Glickman, Management Analyst REQUEST: Approve a temporary waiver to Palm Desert Municipal Code Section 9.58.010 (Consumption of alcoholic beverages on public property) for the sale and consumption of alcohol at the Palm Springs Art Museum in Palm Desert (72567 Highway 111) for FY 2018-2019. Recommendation By Minute Motion: 1. Approve a temporary waiver to Palm Desert Municipal Code (PDMC) Sections 9.58.10 and 9.58.20 (Possession/Consumption of Alcohol on City Property) in conjunction with events related to First Weekend and annually occurring special events. 2. Authorize the City Manager to approve up to five (5) additional temporary event waivers to PDMC Sections 9.58.10 and 9.58.20 (Possession/Consumption of Alcohol on City Property) as needed throughout FY18/19. 3. Authorize the City Manager to execute any California Department of Alcoholic Beverage Control documents, as required. Strategic Plan The activities of PSAM help to create a better community for residents and visitors to Palm Desert. This concept is in line with the Arts & Culture Mini-Vision which states: "Arts and culture give a community its soul. Palm Desert is the cultural core of the Coachella Valley. Cultural tourism drives economic growth in Palm Desert. The community is host to internationally recognized cultural events that bring significant economic benefits to the City. Palm Desert is a leader in arts education, ensuring a well- rounded population that possesses high levels of creativity and critical thinking skills." October 11, 2018 - Staff Report PSAM Special Events Page 2 of 3 Background The Palm Springs Art Museum in Palm Desert (PSAM) continues to be a strong partner with First Weekend and annually occurring special events. Below is a brief description of the character of each event being proposed at PSAM: 1. First Weekend: PSAM has had success with hosting First Friday events which include live music, catered food, and beer and wine offerings. The sculpture garden and Carriage Lane lend themselves well to outdoor functions and the PSAM expects approximately 300-400 attendees at each event. Events are held once monthly on the first Friday of each month November through May. 2. Annually Occurring Special Events: PSAM annually hosts the Meet the Galen, Fashion Week After Party/Museum Fundraiser, Helene Galen's Street Party, and Earth Day events which also include live music, catered food, and beer and wine offerings. As with First Fridays, these events are held in the sculpture gardens, and along Carriage Lane. PSAM would like to have the option to serve alcohol at these events. PSAM will adhere to all requirements of the Alcohol and Beverage Control and will apply for all related permits. In addition to the regularly scheduled events, staff would like to have the ability for approval up to five (5) additional events that would include serving alcohol. These events would be subject to final approval by the City Manager and are not intended to interfere with normal operations at PSAM. Having a reserve of flexible event waivers would assist staff in managing operations with PSAM. Staff will work with PSAM to ensure that they will have liquor liability on their insurance policy prior to the commencement of any event. No person shall drink, use or consume any alcoholic beverage, as defined in Section 23004 (and related sections) of the Business and Professions Code of the state, upon any public street, sidewalk, highway, road, lane or alley, or in or upon any other publicly owned property which is open to the use or the business of the public at the time, but which place is not licensed for the consumption of such beverage on the premises. The provisions of this section shall not apply, however, to the park and recreation area regulated elsewhere in this code. No person shall, in or upon any of the places listed in Section 9.58.010 of this chapter, have in possession any alcoholic beverage defined as in Section 9.58.010 of this chapter contained in any bottle, can or other receptacle, which has been partially removed; provided, that this section shall not apply when the beverage is in possession at the time strictly for the purpose of transporting it, along with other items, briefly and temporarily and directly through a place listed in Section 9.58.010 of this chapter. Further, this section shall not apply to park and recreation area, regulated elsewhere in this code.
