Conditions of Approval Tentative Parcel Map Final Parcel Map Vicinity Map Recommendation Waive further reading and adopt Resolution No. 2017- 05 approving Parcel Map No. 36700. Strategic Plan Objective Approval of this parcel map indirectly contributes to Priority 4 of the Economic Development goals of the Strategic Plan by providing business-friendly services in order to retain and attract business. Background Parcel Map No. 36700 is located on the west side of Highway 74 and north of Homestead Road. The map provides for the creation of two parcels from one 6.68-acre parcel. The site has developed parking areas, landscape improvements, and four separate buildings: a church worship center, a pre-school and nursery, an elementary and intermediate school, and administrative offices. The two parcels will be split along an existing drive aisle. Parcel 1 will be 5.11 acres in size and will be comprised of three of the four existing buildings, including the church and administrative facilities, as well as the entirety of the parking areas. Parcel 2 will be Staff Report Resolution to Approve Parcel Map 36700 Page 2 of 2 January 12, 2017 1 .57 acres in size and will contain the existing elementary and middle school. Parcel 2 will not contain any parking. The approval of the tentative map by the Planning Commission included the conditions on the applicant to ensure that shared facilities, such as the existing parking lot, are available for both parcels. The final parcel map satisfies this condition by retaining reciprocal easements between the two parcels for pedestrian and vehicular access and parking purposes. The Tentative Parcel Map No. 36700 was approved by Planning Commission on May 20, 2014, and the Tentative Map will expire on May 20, 2017. This map is substantially the same as it appeared on the Tentative Parcel Map. Those conditions of approval related to the map have been satisfied, and the map conforms to the requirements of the Subdivision Map Act and City ordinances. The Final Subdivision Map of Parcel Map 36700 of City of Palm Desert, California, is hereby approved as the official subdivision map of said parcel map, subject to conditions of the Tentative Parcel Map. 2. The City Engineer is directed to process the Final Parcel Map for recording upon receipt of the required payment of all fees. KLASSEN, CITY CLERK CITY OF PALM DESERT, CALIFORNIA PLANNING COMMISSION RESOLUTION NO. 2629 CONDITIONS OF APPROVAL CASE NO: TPM 36700 DEPARTMENT OF COMMUNITY DEVELOPMENT: 1. The development of the property shall conform substantially with exhibits on file with the Department of Community Development/Planning, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein, which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Building & Safety Department City Fire Marshal Public Works Department Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building & Safety at the time of issuance of a building permit for the use contemplated herewith. 4. All conditions of approval shall be recorded with the Riverside County Clerk's office before any building permits are issued. Evidence of recordation shall be submitted to the Department of Community Development/Planning. 5. Applicant shall defend, indemnify and hold harmless the city against any third party legal challenge to these approvals, with counsel chosen by the city at applicant's expense. 6. Tentative Parcel Map 36700 shall be recorded within two years from the date of final approval unless an extension of time is granted; otherwise said parcel map approval shall become null, void and of no effect whatsoever. 7. Any proposed change to TPM 36700 will require an amendment, which will result in a new public hearing. 8. A reciprocal access and parking agreement shall be recorded between the two newly created parcels. DEPARTMENT OF PUBLIC WORKS: 9. Title 24, California Code of Regulations. i. 2013 California Fire Code and its appendices and standards. 11.Submit a fully dimensioned plot plan showing size, location, occupancy group(s) and type (s) of construction of all existing structures on the lot. Identify all property lines and easements and dimension all setbacks to existing buildings. CBC Section 107.2.5 12.Due to the lack of information provided to fully demonstrate code compliance for this project, additional corrections may become necessary upon submittal of such information.
