Mr Ceja,
We are oppossed to this GIANT Structure called the Sands Apartment Project.
My husband and I are residents of the Venezia Community, we purchased our home in May of 2014. At the
time of purchase we were assured that the project next door would be a mirror image of the Cantarra Apartment
Complex. How has this gotten so out of control? Has the City has not taken into consideration the amount of
revenue it will loose on the valued property taxes of the surrounding TAX PAYORS! I am sure we will ALL
now apply for decline in value! Shame on those that decided to change the zoning on an already existing
housing community.
PLEASE RECONSIDER THE THREE STORY STRUCTURES IN THE SIGHTLJNE OF THE VENEZIA
COMMUNITY.

As a current board member on the Portola board, a former assistant GM and Controller at Palm Desert
Marrakesh Country Club and current Director of Finance at Heritage Palms in Indio I am appalled at the greed of this
project being developed behind Portola. It was previously approved as a two story project and that has morphed into a 3
story development. Let's get it done as it was originally planned and eliminate this unnecessary issue. Being close to our
walls as well as the school presents all kinds of problems as I am sure you have previously heard. We are tax paying
citizens as well as voters and this entire mess is uncalled for because a developer got greedy. Let's do the right thing this
time.

My name is Diana Ritz, I am a resident at Portola Country Club. I am sending this email in protest to the
excessive and intrusive development plans submitted by New Cities Investment Partners LLC, who purchased
in 3/2017. I was extremely disappointed at your last city planning committee meeting!
It was clear the moment city attorney spoke that our voices were to be heard by deft ears. It was also clear to
me that Newell and Moran are cooperating with each other.. especially since New Cities purchased this land last
year from Canterral.. Take a look at the recorded title, this property was also a Non -Arms Length transaction
between the two as stated on the title! Also, the Environmental Impact statement commission accepted was
done by a company hired by New Cities, certainly the company they hired would be biased. As a tax payer it is
the responsibility of the city to verify the legitimacy and obtain an unbiased report.
The development they are requesting is a huge negative to the nearby residents, school, traffic load. I
understand the City of Palm Desert stands to gain financially by cooperating with HUD however this is at the
expense to the residents who pay taxes and employ the city representatives!
To allow a development with plans to build 2 and 3 story buildings is beyond incomprehensible and not even
addressing the excessive unit numbers! I encourage you to visit our property and take a good look at 1) how the
height of buildings will block the beautiful Mountain View we as homeowners PAID for, and the reason we
came to palm Desert 2) the excessive noise level this will add to what is currently a quiet neighborhood 3) the
intrusiveness to our privacy as these building heights will tower over the surrounding properties, which are
NOT COMMERCIAL but Residential!
I understand the city must seek sources to improve financial resources BUT not at the expense of
developments/residents who are long term city supporters! Certainly Portola CC is! In addition, developer must
be responsible for building a higher wall, clarify planting more mature soft scrape, insure liability to
surrounding properties for any damage caused by construction.
As a Realtor 1 respect this developers rights and desire to develop for profit, but this should not be at the
expense, infringement and disrespect to existing residents. I ask the city reduce the total of units and reduce the
heights of the development to protect the beauty and desirability of this city and respect the current residents!

I send this to you with utmost respect and appreciation...I find it hard to believe this wonderful city of Palm
Desert would think it in the best interest of residents and property owners to go ahead with this project, as
planned. Has the following been taken into serious consideration:
1) A THREE -story project in an area of non-existent three-story buildings.
2) Drought and water conservation in our valley.
3) Current safety hazards of traffic back-up onto Portola for elementary school drop-
off and pick-up will become even more severe.
4) Quality of life, property values and aesthetic impact for those of us who live nearby.
I implore you and those in a position to do so, to reconsider this dreaded project. Shame on you all for
considering going ahead with it as planned.

Eric, I was very disappointed at the recent planning commission meeting. Not only with the result but to me what
appeared to be lip service paid to the many people who came to speak against the development. For example, why was
the developer allowed to defer his comments until after all opposing people in the audience spoke? Why weren't a few
people opposing the development not allowed to speak again to respond to the developer?
After hearing the developer speak, I could not help but wonder why he negotiated with Cantera I and not with Via Venezia
and Portola Country Club. Could it be because of a potential conflict of interest? That is, from the developers comments,
I understand that the land for Cantera I and the land for the new development are owned by the same entity. Also, I
understand from the developers comments that the management company for the new development will be the same as
for Cantera I. To my there is indeed a conflict of interest, if not actual, then certainly a perceived conflict. Because of
this, it certainly seems to have been in the developers best interest to have a negotiated agreement with Cantera I but no
incentive for them to do the same with the Via Venezia or Portola Country Club.
Since the developer could not be unbiased to all 3 communities, why did the planning commission not force it upon the
developer to negotiate with the other 2 communities to come up with a solution that everyone could live with? Wouldn't
that have been a much better result than having people from 2 long-standing established communities upset? Is this the
way Palm Desert plans to move forward - coming out on the side of developers and not caring about the impact on
existing communities?
I trust you will forward my comments on to city council for their upcoming review of this project.

Eric, thank you for your response. I did not respond further at that time because I thought the project was on hold or
canceled. I heard very recently that the project was still on the books to proceed.
As a home owner in Portola Country Club I remain opposed to this project.
- A new development should not be allowed to alter the aesthetics (and hence property values) of 2 long standing and
established communities of Venezia and Portola Country Club. The height of the new development will block views from
these 2 communities and will allow for unfettered peering from 3rd story apartments into the 2 existing communities.
- There will be huge impact on the already bad traffic flow in the area of Portola and Hovley East. Have you been there
around the time school is dismissed in the afternoon? I recently drove north on Portola and tried to turn right on Hovley
Lane East. There were cars blocking the right lane on Hovley all the way from the school to Portola and the outside right
turn lane from Portola was also completely blocked. Luckily I was able to use the inside right turn lane but I proceeded
extremely slowly as I was not sure whether another vehicle would veer into my lane or a child would run out. This is
already an accident waiting to happen without the additional traffic brought on from a large new development. To
someone who does not realize that people are waiting to pick up children at the school or that there are 2 right turn lanes
from Portola onto Hovley E, they will be extremely frustrated and we all know what frustrated drives can do!
Please remember that just because the Palm Desert general plan allows for and state law calls for concessions when low-
cost housing is proposed, not all projects that request the concessions are warranted.

Mr. Ceja,
I'm writing this email to express my opposition to the plans of the Sands Apartments. The vacant
property is going to be developed, and it should be developed.
However, the developers of that vacant piece of property should not be given the opportunity to build
higher than two stories. If special concessions were made to allow this developer to build three
stories by past council, I suggest you find a way to reverse that. Offer some other incentive. It
appears the developer managed to get the upper hand in this deal. I hold the City Council
responsible for that. The jobs of city council are to protect the constituents from aggressive
development.
Why does this little patch of Palm Desert get three stories for apartments? Why?
Why does this developer not need to provide a landscape barrier between the new and existing
properties that surround the lot.
Are not all developers held to the same standards and regulations?
I strongly encourage you to deny the three story buildings.

Dear Mayor and Members of the Palm Desert City Council,
We are residents of Palm Desert and Portola Country Club, and we're writing to request your help in
safeguarding the privacy and quiet enjoyment of our neighbor families, especially those living on the
north side of our community.
With your help, our families can continue to make private use of their backyards, be free from others
peering into their windows and enjoy their home as they have until now.
Although our families do not have children, we are families nonetheless, a factor which may have
been overlooked in previous considerations of this project.
To that end, we ask for you to help in these ways by requiring the builder to:
1. limit the project to two stories, and 2. set the foundation of the project so this it is level with the
street, and 3. build a wall and plant trees tall enough on the south wall of the project to enhance the
privacy of our north border families, and maintain those trees regularly, and 4. provide detail plans of
these specifics to the City Council prior to commencing the project, also allowing the City Council
further time to consider the needs of the surrounding family communities.

? 3 story buildings do not belong on the lot on Hovely. The lot was originally desZgna'ted
for 2 story buildings as Canterra next door is and I have absolutely no problen with T
that. 3 story buildings will be totally inappropriate at this location when all the
surrounding communities in any direction are one story for the most part and two story
and you are talking 40 ft buildings that will tower over everything. I do understand the
city has an obligation for low cost housing and we definitely need it but this site is not
the appropriate site to try to cram your obligation for that into it. Make all 306 units
low cost housing and that would be wonderful. The designation on the City Plan is a
Town Center site for the Canterra and Sands lot. In no way does the description of
these two properties fit into what the City Plan describes as a Town Center. These two
lots are wedged in between long standing neighborhoods, a school and a resort. There
are no stores, not even any street parking that you could conceive a vision of a town
center as it was rezoned to . Please consider leaving the Sands project the two story
project that was originally intended. If that cannot be done, I would like to see
building 11 & 8 moved to the front of the property to replace 1 & 6.
? Portola Country Club is to the south of the site and the existing wall is six feet or
under. The Canterra wall is 8+ ft and I request the developer continue the 8 ft wall so
the PCC neighbors at least can continue to have some privacy and the quiet
neighborhood they have enjoyed. While the planting buffer will be great, planting
should be done early in the project to allow the plants/trees to be at least higher than
the wall. Putting in 24" box plants will not achieve a decent height for about 4-5
years. Landscape buffer needs to be maintained by current owner or future owner and
plants replaced if removed or die so it remains as planned and approved. Canterra has
removed trees that make the 2nd story units very visible in Portola now.
? The current site has huge sand dunes from front to back and will require a lot of
earthmoving to bring the site down to the proposed grade level. All this earthmoving
may cause vibration damage to our homes and we request funds put aside or an
insurance policy available to cover such damage without us having to hire an attorney

to take care of issues that arise. My neighbors home had damage occur during the
Canterra construction and they experienced cracks in walls and windows.
For this meeting, 1 don't think this project should be approved as it was sent from the
Planning department, and request you delay the vote while the concerns and ideas of the
neighboring properties can be given the same consideration as the developer was
given. This whole project started off with little transparency to surrounding neighbors. The
initial 2 meetings of the Planning Dept were held in the summer months when population was
down. Canterra's owner and the Sands developer worked out their issues to address their
concerns just prior to Planning meetings however Portola Country Club did not have the same
opportunity with the developer and we will be living here with whatever is done now and he
will be down the road to Oakland while we live with it.

I have attended all the past meeting but am unable to do so tonight. I have a few comments...Your citizens are
exhausted trying to get the planning commission to at least put us on equal ground in importance as the Sands
developer. We are vehemently opposed to all the 3 story buildings that will shadow our community.
Our thoughts and common sense approach to this matter has been largely ignored by the commission. You are the last
refuge of hope we have against the damage this will cause to our neighborhood.
Please don't be part of the collective tyranny that opposes the wishes of our community.

I cannot attend your meeting since I work, but I have serious concerns about the project. These concerns will
undoubtedly be ignored since money talks and the developers have the money.
Traffic is already a problem on Hovley Lane East, particularly when parents are dropping their kids off at Carter
Elementary School. Those of us living in Canterra Apartments it's extremely difficult to make a left turn
without waiting a ridiculously long time. I, for one, have to turn right, go to Cook Street, turn left and
backtrack to Country Club then to Monterey to get to work on Hwy. 111. The addition of this development
(can you say monstrosity) will make the traffic far worse and will create safety issues for the children and
everyone trying to be on that narrow road all at the same time. If the developers are so gung ho about putting
this in, collecting their money and hiding in their mult-million dollar homes, then they can address the traffic
and safety issues by installing a traffic signal at the entrance of their development paid for out of their
pockets. They cannot be allowed to use the old excuse, "it's not our problem". Yes it is.

Thank you for your time. Since last May we've brought up
concern after concern.. traffic , school class size, water
shortages, fire safety and noise to name a few. We've heard
answers from staff for all of them.
To solve the traffic problem a stripe of paint was applied on
portola to make 2 right hand turn lanes which eliminated the
bike lane there at Hovely. We've been told the new children
will walk to Carter and other children can be uprooted and
attend different schools if necessary.
We know the city is going to proceed with this project and it's
been amended somewhat to suit Canterra and Venezia, but
there have been no concessions for the 500 homes at Portola
CC, some of which have been there since 1970. We hope that
after listening to our ideas you will be able to amend the plan
even more to help Portola live with the outcome. I also hope
you won't rush into a decision tonight ... you have other big
projects coming up soon like Palm Desert CC... but please give
our ideas the consideration they deserve.
1..No 3 story buildings, but if there must be, how about one
Tess, Mr Newell knocked down one building to 2 stories at the
last meeting in the blink of an eye... or start them at a lower
grade, or reduce the height from 40, or change the roof line
check out the roof line at The Enclave apartments.
2. Install an additional wall between 8 and 12 feet depending
on the grade..with my 6 ft wall I can see into 6 apartments at
Canterra 250ft away.and vice versa.the new ones will be only
103 feet away so I can only imagine.
3. Start the Portola landscape buffer with more mature
trees..Use 48" box rather than 24" and plant them ASAP so
by the time the units are occupied, our buffer will have filled
in..this will help offset the ambient heat caused by asphalt,
carports and rooftops.
4. Name Portola and Venezia as additional insured members on
his insurance policy, make us not liable to pay a deductible, so
that if there is damage to our homes we don't have to retain
lawyers to pay for repairs..we encourage the developer to take
photos of our properties beforehand to protect himself. We
are not looking for a windfall here, just fairness and
protection. We hope collecting funds won't be necessary, but
it happened when Canterra was built.
5. Guarantee a line item that says the landscape buffers will
be maintained and replaced as needed, even if ownership
changes hands. Trees have been removed from Canterra and
never replaced.
6. If building 4 is still two stories, swap 11 and 7. If building 4
remains 3 stories, swap 11 and 6.
7. Move to postpone your vote to an upcoming meeting because

Subject: Sands Apartment Project Resolution 2018-18
My Name is Loren Campbell and I live at 74051 Via Pellestrina. I am here tonight because I
oppose the three story buildings in the proposed plans, especially as they adjoin Venezia.
This conflict was created when the City approved the new Town Center Neighborhood that
allowed 3 story buildings immediately next to golf and resort homes; creating this edging
challenge. The Developer has made some concessions to date, but far too often our requests
have been answered or filtered by Eric without even presenting them to the Developer. The
fact that Eric said the Developer was unwilling to meet with us is bothersome, sounds like he's
already decided the Project is approved. Now we need to find a solution...
It was mentioned at the last Planning Commission Meeting that a better approach would have
been to have workshops where the City, the Developer, and the neighbors work together to
try to find the best solution. The Commission agreed that would have been a better process, as
have some of you. While it is unfortunate that this process was not adopted before now, it's
not too late to do it now.
Put the stakeholders in a room to work out a solution and amazing things can happen. You
should note that Canterra and the Developer were able to reach an agreement in just a couple
of hours once they sat in a room together back in February.
While I do not want any 3 story buildings in the Project, I especially do not want them on the
Southern portion of the property bordering our Single story neighborhoods. I believe there is
a better way to place the 384 units Mr. Newell needs on the land available, but the best
solution requires everyone working together.
We've heard a lot of good ideas already, but very likely the best solution is still waiting to be
discovered in a brainstorming session.
The City has an opportunity to make a better decision on this plan, I urge you to direct the
Developer, the surrounding neighbors, and the City to meet together so you can vote on a
better plan at your next meeting.

My name is Jose Martinez and I live at 74051 Via Pellestrina with my husband, Loren Campbell.
I brought in 2 large photos of our common areas in Venezia, in the photos you can clearly see
the 2 story Canterra apartments, which are 200 yards away (2 football fields).
I'm here today to ask you to stop the 3 story buildings proposed that will be adjacent to our
two well established single story neighborhoods. When most of us invested and purchased our
home, we were aware that someday, Phase 2 of Canterra would be built, with only 2 stories. I
can confidently say the #1 issue for most of us in this room are the 3 story buildings -that is
what brought us all together.
I believe that the City Planning Department has been biased throughout this project in favor of
the Developer. For example, I find it very misleading, and slightly offensive that the Staff
Report in front of you tonight, and what was presented last month at the Planning
Commission would list one of the key concerns were objections to affordable housing. I
understand the need for affordable housing, I grew up in low income neighborhoods. I also
know that my neighbors feel the same way.
We need to find great solutions for all of us, I have a couple ideas...
• If the buildings were reduced to 2 stories, could the loss be made up by reducing the
square footage of each unit, adding more units and making up the loss of the third floor.
• Could some of the open space or amenities be reduced in size or eliminated to add
more units?
• If we are left with the need for some 3 story buildings, why can we not place the 3 story
buildings next to the existing Canterra's 2 story buildings. Fairness is what we're looking
for, and it seems fairer to put buildings of similar heights next to each other so that
adjacent buildings only go up 1 story at a time, not 2. (Example: Single story building
next to a 2 story, 2 story next to a 3 story)
I urge you to continue this hearing till April 26, and ask that the Dev h er work with all their
neighbors to find a better common sense solution.

Thank you for the opportunities you have given us to meet with you not only personally, but during public R'
hearings. It has been a gut -wrenching process, hearing soon that our beloved home will be adjacent to the tallest
apartment buildings in all of Palm Desert. The concerns over loss of privacy, views, and property values are
real.
My husband and I moved from Connecticut and chose Palm Desert after reading news of Palm Desert's
commitment to education by donating land for the university so that the valley's young people wouldn't have to
leave town for a college degree. Truly this remains a source of pride for Palm Desert!
I volunteered for 2 years at the Palm Desert Library teaching beginning computer classes to predominantly
senior citizens. (Attended two very nice luncheons as a thank you from the City.) With Portola CC being 55 and
older, and many of Venezia's residents new to Palm Desert, I understand why we didn't know any specifics for
the "Revised General Plan." Most wouldn't know how to "surf' the City's website. You need to know what
you're looking for, and then you must sort through an exhaustive list of meetings to find out which items were
covered during which meetings. Countless hours are spent with little success, and most don't have the patience
for it.
Most do know about the planned revitalization of downtown and the CV Link thanks to press coverage, the
Council's State of the City address and the Coffee with the Mayor at El Paseo. Sadly, the press did not cover
zoning going to 3 stories in some residential area, or changes in the zoning designation next door. Our
communities were only aware of the existence of the "Canterra II" long term agreement next door (306 units, 2-
story buildings) which was for 30 years, until 2019. And except for Ariana Boutique Apartments on Deep
Canyon, which was built in 1978, before most of nearby developments existed, there are no other 3-story
apartments.
Clarification of the Revised Plan has not seemed that transparent. Maybe those who are in public office tune in,
but so many of us are retired and are enjoying the peace and quiet of retirement. This change needed a horn
blowing, a full page ad in the paper, a revised zoning poster on display in the library! Two months ago, after
failing to find the revised Plan on the City's website (the link went to the old one and has since been updated), I
asked to purchase a Copy of the new General Plan, but none are available. One or two copies could be placed in
the library for viewing. I don't know who the 100 people were, how they were recruited, but I can imagine they
understood this town government a lot more that those who visit, then settle here for retirement.

My gut feeling is that the news of California's government regulated housing shortage is the big news back east
these days. Sadly, here we are now, living in a perfect example of that change.

improve the Plan. I am confident that we can make the plan better through mutual engagement.
Last night Steve paid a compliment to Mr. Newell for getting us to know our neighbors, and it is very true that it has
brought us together. Our communities are strong, and very bright. Many of us came from business, and we understand
that money for any project is not boundless in supply, and the best ones are often the ones that don't cost money,
though often take more work to discover.
With the right leadership, I am confident that our meeting next week will reach consensus on a better plan. With that

think his insight as to what is possible with the City is a crucial aspect of the outcome.

l am sending this letter to you, our City of Palm Desert Representatives and
Decision Makers, to ask that before you vote or move forward on the Sands Project,
that you will listen, consider and act on the valuable input of Palm Desert
Residents. We have met with you, written letters of concerns, we have attended a
variety of meetings and raised many important questions, some of which are still
unresolved.
We present ourselves to you because we love our community and are proud voters,
tax payers, shoppers, diners, active city participants and supporters of responsible
development in "Our Beautiful City of Palm Desert." But, before you vote - please
first:
1. Consider all resident issues and concerns presented to you and attempt to
resolve unanswered questions;
2. Share your thoughts with the residents about The City's position, prior to
your vote;
3. Resist fast -tracking the vote to approve The Sands Project;
4. Require that all three story buildings be moved to the front of the project.
5. Be aware that in a May 2017, in a meeting with the Mayor and Portola &
Venezia residents, The Planning Department and other City Council
Members shared that while welcoming public comment and bringing our
concerns forward was useful and valued, commenting on or demanding
change based upon the Loss of View, would not be considered or allowed,
simply because "No One Owns A View."
6. Be aware that in a meeting on Monday April 9, 2018, with Kathleen Kelly,
Susan Marie Weber, the Planning Department and five Portola CC Residents,
it was revealed that a vital decision making rational on the movement or
switching of two/three story buildings by Newal and Moran, was actually
based upon the impact of View of Cantera's "High Rent Units."
7. Consider why the views of Cantera "l-ligh Rent Units" is relevant to The City
and the neighboring residents, as was discussed in the April 9th meeting.
8. Question why Newal and Moran, have been allowed to answers on -the -fly
questions about building placement. While at the same time, external stake
holders, the residents and neighbors are left to bargain directly with the
developer or beg The City for consideration of our concerns;
9. Require a frank forthcoming discussion with Newal and Moran and The City
Council, on the importance of building placement for the existing residents

and have them affirm to The Council that their decision is anything other
than based on financial impact on Cantera's "High Rent Units Views."
10. Per the Planning Department, wall at the back of The Sands property line,
adjoining Portola C.C., is beyond its 50% expected life and can not be added
to, or modified.
1. The City should approve a variance to construct a new wall and increase
the height to between 8' - 12' which follows the contour of the property.
The new wall will provide an appropriate level privacy screening and
reduce the environmental impact to the existing residents, reduce noise,
"environmental quieting" reduction of ambient heat radiating from
buildings, streets and other improvements from the Sands Project.
11. Require that the Landscape adjacent to Portola C. C., be placed in the first
phase of the project. This will assure that during and the at the end of the
24-36 month building cycle, the neighboring residents will see a mature
thriving greenbelt in place upon the first residents arrival at The Sands.
1. Landscape plant materials and installation should be done with approval
of The City. Appropriate desert landscape materials and plants of an
evergreen nature and in sizes that assure the goals of the neighboring
residents are met.
2. Canopy trees selected should be a combination of 48" background trees
and 24 - 48" box foreground trees of varying texture, color, evergreen,
desert tolerance, durablity and water wise selections.
1. Rear placed Canopy Trees: Acacia Salicina, Southern Live Oak
2. Front placed Canopy Trees: Desert Museum Palm Verde, Mesquite
3. Understory plants: Dwarf Ornamental Olive, Petit Pink Oleander,
Leucophyllum Compacta, Durante Sweet Memory' Bush, Tacoma
Lydia, Olea Munchkin, Lagerstroemia Tuscarora, Xylosma.
4. Upon completion the Landscape plan should be filed with The City to
assure that appropriate landscape materials are replaced and renewed as
necessary' over the life of the Sands Project.
12. Require The Developer to individually name and include adjacent Portola C.
C. residents properties, in their overall construction insurance umbrella
policy with $0.00 deductible, for any consequential damages to their homes,
during the construction phase of the project.
13. All of the above, are concerns that have been discussed over the course of
considering The Sands Project with The City of Palm Desert and It's
representatives by written correspondence, telephone calls, town hall

meeting, private meetings and direct participation in Council Meetings by
and with concerned residents;
14. Upon reaching consensus and prior your vote on The Sand Project -
1. Set firm conditions for the project that specifically targets the safety,
privacy, environmental impact, and lifecycle of the property
management,
2. Recalculate the project parameters on survey elevations, parking space
allocations, and property use based on what The Sands Project property
owner actually own.
3. Validate that the City of Palm Desert's 42nd Street Easement was in
fact, properly granted to the Developer so that the muddy water of the
actual useable acreage in question, can be cleared.
4. Verify that the adjacent property to Portola CC, parcel (AP#
624-060-089-7,) is/not incorporated into the true building envelope of
The Sands Project or if it is held by separate by Grant Deed, by New
Cities investment Partners, LLC.
Without a doubt, if this project is approved by The City of Palm Desert, it will be a
welcome and beautiful Class A Development project that will provide wonderful
housing for many new and contributing residents. My hope is that these new
residents will, like we who have raised our voices in this project, will participate,
make their voices heard and affect future projects as we as The City Of Palm
Desert, moves toward welcoming more development in the coming years.
1 am confident in and enthusiastic about The City of Palm Desert assuring that the
needs of Developers, the goals and plans of The City and the business associations
of The Sands Project and Cantera Do Not outweigh the importance of the voting
members of our community, and the leadership that we are proud to call ours -The
City of Palm Desert!

I am an owner in Portola Country Club. I understand that the Palm Desert City Council, this week, will be reviewing and
possibly approving the new Sands development on Hovley Lane East between the school and existing Canterra
apartments.
I was extremely disappointed that the developer did not negotiate with residents of either Via Venezia or Portola
Country Club prior to going to the planning commission for their recommendation approval; I understand they only
negotiated with residents of Canterra. However, I was quite pleased when the Palm Desert City Council requested, at a
recent meeting, that the developer meet with representatives from Via Venezia and Portola Country Club. While I could
not attend that meeting, I am very comfortable with the recommendations from that meeting and suggest that when
City Council approves the development, the following conditions form part of that approval:
1- A new 8 ft wall be constructed between Portola Country Club and the Sands at approximately the same elevation as
the homes on Angels Camp in Portola Country Club. That is, 187 to 189 feet above sea level. This height will be
consistent with other portions of the wall behind Angels Camp and other developments.
2 - Two rows of MATURE landscape buffer be planted between Portola Country Club and the Sands.
3 - The developer names all adjoining Portola Country Club homeowners as additionally insured with zero deductible to
pay for any possible damages that occur during construction.
4 - The developer moves buildings 11 and 8 forward by swapping with buildings 1, 2, 4, 6, 7 or 10.

My name is Susan Youmans. Five years ago, after traveling the country in an RV for 12
years, my husband and I made the decision to move to Palm Desert. We had wintered
in the valley for seven years prior, and got to know the cities that occupy this beautiful
valley very well. We chose Palm Desert as it seemed to be a hub for entertainment and
shopping, while still maintaining residential areas that were able to enjoy the beautiful
views. We were also impressed by how well the city was managed.
My husband and I live in Portola Country Club. The approval of the Sands Project,
particularly the three story buildings, is very disturbing, particularly since we thought we
were moving into a part of the city that was zoned residential. Now, we find that this is
not the case. In fact we are now zoned with the designation of "Town Center."
Of course, this is all water under the bridge. Amid an outcry of protests from Portola
Country Club, Venezia, and Canterra (initially), the project, with some concessions by
the builder, was approved by the planning commission.
With all that being said, I am writing to ask that if you do vote to approve the Sands
Project please do so with the following conditions: 1. Require the builder to construct a
new eight foot wall on the Portola Country Club border, with two rows of mature
landscape buffer in the easement between the two properties. 2. Name the
homeowners on Angels Camp Road, who will be directly affected by the construction, as
additional insured, with no deductible, to cover damages caused during
construction. 3. Move buildings 8 and 11 forward and swap them with 1,2,4,6,7, or
10. 4. Lower the grade on the property so the buildings do not tower over the one
story residential homes adjoining the project.

Given the numerous hazards and documented issues, we do not want 3 story buildings in the Southern part
of The Sands property. Currently, Buildings 8 and 11 are slated as 3 story buildings, and there are proposals

We are writing to express our non-support of The Sands project in Palm Desert Community as currently planned.
We currently live in the Venezia Housing area, which is next to The Sands planned development thus have major concerns in
the following areas:
1. Three story (3-story) buildings can not exist at The Sands - 3-story (eight of them), two story (2—story) buildings (7
of them) are planned but can not exist as requested.
o Does not conform with zoning codes applied to similar neighborhoods which only allows for 2-story buildings.
o Extreme privacy and safety concerns of putting a 3-story building next to existing 1-story homes and a school
play ground. In light of recent school gun issues and the recent Las Vegas Hotel shooting, we submit that
allowing a 3-story building next to a school play ground and housing area violates privacy and safety issues.
2. Garages Must Have 25 Foot Setback from Venezia Homes - Garages lining the property line between Venezia:
o Concern that The Sands will extend 5 feet or more (if sand isn't removed!) above backyard walls of Venezia.
Causing privacy and visibility issues.
o Garages too close to the Venezia Housing area wall should be 25 foot setback to allow for privacy and
safety. A fire in a garage could cause damage to a Venezia Home.
3. Increased Traffic Congestion - Additional traffic in the area to include the over crowding of the school system is a
major concern.
4. Redundant Play Grounds Not Needed — The Sands development plan calls for additional development of play
grounds when there is currently a large outdoor recreational complex that could be used by The Sands residents just
next door. The noise and lights from the additional play ground with in 100 feet of the Venezia Community will cause
Privacy and Noice issues. Thus do not build.
5. Impact of Low Income Housing on Surrounding Areas - Addition of low-income housing next to a recently planned
and established high -income housing area is going to reduce the value of the homes in the Venezia Housing
Area. Thus request the City of Palm Desert immediately offer a Tax Assessment adjustment for 2018, and following
years, of 40% less than 2017 tax assessment to account for the direct negative influence of the City Of Palm Desert
Planning Division's impact on the home owners of Venezia.

Again, thanks for your continued support regarding this critical issue to the Palm Desert Community. And if possible, I would
like to request a meeting with you to further address our concerns.
