ORDINANCE NO. 1357 MEETING DATE: PREPARED BY: REQUEST: STAFF REPORT CITY OF PALM DESERT COMMUNITY DEVELOPMENT DEPARTMENT September 10, 2020 Ryan Stendell, Director of Community Development Consideration for approval an interim urgency ordinance establishing a temporary moratorium on the issuance of short-term rental permits within all Planned Residential zoning districts, unless the owner can provide an affirmative response from an HOA that short-term rentals are lawful. Recommendation 1. Waive further reading and adopt Interim Urgency Ordinance No. 1357 establishing a temporary moratorium on the issuance of short-term rental (STR) Permits within all Planned Residential (PR) zoning districts, unless the owner can provide written approval from an Homeowners Association (HOA) that short term rentals are permitted within the HOA. 2. By Minute Motion, direct the existing City Council STR subcommittee (Kelly and Nestande) to review and provide a recommendation to the City Council. Executive Summary Approval of staff's recommendation will approve an interim urgency ordinance that will place a 45-day moratorium on issuing new STR permits within all PR zoning districts unless approved by the governing HOA. The moratorium allows existing permitted STR properties within the affected zoning district to continue operating, including permit renewals. Given that this is an urgency ordinance intended to take effect immediately, it requires a 4/5 vote to pass. Background Analysis At its regular meeting of August 27, 2020, Councilmember Jonathan requested that staff review a known zoning irregularity within PR zoning districts that do not have a governing HOA as it relates to STR use. Councilmember Kelly added her concurrence to that effort, however she expressed the need to bring forward an interim urgency ordinance, placing a moratorium on the issuance of STR permits within Planned Residential zoning districts unless approved by the HOA. Councilmember Jonathan concurred that both are important. September 10, 2020 - Staff Report Interim Urgency Ordinance — STR PR Zoning Districts Page 2of2 Discussion Staff, at the direction of the City Council, has been monitoring STR permits in PR zoning districts since the updated STR ordinance was approved in late 2017. The PR zone provides maximum flexibility in development, ranging from large planned communities to developments that function the same as R1 or R2 single family zoning districts. Areas such as the Hovley Lane West, Shepherd Lane, and ungated developments along Deep Canyon Road are good examples of neighborhoods that are zoned PR, but share many commonalities with the R1 or R2 zoning districts. Staff has prepared the language to include all PR zone properties subject to proof of HOA approval because we are aware of at least one PR zoned development (The Grove) that has an HOA that is not currently active. There could be additional locations where this exists, which is why staff is proposing the Interim Urgency Ordinance in this way. Memo to City Council Dated July 24, 2020: Staff prepared the most recent update to the City Council in late July of this year; it is attached to this staff report. At that time, staff noted there had been a fairly significant increase in complaints from surrounding residents. As was learned in 2016, resident input is one of the biggest indicators of a mounting STR concern. Consistent with the memo, staff's recommendation remains the same: Refer this to the STR subcommittee whose members are uniquely qualified to develop a strategy to be submitted to the entire City Council for consideration. Fiscal Analysis Staff believes that the impact on Transient Occupancy Tax revenue of this moratorium while short-term rentals are studied would be relatively insignificant. LEGAL REVIEW DEPT. WHEREAS, the Palm Desert Municipal Code permits short-term residential rentals within certain zoning districts, subject to the requirements of Palm Desert Municipal Code Chapter 5.10, which includes a requirement for a short-term rental permit, as well as operational requirements and standards; and WHEREAS, in recent years, notwithstanding steadily increasing short-term rentals in Planned Residential zoned districts, the City has not experienced significant public nuisance complaints associated with properties used as short-term residential rentals because the City has maintained a rigorous short -term -rental enforcement program; and WHEREAS, other Coachella Valley communities have experienced significant public nuisance complaints as the density and frequency of short-term rentals has grown, and have recently taken actions to ban or curtail short-term rentals; and WHEREAS, there is concern that the density and frequency of short-term rentals in Palm Desert will increase in response to limitations imposed elsewhere, which may result in unwanted changes in the character of residential neighborhoods within the City; and WHEREAS, based on the foregoing, the City Council finds that issuing additional short-term rental permits in Planned Residential zoning districts prior to the City's study and evaluation of the potential impacts of such short-term residential rentals would pose a current and immediate threat to the public health, safety, and welfare, and that a temporary moratorium on the issuance of such permits is thus necessary; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Imposition of Moratorium and Findings. A. In accordance with the authority granted to the City of Palm Desert under Government Code Section 65858, from and after the date of this Ordinance, no new short-term rental permit shall be approved or issued for a short-term residential rental for a period of forty-five (45) days in PR zones, unless with written approval of the homeowner association having jurisdiction over the property, except as provided below: (1) Annual renewals of existing permits shall be permitted under Section 5.10; 72500.00896\33239117.1 INTERIM URGENCY ORDINANCE NO. 1357 B. This Ordinance is an interim urgency ordinance adopted pursuant to the authority granted to the City of Palm Desert by Government Code Section 65858, and is for the immediate preservation of the public health, safety, and welfare. The facts constituting the urgency are: (1) as the density and frequency of short-term rentals have grown, neighboring Coachella Valley cities have received an increasing number of public nuisance complaints emanating from short-term residential rentals and have recently taken actions to ban or limit such rentals; (2) excessive density and frequency of short-term rentals in Planned Residential zoning districts may threaten the character of existing residential neighborhoods; (3) the density and frequency of short-term rentals within Planned Residential zoning districts has gradually grown over the last several years; recent limits placed elsewhere in the Coachella Valley may cause a significant increase in applications for short-term rental permits in the City; (4) the City needs time to study and evaluate the potential impacts of short-term rentals in Planned Residential zoning districts to determine the necessary regulatory requirements to ensure that short-term rentals do not fundamentally alter the character of existing residential neighborhoods. C. This moratorium shall not apply to existing short-term rental permits. D. The City finds and declares that this moratorium is a reasonable and necessary measure designed to protect the important public purpose of the preservation of the public health, safety, and welfare. SECTION 2. Compliance with California Environmental Quality Act. The City Council finds that this Ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly; it prevents changes in the environment pending the completion of the contemplated study of impacts. SECTION 3. Severability. If any sentence, clause, or phrase of this Ordinance, or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each sentence, clause, or phrase thereof, irrespective of the fact that any one or more sentence, clause, or phrase be declared unconstitutional. 2 72500.00896\33239117.1 INTERIM URGENCY ORDINANCE NO. 1357 SECTION 4. Effective Date. This Ordinance shall become effective immediately upon adoption if adopted by at a least four -fifths (4/5) vote of the City Council and shall be in effect for forty-five (45) days from the date of adoption unless extended by the City Council as provided for in the Government Code. SECTION 5. Notice of Adoption. The City Clerk shall certify to the adoption of this Ordinance and cause it, or a summary of it, to be published once in a newspaper of general circulation printed and published within the City of Palm Desert. SECTION 6. Report. City staff is instructed to prepare the report required by Government Code Section 65858 (d) describing the measures taken to alleviate the condition that led to this Ordinance's adoption for presentation to the City Council no later than ten days prior to the expiration of this Ordinance. Below is the information staff presented during the meeting for each of the four non -gated PR neighborhoods and associated complaint history: • Shepherd Lane: The neighborhood is mostly off Shepherd Lane, north of Frank Sinatra Drive, west of Portola Avenue, and south of Gerald Ford Drive. Total Short-term Rental (STR) Permits as of November 14, 2019: 29 2018 — Three Complaints 2019 — Five Complaints • Hovley Lane West: The neighborhood is east of Monterey Avenue and west of Portola Avenue. Total STR Permits as of November 14, 2019): 23 2018 — Zero Complaints 2019 — Zero Complaints • The Grove: The neighborhood is west of Deep Canyon Road, south of Fred Waring Drive, and north of Highway 111. Total STR Permits as of November 14, 2019: 3 2018 — Zero Complaints 2019 — 30 Complaints. The City has received letters from all 30 residents who would like to see their neighbor rezoned to R1. STR Update in Homeowners' Associations July 24, 2020 Page 2 • North Deep Canyon (Lavender Way, Columbine Drive, Coral Bells Circle. Strawflower Circle. Davlily Circle, Waterlily Circle, Amaryllis Way, and Moss Rose Drive): The neighborhood is east of Deep Canyon Road, west of Palm Desert High School, north of Fred Waring Drive, and south of the Whitewater Storm Channel. Total STR Permits as of November 14, 2019: 6 2018 — Two Complaints 2019 — Five Complaints At the conclusion of the November 2019, City Council meeting, the Council directed staff to monitor the areas mentioned above, and prepare a request for action if any reason exists to do so. Discussion Over the last two months, staff has received numerous STR complaints from residents primarily along Hovley Lane West. While this memo focuses heavily on compliance activities on Hovley Lane West, staff continues to monitor all of the ungated PR zones as directed by the City Council. City staff is responding to each complaint and has been in contact with most residents regarding the process for rezoning. The resident STR complaints and operator arguments are the same today as they were in 2017. The city council banned STRs in R1 & R2 zones in 2017 after considering the same types of testimony. The purpose of this letter is to advise the council about what our neighborhood group wants the council to do regarding STRs in the HLW neighborhood. We have expressed our unhappiness about STR operations in our neighborhood in other messages to the council and city staff. We are living in a STR perfect storm. The Governor has issued a stay at home order. STRs are a lucrative business and very popular as a safe way to vacation. And the city code compliance department is short two officers on the day shift. We are asking the city council to change the HLW neighborhood to the R1 zoning standard. We are not asking to change the STR ordinance in any way. The city has acknowledged that our neighborhood functions the same as R1. We want to enjoy the same protections from STRs as the R1 and R2 residents. There are no new wheels to be invented. The city has a model from 2017 for including single family home residents in the R1 standard. The model starts with an initiation of a new permit moratorium. Move the administrative process forward to the formal hearings to change the HLW neighborhood zone to R1. We expect there to be a sunset period for the active STRs to move their operations outside of the HLW neighborhood. In 2017 the council provided a two year sunset period. Since our request is a much smaller scale, we are asking for the sunset period to be less than one year. The Homeowner Application For Short -Term Rental Permit includes the following language: By applying for and accepting a Short Term Rental permit, Applicant acknowledges that the City of Palm Desert is conducting, on an ongoing basis, a comprehensive review of regulations of Short Term Rentals (STR) within the City. Any changes to City's regulation of STRs will likely apply to this permit. Applicant acknowledges that the City has decided to largely eliminate STR activity in R1 and R2 zones by January, 2020 and may likely decide to extend that ban to other residential areas not governed by a functioning homeowners association, and permits issued in those areas after January 16, 2018, may be terminated. The City may decide to further severely limit or eliminate STR activity, and may decide not to renew STR permits on an annual basis. Applicant acknowledges that a STR permit does not authorize activity when property restrictions imposed by CCRs or similar property restrictions prohibit such activity and that any STR permit is subject to revocation if the City determines that the permitted property is subject to any such restrictions. July 23, 2020 The city had the foresight to anticipate the need for additional restrictions and put applicants on notice that their permit may need to be discontinued. Can this language be applied to our zone change request and streamline the administrative process? The city uses the number of STR permits, complaints and citations to measure the impact of STRs. We think the number of residents nearby each STR should be included in this analysis. In 2017 the city improved the enforcement process and resources. Our experience with complaint enforcement gives us little confidence that irresponsible STR operators and renters will be cited to a level that will return our neighborhood to the peace and quiet we once enjoyed. Prohibiting STRs is the only option that will give us day to day confidence that we will not have our lives disrupted by short term renters. STRs are a business. Businesses of all types must constantly adapt and adjust to new requirements. Prohibiting STRs in our neighborhood will require them to sell the property and relocate to another location. Renting the property seasonally or longterm is another option. Assuming there will be a sunset period they will have time to make these adjustments. The TOT revenue from the current 26 STRs in our neighborhood is about 2% based on the total number of STRs in Palm Desert. Home sales and prices are increasing in Palm Desert. It is reasonable to expect that many of the STRs will relocate and restart their operations. When we moved here we had no Short Term Rentals (STR) on our street and now we have 4 with permits and 4 more with permits on the street immediately to the west. The street immediately to our east has 1 with a permit and 2 other STRs in operation but we don't know their permit status. We are very concerned about the growth of STRs in our neighborhood. We become anxious every time a house goes up for sale. We've noticed the advertisements for some houses for sale include "great property for Short Term Rental". We were part of the 2017 effort to remove STRs from R1/R2 zones and mistakenly believed our neighborhood was included. In talking to Kevin Swartz in zoning, we understand that Council Members realize that we function as R1. We believe our neighborhood should be included under the R-1 standard. 1n February the house next door to us began renting and our life has become a daily torment. Every weekend is a party weekend. Every day we live with the fear and uncertainty of who will be in that house, how much noise we will have to endure, cars parked on the street and trash on the property. Along with many of our neighbors we are calling in our complaints to the the STR hotline and the Palm Desert Service App. We are getting no satisfaction especially in regards to noise. Our feeling is that the process we are trying to navigate is inconsistent, subjective and we receive no feedback on the outcome of any investigation unless we follow up. Pedro Rodriguez advised us that they use the measure "not common in a neighborhood setting" to determine if renters are violating regulations. He gave a family playing in the pool as an example of noise common to a neighborhood. We agree. But it is not common to have a pool party every day of the week. And most of the noise is not families playing in the pool. Our quality of life is now terrible. Instead of enjoying the beauty of Palm Desert and our lovely neighborhood we are bombarded with noise and strangers and trash. We are over 65 and because we are high risk for COVID we are home all day and all night except for essential shopping. We are being exposed to strangers and their outrageous behavior on a daily basis. 1 We are reaching out to you for support and help in the following areas: 1. Make enforcement effective. It leans toward favoring the STR not your residents. Residents have to make a huge effort to get any results. We understand code compliance is short staffed. If they do not have the staff to effectively enforce STR regulations, the city should close STRs until staffing is adequate. STRs should also be closed due the high number of cases of Covid-19 in Riverside County. 2. Inaccurate records. We have received reports on complaints from Keven Swartz and appreciate his willingness to work with us. We have shared these reports with neighbors and we know the numbers are not accurate as they have called with complaints that are not included in these reports. 3. Deal with the party house next door (40641 Diamondback Dr). We and our neighbors have made numerous complaints about noise. The efforts of code compliance are ineffective based on the standards they use. We feel helpless and avoid engaging in the complaint reporting process because it takes our time and increases our blood pressure for no relief. We are imploring you to help us and deal with this party house. No one should be expected to live like this on an ongoing basis in a normally quiet neighborhood. 4. Include Hovely Lane West under the R-1 standard for STRs. Make our beautiful neighborhood a stable, welcoming place to live in again. Let us know know when it would be best to talk with you. During my 32 years on active duty, I had 17 different assignments that took me to places around the world and throughout the United States. Our dream for post -retirement was to settle in a community and a neighborhood where we knew our neighbors, respected each other's ownership and order and would Iook out for each other's well-being and needs. We found that neighborhood off of West Hovley Lane and settled into a very enjoyable setting. Then a few years ago, a house three doors from us sold to an out of town owner to be used as a short term rental. Two years later, the house directly across the street from us and directly across the street from the other short term rental sold to another owner as a short term rental. Our enjoyable, safe and quiet neighborhood has never been the same since. We now have a continual and steady turnover of large short term rental groups that regularly have loud parties, loud music and fill our quiet street with a multitude of cars. One weekend at just one of the rentals, 17 cars were parked on the street supporting the huge party being hosted in the backyard of the short term rental. This is not the neighborhood we bought into and certainly not the living environment we were hoping for at this point in our lives. It is our understanding that the Palm Desert City Council banned short term rentals in 2017 but "excluded" Hovley Lane West neighborhoods. Why our City Council would exclude our neighborhoods in favor of supporting those out of town owners who buy up houses for short term rental purposes eludes us. We are VERY hopeful that you will correct this unfortunate decision made back in 2017. We are requesting that the Palm Desert City Council open a Request For Action to correct this omission and change the streets in our neighborhoods with single family homes to the R1 standard. The worst one is right next door to us, as the owner has rented it out almost every night of the week to parties of seemingly 10 people or more, who congregate in the back yard in the evening to play very loud music, scream and laugh loudly (often including profanity), and in many cases smoke pot into the night, all of which is a concern not only because it devastates the quiet enjoyment of our home and keeps us awake at night, but it disturbs my two young children who are forced to be a part of the sounds and smells emanating nightly from the property. They have also packed our street with vehicles, and have even used our trash cans several times in an attempt to deal with the debris from their parties. All of this is unacceptable! I have had to call the police several times, until learning about the STR hotline which we then began to employ, and have had great success with that but we are definitely concerned about this ongoing problem, as are many of our neighbors. We have no desire to continue calling the police on a weekly basis and wasting their valuable time, and much less do we feel we should have to continue putting up with this level of disturbance. I have spoken to several of our neighbors and they are also very concerned, one of them mentioning to me the other day that he has nowhere to go in his own home to get away from all of the constant noise. In the 1990's we owned a second home in Palm Valley CC, that experience helped in our decision to seek a regular neighborhood without guard gates and with full-time residents. We live on a quiet cul-de-sac that has twelve homes; all home are occupied by full-time residents. We have two doctors, a golf professional (Big Horn CC) and a number of retired couples. We know all of our neighbors and could not be happier with our beautiful street and wonderful neighbors. Our corner neighbor is moving to Seattle and we are very concerned that their house will be sold to a STR investor. I understand that our neighborhood was missed when The Palm Desert City Council banned Short Term Rentals in 2017; some kind of zoning error. We are asking the City Council to please open a Request for Action regarding this issue, to correct the omission and change the streets with single family homes to the R1 standard. Our immediate neighborhood has really been hurt by allowing STR's. We have two homes close to us that have dramatically changed our neighborhood. These homes are being used for parties, filled with party -goers, cars parked everywhere, loud music, rude loud people and followed by piles of trash that sits alongside of the houses for days (our CCR's don't allow trash cans to be seen from the street). Our hearts are sick for our dear neighbors who, for no fault of their own, find themselves living next door to an STR. It should be easy for anyone to see that the Hovely Lane West community should have been included in the 2017 decision to ban short term rentals. There is absolutely no way to change the behavior of the renters, they pay big money to rent big houses to throw big parties. It is unfair to the other neighbors who work, have to get up in the morning and would like to enjoy their houses without listening to a loud party not just on the weekend but all -week long. This short term rental always has more than the allotted cars because it doesn't allow use of the garage. Almost every time it is rented, we see many cars parking off the site at the Temple and other streets like Palm Ct. With all the closures, this rental is very busy with at least 3 different groups of people from week to week and barely one day between rentals. We are tired of calling and making reports to Code Compliance only to be told we don't have valid complaints because the officer can't hear the music from inside his truck and more than150 feet away. We are tired of hearing that WE are the problem when this issue came to light several years ago when STRs were banned in Residential neighborhoods. We are tired of loud screaming people, music and unruly people that come to this house for one reason, to vacation and party. Two weeks ago, I sent a letter, slide show and evidence of the noise, overflowing trash and parking violations to Mr. Rodriguez, but he never replied! This past weekend was extremely bad again with parties that started at 11 AM and went until 3 AM! Their idea of quiet is to blast music from inside their house and that seems to be fine with Code Enforcement while we hear the bass inside our own houses. We have to document the noise for your officers and even then, sometimes they decide not to go and ask loud guests to be quiet. The 55 limit decibel stated in the City's code is never enforced objectively because the officers sit on the other side of the street when the noise is in my backyard and house. They also argue about what type of noise can exceed the limit, like screaming teenagers. It seems short-term rental people have more rights to party than I do to live in my house. I am in fear every Tuesday and Friday as to what mayhem we will have to endure when the new renters come. We moved to Diamondback Drive in 2014 and had a very quiet, peaceful neighborhood except for a couple of rentals on our street a few years back.(we made complaints but I guess they were erased) 1 When the house next door sold to people from out of state, they immediately started renting it and it is now an utter nightmare to live in my house. There has not been one weekend since the beginning of June, that we have been able to enjoy the serenity of our own home without being subjected to a loud raucous party and rude guests who play music louder and yell "f@#k the neighbors," when they are asked to be respectful. My neighbors and I are begging you to stop this detriment to our health and well being. This constant gathering of different people is sure to add to the spread of COVID and moreover, deeply affects the people who live, work, and pay taxes in this neighborhood. It is hard to understand why these rentals are allowed to operate when the rest of the Palm Desert businesses including City Hall, have been shut down. This is maddening and so I beg you to please immediately stop this rental from operating and rezone our Hovely Lane West area to an R1 and include us in the Short - Term Rental Ban. We purchased the home as a second home to enjoy the winters with a little spring and fall thrown in. We have spent a substantial amount of money furnishing it beautifully for ourselves. We have spent around $40,000 more in adding solar to the home so that we could have more of a worry free home that we could enjoy. When purchasing the home we verified that it was in an area where it is zoned to allow for Short Term Vacation Rentals. Our intent was never to actually use the home as a vacation rental but wanted the option if there was a need and also for resale value. Again, our intent was not to rent out the home, but as you know, life has changed in the last few months and this is a necessity for us. We live in the community of Lake Chelan, in Washington, a vacation destination where there are Short Term Rentals everywhere. We totally understand that sometimes renters can be bad and non caring of the neighbors or the property itself. We get it. There are times when we have to call on the renters, but it is a rare event. You and I both know that a STR get a few calls but not a lot. And as you know, when guests are told to tone it down, they usually do. It is my understanding that our neighbors are relentless and are harassing us and our tenants. We are trying very hard to stay within the laws/rules set forth by the City of Palm Desert. Not only do you get phone calls at all hours, but so are we and on top of that we are getting emails from one neighbor specifically William ChopIin that are just plain hateful and rude. I have given Mr. Choplin my phone number (mistake) and my email address (2nd mistake) so that we can get in the middle if there is a problem. Some quotes from Mr Choplin's emails: We are quite dismayed that you opened a small business next to us. Your small business has turned into our daily torment. It's just wrong we have to suffer this way and I don't see you doing anything about it. We have not been impressed with the code enforcement officer responding to the hotline calls. I did receive an email from Vacasa and this is what it says: I had a great conversation with the code compliance officer. He has been on duty since this whole thing started and is on duty every Thursday through Sunday. On this call he admitted that not one time have the guests been out of compliance- besides the parking issue which was resolved immediately on site. Every other call, the Guest was found to be in complete compliance with all rules. The officer stated that the reason he has not contacted us was because no rules have been broken and we have nothing to worry about. He suggested that if the guests are continuously harassed by the neighbors by taking matters into their own hands (knocking on doors at 11 at night, yelling at guests and their children from behind the fence, etc...) We contact the Palm Desert police department and file for harassment. Also, your neighbor called me today stating that guests were in compliance with noise ordinance times, However they don't agree that the time should be as late as it is. He essentially asked that we make our own rules to enforce by making quiet times earlier than 7 PM. I told him that this is not something we would be able to do, however we would reiterate to our guests that it is a residential area and to please be respectful. My guess i is that he will continue to call the hotline even while the guests are in compliance (like he did tonight), however we have nothing to worry about as the compliance officer agrees that no rules have been broken so there is nothing to enforce. I hope that brings some clarity to the issues. So what I would like to know is what can I do to stop the harassment of the neighbors to Me, Vacasa, The City of Palm Desert and the STRenters? I have rights as well as a taxpayer in this beautiful city. In the end we would love a peaceful resolution to this matter, but I am certainly not opposed to legal action if that is what it takes. I will not be bullied by the neighbors. We will be installing cameras around the home to create a safe environment for us and our guests. It is sad, the neighbors on both sides and across the street seemed so nice until we mentioned we may be renting out our home for a while. Your immediate response is requested. We also OWN (2) Short Term Rentals off Hovley Lane, one on Meadow and one on Centennial Circle. We bought Centennial back in 2016, lived there for almost 2 years then began to Short Term Rent it and we've NEVER HAD ONE ISSUE, EVER with our home at 40935 Centennial Circle. When we bought our home on Meadow Lane, (40500) it was going to be our permanent residence, however after fixing it up it was too small for us so we decided to buy another house on Corte Placitas and make that house our residence and we would just STR Meadow lane. Well, ever since that decision, we've had neighbors who decided that they didn't want a STR so they did nothing but create problems. My husband and I have been STR our homes out for over 14 years and we've literally never had an issue, until Meadow Lane and the people who have nothing better to do than to create problems simply because they do NOT WANT ANY STR's on their street! Our guests follow ALL RULES set by the City and by US! We're VERY STRICT and extremely clean and conscientious of EVERYTHING GOING on at both our STR's. We walk every morning past both homes and make sure guests are following ALL rules and regulations. I called Pedro (code enforcement supervisor) and I've talked with Kevin regarding this issue, letting them know that we (my husband and I) are willing to help in any way we can...to make sure the STR's in our neighborhood are ALL following the rules and regulations set forth by the City. The beautiful families who rent our homes are gracious, caring, kind, CONSIDERATE and EXTREMELY RESPECTFUL, UNLIKE some of our 'actual' neighbors, who park cars (more than 4) on the street each night, don't take care of their property, moan and complain about other neighbors... THAT'S crazy to me! We had 'anonymous' people calling in about our house on Meadow, FOR LITERALLY NO REASON! Mike the officer who showed up twice, met with us there and he was even baffled! I think one of the very first things that needs to happen is NO MORE ANONYMOUS CALLERS! If you TRULY have a complaint, CALL YOUR NEIGHBOR, but if they're too cowardly to do that, then they at least should HAVE TO STATE WHO THEY ARE when calling the city! He didn't even know why. My wife was inside doing laundry. I understand there is 26 STR's in the Hovley area, We bring travelers from other Countries, States and Cities. They spend money at our restaurants, golf courses, Tennis clubs, El Paseo, living desert, 111 shopping, designer boutiques etc. I'm not gonna ramble on but here's my thoughts. I would like to have short term rentals banned in our neighborhood as there have been parties where the renter has rented large blow up slides and placed them in the front yard of the home. Renters park their car in front of the mailbox blocking the mail from being delivered and trash from being picked up. I contacted the homeowner about the trash issue, he suggested that I move the trash cans to the street. Nearby homeowners should not have to accommodate airbnb guests. People have gone to our house by mistake and have tried to open our door thinking it is the short term rental. There have continuous noise disturbances such as loud music and partying after the 10:00 p.m cutoff. We have complained to City of Palm Desert. We have had to pick up trash that renters have tossed over the fence into our yard. We have had traffic problems. Having interchangeable disrespectful guests breaks the sense of community in our neighborhood. We have worked very hard to accomplish homeownership. It is our hope to return to a peaceful, close-knit family -oriented neighborhood. . As the City Planner acknowledged, we function as an R1, but we do not have that distinction, so we continue to suffer needlessly from the short-term rental nightmare that has become our life. In 2017, 1 was involved in the movement to ban STR's in Palm Desert only to find out that our Hovely Lane West neighborhood was not included. None of the streets off Hovely Lane West ever formed an HOA as was assumed. After finding out we were a PR, we also made several complaints about the STR's on our street during 2018 and 2019. Unfortunately, they are not recorded with the City even though Code Compliance came out many times. This year we gained another short-term rental on the other side of us which is causing considerable problems. Not only do we have footage of an expensive package being delivered there that was not returned, this property management company and/or their guests have also trespassed on our property leaving us forced to file two police reports and post no trespassing signs on our property. Had these people been neighbors, we would have gotten our package returned as we do with our other neighbors. These violations are in addition to the countless parking, trash and almost always, "unfounded" by Code Compliance, noise complaints. We are tired of having to argue about what is the 50 ft. 55-decibel limit, when the person on duty does not agree because he is 150 feet away and has made claims like "hearing the bass from music is not hearing music" when that music is inside their house, three times the distance away and with all the doors closed. Our backyard is within 50 feet away and the constant party penetrates our backyard and can be heard inside our bedroom which is in the back of the house. We cannot escape it. i There is no amount of enforcement that will be able to stop these constant loud gatherings that plague our house. The parties and loud raucous behavior of transient people who specifically come to short-term rentals to party will ultimately drive out everyone who wants to live in a neighborhood setting. We now refer to our street as "hotel row" and find we must constantly report violations instead of tenants who comply with the rules. The City's reactionary approach is not working and last week we even witnessed tenants get evicted for so many violations. Two days later, a new loud group of revelers arrived. This is a serious problem. - The anxiety of what will happen each time a new large group of people arrives and the noise they create thereafter, continues to have a detrimental impact on our health and well-being. If people need to profit from this neighborhood instead of living in it, then they should either stay on site and monitor their own unruly guests or have rentals for 30 days or more. Therefore, please include our neighborhood to the R1 zoning standard so we may be able to enjoy our home and the neighbors who live, work, and vote here. We moved here from Hoyley Ct to 'get away' from the State run medical homes that surrounded us there. There was always noise and vehicles coming and going at all hours. Now...Short Term Rentals surround us now in this home!! We have a Short Term Rental next door and another a house away AND another lining up to the back of our house too on Petunia. I have called the Complaint Hot Line and the Sheriff's dept. several times over the years because of STR's. One time, the party was SO loud they could not hear me knocking on the door. The partys go on until all hours of the night. The music and the screaming in the pool areas is so loud we can hear it from down the street. Even bouncing balls on their roof went on for hours. Calling the complaint hot line did not help. This includes daytime pool parties and night time parties. Strangers near our home is not a comfortable feeling! We want some peace and quiet in our home and in our own pool area. Something we have worked for all our lives!! STR's don't take care of their front yards the way the other home owners do. The noise is SO irrating so we can't leave our sliders open for fresh air when it's nice outside. We have had booze bottles put in our garbage cans on the street. We have had beach towels thrown over to our side of the retaining 6ft wall! One time, after 1 am in the morning I asked the renters in the pool next door to please quiet down and they told me NO twice! Trying to reason with them myself didn't work so I called the Sheriff to get some peace and quiet. Recently, one evening the music was so loud at one house away from us, I knocked on the door and a very young woman answered. Over ten young people having a VERY loud party. Vehicles come and go at all hours and line the street. Calling the hotline and never works to quiet them down. We ask you to PLEASE include our Shepherd Ln area in the R1 STANDARD zoning and NO more STR permits! It seems quite unfair! Would you like your neighbors to be booming bass music so loud the whole block can hear it? Why is our home is less worthy of being R1 standard than any other home in the City? At the time we and our neighbors mistakenly thought our non - gated neighborhood of single family homes along Hovely Lane West was included in the ban. We are now joining with our neighbors to ask the City Council to include our neighborhood in the RI standard. The city has acknowledged that our neighborhood functions the same as RI. We want to enjoy the same. protections from STRs as the R1 and R2 residents were given in 2017. As Council Members Kelly and Jonathan pointed out in November 2017, enforcement doesn't work. We are here to validate their opinions. We are completely frustrated by the current enforcement process. It does not serve residents. In 20I7 the Council created a sub -committee to study and make recommendations about STRs. We see no value, only delay, in creating a sub -committee to study our request. There is nothing new to learn. The arguments for pro STR and pro Residents are the same. If the Council decides to add our neighborhood to the R1 standard and a sunset period is provided, it should be much shorter. We have already endured the two year sunset provided in 2017. The Homeowner Application For STR Permits includes this language: "Applicant acknowledges that the City has decided to largely eliminate STR activity in R1 and R2 zones by January, 2020 and may likely decide to extend that ban to other residential areas not governed by a functioning homeowners association, and permits issued in those areas after January 16, 2018, may be terminated. The City may decide to further severely limit or eliminate STR activity, and may decide not to renew STR permits on an annual basis." We are asking the Council to invoke this language to remove STRs from our neighborhood and streamline the process to do so. Today we are asking the Council to initiate a Request for Action to start the process and impose a new permit moratorium to stop the bleeding. Once I got the program started, our neighbors joined together to build a community where we look out for each other and our property. Most recently we found that one of our neighbors and sold her home at 40620 Glenwood Lane, as her husband had passed away and it was time to down size. Little did we know that the New Owners were purchasing the home to be a Short Term Rental and was advertising it on AirBNB. Just like the home located behind this residence located on Clover Lane. Now our quite neighborhood that we knew and loved has become a "Swinging Door" for anyone who want to invade our neighborhood for a day, weekend or whenever. Being the father of 4 children, obviously I have greater concerns than just the noise and traffic that these homes bring to our neighborhood. We are very particular and cautious about our children being out, even in our own front yard, with people across the street who pose a threat to our neighborhood. This is not what we signed up for when we bought our home on Glenwood Lane in Palm Desert. On more than one occasion, on my early morning walks, I have heard people talking loudly in the backyard of this property. The owners of these short-term rentals have no regard for our neighborhood 'and are motivated by profit only. My wife and I did have a short-term rental next door to us several years ago. It is fortunately now a Tong -term rental, as we were awakened one morning at 2:00 a.m. by our doorbell ringing only to look out the window to find an inebriated 20-something male standing at our door in his underwear trying to get into our home. I recognized the young man as one of the occupants and guided him back to the correct home. He did apologize the next day, but needless to say it was a very unsettling experience. I must also mention that after reading the City Council Staff Report from November 14, 2019, with regards to the number of complaints (page 2) for HovIey-Lane West that there were "Zero Complaints" in 2018 and 2019, which is without a doubt incorrect. Two years later, the house directly across the street from us and directly across the street from the other short term rental sold to another owner as a short term rental. Our enjoyable, safe and quiet neighborhood has never been the same since. We now have a continual and steady turnover of large short term rental groups that regularly have loud parties, loud music and fill our quiet street with a multitude of cars. One weekend at just one of the rentals, 17 cars were parked on the street supporting the huge party being hosted in the backyard of the short term rental. This is not the neighborhood we bought into and certainly not the living environment we were hoping for at this point in our lives. It is our understanding that the Palm Desert City Council banned short term rentals in 2017 but "excluded" Hovley Lane West neighborhoods. Why our City Council would exclude our neighborhoods in favor of supporting those out of town owners who buy up houses for short term rental purposes eludes us. We are VERY hopeful that you will correct this unfortunate decision made back in 2017. We are requesting that the Palm Desert City Council open a Request For Action to correct this omission and change the streets in our neighborhoods with single family homes to the R1 standard. We love Palm Desert and the many opportunities it offers. However, short term rentals have made our lives in these quiet neighborhoods a living hell. Based on my family's experience over the past 3.5 years, we do not believe there is any amount of "policing" or enforcement the city can provide that would properly or effectively manage rentals of this nature Short term rentals are already banned in single family residential neighborhoods, what you refer to as Zone R-1. We are living off Hovely Lane West in exactly what I just described, a single family residential neighborhood. No gates, no guards, no HOA. I have been following the short term rental situation both in Palm Desert and surrounding areas. I urge the council and other residents of Palm Desert to be more forward thinking and not impose any additional measures to ban short term rentals that were not included previously. I have been a SuperHost with Airbnb now for over 4 years and allowing the flexibility of renting out my residence while I am away from home is a source of income and joy I have of sharing my unique home. I have many family members and friends who only book Airbnbs especially now to book unique homes and stay out of public hotels especially during the pandemic. In these uncertain times restricting revenue both to the city as well as to residents should be done with care as the last thing we do for all of us is to lose another`source of revenue during these difficult times. I'see the city as being a hub for technology now and in the future, Airbnb is going public this year and willing to work with us to cut down on disturbances/partying as one of their mandates of now becoming a public entity. Existing measures are already in place from these short term rentals such as banning any mentions of partying, not allowing guests under 25 to book property and more. I know myself I leverage technology to help resolve disturbances such as having multiple cameras, can broadcast a voice message throughout the interior and devices that measure noise levels in a property are used to keep them under control. Rather than imposing cold bans on rentals we need to do some more research on how these bans are impacting long term home prices , revenue for the city and overall economy. I can tell you right now partying right now at Airbnbs isn't an issue just for Palm Desert or not even in California it's an international issue. Due to the pandemic and covid it has been worse as more locals are using party homes as a vacation rather than being able to travel due to the pandemic. I am experiencing this same issue in Canada with my rental there of local residents booking to use as a party home and have had to deny a lot of bookings,I can tell you right now it's an issue everywhere not just in our city. I'm confident we can find a resolution to these issues and be more forward thinking for the future of our city rather than a straight ban on all short term rentals. Recommendation Waive further reading and adopt Interim Urgency Ordinance No. 1357' establishing a temporary moratorium on the issuance of short-term rental (STR) Permits within all Planned Residential (PR) zoning districts, unless the owner can provide written approval from an Homeowners Association (HOA) that short term rentals are permitted within the HOA. 2. By Minute Motion, direct the existing City Council STR subcommittee (Kelly and Nestande) to review and provide a recommendation to the City Council. Executive Summary Approval of staff's recommendation will approve an interim urgency ordinance that will place a 45-day moratorium on issuing new STR permits within all PR zoning districts unless approved by the governing HOA. The moratorium allows existing permitted STR properties within the affected zoning district to continue operating, including permit renewals. Given that this is an urgency ordinance intended to take effect immediately, it requires a 4/5 vote to pass. Background Analvsis At its regular meeting of August 27, 2020, Councilmember Jonathan requested that staff review a known zoning irregularity within PR zoning districts that do not have a governing HOA as it relates to STR use. Councilmember Kelly added her concurrence to that effort, however she expressed the need to bring forward an interim urgency ordinance, placing a moratorium on the issuance of STR permits within Planned Residential zoning districts unless approved by the HOA. Councilmember Jonathan concurred that both are important. September 10, 2020 - Staff Report Interim Urgency Ordinance — STR PR Zoning Districts Page 2 of 2 Discussion Staff, at the direction of the City Council, has been monitoring STR permits in PR zoning districts since the updated STR ordinance was approved in late 2017. The PR zone provides maximum flexibility in development, ranging from large planned communities to developments that function the same as R1 or R2 single family zoning districts. Areas such as the Hovley Lane West, Shepherd Lane, and ungated developments along Deep Canyon Road are good examples of neighborhoods that are zoned PR, but share many commonalities with the R1 or R2 zoning districts. Staff has prepared the language to include all PR zone properties subject to proof of HOA approval because we are aware of at least one PR zoned development (The Grove) that has an HOA that is not currently active. There could be additional locations where this exists, which is why staff is proposing the Interim Urgency Ordinance in this way. Memo to City Council Dated July 24, 2020: Staff prepared the most recent update to the City Council in late July of this year; it is attached to this staff report. At that time, staff noted there had been alfairly significant increase in complaints from surrounding residents. As was learned in 20116, resident input is one of the biggest indicators of a mounting STR concern. Consistent with the memo, staff's recommendation remains the same: Refer this to the STR subcommittee whose members are uniquely qualified to develop a strategy to be submitted to the entire City Council for consideration. I cannot believe the lies that continually happened throughout the neighborhood. Whether it's an email or online this is all a bully tactic. Some of these residents are straight up liars. After reading my neighbors letter I just can't believe it. I personally run a small management company for approximately 12 Airbnb rentals(2in palm desert). 74614 Strawflower Circle and 74529 Lavender I consider myself to be very good management for homeowners. I continually manage the houses, guests and cameras in the best interests for all entities. I have never received a City fine from any city. In fact I have only received a few phone calls from the city of which were false complaints or inaccurate complaints. Nothing like what my neighbor is explaining. This management company is my full-time job and 100% of my income. Without it I would be jobless. One of my neighbors next to the strawflower house is quite happy with my rental that he purchased and invested $650,000 to start his own Airbnb rental 2 houses away. I do believe that the city of Palm Desert and all surrounding cities are having their issues with short term rentals but the answer would be to fix the problem. Not illuminate all rentals. Why not increase the minimum rental days from two days to three days or even possibly four days. Possibly require every rental to have camera systems on the front or the back of the house to monitor noise levels like I do. Fortunately, I've been able to support myself and my family and cover my mortgage and living expenses with the rental income. But I'm deeply concerned that new restrictions could negatively affect my livelihood. As a result, I propose another way to resolve the problems we may be experiencing. I suggest that... 1. we require noise monitors 2. only allow small bluetooth speakers in the backyard 3. talk to nearby neighbors about doing the right thing if there's any problem 4. have actual renters and not property owners are charged with fees if they violate noise rules. I believe this type of approach would get rid of unrespectable renters from our city, eliminate partying, preserve and maintain quiet neighborhoods, and enable me to depend on my rental income. This might be one-sided from my perspective but there are bigger implications if I lose my house. For example, I won't be able to pay my cleaning lady, pool, and maintenance guy who are living off of their jobs. Also, worst come to worst, I may have no choice and put my house into foreclosure which could have a negative economic impact on Palm Desert. Please think through all these possibilities and let's find a better way to resolve short term rental issues and care for our local residents and neighborhoods. For far too many years we have been plagued with STR's directly across and next to us. We have had to put up with all sorts of ruckus on a regular routine basis. The sheriff's department has been out several times, as well as code enforcement on many occasions. Renters routinely play load music, which can be heard from across the street and even when we are indoors. The STIR located at 74-140 College View Circle East, is essentially a party house as noted by their Wi-FI name "The Party House". On a regular basis there are no less than 4-5 vehicles parked at this residence and I have counted as many as 14 at times. Vehicles are regularly parked up and down the street and often blocking the sidewalk. This is a 3- bedroom home with an additional converted bedroom. The property is listed on VRBO as sleeps 12 with additional beds available upon request and "Parties Allowed". I have lived in this once peaceful Neiborhood since it was first developed and have witnessed the negative impacts from STR's. I recently told one of my young children, it is unfair we should have to contemplate moving out of the neighborhood to give way to those only motivated by profit. My neighbors and I selected to live in a residential neighborhood, not a business type neighborhood who's only focus is self-interest and profit. In speaking with a couple of my immediate neighbors, they too are contemplating moving. Our final opportunity to regain our peace and remain in the neighborhood rests with your decision to do the right thing by banning STR's as you did in other parts of Palm Desert. This should have been the 3rd major fine. But they continue to rent. There have been over 37 complaints for this property. Who is responsible for the incompetence? For us, having the ability to have a STR gives us the opportunity to be able to keep our home there in Palm Desert so that we as owners, can use and enjoy our home periodically throughout the year. Without the ability to have part year income, we would have to sell the home. If we were an R 1 residential neighborhood and someone wanted to profit off their home, they would have to be there on site to deal with their guests. This would solve the issue of loud parties because a homeowner would not allow such horrible behavior. Because they are never here, they don't know how bad it really is. Please take swift action to correct the zoning error of these neighborhoods and have a sunset period of no longer than six months to stop this madness. We are sitting ducks. The city made an honest oversight in 2017 when the planned residential neighborhoods with single family homes were not included in the R1 and R2 STR ban. We don't see the issue as complicated. The arguments for and against STRs in single family neighborhoods are the same now as they were in 2017. No one is disputing that our neighborhoods function like R1 neighborhoods. We understand that the city must go through a standard administrative process to include us in R1. But for the past year things have gotten much worse because was a change of ownership. Under the new ownership , the house is listed for Events and for up to 12 people per stay, which brings large groups, people that exhibit a total disregard for the permanent residents of this quiet neighborhood. I live at 74537 Lavender Way in Palm Desert. Due to a short term rental (STR) next door, we have experienced loud noise, large gatherings, trash issues and mail obstruction. In the last 5 months, there have been at least 5 more STRs operating on our street. This has caused more traffic and unknown individuals in our neighborhood. Because of STRs, Palm Desert hotels are losing customers. Hotel employees are losing their jobs due to less occupancy. Some STRs are letting more occupants stay (up to 5 families). More occupants than what is allowed. It is basically living next door to a hotel. Three to four times a week people come and go. Our quality of life has diminished greatly. We feel less safe and fear that the value of our home will decrease. I would like to ask the City Council to: 1) Please consider the passing of a temporary moratorium ordinance for new STR permits. 2) Ask the short term rental subcommittee to study and present recommendations at the September 24th City Council meeting and include a ban on STRs in non-HOA planned residential neighborhoods. And, 3) If a sunset is provided for current STRs, request that the sunset be no longer than 6 months. Council's time and consideration is greatly appreciated. Thank you. Over the past two plus years our neighborhood has changed from being a quiet, friendly and orderly one to a neighborhood of raucous parties, loud music and a continual flow of cars and people into an otherwise quiet, family oriented setting. Each of us purchased our homes in our West Hovely neighborhood because of the peaceful, orderly and supportive nature that it provided. It has now become an unruly and noisy neighborhood occupied by STR visitors who have shown no respect for our order, privacy and cleanliness that we work so hard to maintain with our permanent residents. We are also requesting that the STR Subcommittee recommendations be presented at the September 24th City Council Meeting and include a ban on STR's in non-HOA Planned Residential neighborhoods. We also request that if a"sunset" is provided for current STR's, that it be no longer than six months. We would greatly appreciate your support in our attempts to recoup the neighborhood environment that drew us all to this beautiful neighborhood originally. For far too many years we have been plagued with STR's directly across and next to us. We have had to put up with all sorts of ruckus on a regular routine basis. The sheriff's department has been out several times, as well as code enforcement on many occasions. Renters routinely play load music, which can be heard from across the street and even when we are indoors. The STR located at 74-140 College View Circle East, is essentially a party house as noted by their Wi-FI name "The Party House". On a regular basis there are no less than 4-5 vehicles parked at this residence and I have counted as many as 14 at times. Vehicles are regularly parked up and down the street and often blocking the sidewalk. This is a 3- bedroom home with an additional converted bedroom. The property is listed on VRBO as sleeps 12 with additional beds available upon request and "Parties Allowed". I have lived in this once peaceful Neiborhood since it was first developed and have witnessed the negative impacts from STR's. I recently told one of my young children, it is unfair we should have to contemplate moving out of the neighborhood to give way to those only motivated by profit. My neighbors and I selected to live in a residential neighborhood, not a business type neighborhood who's only focus is self-interest and profit. In speaking with a couple of my immediate neighbors, they too are contemplating moving. Our final opportunity to regain our peace and remain in the neighborhood rests with your decision to do the right thing by banning STR's as you did in other parts of Palm Desert. Please confirm receipt. City Council Members, Since our previous letter to you, at the last city council meeting, it's come to our attention that there is another new Short Term Rental on our street, Via Fonda. This is the 3rd short term rental to arrive on this street of only 12 homes. Which makes that 25% of the homes on our street currently operating as short term rentals. We asking for short term rentals banned as soon as possible, to put a stop to this. It has become completely unmanageable, and the fact that all of the "policing" of these rentals falls on the neighbors and homeowners is no longer acceptable. We don't want to be woken up by the constant noise coming from next door and across the street and be responsible for dealing with this, calling the rental hotline or being redirected to the sherriffs' non emergency line when it's after hours for the city code officers. The common thread in all of this is that no matter where short term rentals are located, NO ONE wants to be the one who lives next to them. The same thing happened in 2017 when you voted to ban them in R-1 and R-2. We are having the same experience due to the fact that the situation has not changed. Please stop the new permits and permanently ban short term rentals in PR zones so that we can enjoy the same quality of life as the residents of R-1 zones. Thank you, Scott and Courtney Halterlein
