REQUEST: Adopt the California Environmental Quality Act (CEQA) Notice of
Exemption for the San Pablo Phase 1 and Phase 2 Streetscape
Improvements Projects; Award Contract No. C35520C in the
amount of $7,941,158.00 to Granite Construction Company of
Indio, California, for the San Pablo Avenue Phase 1 Streetscape
Improvements Project; and Award Contract No. C35520D in the
amount of $56,446.00 to Leighton Consulting, Inc. of Temecula,
California, for Materials Testing and Special Inspection Services
(Project No. 691-16).
Recommendation
By Minute Motion:
1. Adopt the CEQA Notice of Exemption for the San Pablo Phase 1 and
Phase 2 Street Improvements Projects;
2. Award Contract No. C35520C in the amount of $7,941,158.00, based
upon base bid value, to Granite Construction Company of Indio,
California, for the San Pablo Avenue Phase 1 Streetscape Improvements
Project;
3. Authorize the Director of Finance to set aside a 20 percent contingency in
the amount of $1,588,232.00 from unobligated Measure A funds for
Contract No. C35520C;
4. Award Contract No. C35520D in the amount of $56,446.00 to Leighton
Consulting, Inc. of Temecula, California, for Materials Testing and
Special Inspection Services;
5. Authorize the Director of Finance to set aside a 20 percent contingency in
the amount of $11,289.00 from unobligated Measure A funds for Contract
No.C35520D;
6. Authorize the City Manager or designee to review and approve written
requests for the use of the contingencies for unanticipated conditions, per
Section 3.30.170 Section A of Ordinance No., 1335;

Strateqic Plan
The improvements to the San Pablo Corridor fulfill priorities identified in the City's
Strategic Plan, including the following:
• Tourism and Marketing — Priority 1: "Improve access to Palm Desert and its
attractions to enhance the ease of lifestyle."
• Transportation — Priority 1: "Create walkable neighborhoods and areas within Palm
Desert that would include residential, retail, services and employment centers, and
parks, recreation and open space to reduce the use of low occupancy vehicles."
• Transportation — Priority 3: "De-emphasize single/low-occupancy vehicles and
optimize modes of travel (bus, carpool, golf -cart, bicycle and pedestrian)."
• Land Use - Priority 4: "Create a mixed -use city core integrating shopping, dining,
lodging, and housing."
Background Analvsis
The Director of Community Development has determined that the proposed San Pablo
Avenue Improvement project is exempt under CEQA Sections 15301, 15302, 15303, and
15304, as the improvements are within the City's existing right-of-way, the area abutting
the corridor is substantially improved, and served by existing utilities. Therefore, staff is
recommending that the City Council adopt a Notice of Exemption for the purposes of
CEQA.

The first phase of construction of the San Pablo Avenue Corridor Improvements is the
roadway section from Highway 111 to Fred Waring Drive. The project incorporates the
preliminary engineering approved previously by City Council with highlighted project
elements including widened sidewalks, pedestrian crosswalks, pedestrian scale lighting,
landscaping, drainage and pavement improvements, minor utility improvements, and a
roundabout at the intersection of San Pablo Avenue and San Gorgonio Way.
The award of Contract No. C35520C is for the construction of Phase 1 of the San Pablo
Streetscape Improvements project. The Project was appropriately advertised for bid, and
on April 2, 2019, sealed bids were received and opened by the Office of the City Clerk
with the following results:

A Request for Proposals for materials testing and special inspection services was also
appropriately advertised, and on March 15, 2019. Eight proposals were received. The cost
of the proposals ranged from $16,000 to $95,000 with the median cost being around
$71,000. The internal selection committee recommends awarding the contract to the top
consultant, Leighton Consulting, Inc. in the amount of $56,446.00 based on both the
quality of their proposal and their cost.

This project, which was included in the CIP Budget for Fiscal Year (FY) 2018/2019, has
an estimated total cost of $9,597,125, including contingency. The amount of
$4,296,298.50 is currently available from Capital Bond Funds and $5,300,826.50 is
available in the accounts previously listed. Phase 2 of the project is expected to be
presented to City Council in FY 2020/2021.

Magnesia Falls Drive, including: 1) making pedestrian,
bicycle, and vehicular improvements within the existing
right-of-way, 2) the addition of vehicular traffic calming
measures such as a road -diet; removing a vehicle travel lane
in each direction; a pedestrian mid -block crossing between
Catalina Way and San Nicolas Avenue, and round -a -bouts
at San Gorgonio Way, the eastern entrance to College of the
Desert, and Magnesia Falls Drive, and 3) making landscape
improvements to existing City -owned properties to enhance
the pedestrian experience along the corridor, 4
demonstration of these improvements was piloted

The UNDERSIGNED, "CONTRACTOR", having carefully examined the site and the
Contract Documents for the construction of San Pablo Avenue Phase 1 Streetscape
Improvements, PROJECT NO.691-16, CONTRACT NO. C35520C, hereby proposes to
construct the work in accordance with the Contract Documents, including Addenda No(s).
1, 2, 3, 4 for the amount stated in this Bid.
By submitting this Bid, the Contractor agrees with the City:
1. That unless withdrawn in person by CONTRACTOR or some person authorized in
writing by CONTRACTOR before the time specified in the Notice Inviting Bids for
the public opening of bids, this Bid constitutes an irrevocable offer for n i n e t y
( 90) calendar days after that date.
2 The CITY has the right to reject any or all Bids and to waive any irregularities or
informalities contained in a Bid.
3. That the contract shall be awarded only by the governing body of CITY. Said
contract shall only be deemed awarded after the CONTRACTOR'S complete
submission of all contract documents, bonds, insurance documentation, and the
CITY shall obtain all necessary signatures of the governing body, at which time
the contract shall be deemed awarded.
4. To submit to CITY such information as CITY may require to determine the Bidders
financial standing experience and to perform thework.
5. That the accompanying cash, certified or cashiers check or Bid Bond constitutes
a guarantee that if awarded the contract, CONTRACTOR will execute the
Agreement and deliver the required bonds and certificates of insurance within 10
days after notice of award. If CONTRACTOR fails to execute and deliver said
documents, the cash, check or B i d B o n d is to be charged with the costs of
the resultant damages to CITY, including but not limited to publication costs, the
difference in money between the amount bid and the amount in excess of the bid
which costs CITY to do or cause to be done the work involved, lease and rental
costs, additional salaries and overhead, increased interest and costs of funding
the project, attorney expense, additional engineering and architectural expense

It is understood that the quantities shown hereon, except for those quantities marked
"Lump Sum", are estimates and the final payment will be based upon the actual work
performed, subject to such adjustment and alterations as elsewhere provided herein.

relating to the proposal for the construction of STREET IMPROVEMENTS as specifically
set forth in documents entitled SAN PABLO AVENUE PHASE 1 STREETSCAPE

accordance with the Plans and Project Specifications on file at the City of Palm Desert
Engineering Department, the undersigned bidder, having familiarized himself with the
terms of the Contract, the local conditions affecting the performance of the Contract and
the cost of the Work at the place the Work is to be done; and with the Plans, Project
Specifications and other Contract Documents, hereby stipulated; the Contractor agrees
to complete the Contract, including all of its component parts and everything required to
be performed, and to provide and furnish any and all labor, materials, tools, equipment,
expendable supplies and all utility and transportation services necessary to perform the

A. Description of Bid Items:
Bid Item 1. Mobilization & Demobilization: Bid item shall include full compensation for all
bonds, insurance, sureties, licenses, permits, facilities, labor, equipment and material
necessary to complete all work required in advance of construction operations, and upon
the initiation of construction operations, to mobilize all required equipment, materials and
personnel on -site, and complete all associated and appurtenant work in accordance with
the Standard Specifications, the Supplementary General Provisions, and as directed by
the Engineer. The Bid Item shall also include all labor, equipment and material required
to clean-up and restore the site, demobilize and remove all equipment, materials, and
staging, and complete all work required at the end of construction operations in
accordance with the Standard Specifications, the Supplementary General Provisions, and
as directed by the Engineer. The lump sum price for this item shall not exceed 5% of
the total contract price.
Bid Item 2. Proiect Information Siqn: Bid item shall include full compensation for labor,
materials and equipment to fabricate, install and maintain project information signs, in
advance of the project, providing project and funding information throughout to project
duration.
Bid Item 3, Public Notification per Special Provisions, Section 1.29: Bid item shall include
full compensation for labor, materials and equipment to provide public communications
materials to the City for their use, individual residents and business, general public,
fabricate, install and maintain project information signs such as "open for business" signs
for individual businesses, throughout to project duration.
Bid Item 4. Develop and Implement Risk Level 1 Storm Water Pollution Prevention Plan
(SWPPP): Bid item shall include full compensation for labor, materials and equipment to
review, modify, implement SWPPP, all work necessary to complete a project NOI, certify
the project SWPPP, compile and submit project PRDs (Permit Registration Documents),
appoint a project QSD and QSP, install all required construction phase BMPs, complete
all required pre -construction SWPPP documentation and associated work as required to
ensure the project's full compliance with State Water Resources Board's General
Construction Permit (Order No. 2009-0009-DWQ) and Section 1.14 of the Special
Provisions.
Bid Item 5, Implementation of Erosion Control, Sediment Control. Waste Management,
Trackino Control, Contractor SWPPP Documentation upon Mobilization: The monthly
unit Bid item shall include full compensation for all labor, equipment and materials
required to complete all work necessary to maintain, repair and replace all temporary
construction BMPs, provide project oversight by the QSD and QSP, monitor, document
and report project compliance, complete all SWPPP administration and associated work
as required to ensure the project's full compliance with State Water Resources Board's
General Construction Permit (Order No. 2009-0009-DWQ) and Section 1.14 of the
Special Provisions.

Bid Item 6. Temnorary Water Quality Manaaement BMPs: Bid item shall include full
compensation for labor, materials and equipment to install and maintain additional units
of this bid item required by the City and not included in the bid item required in the SWPPP
documentation or for routine maintenance of BMP's to keep BMP's in good working order.
This bid item is not intended to compensate Contractor for damage to BMP's caused by
normal wear and tear. This Bid Item is not subject to Section 3 Changes In Work. This
Bid Item shall account for Silt Fence, Sand/Gravel Bags, Straw Wattles, Inlet Protection,
and any additional BMP's as required by the approved Contractor SWPPP.
Bid Item 7. Changeable Message Boards for Travel Conditions and Advanced Proiect
Wamina:, Bid item shall include full compensation for labor, materials and equipment to
place, install and maintain project changeable message boards warning and informing
motorist, pedestrians and the general public to use alternate routes and other information
as directed by the Engineer throughout to project duration. Traffic control signage needed
for changing lane conditions not included in this bid item.
Bid Item 8. Traffic Control and Construction Staaina: Bid item shall include full
compensation for all labor, equipment and materials required to complete all work
required to prepare, submit and obtain approved Traffic Control Plans from the City of
Palm Desert Public Works and Engineering Department, and any additionally affected
state, federal and local agencies including Caltrans, CVAG and Riverside County; handle
traffic (including flagging costs and person(s) to safely control pedestrian and vehicular
traffic), furnish tools, equipment and incidentals, and for doing all work involved in staging
constructing, furnishing, placing, removing, storing, maintaining, moving to new locations,
replacing and disposing of the components of the traffic control system (including traffic
control devices, temporary steel plate bridging, temporary road resurfacing); temporary
pavement per plans and Section 302-5 Asphalt Concrete Pavement of the "Standard
Specifications for Public Works Construction (Greenbook)," (SSPWC) (latest edition);
installation and removal of all required temporary striping and signing associated and
appurtenant work as specified in the Standard Specifications, the Supplementary General
Provisions, and as directed by the Engineer.
Bid Item 9. Potholing - Locate, Protect and Restore Existing Utilities and Improvements:
Bid item shall include full compensation for all labor, equipment and material required to
locate, protect and restore all existing utilities and improvements which `may be affected"
or "are affected" by the Work in accordance with the Standard Specifications, the
Supplementary General Provisions, and as directed by the Engineer. The location,
protection and restoration of existing utilities and improvements specifically identified for
payment under other bid items shall not be included for payment within this bid item. All
other location, protection and restoration required to complete the Work shall be
incorporated into this bid item.
Bid Item 10. Survev Monument Preservation: Bid item shall include full compensation for
all labor, equipment and material required to locate, protect and restore all existing survey
monumentation within the project limits.

Bid Item 11. Record Drawing ("As -Built") Plans (stivulated amount): Bid item shall include
full compensation for all labor, equipment and material required to provide City with
accurate "red line" plans showing the exact location of all improvements, existing utilities,
that have been modified as part of the Work.
Bid Item 12. Class "A" Field Office: Bid item shall include full compensation for all labor,
equipment and material required to provide a class "A" field office as described in Section
1.30 and any other related work shall be considered as included or included in the costs
of other work. No additional compensation will be made.
Bid Item 13. Clear and Grub With Clean-Ur)/Maintenance: Bid item shall include full
compensation for all labor, equipment and material required to complete all work
necessary to remove and dispose all natural and artificial objectionable material within
the limits of excavation, as required to complete the Work and additional clearing and
grubbing as may be identified within the Contract including but not limited to, concrete
pavement, concrete walks, curbs, gutters, cross gutters, driveways and alley intersections
in accordance with the Standard Specifications, the Supplementary General Provisions,
and as directed by the Engineer. Included in this bid item shall be full compensation for
all labor, equipment and material required to remove existing dry -wells identified on the
plans as part of this project that conflict with the Work shown on the plans, and any other
related work shall be considered as included or included in the costs of other work. The
infiltrating pipe within and extending below the dry -well may be abandoned in place; and
any required street sweeping or trash removal activities. Removal and disposal of trees,
street lights, and bituminous pavement is not included in this bid item. No additional
compensation will be made. This Bid Item is not subject to Section 3 Changes In Work.
Bid Item 14. Remove and Dispose of Existing Tree and Root Svstem. Grind StumD: Bid
item shall Include full compensation for all labor, equipment and material required to
complete all work necessary to remove, grind, and dispose of identified trees and
associated stumps, within the limits of excavation, as required to complete the Work.
Bid Item 15, Remove Existina AC Pavement: Bid item shall Include full compensation for
all labor, equipment and material required to complete all work necessary to remove and
dispose of bituminous asphalt concrete pavement, base and sub -grade to the depth and
limits identified within the Contract Drawings and as may be necessary to reconstruct and
re -pave existing streets and drives in accordance with the Contract Drawings, Standard
Specifications, the Supplementary General Provisions, and as directed by the Engineer.
Existing asphalt thickness may vary. Depth of AC Pavement has been measured at 6"
typical, but varies throughout the project limits. No additional compensation will be made
due to variable thickness of AC Pavement.
Bid Item 16. Sawcut and Remove Existina PCC Sidewalk (4" thick tvvical) and Driveways
f6" thick tvvical); Bid item shall include full compensation for all labor, equipment and
material required to complete all work necessary to remove and dispose of existing
concrete surface improvements as shown on the Plans and any other related work shall

vary. No additional compensation will be made.
Bid Item 17. One Foot (1') AC Slot Cut For Removal of Curb & Gutter. Bid item shall

work necessary to sawcut, remove and dispose of existing AC improvements as shown
on the Plans and any other related work shall be considered as in the costs of other work.
No additional compensation will be made.
Bid Item 18. Remove Existina PCC Curb & Gutter (6" C.F. tvvical): Bid item shall include
full compensation for all labor, equipment and material required to complete all work
necessary to remove and dispose of existing curb & gutter.
Bid Item 19, Remove Existinq PCC Curb (6" C.F. tvvical): Bid item shall include full

Bid Item 23. Adiust Storm Drain Manholes to New Grade: Bid item shall include full
compensation for all labor, equipment and material required to adjust existing and
proposed storm drain manholes to flush and even with final and temporary finish surfaces,
concrete collar, all associated and appurtenant work in accordance with the Standard
Specifications, the Supplementary General Provisions, and as directed by the Engineer
as shown on the plans and any other related work shall be considered as included or
included in the costs of other work. No additional compensation will be made.
Bid Item 24. Adiust Existina Storm Drain Catch Basin to New Grade: Bid item shall
include full compensation for all labor, equipment and material required to adjust existing
storm drain catch basins to flush and even with final and temporary finish surfaces, all
associated and appurtenant work in accordance with the Standard Specifications, the
Supplementary General Provisions, and as directed by the Engineer as shown on the

Bid Item 28, Coordinate with CVWD to Relocate Water Meter & Reconnect (Work to be
done by CVWD): Bid item shall include full compensation for all labor, equipment, time
and material required to coordinate with CVWD on the relocation and reconnection of
existing water meters per CVWD Specifications. CVWD to perform the work, which shall
include installation of meter box per CVWD Std. Dwg. W-5A & W-513 and street trench
repair, trench, place pipe bedding, in accordance with the Contract Drawings, Standard
Specifications, the Supplementary General Provisions, as shown on the plans and any
other related work shall be considered as included or included in the costs of other work.
Contractor shall be responsible for connecting Irrigation service lines to the new,
relocated meter. Contractor shall be responsible to coordinate with CVWD to prepare the
work area prior to relocation of the meter and upon completion of the work to return
service and surrounding area to operating conditions. No additional compensation will
be made.
Bid Item 29, Remove and Relocate Existing Private Mailbox: Bid item shall include full
compensation for all labor, equipment and material required to remove, replace, and

Qualifications
Leighton Consulting Inc. (Leighton), a Leighton Group Company, founded in 1961, provides geotechnical, geo-
environmental, and materials testing and inspection services for transportation and infrastructure projects. Our staff
of more than 175 is located in eight offices across southern California, including Palm Desert, Temecula, Rancho
Cucamonga, Irvine (HQ), Los Angeles, Ventura, Santa Clarita and San Diego. Our project experience includes
municipal projects such as roadways and local streets, water infrastructure and public facilities. Services for this
project will be provided out of our local Palm Desert office, with support from our 7 other southern California locations,
if needed. Leighton is in a solid financial position, and unaware of any condition (e.g., bankruptcy, pending litigation,
planned office closures, impending merger) that could impede our ability to provide services to the City of Palm Desert
(City) over the life of this contract.
Our field personnel have years of construction geotechnical work experience and follow all relevant industry standards
of practice for the safe execution of quality public works construction projects. Our selected field personnel are able
to understand and interpret project construction plans and specifications and applicable standards for Public Works
Construction (Greenbook, Caltrans Standard Plans and Specifications; and CaUOSHA Construction Safety Orders).
Our field technicians have repeatedly demonstrated their ability to interact professionally with contractors, engineers,
inspectors, and the public at large. They typically coordinate with other City personnel and consultants; promote
quality customer service and a professional image of the City; and respond promptly and courteously to requests. All
of our technicians work under the responsible charqe of a person registered by the California State Board of
Reqistration as professional civil engineer and/or geotechnical enqineer.

Leighton's experience on similar projects in this immediate area and our familiarity with City requirements will be
critical for efficient testing procedures and will allow us to respond quickly to unexpected construction related issues.
Leighton's services are supported by our in-house laboratory. All Leighton laboratories participate bi-yearly in
Cement and Concrete Reference Laboratory (CCRL) Sample Proficiency Testing and consistently achieve the
highest possible ratings. We hold certification from Caltrans, AASHTO, and others. Our laboratory participates in
the Cement and Concrete Reference Laboratory (CCRL) Sample Proficiency Testing, AASHTO Materials Reference
Laboratory (AMRL) Proficiency Sample Program, and Caltrans Reference Sample Program (RSP).

TECHNICAL APPROACH I WORK PLAN
Based on our review of the RFP and project plans and specifications, we understand that the current project phase
includes substantial improvements to San Pablo Avenue between Highway 111 and Fred Waring Road. The work
consists primarily of vehicle lane realignment / pavement replacement and associated construction of traffic
roundabouts, sidewalks, and drainage improvements. Additional improvements include stormwater catch basins,
ADA ramps, and curb and gutter replacements. The following approximate material quantities are anticipated: 3054
tons of AC pavement (-1700 feet full section replacement and -1500 feet grind and overlay), -70,000 square feet
concrete paving (-5,000 feet pedestrian sidewalk), '8,500 linear feet curb and gutter, 15 catch basins and 591 feet
RCP storm drain, 1,915 yards aggregate base, 49 ADA ramps, and -600 feet retaining/seat wall. A construction
schedule was not available for our review at the time of this proposal; however, the overall project construction is
anticipated to require approximately 10 months duration and will begin in May or June 2019.
Based on our extensive experience in this area and with similar projects, issues that are likely to require Leighton's
services during construction are as follows:
Preconstruction Meeting and Review of Submittals: Leighton has demonstrated a proactive approach to
construction projects by attending construction meetings and reviewing bid documents and submittals as necessary
to provide clarification or solutions. We will routinely work with your project manager/inspector regarding work
progress, and resolve any pending issues to keep the project on time and alleviate unnecessary activities.
Geotechnical Observations and Compaction Testing: Leighton will coordinate with the City PM/Inspector to
provide geotechnical observation and compaction testing during all earthwork and pavement construction. This field
observation is a crucial part of the overall QA testing to ensure that proper compaction procedures are being
implemented to achieve the required compaction. Due to their very extensive experience with such construction
procedures and different soils conditions, our technicians will play an important role in supporting your staff and take
a proactive approach in identifying any potential deficiencies in the contractor's compaction methods and OC testing

procedures. In addition to the project plans and specifications, our staff will ensure that the testing procedures comply
with applicable California Test Methods and per project specifications. Our QA field density testing will be performed
in accordance with ASTM D-6938 (nuclear gage method) and follow frequencies set forth in the construction
documents and pmject/City Quality Control Plan (QCP), if any. Leighton can provide daily field reports and progress
reports, if needed. These reports may include the following:
■ Daily field reports (DFRs) will be prepared and distributed on the same day or the following day to you or
your CM, or when needed. These reports and any field photographs of construction progress will be
maintained for the project team's ready reference. Our DFR is typically prepared electronically and can
submitted or emailed in a short notice. A sample report showing the type of information typically included in
our DFR is presented as Exhibit 1. This report typically includes information such as test results, location
and depth, and other pertinent field observations, etc.
■ Laboratory test reports as requested or needed during construction.
■ Interim compaction reports to approve final subgrade or trench backfill prior to placement of Aggregate Base
and pipeline testing, if needed.
• Final compactiontsoils report can be provided at completion of work to summarize our observations and
present density tests taken for various aspects of the project. This table can be customized and specific for
various elements of the projects. This table can also keep track of any failing tests and confirming test results
and frequencies of tests taken by the QC technician.
Leighton project manager/engineer will provide timely, same -day, corrective and/or remedial recommendations that
may be needed due to site conditions, materials, or contractor methods.
Materials Testing: Leighton will perform QA materials testing in accordance with the contract documents and as
requested by the CM. This testing is expected to include, but may not be limited to, the following:

a Asphalt Testing. Verify HMA Mix Design and perform CIA testing that will typically include extraction,
gradation, bitumen content, Hveem or Stabilometer. Laboratory testing will also be performed on collected
import or batch plant samples to verify conformance with the project specifications.
■ Aggregate Base: Tests will comply with applicable City standards, "Greenbook" and the Special Provisions
for this project and may include Gradation, Durability Index, R-Value, and Sand Equivalent. Laboratory
testing will also be performed on collected source and onsite samples to verify conformance with the project
specifications
During the course of the project, Leighton will maintain and provide to the City, when required, records of sampling
and testing for the project that may include the following:

Cost effectiveness/budget control: Our approach is to provide a thorough review of the project documents and
include sufficient time for our engineers and techniciantinspectors to perform the necessary services and be able to
foresee or deal effectively with arising issues. We consistently provide our clients cost savings by minimizing
construction delays and change orders related to unexpected soils and materials issues. As a standard in-house
procedure, our project managers always closely monitor field activities with an eye toward mitigating redundant field
inspection and testing time to stay within budget.
