PERSONS AND FAMILIES OF LOW AND MODERATE INCOME
PURSUANT TO HEALTH AND SAFETY CODE SECTION 34176.1.
Recommendation
By minute motion that
1) The City Council adopt Resolution No. 2018-76 , reaffirming its intent that affordable
housing be developed on Authority owned vacant lots known as APN 627-122-013 and
627-122-003 and extending the time period for retention of such property for an
additional five years, pursuant to Health and Safety Code Section 34176.1; and
2) The Housing Authority Board adopt Resolution No. RA-87 reaffirming its intent that
affordable housing be developed on Authority owned vacant lots (as Successor Housing
entity) known as APN 627-122-013 and 627-122-003 and extending the time period for
retention of such property for an additional five years, pursuant to Health and Safety
Code Section 34176.1
Strategic Plan
This request relates to the strategic plan objective, Land Use, Housing, and Open Space, more
specifically Priority 2: Facilitate development of high -quality housing for people of all income
levels. The Sagecrest Expansion property is part of the Authority's affordable housing portfolio,
providing homes for rent to income -qualified families and seniors.
Executive Summary
The Palm Desert Housing Authority (the "Authority") is required to request an extension of time
to develop land owned and intended for affordable housing purposes, if the land is not
developed within five (5) years of acquisition. With the approval of the transfer of assets to the
Authority in 2013, it is necessary to request such approval for the "Sagecrest Expansion"
parcels that have not yet been developed.

Background
The former Palm Desert Redevelopment Agency ("Agency") acquired parcels in the Project
Areas (the "Properties") using moneys from its Low and Moderate Income Housing Fund,
including the proceeds of bonds issued by the former Agency that were payable from and
secured by tax revenues required to be deposited into the Low and Moderate Income Housing
Fund.
In 2012, the former Agency was dissolved due to the passage of the Dissolution Law. The Palm
Desert Housing Authority became the Housing Successor to the former Agency, and several
vacant parcels were transferred as part of the housing assets to the Authority in its capacity as
Housing Successor. On January 10, 2013, the California Department of Finance ("DOF")
issued a letter approving as housing assets certain items, including the Properties, and the
Properties were transferred to the Authority as housing assets. Of the numerous assets
transferred to the Housing Authority, there were three vacant properties that fall into the five-
year requirement. The Sagecrest Expansion is the only transferred Housing Asset property that
remains undeveloped at this time.
During the first five (5) year period, staff was focused on developing projects in process and
disposing assets with the greatest carrying costs. Staff is currently working on developing an
RFP to develop the Sagecrest Expansion property as privately owned, multi -family affordable
housing.
The Redevelopment Law, as modified by the Dissolution Law, provides that if the Authority has
not initiated activities to develop the Properties as affordable housing by 2018, Authority Board
may adopt a resolution to extend the period during which the Authority may retain the Properties
for one additional period not to exceed five years. The resolution of extension must affirm the
intention of the City (the Legislative Body) that the Properties be used for the development of
housing affordable to persons and families of low and moderate income. If physical
development of the Properties for affordable housing has not begun by the end of the extended
period January 10, 2023, the Properties must be sold and the moneys from the sale, less the
costs of the sale, must be deposited in the Housing Successor's Low and Moderate Income
Housing Asset Fund.

WHEREAS, the former Palm Desert Redevelopment Agency (the "Former
Agency") acquired the Sagecrest Expansion parcel identified on Attachment A, attached
hereto and incorporated herein, in the City of Palm Desert for development of low and
moderate income housing utilizing moneys from the Former Agency's Low and
Moderate Income Housing Fund, including the proceeds of bonds issued by the Former
Agency that were payable from and secured by a pledge of tax revenues required to be
deposited into the Former Agency's Low and Moderate Income Housing Fund, as
authorized by Health and Safety Code Section 33334.2 (the "Properties").
WHEREAS, the Former Agency was dissolved on February 1, 2012 pursuant to
AB X1 26, and the Palm Desert Housing Authority became the housing successor to the
Former Agency (the "Housing Successor").
WHEREAS, pursuant to Health and Safety Code Section 34176(b), all of the
housing assets of the Former Agency, including the Properties, transferred to the
Authority, as Housing Successor, in accordance with the California Department of
Finance ("DOF") letter dated January 10, 2013, approving as housing assets certain
items included on the Housing Assets Transfer Form, including the Properties.
WHEREAS, Health and Safety Code Section 33334.16 provides that for each
interest in real property acquired using moneys from the Low and Moderate Income
Housing Fund, a redevelopment agency shall, within five years from the date it first
acquired the property interest for the development of housing affordable to persons and
families of low and moderate income, initiate activities consistent with the development
of the property for that purpose. Health and Safety Code Section 33334.16 further
provides that If such activities have not been initiated within this period, the legislative
body may, by resolution, extend the period during which the agency may retain the
property for one additional period not to exceed five years. The resolution shall affirm
the intention of the legislative body that the property be used for the development of
housing affordable to persons and families of low and moderate income. Finally, Health
and Safety Code Section 33334.16 provides that in the event that physical development
of the property for this purpose has not begun by the end of the extended period, or if
the agency does not comply with this requirement, the property shall be sold and the
moneys from the sale, Tess reimbursement to the agency for the cost of the sale, shall
be deposited into the agency's Low and Moderate Income Housing Fund.

WHEREAS, Health and Safety Code Sections 33007 and 33002 define the
"legislative body" as the City Council of the City.
WHEREAS, Health and Safety Code Section 34176.1(e) provides that with
respect to interests in real property acquired by a former redevelopment agency prior to
February 1, 2012, the time periods described in Section 33334.16 shall be deemed to
have commenced on the date that the DOF approved the property as a housing asset.
As set forth above, the DOF approved the Properties as housing assets on January 10,
2013.
WHEREAS, the Housing Authority Board desires to extend the period during
which the Authority, as Housing Successor, may retain the Properties for development
of housing affordable to persons and families of low and moderate income.
NOW, THEREFORE, THE CITY COUNCIL HEREBY FINDS, DETERMINES,
RESOLVES, AND ORDERS AS FOLLOWS:
Section 1. The above recitals are true and correct and are a substantive part
of this Resolution.
Section 2. The Authority Board affirms the Board's intention that the
Properties be used for the development of housing affordable to persons and families of
low and moderate income. Accordingly, the period during which the Housing Successor
may retain the Properties is hereby extended until January 10, 2023.
Section 3. This Resolution shall take effect immediately upon its adoption.

The City of Palm Desert Successor Agency (Agency) notified the California Department of
Finance (Finance) of its October 8, 2012 oversight board (OB) resolution 018 on October 9, 2012.
Pursuant to Health and Safety Code (HSC) section 34179 (h), Finance has completed its review
of the OB action, which may have included obtaining clarification for various items.
Based on our review and application of the law, OB Resolution No. OB-018, related to the
transfer of assets identified in the Housing Assets Transfer Form to the Palm Desert Housing
Authority, is approved.
