Strategic Plan Obiective Approval of this request demonstrates support of the following Strategic Plan Objectives in the strategic results area of economic development: • Expand job and business creation opportunities; and • Expand and raise awareness of business -friendly services in order to retain and attract business. Background The Palm Desert Area Chamber of Commerce (Chamber) holds monthly business networking mixers for members and potential members at different locations throughout the city. The Chamber would like to hold its January meeting at the Family YMCA of the Desert (YMCA) on January 18, 2017 from 5:00 to 7:00 p.m. The "Business After Hours Mixer" includes food, beverages, alcohol, and networking activities. The Chamber estimates approximately 80 to 100 people will attend the event. The event will be held indoors. Staff Report TUP 16-358 Chamber Mixer at YMCA Page 2 of 2 January 12, 2017 The YMCA building located at 43-930 San Pablo is on City -owned property. The City Council may grant permission for consumption of alcoholic beverages on City -owned property for special events per Section 9.58.040 of the Palm Desert Municipal Code. The event will be conditioned to obtain all necessary Health Department and Alcoholic Beverage Control permits prior to the event and conform to the additional conditions listed on the attached list. Staff recommends that the Council approve the event as conditioned by staff as this event promotes business friendly practices and supports the City's Strategic Plan Objectives. Fiscal Analysis There is no direct fiscal impact associated with the approval of this request. TUP 16-358 Community Development Department: 1. The event shall conform substantially with exhibits on file with the Department of Community Development, as modified by the following conditions. 2. The applicant shall indemnify, defend, and hold harmless the City and its officers, employees, and agents ("City indemnitees"), from and against any and all causes of action, claims, liabilities, obligations, judgments, or damages, including reasonable legal counsels' fees and costs of litigation ("claims"), arising out of the applicant's use of the City -owned property, including the City's active or passive negligence, except for such loss or damage arising from the sole negligence or willful misconduct of the City. 3. The event shall maintain compliance with the City's lighting and noise ordinances. No off - site signs will be permitted unless prior approval is obtained from the City's Community Development Department. 4. All vendors will be required to obtain business licenses from the City's Finance Department. The applicant shall obtain all permits from outside agencies, including Riverside County Department of Health and the State Department of Alcohol Beverage Control prior to the event. 5. The applicant shall maintain commercial general liability insurance, in an amount not less than $1,000,000 per occurrence, $2,000,000 general aggregate, for bodily injury, personal injury, and property damage, including without limitation, blanket contractual liability. If liquor is served without charge, the general liability policy shall include coverage for "host liquor liability," or if liquor is sold at an event, special liquor liability insurance will be required. 6. Fire lanes shall be established and/or maintained during the event.
