Discussion
The current Franchise Agreement between the City and Burrtec Waste and Recycling
Services stipulates that the following programs/fees be considered: 1) Recycle Fee; 2)
Vehicle Impact Fee; and 3) Food Waste/Organics Program. In 2016, staff brought
forward the Recycle Fee and the Vehicle Impact Fee to the City Council for
consideration. To lessen the impact on residential and commercial customers, staff
proposed, and Council approved, the implementation of the Vehicle Impact Fee with the
intention to return in 2017 to consider approval of the Recycle Fee. This staff report
presents three potential options (see options A, B, and C in the following tables) for
increasing waste and recycling fees.
The City's Recycle Fund has a balance of approximately $2,755,000 (including
anticipated FY 2016/2017 expenditures). At the current average annual expenditure
rate of approximately $450,000 (excluding street related projects), the Fund will be
exhausted in six or seven years. To ensure the Recycle Fund's continued viability, staff
is proposing to implement the Recycle Fee at 50% (roughly $294,000) of the
approximately $598,000 expended by the City for recycling related programs and
expenses each year as shown in the Recycle Nexus Study.
State law regarding Food Waste/Organics becomes more restrictive each year. The
law initially required businesses that generated eight (8) cubic yards or more of organic
waste to implement a food waste recycle program. On January 1, 2017, the threshold
was reduced to four (4) or more cubic yards of food waste. Effective January 1, 2019,
businesses that generate 4 cubic yards or more of commercial solid waste (food, dirty
paper products, green waste, etc.) per week will also be required to recycle. As of Jan
1 , 2020, CalRecycle could also make a determination requiring businesses generating
two (2) or more cubic yards of solid waste to recycle. In order for Burrtec to expand the
pilot commercial food waste program, a new rate structure is proposed (attached).
The implementation of the Recycle Fee and Food Waste/Organic's Program and rates
are subject to notification requirements outlined in Proposition 218. In accordance with
these requirements, the City notified all residential and commercial property owners of
record regarding the potential PPI rate increase, Recycle Fee, Commercial Food
Waste/Organic Program and rates, and any other future adjustments that are allowed
within the Franchise Agreement.
Palm Desert's rates for waste and recycling services, with or without the Recycle Fee,
are less than the rates in other Coachella Valley cities served by Burrtec including
Cathedral City, Coachella, Indio, and La Quinta.

Outlined in the tables below are examples of how the proposed rate increase options
would affect residential and commercial customers:
OPTION A (RECOMMENDED):

OPTION B: PPI (TIPPING/DISPOSAL FEE) ONLY
Service Type Rate Increase Current New
Rate Rate
Residential Service: 96-gallon $0.27 $11.60 $11.87
serviced once per week
Commercial Trash Service: 3-yard $1.24 $251.30 $252.54
bin serviced three times per week (per bin per week)
Commercial Recycle Service: 3-yard $.43 $87.96 $88.39
bin serviced three times per week (per bin per week)
Note: No actual PPI increase to commercial. The rate increase only reflects the
County's Tipping/Disposal Fee increase and is a formality as Riverside County has
already approved the increase.
OPTION C: PPI and RECYCLE FEE
Service Type Rate Increase Current New
Rate Rate
Residential: 96-gallon serviced once $.62 $11.60 $12.22
per week
Commercial Trash Service: 3- yard $12.29 $251.30 $263.59
bin serviced three times per week (per bin per week)
Commercial Recycle Service: 3- $4.30 $87.96 ' $92.26
yard bin serviced three times per week (per bin per week)
Note: Rates are identical to Option A with the exception that Option A includes
the Commercial Food Waste/Organic Program
Staff recommends approval of implementation of the PPI adjustment, Recycle Fee, and
Food Waste/Organics Program and rates as proposed.
Fiscal Analysis
Implementation of the rate increases will not directly impact the City's General Fund.
However, approval of staff's recommendation would assist the City with recycling
related programs and help Burrtec to implement the Food Waste/Organics Program.
(Note: The County Tipping/Disposal rate increase will pass through to Burrtec
customers. The Food Waste/Organics rates will also pass through to Burrtec
customers; however, the Recycle Fee will be collected by Burrtec and be remitted to the
City in the approximate amount of $294,000 per year).

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Desert
(the "City") will conduct a Public Hearing on June 22, 2017, at 4:00 p.m., in the City
Council Chambers in the Civic Center, located at 73510 Fred Waring Drive,
Palm Desert, California 92260, or as soon thereafter as the matter may be heard, to
consider the annual solid waste and recycle Producer Price Index (PPI) rate change
and proposed implementation of Recycle Fee and new Commercial Organics Recycle
Rates.
The City has an exclusive franchise agreement with Burrtec Waste and Recycling
Services, LLC ("Burrtec") for the collection and handling of solid waste, recycling, green
waste ("Refuse") within the City. All property within the City is required to subscribe to
Refuse collection and handling services provided by Burrtec. Pursuant to the franchise
agreement, the amount to be paid Burrtec each year may be increased each July 1 by a
cost of living adjustment ("COLA") and/or any other approved fees. Additionally, it may
be adjusted for any increases in the rates for the tipping fees ("Tipping Fees") paid to
Riverside County for disposal of solid waste at the contractually approved
landfill/transfer station. In the event that there is an increase in the rates for Tipping
Fees, City ordinance authorizes the increase as a pass through to property owners
within the City. Provided, however, in no event shall the rates for the Refuse Fees be
increased, as a result of the Annual COLA or any Tipping Fee Pass Through, by more
than the City's cost of providing solid waste services or in excess of 5%.
Any property owner or any tenant directly responsible for the payment of Refuse Fees
(i.e., a customer of record) may submit a written protest to the proposed rate
imposition and potential rate increases to the City's Refuse Fees; provided, however,
only one protest will be counted per identified parcel. Any written protest must: (1)
state that the identified property owner or customer of record is in opposition to the
proposed rate increases; (2) provide the location of the identified parcel (by assessor's
parcel number or street address); and (3) include the name and signature of the
property owner or customer of record submitting the protest. Written protests may be
submitted by mail or in person to the City Clerk at 73510 Fred Waring Drive, Palm
Desert, California 92260, or at the Public Hearing (date and time noted above),
provided they are received prior to the conclusion of the public comment portion of the
Public Hearing. Any protest submitted via e-mail or other electronic means will not be
accepted. Please identify on the front of the envelope for any protest, whether mailed
or submitted in person to the City Clerk, Attn: Public Hearing on Refuse Fee Rate
Increases.
The City Council will hear and consider all written and oral protests to the proposed
rate increases at the Public Hearing. Oral comments at the Public Hearing will not
qualify as formal protests unless accompanied by a written protest. Upon the
conclusion of the Public Hearing, the City Council will consider adoption of an
ordinance authorizing the rate increases to the City's Refuse Fees as described
herein. If written protests against the imposition of proposed rates as outlined above
are not presented by a majority of property owners or customers of record of the
identified parcels upon which the rates are proposed to be imposed, the City Council
will be authorized to impose the proposed rates. If adopted, the proposed Refuse Fees
will be in effect beginning July 1, 2017.
For further details regarding the basis and reasons for the proposed rate increases to
the City's Refuse Fees, or for any questions you may have regarding the proposed
fees to be imposed on your parcel, please contact the City at (760) 346-0611 ,

Dear Palm Desert Residents and Business Owners, (ram
You are invited to attend a public hearing beginning at 4 p.m. on June 22, 2017, at Palm Desert
City Hall, located at 73510 Fred Waring Drive, where the Palm Desert City Council will consider
proposed changes to its refuse fees for waste disposal services.
The public hearing will provide an opportunity for you to share your input regarding the
proposed changes to the amount you pay for waste disposal services.
This letter supplements the detailed legal notice which is enclosed and required by law.The
letter provides a brief overview of the proposed changes to the amount you pay for waste
disposal services and describes how you may object to those changes if you would like to.
The City contracts with Burrtec Waste and Recycling Services for the collection and handling of
solid waste, green waste, organic waste, and recycling in Palm Desert. Burrtec's fees for these
services are set forth in its contract with the City and passed through to property owners and
customers. /2--
Under the contract, Burrtec's fees may be adjusted annually for residential customers and, I V
beginning July 1, 2018,for commercial customers, based on the national Producer Price Index
for Finished Goods (PPI). These PPI-related increases cannot exceed 5% per year.
Additionally, refuse fees may be adjusted when the tipping fees that Burrtec pays Riverside
County to dump waste at County landfills increase. The proposed increased rates, based on
the aforementioned changes, would be effective beginning July 1, 2017, and are shown in the
attached charts.
For commercial customers, State law requires the City to have an organic waste recycling
program. Under the proposed changes, some commercial customers would be subject to a ne
charge for the disposal of food and other organic waste. The charge would be based on the
size and number of a business' carts and the number of pick-ups per week. The propos.•
charges are shown in Exhibit 2 of the attached.
The City is also proposing a new Recycle Fee that would be incorporated into the rates for all
residential and commercial customers. The fee would help offset the City's costs to comply with
state mandates regarding the disposal of hazardous waste, used oil, sharps, batteries, etc.
For a typical residential customer with a 96-gallon container, serviced once a week, the
proposed changes would increase the amount paid for waste disposal services by 62 cents a
ont ay.}....44.....,
a
rn
A commercial 4tomer with a three-yard trash bin, serviced three times a week, would see its
rates increase by$8. -10

Property owners or tenants who pay waste disposal fees may submit a written protest to the
City regarding the proposed rate changes. Only one protest will be counted for each address
or identified parcel. Written protests must state that the property owner or customer opposes
the proposed changes, provide the relevant street address or assessor's parcel number, and
include the property owner's or tenant's name and signature. Oral comments at the public
hearing do not qualify as formal protests unless accompanied by a written protest.
Written protests may be submitted by mail or In person to the City Clerk at 73510 Fred Waring
Drive, Palm Desert, California, 92260, or at the aforementioned public hearing and must be
received by the City prior to the end of the hearing's public comment period. Formal written
protests cannot be submitted via e-mail or other electronic means.
The City Council will consider all written protests as well as comments made during the public
hearing and then consider whether to adopt the proposed rate changes.
If the written protests are not received from a majority of property owners or tenants,
the City Council will be authorized to impose the proposed rate changes.
For more information, please contact the City at 760-346-0611, ext. 331.
Sincerely,
Laud Aylalan

Attn: City Clerk
Subject Attn: Public Hearing on Refuse Fee Rate Increases
Dear City Council
With regard to your notification regarding the proposed changes to the amount we pay for waste disposal services,
please take into consideration the following:
The Courtyards at Desert Falls, Palm Desert, as with many homeowner associations, pay Burtec Waste and
Recycling Services monthly from the Homeowners Association directly. There are 102 unit owners in the
Courtyards Association but only 38 that are here during the summer months. The remaining 64 are not here for 6
months of the year. The association pays $9,878.00 a year for all of the 102 unit owners even when the owners
who do not put out trash for 6 months of the year.
This means that the association is paying for services not rendered by Burtec for those not here during the 6
summer months. The association pays Burtec $8.07 a month for the 102 units owners, including the 64 unit
owners that leave for the summer.
The following calculation shows what we pay yearly for Burtec's services which does not include the 63% of our
unit owners that are not here during the summer. This means that they are collecting for the services, which we
have contracted for but are in excess of what is needed by Burtec for the services. This is extra profit for Burtec.
Unit owners here full time (12 mo. of the year). $8.07 x 102 Units x 12 months=$9878
Amount paid in excess for unit owners that are here for 6 mo. of the year. $8.07 x 64 Units x 6 months = ($3099)
The Associations bill if paid for the services rendered would only total $6779
However for the convenience of the owners we pay for waste and recycling services for all owners 12 months of the
year. So currently Burtec gets and extra$3099 a year from our association for the services rendered.
Under these circumstances we find that the request for an additional increase in costs to the association is
unfounded and unfair to those paying for yearly pickup and protest the increases requested.

I am aga9nst your tax increase for services to our empty
Condominium. I am further upset by your timing when
most owners or renters are not in residence this late. I fully
understand you don't care because we are not voters but your
position is very one sided.
I am equally upset by the city not taking a vote on the wasteful!
Ling plan which has no set cost estimates for construction and
even less for maintenance. You knows better is not an answer.

Dear City Council:
I am writing to protest the upcoming proposed changes to the refuse fees for
waste disposal services for residential customers. It is unfair and burdensome to
increase these costs for this category of citizen.
When governmental entities want more money, such as the City of Palm Desert,
in this case, they just tell citizens, pay me more.
So, where does the average citizen go to ask for more money when you increase
their expenses?
Please do not burden residential customers with this proposed increase.
Thank you,
r,

RE: Burrtec Fee Increase
Gentlemen:
This recent notification of a potential price increase was one reason I did not want this money added to
my property tax, I lose control of my costs.
Secondly, I do not feel that there is sufficient information being provided to warrant another price
increase for the waste hauler, Burrtec, not to mention in Desert Falls Country Club Resort, the majority
of owner(s) are second home owner(s)and are not using their services weekly, but yet we are paying for
a weekly service. Thus this should be lowering the cost of doing business for Burrtec and I am certain
there are many more homes doing exactly the same thing.
Please register my NO NO VOTE against this proposed price increase.

Re: Opposition to Proposed Refuse Fees Increase
To Whom It May Concern:
I am the property owner of record for 77170 Florida Avenue, Palm Desert, CA 92211. As such I am
providing written protest to any proposed rate increase to Burrtec Waste and Recycling Services,
effective July 1, 2017.
The reason for my opposition is stated below:
• My visits to my property are generally from 5pm Saturday to 3pm Sunday, one to two times per
month.
• Any trash generated during these overnight visits is carted away to my primary residence in
Redondo Beach, CA, as my scheduled Palm Desert trash pickup is on Fridays, when I am never
present. Please note that at no time do I use any public receptacle to dispose of trash as the
trash generated by my visit generally consists of muffin wrappers and tissue paper.
• During the time period that Burrtec has been contracted with the City to pick up refuse, I have
NOT ONCE UTILIZED THEIR SERVICE. Still I pay for these services through my property taxes in
adherence to City regulations.
• You may review my service record with Burrtec and you will find that I have not once put a bin
of refuse for collection onto the streets.
Please;;ive my ohjm rion to a rate Inirw±se consideration in your p lhlic hearing on.I!In.= 72, 701.7

Comments or Concerns:
Good Afternoon,
I am the General Manager for the Ironwood Community Association and some of our homeowners recently received word
that there will be a public hearing to discuss Burrtec's proposed rate increases. It is our understanding that any objections to
the proposed fees be in writing and be received prior to the June 22 meeting.
Since the Ironwood Community is made up of many seasonal owners, most of our residents do not stay at their properties all
year round and therefore do not need to have trash service during the summer months. The proposed rate increase seems
unwarranted in this circumstance since it is based on trash collection for 12 months. Given the large number of homes in the
Ironwood community, this does amount to a significant increase.
It would seem to me that there should be some arrangements for Burrtec to offer a "vacation" hold which would ultimately
reduce their operational costs. We see this option in many other services such as newspaper and mail delivery.Thank you for
your consideration to this matter.
Sincerely,
Daniel Farrar
General Manager
Ironwood Community Association
Thank you,
