REQUEST: Adopt Resolution No. 2019- 23 approving adjusted rates for
Burrtec Waste and Recycling Services (Burrtec) under Contract
No. C27410; and requesting the County of Riverside collect the
associated costs for individually billed residences on the Tax
Assessor's Property Tax Roll for Fiscal Year (FY) 2019-20.
Recommendation
1. Conduct a public hearing and accept public comment related to collecting the solid
waste and recycling service charges for individually billed residences for FY 2019-
20 on the County of Riverside Assessor's Property Tax Roll, and related items
stipulated therein; and following public testimony, close the public hearing.
2. Waive further reading and adopt Resolution No. 2019- 23 , approving adjusted
rates in Exhibits 3A, 313, 3C, and 3D for Burrtec under Contract No. C27410; and
requesting the County of Riverside to collect the associated costs for individually
billed residences on the Tax Assessor's Property Tax Roll for FY 2019-20.
3. Authorize the City Manager to execute any documents necessary to effectuate the
actions taken herewith.
Strategic Plan
The proposed action has no impact on the Strategic Plan.
Background Analvsis
The City of Palm Desert contracts with Burrtec for integrated solid waste management
services through a Franchise Agreement that was amended May 28, 2015. Each year
this agreement allows Burrtec to request a rate adjustment for services based on an
increase in the Producer's Price Index (PPI) for Furnished Goods, and pass through
increases in disposal costs. For FY 2019-20 Burrtec has requested a rate increase based
on both PPI and disposal cost increases.
The rate adjustments for residential, commercial, and roll -off box rates are calculated
using formulas established in the Franchise Agreement. The percentage increase in PPI

from December 2017 to December 2018 is 1.40%. For FY 2019-20 Edom Hill Transfer
Station is increasing the Refuse Tipping Fee by 2.99%, from $47.55 to $48.97 per ton;
and increasing the Green Waste Tipping Fee by 4.35%, from $46 to $48 per ton. The
amount of the rate increase for these factors is calculated by multiplying the percent
change in each of these components by the percentage of revenue associated with them,
creating a weighted rate adjustment for each.
The total weighted rate adjustment for residential rates for FY 2019-20 amounts to
1.852% (1.054% for the service component based on PPI plus 0.798% for the disposal
component based on increases in the disposal tipping fees). A detailed listing of the
current and proposed residential rates is included in Exhibit 3A. Below is an example of
the increase in terms of dollars:

Note: Customers with manual curbside collection or higher service demands will pay a
higher fee. Residential recycling service is provided at no cost.
Staff recently discovered that the Manual Curbside Collection Fee for individually billed
customers was miscalculated during the FY 2016-17 rate adjustment. The error resulted
in the rate reflected on the rate sheets being $0.07 less than the correct rate. Staff
proposes correcting this error in FY 2019-20 resulting in a slightly higher increase to this
rate than the other rates (a total increase of 2.366% instead of 1.852%). The rate sheet
attached includes the corrected monthly rate of $14.28 effective July 1, 2019, increased
from the current monthly rate of $13.95.
The total weighted rate adjustment for commercial bin rates for FY 2019-20 amounts to
1.824% (1.027% for the service component based on PPI plus 0.797% for the disposal
component based on increases in disposal tipping fees). A detailed listing of the current
and the proposed commercial bin rates is included in Exhibit 3B. Below is an example of
the increase in terms of dollars:

The proposed roll off service rates are calculated by increasing the current rates by the
PPI amount of 1.40%. A detailed listing of the current and the proposed roll off service
rates is included in Exhibit 3C.
The City implemented a Commercial Foodwaste/Organics Program in FY 2017-18 to
comply with Assembly Bill 1826, which requires certain businesses to recycle their
organic waste. A breakdown of how the fees are calculated is included in Exhibit 3D. The
proposed commercial foodwaste rates for FY 2019-20 are adjusted by an increase in both
the PPI (1.40%), applied to the recycling collection component of the rate, and an increase
in the disposal tipping fee (8.33%), applied to the service collection component of the
rate. Below is an example of the increase in terms of dollars:

On April 23, 2015, the City Council approved the implementation of billing residential
services for all individually billed (non -master billed) residences through the County of
Riverside Tax Assessor's Property Tax Rolls. Individual billed residences exclude any
master billed residences, where a homeowner association pays the costs for its residents.
A copy of the written report containing the listing of all residences included in this billing
and the rates assessed is available for public review in the Office of the City Clerk. In
order to continue this process, the County Tax Assessor requires the City Council to adopt
a resolution annually requesting the costs be placed on the tax rolls. The City is also
required to hold a public hearing each year to allow impacted residential property owners
an opportunity to voice their concerns in regards to the placement of this billing on the tax
roll.

As the request is authorized by the current Franchise Agreement, staff recommends
approving the adjusted rates as shown in Exhibit 3A, 3B, 3C, and 3D; and adopting the
proposed resolution authorizing tax roll billing.
Fiscal Analvsis
Approval of the rate increases will not directly impact the City's General Fund. Authorizing
tax roll billing for individually billed residences allows the City to continue to collect
revenue per the Franchise Agreement, through a tax roll billing credit of $1.06 per
customer enrolled ($0.73 to the Recycle Fund and $0.33 to the General Fund).

PUBLIC HEARING ON FILING A REPORT REGARDING
THE CITY OF PALM DESERT'S ANNUAL SOLID WASTE
AND RECYCLING SERVICE CHARGES FOR FISCAL
YEAR 2019 — 2020, AND CONSIDERATION BY THE CITY
COUNCIL TO ADOPT THE REPORT AND ELECT TO
COLLECT SUCH CHARGES ON THE TAX ROLL
NOTICE IS HEREBY GIVEN, pursuant to Calif omia Health and Safety Code section 5473
et seq., that the City of Palm Desert (the "City") has caused a written report to be filed
with the City Clerk of the City describing each parcel of real property receiving City Solid
Waste and Recycling services and the amount of the Solid Waste and Recycling service
charges to be imposed on each parcel for Fiscal Year 2019 — 2020, computed in
conformity with the charges prescribed by resolution of the City, and any delinquencies
due and owing for such charges for each affected parcel. A copy of the written report is
available at the City Office located at 73-510 Fred Waring Drive, Palm Desert, California
92260, California, and may be reviewed there by any interested person. NOTICE IS
FURTHER GIVEN that a public hearing has been scheduled for May 23, 2019, at
4:00 p.m., in the City Council Chamber in the Civic Center, located at 73-510 Fred
Waring Drive, Palm Desert, California 92260. At the public hearing the City Council will
hear and consider all evidence, testimony, objections, or protests, if any, to the written
report by all interested persons, and may continue the hearing from time to time. If the
City Council finds that protest is made by the owners of a majority of separate parcels of
property described in the report, then the report shall not be adopted and charges shall
be collected separately from the tax roll and shall not constitute a lien against any parcel
or parcels of land. Upon conclusion of the hearing, the City Council may: (1) adopt, revise,
change, reduce or modify any charge, or overrule any or all objections and make its
determination upon each charge as described in said report which determination shall be
final; (2) adopt the report as presented or modified by the City Council; and (3) direct the
City Manager to file a copy of the report as presented or modified with the Auditor of the
County of Riverside for the purpose of placing the Fiscal Year 2019 — 2020 Solid Waste
and Recycling service charges and any delinquencies on the tax roll.
All interested agencies, groups, and persons wishing to comment are invited to attend the
public hearing. Interested parties should appear at the above set public hearing to provide

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING THE ADJUSTED RATES IN
EXHIBITS 3A, 3B, 3C, AND 3D FOR BURRTEC WASTE AND
RECYCLING SERVICES UNDER CONTRACT NO. C27410 FOR
INTEGRATED SOLID WASTE MANAGEMENT SERVICES; AND
REQUESTING THE COUNTY OF RIVERSIDE COLLECT THE
ASSOCIATED COSTS FOR INDIVIDUALLY BILLED RESIDENCES ON
THE TAX ASSESSOR'S TAX ROLL FOR FISCAL YEAR 2019-20.
THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINDS,
DETERMINS, RESOLVES AND ORDERS AS FOLLOWS:
WHEREAS, on May 28, 2015, the City Council approved an Amended Franchise
Agreement with Burrtec Waste and Recycling, LLC to provide solid waste collection and
recycling services to the residents and businesses within Palm Desert. The term of this
agreement is June 1, 2015, through May 31, 2023; and
WHEREAS, the Franchise Agreement establishes rates for solid waste and recycling
services within the City of Palm Desert. These rates may be adjusted annually, as set
forth in the agreement, commencing on the second year of said agreement. Rates
adjustments may be applied at 100% of the PPI with a 5% cap, unless otherwise
approved, and to become effective July 1 st of each year; and
WHEREAS, the City Council approved the implementation of the Vehicle Impact/Road
Maintenance Fee effective July 1, 2016; and
WHEREAS, the City Council approved the implementation of the Recycle Fee effective
July 1, 2017; and
WHEREAS, the City Council approved the implementation of a Commercial
Foodwaste/Organics Recycle Program effective July 1, 2017; and
WHEREAS, effective July 1, 2019, Edom Hill Transfer Station will increase the Green
Waste Tipping Fee by $2 per ton, from $46 to $48; and increase the Refuse Tipping
Fee by $1.42 per ton, from $47.55 to $48.97. These fee increases are proposed to be
passed -through per the Franchise Agreement and are included in the proposed rates in
Exhibit 3A, and 313; and
WHEREAS, effective July 1, 2019, the foodwaste disposal tipping fee will be increased
by $5 per ton, from $60 to $65. This fee is found to be within a reasonable range of
comparable facilities and as such are allowed to be passed -through per the Franchise
Agreement, and is included in the proposed rates in Exhibit 3D; and

WHEREAS, the collection of refuse service fees for single-family residential properties
may be collected through the County of Riverside Tax Assessor's Tax Rolls in
compliance with all laws pertaining to the levy of the assessment, and as authorized by
City of Palm Desert Code Section 8.16.110. These charges are levied without regard to
the property valuation; and
WHEREAS, commencing July 1, 2015, to June 30, 2016, the City approved the County
of Riverside to collect fees for solid waste and recycling management for individually
billed residences on the Tax Assessor's Tax Rolls, until such time as rescinded; and
WHEREAS, a copy of the written report containing the listing of all residences included
in tax roll billing and the rates assessed is available for public review with the City
Clerk's Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PALM DESERT,
CALIFORNIA AS FOLLOWS:
1. The foregoing recitals are true and correct.
2. The proposed service rates for solid waste and recycling management services
provided by Burrtec Waste and Recycling Services, LLC, as reflected in Exhibit
3A, 3B, 3C, and 3D, are hereby approved to take effect July 1, 2019. All other
rates, fees, services, remain in accordance with the Franchise Agreement
currently in effect.
3. The City Council hereby requests the Riverside County Tax Assessor to place
the collection of costs for solid waste management services for individually billed
residences on the County's tax rolls.
4. Burrtec will pay to the City $1.06 in a tax roll billing credit to the City, to be
divided $0.73 to the Recycle Fund and $0.33 to the General Fund.
