C36800 STAFF REPORT ` CITY OF PALM DESERT DEPARTMENT MEETING DATE: June 11, 2020 PREPARED BY: Christina Canales, Engineering Assistant REQUEST: Approve Amendment No. 3 to Contract No. C36800 with Michael Baker International, Inc. of Palm Desert, California, for On -Call City Surveyor Services, extending the term through December 31, 2020, and increasing the contract amount by $50,000. Recommendation By Minute Motion: 1. Approve Amendment No. 3 to Contract No. C36800 with Michael Baker International, Inc., for On -Call City Surveyor Services to extend the contract until December 31, 2020; and, 2. Increase the contract in the amount $50,000 from available funds in Fiscal Year 2020-21; and, 3. Authorize the City Manager to execute said Amendment. Upon approval of the Fiscal Year 20/21 budget, additional funds will be available in Account No. 1104300-4301000, Prof- Architectural / Engineering account. Strateqic Plan This action has no direct effect on any one of the specific goals in the Strategic Plan. Backqround Analvsis The City Council awarded Contract No. C36800 to Michael Baker International, Inc. on March 22, 2018, for On -Call City Surveyor Services for a one (1) year term in an amount not to exceed $100,000. On March 14, 2019, the City Council approved a one-year extension to the contract. This action carried over the remaining contract funds to Fiscal Year 19/20, and allocated $50,000 to the San Pablo Improvements Project. On February 27, 2020 the City Council approved Amendment No. 2 to extend the contract until June 30, 2020, and increase the total amount from $100,000 to $150,000. June 11, 2020 - Staff Report Amendment No. 3 to Contract No. C36800 Page 2 of 2 Staff anticipated submitting an RFP to go out to bid for On -Call Surveying Services prior to the end of the contract, but due to staff vacancies and the Shelter in Place order this task did not get completed in time to award a new contract prior to the existing contract's expiration. In order to continue with on -call surveyor services staff requests to extend the contract until December 31, 2020. Staff also requests that the remaining funds be carried over to Fiscal Year 20/21, and increase the contract amount by $50,000 for a total contract amount of $200,000. Fiscal Analvsis Historically, Public Works budgets $100,000 per Fiscal Year for On -Call Surveying Services. Based on past budgets, staff has calculated the amount needed to fund On -Call Surveying Services for an additional six months to be approximately $60,000. The current contract has a balance of $28,790. Staff expects to expend an estimated $20,000 by June 30, 2020, and carryover the remaining balance to Fiscal Year 2020-21. The additional $50,000 needed will be available in the Professional Architectural / Engineering account upon approval of the Fiscal Year 20/21 budget. LEGAL REVIEW Robert W. C36800 THIRD AMENDMENT TO AGREEMENT WHEREAS, the City of Palm Desert ("City") and Michael Baker International, Inc. ("Contractor"), entered into an agreement, dated March 22, 2018, for on -call City Surveyor services ("Agreement'), the parties wish to amend the agreement effective June 11, 2020. NOW, THEREFORE, the parties agree as follows: A. The Amount of the contract will increase by the sum of fifty thousand and 00/100 dollars ($50,000) for a total contract amount of $200,000. B. All other terms and conditions of the Agreement shall remain unchanged, and shall remain in full force and effect.
