2.52.700 Holidays. * Passed to 2nd reading as amended with the change
discussed to the first sentence of paragraph B,

Executive Summary:
The City's personnel system was updated in 2012 to accommodate the
development of part-time positions in the Visitor Center. These positions were
developed to provide primarily customer service and the salary was set much
lower than any other City positions. Prior to this the City had not employed
regular part-time employees since 1999 and did not have clear guidelines for the
administration of benefits.
Since 2012 there have been a number of changes with respect to part-time
employees. The City relocated the Visitor Center and eliminated all but one part-
time position. Over this time the cost of health and ancillary benefits has
increased eroding the modest salary of the part-time employee pay grade and
meaningfully decreasing the incumbent's net pay each year. Staff recommends
minor modifications to the City's policy in order to provide equitable
administration of benefits for the part-time employee(s).

Background:
When the part-time Customer Service positions were created in 2012, all benefits
were set up to be paid and accrued at 50%, with the employee paying 50% of
premiums and earning 50% of vacation and holiday leave. At that time it was
envisioned that such employees would likely work 20 hours per week. At that
time the City's payroll and benefits administration systems were also
cumbersome and the administration of different benefits amounts for different
employees was difficult. Since that time the schedule for the part-time employee
has been 25 hours per week, and in order to serve the needs of the City may be
adjusted up or down. Additionally, the City implemented a new payroll system
that can accommodate different benefits levels for different employees more
easily.
Currently holidays are provided at a flat four hours for each full day holiday. This
causes inequity as the employee may have been regularly scheduled to work
more than 50% of the day. For example, City Hall is closed on Monday, Martin
Luther King Jr. Day, and all full-time employees receive eight hours of holiday
pay. The part-time employee is normally scheduled to work five hours, but only
receives four hours pay, therefore her paycheck is one hour shorter than normal.
Providing Holiday pay proportional to hours scheduled resolves this issue.
Staff recommends that the municipal code be amended as attached to allow the
provision of benefits and holiday pay for part-time employees to be proportional
to the hours worked. For example, if the employee is scheduled 20 hours per
week benefits would accrue at 50%, however if they are scheduled for 30 hours
per week benefits would accrue at 75%. This provides some equity in the
administration of benefits based on the employee's schedule.
This amendment has been discussed with the Palm Desert Employees
Organization and a copy has been provided to them for review and comment.
The organization took no exception to the proposed changes.

Fiscal Analysis:
The current schedule would potentially result in cost increases of up to $1,500
annually for insurance premiums. This is dependent on the employee's schedule
and premium costs. The potential increases in holiday hours are not significant.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, AMENDING CHAPTER 2.52 OF THE PALM
DESERT MUNICIPAL CODE BY AMENDING SECTIONS 2.52.305
EMPLOYMENT TYPES AND 2.52.700 HOLIDAYS.
WHEREAS, the City of Palm Desert has established a personnel system in
section 2.52 of its municipal code; and
WHEREAS, the City of Palm Desert employees part-time employee's and
desires that the administration of benefits be equitable to their contributions of time
worked; and
WHEREAS, these amendments allow benefit to be provided proportionate to an
employee scheduled hours of work; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, DOES HEREBY ORDAIN THAT THE FOLLOWING SECTIONS OF
THE PALM DESERT MUNICIPAL CODE ARE HEREBY AMENDED AS FOLLOWS:
Section 1. That Sections 2.52.305, 2.52.700 and 2.52.705, of the Municipal
Code are hereby amended to read as illustrated in Exhibit "A."
Section 2. That the City Clerk shall certify to the passage and adoption of this
ordinance and shall cause the same to be published once in The Desert Sun, a
newspaper of general circulation, printed and published in the County of Riverside and
circulated within the City of Palm Desert and shall be in full force and effective thirty (30)
days after its adoption.

2.52.305 Definition of Employment Types
A. Regular Full -Time Employment. Employees are those who successfully complete
the probationary period and who regularly work forty hours per week, the maximum
number of hours scheduled by a department or division. Regular full-time employees
receive all benefits outlined in the labor group bargaining agreements and in the
municipal code, unless otherwise stated.
B. Regular Part -Time Employment. Employees who are regularly scheduled to work
more than twenty hours per week lec , than forty hourc por wook and moro than twonty
houra por wool and who successfully complete the probationary period.
Regular part-time employees, provided they are employed on a basis of twenty or more
hours per week, are eligible for vacation, sick leave, other leaves of absence credits,
and CaIPERS service credit, proportional to their assigned work hours. They are
eligible for holiday pay in accordance with municipal code Section 2.52.700, Holidays.

will be eligible to receive fixed cost benefits such as health, dental, vision, long term

2.52.700 Holidays.
All regular and probationary full-time employees of the city shall receive eight or four
hours pay for each holiday, as described in this section.
All regular and probationary part-time personnel, as defined in Section 2.52.305, shall
receive holiday hours pay proportionate to their scheduled hours of work on the
designated holiday. "Scheduled hours" are determined by the Department Head.
Example, City Hall closed for eight hours for Independence Day, employees normally_
scheduled to work five hours on said day would receive 5 hours of Holiday Pay.
