Request for Reimbursement of Building Permit Fees to Comstock
Crosser & Associates consisting of inspection fees for Projects
Number #17-72059 (4011 Via Carrarra) in the amount of $4,164.93,
#17-72057 (4105 Via Tramonti) in the amount of $5,420.64, and
#17-72058 (4105 Via Cararra) in the amount of $5,420.64. Total
refund requested is $15,006.21, for the Villa Portofino project.
By Minute Motion, approve the request for reimbursement to Comstock Crosser
& Associates of building inspection fees for Projects Number #17-72059 (4011
Via Carrarra) in the amount of $4,164.93, #17-72057 (4105 Via Tramonti) in the
amount of $5,420.64, and #17-72058 (4105 Via Cararra) in the amount of
$5,420.64. Total refund requested is $15,006.21, for the Villa Portofino Project.
If the above action is approved, funds will be available in Account Number
1100000 2220000.

Executive Summary
Building Permit Fees of $15,006.21 were paid by Comstock Crosser & Associates. The
City received a revised refund request via email on October 2, 2017. A refund cannot
be issued if Willdan Engineering's invoice is not paid. It was not paid at the time of the
request. On December 4, 2017, we learned that the Willdan Invoice was paid, therefore,
the refund request could move forward to the City Council for approval.
Background Analysis
Mr. Robert W. Comstock of Comstock Homes requested in a meeting with the previous
City Manager, John Wohlmuth, that Comstock Homes be allowed to enter into a "Third
Party Inspection Agreement." This agreement allowed a full time inspector on the site at
all times in hopes of accelerating completion of the Villa Portofino project. The City
entered into an agreement with Comstock Homes on March 21, 2014, which allowed
Comstock Homes to contract with Willdan Engineering to provide third party inspection
services for the Villa Portofino project.

The fees requested for reimbursement are only those fees that were collected to cover
building inspections. The refundable building inspection fees are as follows:

THIS AGREEMENT is made and entered into this 2111 day of March. 2014 by, between and
among Wilidan Engineering, a California corporation (Inspector), the City of Pahl Desert,
California and Comstock Hones ("Appficanr).
RECITALS
Whereas. City Of Palm Desert is agreeable that Applicant may contract directly with a qualified
third party engineering firm to perform Inspection services on behatf of the City;
Whereas, Applicant desires to enter into a third party agreement with Inspector to perform such
services;
Whereas, Inspectors are experienced In providing such services far municipal corporations and
is able to provide experienced personnel to carry out the duties involved;
NOW, THEREFORE, in consideration of the covenants and premises herein stated, it is agreed
as follows:
A. Applicant intends to construct Housing Tract (hereinafter the "Project"). Inspector agrees to
perform the following services for Applicant with respect to the project Inspection In
accordance with ICC Buildtlne Standards Codes. City of Palm Desert Ordinances and
other applicable Standards.
B. inspector shall be compensated for such services by direct payment from Applicant
Notwithstanding that Applicant is to compensate Inspector directly, it is agreed that Inspector's
duties with respect to this project are to State and City requirements and not to Applicant The
compensation shall be as follows: Hourly rate of 595. Such compensation to Inspector shall
not be in lieu of other fees as may be charged by the City.
IN WITNESS WHEREOF, the parties execute this agreement upon the terms and conditions
stated above and the "PROVISIONS OF AGREEMENT' following the signatures below.
