Backqround
The proposed parcel map for PM 37883 is an existing commercial center located at
Corporate Way between Hovley Lane East and Lennon Place. This Parcel Map
subdivides a 1.12 acre parcel into two parcels. The boundary for proposed Parcel Map
37883 was created by Tract Map 21493.
Tentative Parcel Map 37883 was approved by the Planning Commission on May 19,
2020. This map is substantially the same as it appeared on the Tentative Parcel Map.
Those conditions of approval related to the map have been satisfied, and the map
conforms to the requirements of the Subdivision Map Act and City ordinances.
Fiscal Analvsis
There is no fiscal impact associated with the approval of this map.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING THE FINAL SUBDIVISION MAP
OF PARCEL NO. 37883.
BE IT HEREBY RESOLVED, by the City Council of the City of Palm Desert,
California, as follows:
(1) The Final Subdivision Map of Parcel 37883, City of Palm Desert, California,
is hereby approved as the official map of said parcel, subject to the
conditions of the Tentative Map.
(2) The Director of Public Works is directed to process the Parcel Map for
Recording upon receipt of the required payment of all fees.

A RESOLUTION OF THE P�ANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A TENTATIVE PARCEL MAP TO
SUBDIVIDE A 1.12-ACRE COMMERCIAL LOT INTO TWO PARCELS AT �1-
651 CORPORATE WAY; AND ADOPTING A NOTICE OF EXEMPTION IN
ACCORDANCE WITH THE CALI�ORNIA ENVIRONMENTAL QUALITY ACT
(CEQA)
CASE NO: TPM 37883
WHEREAS, the Planning Commission of the City o� Palm Des�rt, California, did on
the � 9t� day of May 202Q, hald a duly noticed public hearing to consider the request by The
Alium Group, Inc., for appro�al of the above-noted; and
WHEREAS, said applicatian has complied wEt� the requirements of the "City of Palm
Desert Procedure for Implementation of the CEQA" Resolution No. 2019-41, in that the
Direckor of Community Development has de#ermined that the pro�ect wi[I nat F�ave a significant
impact on the er�vironment and that the project is categoricalfy exempt under Article 19,
Section 153�5 — Minor Subdivisions (Class 15} of the CEQA Guidelines; and
WHEREAS, at the said public hearing, upon hearing and considering all testimony
and arg�ments, if any, of all interested Persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify th� approval of said
request:
F[NDINGS OF APPROVAL:
Findings must be made in order to support the proposed �and division as r�quired by Section
2fi.20.100, Planning Commission Action, of Titfe 26 Subdivisians, of the Palm Desert
Municipai Code.
1. That the proposed map is consistent with app[icable general and specific plans, as
amended.
The propased ientative parcel map is consisfent with the Employment C�nter
Genera! Plan Land Use Designafion. This designation allows office arrd lighf
Industrla! development, and the propased subdivisron meef all applicable
standards wrth regard to a minimum lot area. There is no specific plan for this
development.
2. That the design or improvement of the proposed subdivision is consistent wit�
applicable general and specific �lans.
The site was previously developed ta comply with City standards per the Service
lndustrial Zoning (Slj designation. The desigrt of the proposed su6division wil! not
cause the existing site development to become nan-conformirrg with applicable
development sfandards of the SI zoning designation. There is no specific plan for
fhis developmenf.

3. That the site is physicalfy su�table for the type of development.
The Iot has been previously developed with two existing office condominium
buildings. The existing site rs adequate in size, topography, location, and ofher
factors to accommodate the proposed subdivision. Utflities, including wa�er,
electrical, sewer, and gas are �n place, and campatible wifh surrounding properties.
4. The design of t�e subdivision or the proposed improvemer�ts are not likely to cause
substantial enviror�mer�tal damage or substaniral and avoidable injury to fish, wi[dlife�
or their habitat.
The creation of an additional parce! wi!! not cause substan�ia! environmenfal damage
or injuries to fish or wildlife or fheir habitat since the site has previously been graded
and devEloped. The creation of a new parcel at this site does not creafe any
significant new phys�ca! impacfs on fhe environmenf.
5. That the design of #�e subdivision or the type of improvements is not likely to ca�se
serious public heafkh problems.
The proposa! fo create an additiona! parcel wifhin wr'll not creaie a physica!
change io the exisfing site and will not cause publfc l�ealt� problems. Each !ot
will have access to a public street, and fhe exisfing development on each of
�hese lots conforms �o all applicable developmenf standards. The lots will nof
create serious public health problems, as utrlities are available to support the
site, use of the properties �or office and light indr�sirial is compatib�e with the
surround�ng properties.
6. That the design of the subdivision or the type of improvements wil� not conf�ict with
easements, acquired by the public at large, far access t?�rough or use of praperty
w�thin the proposed subdi�is�on.
The creafion of a new parcel at this site will not impact any public easements
as pari of the subdivisian. No changes are proposed to the existing
conform�ng developmenf
7. That #he design of tF�e subd��ision o� the type of improvements will not restrict solar
access to the property.
The design of this subdivision and orientation of the lots wi!! not impact solar access
to adjacent properties or the subject properti�s.
NOW, THEREFORE, BE 1T RESOLVED BY THE PLANNING COMMISSION OF
THE C1TY OF PALM DESERT, CALIFORNIA, AS FOLLOWS:
1. Thai tl�e above recitat�ons are true and correct and cons#itute the find€ngs of the
Planning Commission in this case.
2. That the Planning Commission does hereby appro�e Tenta#i�e Parce� Map 37883,
subject to co�ditions attached.

DEPARTMENT OF COMMUNITY F]EVELOPMENT:
1. The project site shalE be subdivided and maintained in conformance with the approved
Plans and ex�ibits on file with the City. Any variation from the approved plans must be
reviewed and approved by the Community Development Department prior to building
permit issuance and may require re�iew and approval by #he Planning Commissian
andlor C�ky Caur�cil,
2. The development of the property described F�erein si�a�l be subjec# io the restric�ions
and limitations set forth herein, which are in addition to all municipal ordi�ances and
state and federal statutes now in force, or wi�ich hereafter may be in force.
3_ Prior ta issuance of a bui�cfing permit for construciion of any use contemplated b}� #his
approval, the applicani shall f�rst obtain permits andlor clearance from the following
agencies:
Building & Safety Department
City Fire Marshal
Public Works De�artment
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies sh+all be pres�nted to the
De�artment of Building & Safety at the time of issuance of a building permt't for ihe use
contemplated herewith.
4. The Applicant shall agree to defer�d, ir�demnify, a�d hold Y�armless, the Ciiy of Palm
Desert or its agents, officers, and employees from any claim, action or proceeding
against the City of Palm Desert or its agents, officers or employees, to attack, set aside,
void, ar annul, any approval of the City of Palm Desert, whether by its City Council,
Planning Commission, or ot�rer authorized board or officer of the City. Tl�e Cify of Palm
Desert s�ra[I promptly notify the Appiicant of any such cfaim, ac#ion, or proceeding, and
tY�e City of Palm Desert sha�l cooperate fully in #he defense.
5. Tentative ParceE Map 37883 shall be reco�ded within two years frorra the date of final
appro�al unless an extension of #ime is granted otherwise said parcel map aPprova� sha�l
become null, void, and of no effect whatsoever.
