REQUEST: Approval of a Memorandum of Understanding between the cities of Indian Wells
and Palm Desert for fifty percent reimbursement of crossing guard services at
Gerald Ford Elementary School.
Recommendation
By Minute Motion, approve a Memorandum of Understanding between the cities of
Indian Wells and Palm Desert for fifty percent (50%) reimbursement of crossing guard
services at Gerald Ford Elementary School.
Strateqic Plan Obiective
This item is not referenced under any section of the 2013 Strategic Plan, but it does concern the
community's overall safety with the funding of a crossing guard at Gerald Ford Elementary School.
Background Analvsis
Since 1999, the City of Palm Desert funds the cost of crossing guard services at Gerald Ford
Elementary School (Fred Waring Drive and Warner Trail). While many students live in Palm Desert, it
is located within the City of Indian Wells. The City of Indian Wells, since 2000, refunds the City of Palm
Desert for half the costs for crossing guard services at this location. However, staff was unable to find
any written agreement on this matter. Staff respectfully recommends approval of this memorandum of
understanding that will formalize this arrangement.
Fiscal Analysis
This MOU will formalize the reimbursement by the City of Indian Wells for fifty percent (50%) of the
crossing guard services at Gerald Ford Elementary School. In FY 2019-20, this reimbursement
amounted to approximately $4,600, Please note that this amount was less than prior years because
of early school closure due to the COVID-19 pandemic.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE CITY OF INDIAN WELLS
AND
THE CITY OF PALM DESERT
This Memorandum of Understanding ("MOU") is made and entered into as of the 24th
day of September 2020, by and between the CITY OF INDIAN WELLS ("Indian Wells")
and the CITY OF PALM DESERT ("Palm Desert"), herein after referred to as "The
Parties."
RECITALS
WHEREAS, Palm Desert has been funding the cost for crossing guard services at Gerald
Ford Elementary School at the corner of Fred Waring and Warner Trail since September
1999; and
WHEREAS, Gerald Ford Elementary School falls within Indian Wells' city limits; and
WHEREAS, Palm Desert has entered into an MOU with Desert Sands Unified School
District ("DSUSD") to fund crossing guard services throughout the City of Palm Desert;
and
WHEREAS, this MOU is still inclusive of crossing guard services at Gerald Ford
Elementary School located within the City of Indian Wells; and
WHEREAS, the Parties have a documented history of splitting the costs for crossing
guard services at Gerald Ford Elementary School 50/50; and
WHEREAS, Indian Wells has been reimbursing Palm Desert for said costs since 2000;
NOW, THEREFORE, in consideration of the mutual conditions herein stated, the receipt
and sufficiency of which is hereby acknowledged, the Parties hereto agree as follows:
SECTION I
EFFECTIVE DATE AND TERM
1.1 This MOU shall become effective as of the date on which the last Party executes
this MOU ("Effective Date").
1.2 The Term of the MOU will commence on the Effective Date of this MOU and will
remain in effect unless cancelled by either Party upon thirty (30) day written notice
of such cancellation or modified or superseded by mutual agreement in writing.

SECTION II
PURPOSE & GOALS
2.1 The Parties desire to share costs associated with crossing guard services provided
at Gerald Ford Elementary School. Palm Desert shall pay 100% of the costs
associated with their MOU with DSUSD and will invoice Indian Wells for
reimbursement as defined below in Section 3.
2.2 The purpose of this MOU is to formalize the understanding among the Parties and
set for the terms by which the Parties will manage expenditures associated with
the activities outlined herein.
SECTION III
ACCOUNTING
3.1 Palm Desert shall invoice Indian Wells once per fiscal year for reimbursement of
crossing guard services at Gerald Ford Elementary School for fifty percent (50%)
of total annual costs for said services. At no time shall Indian Wells' reimbursement
exceed fifty percent (50%) under this agreement.
3.2 Palm Desert shall include with this invoice:
a. A copy of the breakdown of costs for the billing period;
b. A copy of Palm Desert's payment to DSUSD;
c. A copy of the invoice from DSUSD to Palm Desert; and
d. A Copy of the MOU between Palm Desert and DSUSD (provided once and
subsequently whenever amended)
SECTION IV
INSURANCE
4.1 As the original contracting party, Palm Desert shall maintain any insurance deemed
necessary under the provisions of their MOU with DSUSD.
