Rate Comparison Recommendation By Minute Motion, 1. Direct staff to implement Burrtec's annual rate increase based on Producer Price Index (PPI), Recycle Fee, and Commercial Food Waste/Organics Program and Rates (option A); and 2. Waive further reading and adopt Resolution No. 2017- 50 , approving the new adjusted rate schedule of fees (Exhibit 3 for residential, commercial, and roll-off) as per approved option. Strategic Plan Objective Approval of Burrtec Waste and Recycling Services rate adjustment does not directly relate to identified goals within the Strategic Plan. Executive Summary Approval of staff's recommendation would ensure continued waste and recycling services in the City, establish an ongoing source of revenue for the City's recycling programs, and facilitate the implementation of a Commercial Food Waste Organics Program in Palm Desert. STAFF REPORT BURRTEC 2017/2018 ANNUAL RATE ADJUSTMENT JUNE 22, 2017 PAGE 2 Discussion The current Franchise Agreement between the City and Burrtec Waste and Recycling Services stipulates that the following programs/fees be considered: 1) Recycle Fee; 2) Vehicle Impact Fee; and 3) Food Waste/Organics Program. In 2016, staff brought forward the Recycle Fee and the Vehicle Impact Fee to the City Council for consideration. To lessen the impact on residential and commercial customers, staff proposed, and Council approved, the implementation of the Vehicle Impact Fee with the intention to return in 2017 to consider approval of the Recycle Fee. This staff report presents three potential options (see options A, B, and C in the following tables) for increasing waste and recycling fees. The City's Recycle Fund has a balance of approximately $2,755,000 (including anticipated FY 2016/2017 expenditures). At the current average annual expenditure rate of approximately $450,000 (excluding street related projects), the Fund will be exhausted in six or seven years. To ensure the Recycle Fund's continued viability, staff is proposing to implement the Recycle Fee at 50% (roughly $294,000) of the approximately $598,000 expended by the City for recycling related programs and expenses each year as shown in the Recycle Nexus Study. State law regarding Food Waste/Organics becomes more restrictive each year. The law initially required businesses that generated eight (8) cubic yards or more of organic waste to implement a food waste recycle program. On January 1, 2017, the threshold was reduced to four (4) or more cubic yards of food waste. Effective January 1, 2019, businesses that generate 4 cubic yards or more of commercial solid waste (food, dirty paper products, green waste, etc.) per week will also be required to recycle. As of Jan 1 , 2020, CalRecycle could also make a determination requiring businesses generating two (2) or more cubic yards of solid waste to recycle. In order for Burrtec to expand the pilot commercial food waste program, a new rate structure is proposed (attached). The implementation of the Recycle Fee and Food Waste/Organic's Program and rates are subject to notification requirements outlined in Proposition 218. In accordance with these requirements, the City notified all residential and commercial property owners of record regarding the potential PPI rate increase, Recycle Fee, Commercial Food Waste/Organic Program and rates, and any other future adjustments that are allowed within the Franchise Agreement. Palm Desert's rates for waste and recycling services, with or without the Recycle Fee, are less than the rates in other Coachella Valley cities served by Burrtec including Cathedral City, Coachella, Indio, and La Quinta. Fiscal Analysis Implementation of the rate increases will not directly impact the City's General Fund. However, approval of staff's recommendation would assist the City with recycling related programs and help Burrtec to implement the Food Waste/Organics Program. (Note: The County Tipping/Disposal rate increase will pass through to Burrtec customers. The Food Waste/Organics rates will also pass through to Burrtec customers; however, the Recycle Fee will be collected by Burrtec and be remitted to the City in the approximate amount of $294,000 per year). The City has an exclusive franchise agreement with Burrtec Waste and Recycling Services, LLC ("Burrtec") for the collection and handling of solid waste, recycling, green waste ("Refuse") within the City. All property within the City is required to subscribe to Refuse collection and handling services provided by Burrtec. Pursuant to the franchise agreement, the amount to be paid Burrtec each year may be increased each July 1 by a cost of living adjustment ("COLA") and/or any other approved fees. Additionally, it may be adjusted for any increases in the rates for the tipping fees ("Tipping Fees") paid to Riverside County for disposal of solid waste at the contractually approved landfill/transfer station. In the event that there is an increase in the rates for Tipping Fees, City ordinance authorizes the increase as a pass through to property owners within the City. Provided, however, in no event shall the rates for the Refuse Fees be increased, as a result of the Annual COLA or any Tipping Fee Pass Through, by more than the City's cost of providing solid waste services or in excess of 5%. Any property owner or any tenant directly responsible for the payment of Refuse Fees (i.e., a customer of record) may submit a written protest to the proposed rate imposition and potential rate increases to the City's Refuse Fees; provided, however, only one protest will be counted per identified parcel. Any written protest must: (1) state that the identified property owner or customer of record is in opposition to the proposed rate increases; (2) provide the location of the identified parcel (by assessor's parcel number or street address); and (3) include the name and signature of the property owner or customer of record submitting the protest. Written protests may be submitted by mail or in person to the City Clerk at 73510 Fred Waring Drive, Palm Desert, California 92260, or at the Public Hearing (date and time noted above), provided they are received prior to the conclusion of the public comment portion of the Public Hearing. Any protest submitted via e-mail or other electronic means will not be accepted. Please identify on the front of the envelope for any protest, whether mailed or submitted in person to the City Clerk, Attn: Public Hearing on Refuse Fee Rate Increases. The City Council will hear and consider all written and oral protests to the proposed rate increases at the Public Hearing. SECTION 2: The annual rate increase shall be 100% of PPI with a 5% cap. Resolution No. 2017- 50 SECTION 3: The Franchise Agreement now provides for Tax Roll Billing that commenced with the November 2015 Tax Roll for the billing period of July 1, 2015 to June 30, 2016 and shall continue until such time as rescinded. SECTION 4: Burrtec will pay to the City $1.06 to be divided $.73 to the Recycle and $.33 to the General Funds. SECTION 5: That the City Council of the City of Palm Desert, California, effective July 1, 2016, ratifies the 0% (December 2014 to December 2015) Producer Price Index and 12.65% gate/disposal fee pass through increase for solid waste collection and recycling service requested by Burrtec Waste and Recycling as provided for in the Franchise Agreement for 2016. SECTION 6: Burrtec to hold Producer Price Index (PPI) Increase (does not include tipping fee/disposal increase) for three (3) years (2015, 2016, and 2017) for commercial only commencing in July 1, 2015. Burrtec extended PPI exemption to residential for the 2016 year only. SECTION 7: That the County of Riverside has increased the per ton gate/disposal fee at the transfer station/landfill from $45.11 to $45.96 an increase of $0.85 for Disposal Tipping Fee per ton and from $31.00 to $36.00 and increase of$5.00 for Greenwaste Tipping Fee per ton. SECTION 8: The City Council of the City of Palm Desert, California, approves the new solid waste and recycle rate increases for 2017 as reflected in Exhibit 3A, 3B, and 3C to become effective July 1, 2017. SECTION 9: That the City Council of the City of Palm Desert, California, approved in 2013 the utilization of the remaining AB939 fees of $1.87 (formerly $4.19) per ton tipping fee plus an additional $.03 per ton so that residential and commercial customers (excluding roll off and other special services) did not absorb the PPI and gate/disposal fee increases for 2013. SECTION 10: The additional $.03 per ton was absorbed by Burrtec in mid-2013. SECTION 11: The City Council of the City of Palm Desert, California, approved the commercial recycle rate structure established at 35% of the trash fee and includes the 8% Franchise Fee, effective November 1, 2013. SECTION 12: The City Council approved a phased in approach to implementation of the food waste recycle program and the recycle and vehicle impact/road maintenance fees, commencing with the vehicle impact fee/road maintenance fee in 2016. 2 Resolution No. 2017- 50 SECTION 13: The City Council approved the implementation of the Vehicle Impact/Road Maintenance Fee effective July 1, 2016, at the rate of 6.39% residential, 6.37% commercial, and 6.46% roll off as reflected in Exhibit 3A, 3B, and 3C. SECTION 14: The City Council approved the implementation of the Recycle Fee effective July 1, 2017, at the rate of 3% (or 50% of Nexus Study) residential, commercial, and roll off as reflected in Exhibit 3A, 3B, and 3C. SECTION 15: The City Council approved the commercial organic/food waste recycle program and rate structure as reflected in Commercial Organic/Food Waste Rate Structure Exhibit to be effective July 1, 2017. SECTION 16: All other solid waste and commercial recycling rates, services, 8% franchise fee, any other fees, reports, etc. shall be in accordance with the Agreement currently in effect. SECTION 17: Prior to the end of the term of the Franchise Agreement, Burrtec to replace eight (8) (or approximately 50%) of its route trucks with alternative fuel sources. The City contracts with Burrtec Waste and Recycling Services for the collection and handling of solid waste, green waste, organic waste, and recycling in Palm Desert. Burrtec's fees for these services are set forth in its contract with the City and passed through to property owners and customers. /2-- Under the contract, Burrtec's fees may be adjusted annually for residential customers and, I V beginning July 1, 2018,for commercial customers, based on the national Producer Price Index for Finished Goods (PPI). These PPI-related increases cannot exceed 5% per year. Additionally, refuse fees may be adjusted when the tipping fees that Burrtec pays Riverside County to dump waste at County landfills increase. The proposed increased rates, based on the aforementioned changes,would be effective beginning July 1, 2017, and are shown in the attached charts. For commercial customers, State law requires the City to have an organic waste recycling program. Under the proposed changes, some commercial customers would be subject to a ne charge for the disposal of food and other organic waste. The charge would be based on the size and number of a business' carts and the number of pick-ups per week. The propos.• charges are shown in Exhibit 2 of the attached. The City is also proposing a new Recycle Fee that would be incorporated into the rates for all residential and commercial customers. Oral comments at the public hearing do not qualify as formal protests unless accompanied by a written protest. There are 102 unit owners in the Courtyards Association but only 38 that are here during the summer months. The remaining 64 are not here for 6 months of the year. The association pays $9,878.00 a year for all of the 102 unit owners even when the owners who do not put out trash for 6 months of the year. This means that the association is paying for services not rendered by Burtec for those not here during the 6 summer months. The association pays Burtec $8.07 a month for the 102 units owners, including the 64 unit owners that leave for the summer. The following calculation shows what we pay yearly for Burtec's services which does not include the 63% of our unit owners that are not here during the summer. This means that they are collecting for the services, which we have contracted for but are in excess of what is needed by Burtec for the services.This is extra profit for Burtec. Unit owners here full time (12 mo. of the year). $8.07 x 102 Units x 12 months=$9878 Amount paid in excess for unit owners that are here for 6 mo. of the year. $8.07 x 64 Units x 6 months = ($3099) The Associations bill if paid for the services rendered would only total $6779 However for the convenience of the owners we pay for waste and recycling services for all owners 12 months of the year. So currently Burtec gets and extra$3099 a year from our association for the services rendered. Under these circumstances we find that the request for an additional increase in costs to the association is unfounded and unfair to those paying for yearly pickup and protest the increases requested. It is our understanding that any objections to the proposed fees be in writing and be received prior to the June 22 meeting. Since the Ironwood Community is made up of many seasonal owners, most of our residents do not stay at their properties all year round and therefore do not need to have trash service during the summer months.The proposed rate increase seems unwarranted in this circumstance since it is based on trash collection for 12 months. Given the large number of homes in the Ironwood community,this does amount to a significant increase. It would seem to me that there should be some arrangements for Burrtec to offer a "vacation" hold which would ultimately reduce their operational costs.We see this option in many other services such as newspaper and mail delivery.Thank you for your consideration to this matter.
