Recommendation

1. Approve and authorize staff to use vendors on the Abatement Services
Vendors List appended to this report; and
2. Approve exception to bidding requirements as provided for by Section
3.32.090 of the Municipal Code for Fiscal Year 2017-2018
Executive Summary
The Code Compliance Division utilizes a variety of abatement contractors regularly
through the year. On June 2, 2017, staff posted a notice publically inviting interested
parties to submit letters of interest, their business and contractors' license information
and evidence of insurance coverage. Staff has compiled a list of qualified, cost
effective local vendors and service providers capable of offering immediate services to
abate conditions that threaten the health, safety and general welfare of the public.
Approval of the use of the qualified providers allows the City to simplify the process to
acquire the services as needed thereby providing for more efficient operations and cost
savings.

Background
Section 3.32.090 of the Palm Desert Municipal Code exempts from portions of the
procurement processes certain services that are unique or not subject to competition
from the bidding process. Code Compliance utilizes this section (including the authority
granted in Chapter 8.20, Public Nuisances) to address urgent situations that require
expedited abatement to protect the health, safety and general welfare of the public.
These abatement services are unique in that they combine the need for prompt action
with a scope of work that varies from one purchase to the next; no two properties
require the same abatement work, but they each need immediate action to protect the
health, safety and general welfare of the public. Because the scope of work is not
known until exigent conditions arise, there is not sufficient time to solicit bids without
endangering the health and welfare of the public. This list of vendors is also utilized for
code compliance cases that do require abatement not presenting exigent
circumstances.
For example, foreclosure properties have created an impact to residential communities.
These abandoned properties are abandoned and left behind with green, stagnate
swimming pools that have the potential to propagate the deadly West Nile Virus;
odorous, decaying items that include household trash and other offensive material that
is in close proximity to adjoining properties thus prompting exigent conditions requiring
prompt abatement. Beehives that are found by virtue of their location can be an
immediate threat to surrounding residents and pedestrians; and other related situations
that may adversely affect the health, safety and general welfare of the public.
Abatement services for any given property typically cost less than $500, but
occasionally can reach several thousand dollars.
Approval of the staff recommendation will ensure that vendors can be engaged quickly,
and that if the value of their work exceeds a cumulative amount of $10,000 during the
course of a year, they can continue to provide contractor abatement services to the City
if they are on the abatement services vendors list. Purchases and/or services valued at
more than $25,000 will follow the standard procedures for procurement. Staff,
therefore, requests that the City Council approve the use of these mostly local vendors
and service providers for fiscal year 2017-2018.

The City of Palm Desert's Code Compliance Division is currently updating the following
for Fiscal Year 2017-2018.
• Contractor Abatement Services and Various Vendor List
Notice is hereby given that any potential vendors who can provide
contractor abatement clean up and removal, drain green pools and/or specialized
services as specified will be considered to be added to any of the aforementioned
vendor list. All contractors and vendors must obtain a City business license, provide
proof of liability insurance and workers compensation insurance (if applicable) prior to
being added to the vendor list.

Chapter 3.32 PURCHASING POLICIES AND PROCEDURES
3.32.090 Exemptions.
The purchasing or contracting for professional services and for other materials, supplies, equipment and
contractual services, which by their nature are unique or not subject to competition shall not be subject to the
bidding requirements of this chapter; provided, that the department or agency shall first obtain the approval of
the city council for exemption. (Ord. 224 § 9, 1980)
