REQUEST: Accept partial improvements to Dinah Shore Drive and Portola
Avenue and the release of $344,813 of the Faithful Performance
bond and $172,406 of the Labor and Materials bond for Parcel Map
(PM) 36792.
Recommendation
By Minute Motion:
1. Accept partial improvements to Dinah Shore Drive and Portola Avenue.
2. Release $344,813 of the Faithful Performance Bond and $172,406 of the
Labor and Materials bond for PM 36792.

This action has no impact on the Strategic Plan.
Background
The Millennium project is a multi -phased, multi -use commercial and residential project
located at the comer of Gerald Ford Drive and Portola Avenue. In 2015, at the time of
map recordation, a subdivision improvement agreement and bonds for off -site
improvements to Dinah Shore Drive and Portola Avenue in the amount of $2,906,577 for
Faithful Performance and $1,453,288.50 for Labor and Materials were submitted for PM
36792. Construction for the Millennium Project has been ongoing since the submittal of
bonds. In 2017 and 2018, City Council approved partial releases of the bonds.
Substantial work has been completed to off -site improvements since 2017. The developer
has submitted a new engineer's estimate and quantifies the cost of the remaining work to
be $266,659 for Faithful Performance and $133,329.50 for Labor and Materials. The
Public Works Department has reviewed and approved the estimate as accurate.
Staff recommends that the City Council authorize the acceptance of partial improvements
to Dinah Shore Drive and Portola Avenue and the release of $344,813 of the Faithful
Performance Bond and $172,406 of the Labor and Materials bond for PM 36792 bringing
the total bond amount the City of Palm Desert is holding to $266,659 for Faithful
Performance and $133,329.50 for Labor and Materials.

Fiscal Analvsis
Per the conditions of approval for PM 36792, the developer is required to maintain the
median islands on Dinah Shore Drive for five years. It is the responsibility of the City to
maintain curb, gutter, sidewalks, curb ramps, and other off -site improvements within the
City's right-of-way. Maintenance costs are accounted for in the operational costs budget
in account number 1104310-4332000.
