Authorize an agreement with Willdan Engineering and Planning in an amount not to exceed $70,000 for temporary Code Compliance staffing services for a period of approximately six months. 2. Authorize the City Manager to execute any agreement necessary to effectuate the above action. 3. Authorize payment from account 1104470-4309000 (Professional Services — Other). Strategic Plan Objective: Economic Development Priority 4: Expand and raise awareness of business- friendly services in order to retain and attract business. This action supports business friendly services by providing timely code compliance activities, which maintains the high quality aesthetics that Palm Desert enjoys. Discussion: On April 27, 2017, the Code Compliance Division will say bon voyage to one of our long time employees, Mr. Shawn Kilpatrick. Mr. Kilpatrick is retiring after 26 years of distinguished service to the City of Palm Desert. Mr. Kilpatrick began his career as a Maintenance Worker, and promoted to a Compliance Officer when the opportunity presented itself. Staff Report Willdan Temporary Code Compliance Staffing April 27, 2017 Page 2 of 3 Staffs request to utilize temporary staffing services for a period of approximately six months serves three main purposes, which are outlined below: Staff Development and Promotional Opportunities: The Code Compliance Officer position is seen as an internal promotional opportunity, and historically some of the City's best officers have promoted into this job classification. Both Community Development and Human Resources have had inquiries about how to prepare for this job classification. The basic certifications are the PC 832 Certification, and the Certified Code Enforcement Officer (CCEO), which is a certification administered by the California Association of Code Enforcement Officers (CACEO). Many jurisdictions will require the basic PC 832 certification to be considered for employment and allow some period of time prior to achieving the CCEO classification. To encourage staff development, we are proposing not to fill this position for a period of approximately six months. This should provide the necessary time for internal candidates to prepare for an eventual job announcement. Staff is not suggesting an internal only recruitment, only that we give our existing employees every opportunity possible to be ready. The Human Resources Department would post the open position in August/September as an internal/external recruitment. Code Compliance Division Coverage: The Code Compliance Division responds to large volumes of constituent concerns and additional case load. Currently the City is divided into four main compliance areas split between four officers. While staff is always up for a challenge, the period of six months may prove challenging to cover at existing staffing levels. Having an additional contracted officer should provide the resources to avoid any reductions in services. Staff envisions utilizing a contracted officer 40-hours a week to handle lower priority issues/cases. Incorporate the Findings of the Upcoming Classification and Compensation Study: The City is retaining an outside consultant to perform a comprehensive study of the classification system of City employees and the compensation provided for each type of position. It is possible that the outcome of this study, which should be substantially complete in three or four months, will indicate that the new vacancy should be filled with a different classification of employee and/or at a different salary level. By using a contract employee for a period of time, the City will have time to benefit from the information gained during the study, and will have an opportunity to fill this position in the most appropriate manner for the future. TRUSTED. ��'- Palm Desert Contract Inspection Services The project shall consist of Willdan staff coordinating with the City of Palm Desert Community Development Department to provide Code Compliance staff to the City. Willdan staff shall conduct all inspections and re-inspections of single family, multi-family and commercial properties and will identify and enforce all violations of City's municipal code, ordinances, laws and all applicable statutes. Personnel shall issue notifications, letters, citations and warrants when necessary to achieve compliance. Staff will be required to document all complaints received, inspections conducted through photos, notes and correspondences. In addition to the services mentioned above,Willdan employees would provide the following to the City (this is not intended to be a comprehensive list): • Investigate complaints from the public and staff regarding violations of the municipal codes, ordinances, standards and health and safety regulations. • Initiate contact with residents, business representatives, and other parties to explain the nature of the violations and encourage compliance with municipal codes, zoning and land use ordinances, and community standards. • Prepare notices of violation for non-compliance according to applicable codes and regulations. • Prepare reports for cases requiring legal action or civil abatement. • When required, meet with legal counsel and provides testimony on criminal cases. • Maintain records of complaints, inspections,violation notices and other field enforcement activities. • Coordinate with City departments on cases as they relate to code enforcement. He specializes in developing new code programs, improving existing divisions, revenue enhancement, ordinance revisions, maximizing staff efficiency and enhancing customer relations. Fee Schedule The Willdan rate for code compliance services ranges between $60.00 to$65.00 dollars an hour based upon the experience level of the officer selected from the two candidates listed in this proposal. It is my understanding that this project will continue for a period of two to six months. The total overall cost will depend on the duration of the assignment and the candidate selected to provide service to the City. For your convenience, I have provided a breakdown of the approximate cost based upon both rate fluctuation and varying lengths of assignment.
