Strategic Plan While the Citywide Striping Project is an on-going maintenance activity and is not a specific objective of the Strategic Plan, maintaining the City’s roadway markings contributes to roadway safety. Background Analysis The 2020 Citywide Striping Program will repaint or paint all lane lines, stop bars, symbols, arrows, and crosswalk stripes on public roadways according to Exhibit A attached hereto. December 10, 2020 - Staff Report Award Contract No. C40700 to Superior Pavement Markings, Inc. Page 2 of 3 The Project was advertised for bid on October 13, 2020, and on November 10, 2020, three bids were received via the City of Palm Desert’s online PlanetBids bidding portal with the following results: Contractor Location Total Base Bid Cal Stripe, Inc. Colton, CA $195,663.00 Superior Pavement Markings, Inc. Cypress, CA $275,560.00 Chrisp Company Freemont, CA $300,030.00 The lowest bidder, Cal Stripe, Inc., did not submit their bid guarantee (bond) in original hard copy to the City Clerk prior to the specified date and time for the bid opening, as required by the bid specifications. The failure of Cal Stripe , Inc. to provide a bid bond prior to the bid opening time gave them an unfair competitive advantage and renders its bid nonresponsive. After consulting with the City Attorney, it is recommended to reject the bid from Cal Stripe, Inc. Staff reviewed the bid received from Superior Pavement Markings, Inc. and determined that they are the lowest responsible bidder submitting a responsive bid. The engineer’s estimate for the Project is $280,000.00, which places the bid from Superior Pavement Markings, Inc. at approximately one (1) percent lower than the estimate. The project was bid with one Alternate Bid Item, but the bids are evaluated solely on the Total Base Bid alone. The one Alternate Bid Items is as follows: AA-1 San Pablo Avenue Striping Modifications Alternate Bid Item AA-1 is a modification to the roadway striping on San Pablo Avenue between Royal Palm Drive and Guadalupe Avenue to improve access to a commercial office building. Accepting the Alternate Bid Item adds an amount of $4,102.00 to the contract. Staff recommends accepting this bid alternate. The total contract price is $279,662.00, which includes the Total Base Bid and Alternate Bid Item AA-1. Fiscal Analysis The Citywide Striping Project was included in the approved CIP Budget for Fiscal Year 2020-21. It is an on-going maintenance activity that is funded by Measure A Funds; therefore, there is no fiscal impact to the general fund. As a condition precedent to the satisfactory completion of the Contract Documents, unless otherwise provided for in the Contract Documents, the above obligation shall hold good for a period of one (1) year after the acceptance of the work by the City, during which time if Contractor shall fail to make full, complete, and satisfactory repair and replacements and totally protect the City from loss or damage resulting from or caused by defective materials or faulty workmanship. The obligations of Surety hereunder shall continue so long as any obligation of Contractor remains. Nothing herein shall limit the City’s rights or the Contractor or Surety’s obligations under Contract No. C40700 PROJECT NO. 564-20 CITYWIDE RESTRIPING -13- BOND FORMS the Contract, law or equity, including, but not limited to, California Code of Civil Procedure Section 337.15. Take over and complete the Project in accordance with all terms and conditions in the Contract Documents; or ii. Obtain a bid or bids for completing the Project in accordance with all terms and conditions in the Contract Documents and upon determination by Surety of the lowest responsive and responsible bidder, arrange for a Contract between such bidder, the Surety and the City, and make available as work progresses sufficient funds to pay the cost of completion of the Project, less the balance of the contract price, including other costs and damages for which Surety may be liable. The term “balance of the contract price” as used in this paragraph shall mean the total amount payable to Contractor by the City under the Contract and any modification thereto, less any amount previously paid by the City to the Contractor and any other set offs pursuant to the Contract Documents. iii. Permit the City to complete the Project in any manner consistent with California law and make available as work progresses sufficient funds to pay the cost of completion of the Project, less the balance of the contract price, including other costs and damages for which Surety may be liable. The term “balance of the contract price” as used in this paragraph shall mean the total amount payable to Contractor by the City under the Contract and any modification thereto, less any amount previously paid by the City to the Contractor and any other set offs pursuant to the Contract Documents. Surety expressly agrees that the City may reject any contractor or subcontractor which may be proposed by Surety in fulfillment of its obligations in the event of default by the Contractor. Surety shall not utilize Contractor in completing the Project nor shall Surety accept a bid from Contractor for completion of the Project if the City, when declaring the Contractor in default, notifies Surety of the City’s objection to Contractor’s further participation in the completion of the Project. The Surety, for value received, hereby stipulates and agrees that no change, extension of time, alteration or addition to the terms of the Contract Documents or to the Project to be performed thereunder shall in any way affect its obligations on this bond, and it does hereby waive notice of any such change, extension of time, alteration or addition to the terms of the Contract Documents or to the Project.
