REQUEST: Consideration of Approval to Reimburse Hotel Paseo its Art in
Public Places Fee in the amount of $12,857.23 for Kismet by
Jennifer Asher.
Recommendation
By Minute Motion, authorize reimbursement to Hotel Paseo of its Art in
Public Places Fee in the amount of $12,857.23 for Kismet by Jennifer
Asher.
Monies are available in the Public Art Fund 436.
Strategic Plan Obiective
The installation of public art creates a better community for residents and visitors to
Palm Desert. This concept is in line with the Arts & Culture Mini -Vision of the 2013-2033
Strategic Plan, Envision Palm Desert — Forward Together which states:
"Arts and culture give a community its soul. Palm Desert is the cultural core of
the Coachella Valley. Cultural tourism drives economic growth in Palm
Desert. The community is host to internationally recognized cultural events
that bring significant economic benefits to the City. Palm Desert is a leader in
arts education, ensuring a well-rounded population that possesses high levels
of creativity and critical thinking skills."
Background Analvsis
At its meeting of November 13, 2017, the Art in Public Places (AIPP) Commission was
presented with three potential art pieces for consideration as the public art component
for Hotel Paseo. After deliberation, the Commission recommended approval of The
Airstream by David Winick as the public art component for the hotel. The Commission
additionally noted it's support for the other two proposed artworks; Kismet by Jennifer
Asher and Stone Passage by Roger Hopkins as additional artworks for the hotel.
Important to note that when the Commission approved The Airstream, staff indicated
that the fee paid into the fund for The Airstream could utilize the entire public art fee
paid by the developer.

However, upon the hotel's request for reimbursement for The Airstream, staff was
unable to recommend approval for reimbursement of the entire Art in Public Places Fee
paid by the developer due to reimbursable expenses being limited to the exterior and
surrounding area of The Airstream. This left Hotel Paseo with the remaining balance of
$12,857.23 in the Public Art Fund for which they are now requesting reimbursement for
Kismet by Jennifer Asher.
Although the art has already been installed at the hotel, given that the Commission was
in support of Kismet by Jennifer Asher at the time of their approval of The Airstream,
staff recommends that the City Council approve the requested reimbursement.
Fiscal Analysis
Hotel Paseo paid $107,430 into the Public Art Fund and was recently reimbursed
$94,572.77 for The Airstream by David Winick. The hotel is seeking reimbursement of
the remaining balance paid into the Public Art Fund in the amount of $12,857.23 for
Kismet by Jennifer Asher. Approval of this reimbursement will exhaust the entire fee
paid by the developer into the Public Art Fund.
Monies are available in the Public Art Fund 436. There is no fiscal impact to the General
Fund associated with this request.

least two different viewpoints, and one image of the work in detail.
2. One digital image of the artwork identification plaque as installed.
3. A final accounting of expenses incurred in creating the artwork including
copies of the artist's invoices and receipts for all expenditures related to
the artwork.
4. Proof of payment of the public art fee from the Building and Safety
Department.
5. Proof that appropriate permits and certificates were acquired (Proof of

THIS PUBLIC ART AGREEMENT dated this 241h day of January,
2019 between the City of Palm Desert, a municipal corporation, hereinafter
referred to as "City' and El Hotel Paseo. LLC, hereinafter referred to as
"Owner/Developer" is made with respect to the following:
A. Owner/Developer is the owner of property located in the city of
Palm Desert, County of Riverside, State of California, described in Exhibit "A"
and depicted on Exhibit "B" attached hereto and by this reference incorporated
herein ("Property"). The street address of the parcel is: 45400 Larkspur Lane,
Palm Desert, California 92260.
B. Owner/Developer has heretofore applied for and been permitted to
construct a project for which the establishment of specific public art is required and
in order to comply with the City's requirements, the art should be placed in the
project and the Owner/Developer has continuing indemnification and maintenance
responsibilities as hereinafter set forth.
C. In consideration of the approval process and the installation of such
art, this indemnification and hold harmless agreement executed by the
Owner/Developer, the City proposes to issue all permits for the installation of
same.
D. Now, therefore, the City and Owner therefore agree as follows:
NOW. THEREFORE. the parties hereto agree as follows:
1. City has approved the development of the project of
Owner/Developer that includes the installation of artwork in said project, which
artwork shall remain the ownership of Owner/Developer.
2. So long as artwork remains in place, Owner/Developer agrees to
indemnify and hold harmless the City, its officers, agents, employees and

representatives against any and all losses, actions, proceedings and/or claims,
including attorneys' fees and all other costs of defense that were made against
the City, its officers, agents, employees and representatives in connection with or
arising from the installation, the existence or maintenance of such artwork.
Owner/Developer's obligations under this paragraph are currently running with the
property shall be binding upon owners, successors in interest and assigns.
3. The Owner/Developer has submitted to the City clerk a Certificate
of Public Liability Insurance in a form acceptable to the City manager naming the
City and its officials and employees as additional insureds and with limits as
specified by the City manager. The Owner/Developer shall cause the insurance
to remain in effect for the life of the project.
4. Owner/Developer shall be responsible for the maintenance, repair,
upkeep and replacement of such artwork as required by the City. This
maintenance responsibility shall include the responsibility for all damage to the
area or the artwork that may result from construction or the item being installed on
said property. The property shall be maintained in a clean, safe and attractive
manner. If City, in its sole discretion, determines that the artwork is not being
maintained in an acceptable condition, City through its Code Enforcement
Department shall notify Owner/Developer in writing that they have fifteen (15) days
to correct said deficiency. If the deficiencies are not corrected in the manner and
within the time set forth, the City may make such corrections at the expense of the
Owner/Developer. Upon completion of said maintenance and/or repair City shall
send Owner/Developer a demand letter by first class mail to reimburse City the
cost of maintenance with repairs within fifteen (15) days. In the event there is a
failure to reimburse the City within such time frame, City shall be entitled to
specially assess Owner/Developer of all costs incurred in maintaining or repairing
such artwork, any cost of collection, including attorneys' fees and other court costs,
and lien the property.
5. This Agreement shall be binding upon and inure to the benefit of all
executors, administrators, successors, assigns, agents, employees, attorneys

and representatives of their respective parties hereto. In the event any provision
or disagreement shall be held to be invalid, the same shall not affect any of the
terms of the remainder of the Agreement. In the event of any controversy
including the dispute between the parties, arising out of or relating to this
Agreement, the prevailing party shall be entitled to recover from the other party
reasonable expenses, attorneys' fees and costs.
6. This Agreement is made in and shall be governed by the laws of the
State of California
7. This Agreement shall be notarized and recorded in the County of
Riverside, State of California.

AYE, with Hough ABSTAINING.

A. ORAL REVIEW OF CITY COUNCIL ACTION —
Councilmember Susan Marie Weber
Councilmember Weber reported that the City Council
approved the extension of the contract for the loan of Large
Steel Root.
B. PLANNING COMMISSION REPORT — Lindsay Holt
Ms. Holt reported that the Planning Commission reviewed
Garage Town Storage (73660 Dinah Shore Drive) that
includes 49 units.
The Planning Commission approved a Temporary Use
Permit for Church 212 to occupy a building within University
Park located at Cook Street and Gerald Ford Drive.
The Planning Commission approved an amendment for
Carmax within Monterey Crossing.
C. ARCHITECTURAL REVIEW COMMISSION (ARC) REPORT
— John Vuksic
Mr. Vuksic reported that ARC reviewed and approved a
monument sign for SpringHill Suites Marriott located on Fred
Waring and Highway 111 near Walmart Neighborhood
Market.
ARC approved construction drawings for Desert Business
Club subject to modifications.
D. DISCUSSION OF ART IN PUBLIC PLACES GUIDELINES —
Deborah Glickman
Ms. Glickman stated that Chairperson Boren suggested that
the Commission review the Art in Public Places Guidelines.
Ms. Glickman noted that the public art for a developer's
project must remain with the property if the property owner
changes; the artwork cannot be removed.

HOTEL PASEO LOCATED AT 45400 LARKSPUR LANE
Ms. Glickman referred to the staff report regarding the art
component for Hotel Paseo located at 45400 Larkspur Lane.
The developer has proposed four (4) artworks totaling
$263,000. The total amount of the public art fee paid by the
developer for the hotel is $107,000 which is the maximum
amount that can be reimbursed for the hotel's public art
component. Ms. Glickman stated that staff believes that two
(2) of the four (4) proposed artworks are allotted within the
City's public art guidelines and two (2) of the artworks do not
fulfill the guidelines, and therefore does not feel comfortable
recommending approval. The Arrival by Louie DeCarlo is
incorporated into the porte cochere. After reviewing the
application, there were no examples of past work from the
artist, resume, or biography of the artist which does not
satisfy the policy or requirements. Stone Passage by Roger
Hopkins is proposed to be located at the entrance of the
hotel. Mr. Hopkins is an established artist and the art
component complies with the City's public art criteria as
does Kismet by Jennifer Asher which is proposed to be
placed in the hotel entry. The Airstream by David Winick is a
renovated Airstream trailer that is proposed to be placed in
the back of the hotel and will be available to reserve as a
room. Staff is recommending that The Airstream not be
approved as staff did not receive documentation indicating
that Mr. Winick is an established artist. Ms. Glickman stated
that the fee paid into the fund for The Airstream could utilize
the entire public art fee paid by the developer. If not
approved as the public art component, The Airstream could
be placed at the hotel but would not be considered part of
the public art component under the City's Public Art
Guidelines. The two (2) artworks that staff is recommending
for approval as part of the public art component for the hotel
totals approximately $33,000. The developer would have
ample public art funds remaining for an additional art project.

Chairperson Boren stated that her concern with accepting
The Airstream as the public art component for the project
would be the possible unavailability of it if it is occupied by a
guest, as it would not be available for the public to view the
interior. Commissioner Campbell concurred. Mr. Leach
stated that he would consider having late check in so that
the interior can be viewed during the day.
Mr. Leach stated that The Airstream is a 1950 Airstream
trailer that has been restored. The hotel is a desert
contemporary building with a hint of mid-century and has art
throughout the building. They are hiring a docent instead of a
concierge who will educate visitors of the artwork in the
hotel. Mr. Leach talked about the hotel and the artwork.
Commissioner Adney applauded the idea of The Airstream
as the public art component. Commissioner Miller was in
favor of The Airstream as it is iconic. Commissioner Hough
stated that there is a fine line between fine art, design, and
crafts. There is a fusion of design and fine art. The
Commission has been talking about how it wants art
integrated into the architecture as part of the experience and
not plop art.
Ms. Glickman mentioned that the total amount for all four (4)
proposed artworks is $263,000.
It was the consensus of the Commission that the interior of
The Airstream remains open to the public with late check in.
Chairperson Boren was in favor of Kismet by Jennifer Ash,
Stone Passage by Roger Hopkins, or The Airstream by
David Winick but not in favor of The Arrival by Louie DeCarlo
as it is more of an architectural component than art.
Commissioner Adney was in favor of including the area
surrounding The Airstream as the public art component, and
not just the trailer acting as the public art component. Ms.
Glickman stated that staff would require information from the
developer on the artist to include past works before moving
forward with the project. It would be codified with the Public
Art Agreement that gets filed with the County of Riverside in
the case of the hotel changing ownership any new owner
would know not to change the spirit of the surrounding
environment of The Airstream or they would be in violation of
the AIPP Policy. Commissioner Hough confirmed that staff

is requiring a statement from the artist that The Airstream will
be integrated into the environment setting as part of a whole
unit (a defined area). Ms. Glickman stated that she wants
artwork that is an installation and interactive. Ms. Glickman
asked that the interior not be included as part of the artwork

Commissioner Darby moved to approve The Airstream by
David Winick to include the surrounding environment as the public
art component created by an established artist as per staffs
satisfaction. Motion was seconded by Commissioner Hough.
Motion was carried 6-0-0 with Adney, Boren, Campbell, Darby,
Hough, and Miller voting AYE.
i Staff noted that the Commission was in support of Kismet by
Jennifer Asher and Stone Passage by Roger Hopkins as the
artworks for the hotel.

A. SELECTION OF UP TO THREE (3) COMMISSION
MEMBERS TO SERVE ON A SUBCOMMITTEE FOR
ARTWORK SELECTION FOR THE 2019/2020 EL PASEO
SCULPTURE EXHIBITION
Ms. Glickman stated that due to there being two
Commissioners absent at last month's meeting she
suggested to continue the selection of choosing three
members to serve on a subcommittee for artwork selection
for the 2019/2020 El Paseo Sculpture Exhibition. All of the
Commissioners expressed an interest in serving on the
subcommittee and it was the concurrence of the
Commissioners that the entire Commission would serve on
the committee to select artwork for the 2019/2020 El Paseo
Sculpture Exhibition. Ms. Glickman stated that the artists will
submit their proposals on an online database which will
make for an easier review process.
Commissioner Adney moved to approve that all of the
Commission members serve on the committee for artwork
selection for the 201912020 E/ Paseo Sculpture Exhibition.
Motion seconded by Commissioner Campbell. Motion carried
with a 5-0-1 vote with Adney, Boren, Campbell, Hough, and
Miller voting AYE, with Darby ABSENT (for this item).

CITY OF PALM DESERT'S ARTIST REGISTRY
Artist Daniel Moore applied to be included in the City of Palm
Desert's Artist Registry.
Commissioner Hough moved to accept artist Daniel
Moore in the City of Palm Desert's Artist Registry. Motion was
seconded by Campbell and carried 4-1-1 with Adney, Boren,
Campbell, and Hough voting AYE, Miller voting NO, with Darby
ABSENT (for this item).

X. PROJECT STATUS REPORTS
A. Palm Desert Community Gallery
Ms. Glickman stated that the current show, Inspiration by
CREATE, is doing well.
B. Docent Tours
Ms. Thompson reported that five fifth grade classes from
Washington Charter School took tours of the El Paseo
Exhibition.
C. First Weekend
Ms. Glickman reported that STREET at Westfield Palm
Desert, which was the November opening featured event for
the November First Weekend, went well.
December's First Weekend featured event is Take Me Home
Huey at Freedom Park. The Take Me Home Huey
helicopter/sculpture will arrive on November 30 and will be
removed on December 4. Saturday will include a ceremony
at 1:00 p.m. with a screening of the related documentary film
at 5:00 p.m. Veterans' organizations, color guard from 29
Palms, someone singing the National Anthem, introduction
by the Mayor, Light Horse Legacy, and artist Steve Maloney
will be part of the ceremony. Friday night First Weekend
events will include Cruise Night on El Paseo, art walks,

Galen First Friday, and more. The City's annual holiday
celebration will take place at the Gardens on El Paseo on
December 1.
D. Film Series
Ms. Glickman stated that she is finishing up the details on
the films for the 2018 Film Series.
