C35520B STAFF REPORT _1 CITY OF PALM DESERT PUBLIC WORKS DEPARTMENT MEETING DATE: January 11, 2018 REQUEST: Request for authorization to reject prequalification package submittal from design-build entity, and solicit proposals from professional engineering and design firms for the design of the San Pablo Avenue Corridor Improvements (Project No. 691-16). Recommendation By Minute Motion: 1. Authorize staff to reject prequalification package submittal from the design-build entity for the design and construction of the San Pablo Avenue Corridor Improvements (Project No. 691-16); and 2. Authorize Staff to solicit proposals from professional engineering and design firms for the design of the San Pablo Avenue Corridor Improvements; Funds are available in Account No. 4514342-4400100, SARDA Bond Project Funds. Strategic Plan The improvements to the San Pablo corridor fulfill priorities identified in the City's Strategic Plan, including the following: • Land Use - Priority 4: "Create a mixed-use city core integrating shopping, dining, lodging, and housing." • Tourism and Marketing — Priority 1: "Improve access to Palm Desert and its attractions to enhance the ease of lifestyle." • Transportation — Priority 1: "Create walkable neighborhoods and areas within Palm Desert that would include residential, retail, services and employment centers, and parks, recreation and open space to reduce the use of low occupancy vehicles." • Transportation — Priority 3: "De-emphasize single/low-occupancy vehicles and optimize modes of travel (bus, carpool, golf-cart, bicycle and pedestrian)." January 11, 2108 - Staff Report San Pablo Avenue Corridor Improvements Page 2 of 2 Background On July 13, 2017, the City Council approved the preliminary design for the San Pablo Avenue Corridor prepared by Sargent Town Planning. The plan represents the collective efforts of the San Pablo team, and has been vetted by the City Manager, Public Works Director, and Community Development Director. The City Council also directed staff to prepare final construction drawings. A decision was made to explore moving away from a standard design-bid-build contract to a more inclusive, expeditious design-build contract approach. Staff worked with legal counsel to vet the design-build contract process, and asked for guidance on the best method to proceed. Legal counsel identified a two-step method for proceeding with the design-build contract as a viable alternative. The first step in the process was to issue a Request for Qualifications (RFQ) to solicit qualified design-build entities. The second step in the process would be to issue a Request for Proposals (RFP) to only those firms that have been pre-qualified. The two-step process works best if multiple design-build teams submit prequalification packages and proposals. Unfortunately, the City only received one prequalification package from a design-build team. One team does not allow for competition during the proposal phase. Staff discussed the one team dilemma with legal counsel and explored methods for moving forward. Staff has concluded that the best method to move this project forward while getting competitive pricing for the work is to revert back to the standard design-bid-build contract procurement. Fiscal Analysis The total project cost is currently estimated to be approximately $10 million.
