.3. County staff will provide the appropriate electronic equipment, including cell phones that have email functionality. 1.4. County staff will work to find alternatives to divert behavioral health consumers into mental health services and supports including emergency housing, hospitalization, outpatient mental health services and other mental health services. 1.5. County staff will provide alternatives to incarceration and arrest through referral and linkage to other community based mental health, substance use, and/or social services resources. 1.6. County staff will provide alternatives to mental health involuntary treatment through referral and linkage to other community based mental health and/or substance use and social services resources. 1.7. County staff will provide crisis intervention service planning for individuals with mental health issues. 1.8. County staff will work with Sheriff to improve the appropriateness and quality of behavioral health detentions. 1.9. County staff will work with police to provide direct intervention from the perspective of behavioral health background and training. 1.10. County staff will provide engagement and outreach services to homeless mentally ill persons who come in contact with Sheriff. 1.11. County staff will provide assistance in dealing with calls involving homeless disturbances or violence that involve potential mentally ill or substance use consumers. County staff will provide assistance and support to children and families in crisis, and linkage to appropriate community services. 1.12. County staff will visit local homeless service providers and engage homeless persons. 1.13. County staff will go with Sheriff to work with homeless people where they congregate in order to identify and engage persons that may be eligible for County services and/or to facilitate referrals and linkage to community resources that may assist general population and homeless persons. 1.14. County staff will work in the office to arrange social service supports and coordinate services with other agencies and programs. 1.15. County staff will coordinate with jail incarceration diversion teams and programs including mental health and drug courts to intervene and help to divert persons with a serious mental health disorder into appropriate and recommended mental health treatment services and supports, and persons with impairing substance use disorders into substance use treatment services and supports. 1.16. County staff may work directly County Detention staff to coordinate mental health and/or substance use services and assist with issues involving inmates detained through City in post -booking, pre-trial diversion and linkage to community resources upon release from incarceration. 1.17. County staff may work with other mental health crisis response services involving 9-1-1 calls relating to homelessness, such as training and support to ambulance emergency medical technicians and paramedics. 1.18. County staff will develop public information brochures regarding police/behavioral health collaboration relating to homelessness, contact information and phone numbers for community resources and referral, and Frequently Asked Questions. 1.19. County staff will work directly with City staff to identify and engage homeless persons who appear to suffer from a serious mental health and/or substance use disorder. 1.20. County staff assigned to City shall have lead County liaison responsibilities, providing linkage, coordination and follow-up communication with all County programs that would be appropriate to provide services and support to the homeless individuals, including family, as needed, for both new and existing consumers of service. 1.21. County staff shall submit regular progress reports to City staff; the frequency and substance of said reports shall be mutually agreed in the future. 1.22. And other duties as agreed upon between both Parties. 2. CITY RESPONSIBILITIES 1.1. City staff will provide County staff general access into the appropriate facilities. 1.2. City staff will provide cubicles or equivalent space for County staff to complete office work. 1.3. City will reimburse County for salary and benefit cost incurred for the positions. 1.4. City will reimburse County for vehicle leasing costs and cell phone costs incurred in order to provide Services. 1.5. And other duties as agreed upon between both parties. Attachment B City Resolution No. 2020-49 RESOLUTION NO. 2020-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT WHEREIN THE CITY COUNCIL HEREBY AUTHORIZES THE SUBMITTAL OF AN APPLICATION TO THE CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR THE PERMANENT LOCAL HOUSING ALLOCATION PROGRAM; THE EXECUTION FOR SUCH FUNDING AND ANY AMENDMENTS THERETO; AND ANY RELATED DOCUMENTS NECESSARY TO PARTICIPATE. A. WHEREAS, the State of California (State), Department of Housing and Community Development (Department), is authorized to provide up to $195 million under Senate Bill 2 (SB 2) Permanent Local Housing Allocation (PLHA) Program Formula Component from the Building Homes and Jobs Trust Fund for assistance to Cities and Counties (as described in Health and Safety Code section 50470 et seq. (Chapter 364, Statutes of 2017 (SB 2)); and B. WHEREAS, on February 26, 2020, the Department issued a Notice of Funding Availability (NOFA) under the PLHA Program; and C. WHEREAS, the City of Palm Desert (Applicant) is an eligible Local government applying for the program to administer one or more eligible activities, or a Local or Regional Housing Trust Fund to whom an eligible Local government delegated its PLHA formula allocation; and D. WHEREAS, the Department may approve funding allocations for the PLHA Program, subject to the terms and conditions of the Guidelines, NOFA, Program requirements, the Standard Agreement and other contracts between the Department and PLHA recipients; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS: 1. If Applicant receives a grant of PLHA funds from the Department pursuant to the above referenced PLHA NOFA, it represents and certifies that it will use all such funds in a manner consistent and in compliance with all applicable state and federal statutes, rules, regulations, and laws, including without limitation all rules and laws regarding the PLHA Program, as well as any and all contracts Applicant may have with the Department. 2. Applicant is hereby authorized and directed to receive a PLHA grant, in an amount not to exceed the five-year estimate of the PLHA formula allocations, as stated in Appendix C of the current NOFA ($1,027,836) in accordance with all applicable rules and laws. 3. Applicant hereby agrees to use the PLHA funds for eligible activities as approved by the Department and in accordance with all Program requirements, Guidelines, other rules and laws, as well as in a manner consistent and in compliance with the Standard Agreement and other contracts between the Applicant and the Department. 4. If applicable: Applicant certifies that it has or will subgrant some or all of its PLHA funds to another entity or entities. Pursuant to Guidelines Section 302(c)(3), "entity" means a housing developer or program operator, but does not mean an administering Local government to whom a Local government may delegate its PLHA allocation. If applicable: Applicant certifies that its selection process of these subgrantees was or will be accessible to the public and avoided or shall avoid any conflicts of interest. 6. If applicable: Pursuant to Applicant's certification in this resolution, the PLHA funds will be expended only for eligible activities and consistent with all program requirements. 7. Applicant shall be subject to the terms and conditions as specified in the Standard Agreement, the PLHA Program Guidelines and any other applicable SB 2 Guidelines published by the Department. 8. Lauri Aylaian, City Manager, is authorized to execute the PLHA Program application, the PLHA Standard Agreement and any subsequent amendments or modifications thereto, aswell as any other documents, which are related to the program or the PLHA grant awarded to Applicant, as the Department may deem appropriate. The Program serves households with incomes no more than 60% area median income (AMI). In fact, the households served are likely all extremely low mccme. The Program prioritizes investments by creating housing opportunities for some of one of the most vulnerable populations. 02(c)(4)(C) Provide a description of how the Plan is consistent with the programs set forth in the Local Government's Housing Element. The Housing Element includes policy directives can sistentwith the PLHA Plan. For example, the Housing Element (Policy 5) states. "The City shall strive to provide shelter for the homeless." In addition, the policy directive (Program 5.C) encourages the City to collaborate with local nonprofit organizations to address homelessness.
