Strateqic Plan The proposed action will further the goals of the Strategic Plan by providing a safe and efficient transportation system for residents, businesses and visitors. Backqround Analvsis The City of Palm Desert last established speed zones when the City Council adopted Ordinance 1266A on June 12, 2014. The California State Legislature sets in place the regulations for California speed limits and the California Vehicle Code (CVC) places these regulations into language used primarily for enforcement purposes. Various jurisdictions have responsibility for roadways throughout California, including the responsibility to set speed limits on these roadways according to the standards and procedures established by Caltrans. The guidelines from the 2014 California Manual for Setting Speed Limits published by Caltrans (May 9, 2014) are used in this study. These guidelines help in establishing speed limits that are uniform throughout the state and avoid influence from political pressure or emotional perceptions. CVC Section 40802 requires that an Engineering and Traffic Study (E&TS) for speed limits should be conducted at least once every 5, 7 or 10 years based on established criteria. State and local agencies re-evaluate non-statutory speed limits on their street segments that have undergone a significant change in roadway characteristics or surrounding land uses since the speed limits were last reviewed. Speed limits are established primarily for protecting the public from the behavior of reckless, unreliable, or dangerous drivers. Speed limits are generally established at or near the 85'h percentile speed. The 85t'' percentile speed, also referred to as the critical speed, is defined as the speed at or below which 85 percent of traffic is moving in free flow conditions. Speed limits established on this basis conform to the consensus of those December 10, 2020 - Staff Report Establishing Speed Zones Throughout the City of Palm Desert Page 2 of 6 who drive on the roadways as to what speed is reasonable and safe under normal driving conditions. Many factors influence drivers and their perception of the safe speed at which to operate a vehicle. These factors should be considered as a whole because it is not practical to consider each individually. The design and physical characteristics of the roadway place limitations on the safe operating speed of vehicles. These characteristics include: • Roadway geometrics, shoulder condition, grade, alignment, and sight distance • Roadside development, zoning, and environment • Parking practices, bicycle and pedestrian activity • Driveway density • Signalized or stop-controlled intersections • Rural, residential or developed areas At its November 14, 2019 meeting, the City Council awarded a contract in the amount of $90,625 to TJKM Transportation Consultants (TJKM) of Pleasanton, California to conduct the Engineering & Traffic Survey of 80 roadway segments with posted speed limits based on current state law. The consultant was also tasked with identifying and reporting on any changes enacted or active efforts to change state law concerning the establishment of speed zones. The report entitled “Engineering & Traffic Survey - City of Palm Desert” has been completed to satisfy the Engineering and Traffic Study requirements. The report provides detailed analysis of all roadway segments with posted speeds throughout the City. The objective of the analysis is to review the adequacy of existing speed limits and to provide recommendations for new posted speeds by examining the various roadway characteristics that contribute to the establishment of appropriate speed limits. The 2014 Edition of the CA Manual on Uniform Traffic Control Devices (MUTCD) requires as a standard that a speed limit shall be established at the nearest 5 mph increment of the 85th percentile speed, except that the posted speed may be reduced by 5 mph from the nearest 5 mph increment of the 85th percentile speed in compliance with CVC Sections 627 and CVC 22358.5. According to CVC 21400, for cases in which the nearest 5 mph increment of the 85th percentile speed would require rounding up, the speed limit may be rounded down to the nearest 5 mph increment below the 85th percentile speed if no further reduction is used. The following examples are provided to explain the application of these speed limit criteria: • If the 85th percentile speed in a speed survey for a location was 37 mph, then the speed limit would be established at 35 mph since it is the closest 5 mph increment to the 37 mph speed. The 35 mph established speed limit can be reduced by 5 mph to 30 mph if the conditions and justification for using this lower speed limit are documented in the E&TS and approved by a registered Civil or Traffic Engineer. • If the 85th percentile speed in a speed survey for a location was 33 mph, then the speed limit would be established at 35 mph since it is the closest 5 mph increment December 10, 2020 - Staff Report Establishing Speed Zones Throughout the City of Palm Desert Page 3 of 6 to the 33 mph speed. The 35 mph established speed limit can be reduced by 5 mph to 30 mph if the conditions and justification for using this lower speed limit are documented in the E&TS and approved by a registered Civil or Traffic Engineer. Section 2B.13 of the 2014 CA MUTCD further states that justification for reducing speed limits can be based on residential density, pedestrian/bicyclist safety and other factors not readily apparent to drivers but essential to meet the traffic safety needs of the community. The following factors may be considered to adjust and determine the final speed limits: • Road characteristics, shoulder condition, grade, alignment, and sight distance • 10 mph pace speed (a 10 mile range in which the highest number of data is recorded) • Roadside development and environment • Parking practices and bicycle/pedestrian activity • Reported crash experience for at least a 12-month period The guidelines from the 2014 California Manual for Setting Speed Limits (May 9, 2014; updated March 9, 2018) published by Caltrans were followed in this study. The speed limit recommendations are proposed for the 80 street segments in the study based on the above discussed guidelines and speed data analysis. The speed limit for each study segment was recommended after determining the average speed, 85th percentile speed, pace speed and considering other significant factors such as existing land use, roadway design characteristics and collision rates. Additionally, TJKM considered the posted speed limits of adjacent roadway segments to ensure the recommended speeds remained within 10 mph of adjacent speed zones, as per the 2014 CA MUTCD guidelines for Engineering and Traffic Surveys. Data was collected along the 80 study segments, including radar speed surveys, average daily traffic (ADT), collision data and field observations performed via Google Maps. Radar speed surveys and average daily traffic counts were collected by TJKM and City staff throughout the study effort. Data was collected, compiled, and analyzed as per guidelines set by the State of California in the California Vehicle Code (CVC), and by Caltrans in the CA MUTCD. TJKM provided speed limit recommendations based on the data results and with input given by the City of Palm Desert. The consultant recommends the posted speed limit decrease by 5 mph along eight study segments, and by 10 mph along two study segments, and by 15 mph on one study segment. The consultant recommends the speed limit does not change along 69 study segments. Table 1 below shows the recommended speed limit changes along the study segments. It should be noted that two roadway segments proposed for speed limit reduction are shared with adjacent agencies, which include Dinah Shore Drive from Miriam Way to Monterey Avenue shared with Rancho Mirage; and Hovley Lane East across the Toscana Country Club frontage shared with Indian Wells. Staff has coordinated the study results with city staff at both cities, who concur with the Palm Desert E&TS study recommendations and will submit similar speed limit ordinances for adoption to their respective city councils. The California Legislature established a process in 2019 which led to the creation of the Zero Traffic Fatalities Task Force. The Task Force is considering steps to improve traffic safety in California by, among other things, changing the process by which speed limits are established: • Require traffic surveys to give consideration to pedestrian and bicycle safety and provide guidelines on how to do so. • Add “business activity district” as a class of location eligible for a prima facie speed limit. • Allow speeds to be lowered along High Injury Networks (HINs). Additional recommendations include long‐term policies that require consideration of all roadway users, pedestrian and bicycle facilities, and likelihood of conflicts between vehicles and other roadway users. The recommendations are aimed to reframe changes to speed limits while helping reduce traffic‐related fatalities and serious‐injuries in support of the State’s Vision Zero goals. The Zero Traffic Fatalities Task Force issued in January 2020 its Report of Findings. The Southern California Association of Governments (SCAG) began developing legislation to enact the recommendations above, however, these efforts were interrupted by the COVID‐19 pandemic. The task force expects to continue efforts on legislation that would implement the recommendations. It is important to note that any change to the State law via this effort would be implemented beyond the expiration of Palm Desert’s current speed limits, and it is therefore important to adopt the speed limit recommendations of this study at this time. The speed zone recommendations were presented to the ATP Subcommittee on November 16, 2020. Staff recommends that City Council adopt Ordinance No.1361, rescinding prior ordinances as listed and establishing speed zones as recommended in the City of Palm Desert Engineering & Traffic Survey report dated November 23, 2020.
