WHEREAS, or� Jtaly 9, 20'15 the City �oun�il held a full and fair public hearing regarding
t�a renewallforrnatian af fhe '�istrict and the estaE�lishment af annual assessments and fhe
maximuTn assessments required ta pay the rnaintenance and services af landscaping, lighting,
refuse coliection and all appur�er�ant facilities and aperations refated thereto for a five-year periad
b�ginnir�g July 1, 2�� 5 and ending June 3�, 2D20 pursuar�t fo the Cade; and,
WHEREAS, Upon conclusion of the public hearing oi Ju�y 9, 2�15 the �ity Councif
tabUlated the property owner assessment pratest �allots returned and �y resalufian cor�firmed ti�af
majarity protest did nat exist and by r�sofution a�praved the Mar�agemenf District Plan, appvir�ted
an Advisary 6oard for the District, ordered the renewalffarrnation flf the District, and ordered the
levy and cof�ection of the first ar�nual assessments; arid,
WHEREAS, pursuant to tha Code, the City �ounci! appointed the E[ Paseo Business
Asso�iation as the Advisary Board for the District and this Advisary 8oard shal[ cause to be
prepared an annual Managernent Dis#rict Plan (hereafter referred ta as the "Repflrt"} eaci� fiscal
year for w�ich assessmenfs are �o be le�ied and �aflected, sai� Repvrt shall be filed with the �ity
Clerk ar�d sha�l contain: any praposed ct�anges fo �ne District baundary; the impravements and
ac#ivities to be pravided; the estimated c�sts and method ❑f assessrnent; the amaunt of any
surplus or de�cit; and cor�tributio�s from ot��r sour�es; and,

presan#ed to tne Ci�y Council and �iled with the City Clerk, f�e ��y �ounci! heref�y finds and
detet�mines that;
A. The territary of land wifhin the ❑istricf will receive special benefits tram the
op�ration, maintenance and servicing af t�e imprvvements an� appurtenant
facifities lo�afed within the bvur�dari�s of the Disfrict.

Se�tion 5. The City Caunci] hereby orders the impro�ements to be made, and the levy and
calle�fion of annua! assessrnents to pay far thase irnpro�ements to be presented ta fhe Caunty
Audit�rlCantrvller af Ri�erside far Fiscal Year 2�17I��'i8, The Caunty RuditvrlCantrolfer sY�alf
er�ter ❑n the County Tax Roll oppasite eac� parcel of land th� amount �f �evy, and su�h [evies
shall �e callected at the sam� time and in the same manner as the GoUnty taxes are callected.
After coilectivn by the Counfy, the net amount af the �evy shall be paid ta the City Treasurer.
5ectian 6. The City Treasurer shall �eposit all rrioney r�preser�ting assessments �oltected �y
the Caur�ty fflr the Dist�ic� to the credit af a f�r�d for ti�e President's Pfaza Property and Business
Impro�ement Assessment ❑istrict, and such maney shall be expended �nly for the improvements
described in the Management District Plan.

The City af Pa[m Desert �uCity"} formed and established the Presidenf's Pfa2a
Praperty and Business Impro�ement Assessmer�t District {"District"} beginning in
Fiscal Year '199$l1999 t� pravide impravements and activities that confeT special
benefits upon real prv�erty within tne houndaries vf the Disfrict. The i�isfrict was
estabfished and le�ied pursuant to Pra�erty and B�sin�ss lmpravement District
L.aw af � 994, Rart 7 of Divisian 18 af the Galifornia Streets and Highways Code
(the Act}. Pursuant ta the Act, property awners within fhe District submitted a
signed petition reques#ing fvrmatian of #he Distric#. For each term, a maximum
assessment was approved by fhe prvperty owners through an assessment ballat
pra�eeding, cvnducted accarding ta pra�isions of the Califarnia Consfitutian
Arficle }CIIIa �"Pro�vsition �18"].The District was su�cessfully fvrmed far a term af
fve years ending in Fiscal Year 2�D21�003 and suc�essfufly renewed in Fiscal
Year �20�3120�4 far a term vf f[ve years ending in Fiscal Year 20D7l20D8. llnder
the provisions af the Act, fhe properfy vw�ers witi�in the District may rer�ew the
District for a maximum #erm of �fen �1 �} y�ars. The District then nee�s ta �e
farmed again and the process is the same as that vf th� ariginal fvrmatian. The
District was successful[y Re-farmed in Fisca[ Year 20'I512415 fvr a term of five
years ending in Fiscal Year 2Q'191202fl. Fiscal Year 2�1912��0 is the last y�ar af
the term af fhe �urrently existing District. Pursuant to tne Act, the City propvses
ta annually levy and calfect assessmerits to prflvide f�nding far improvements
and activities authori�ed within the ❑istric# fvr a periad of five years �Fiscal Years
2� 15I�0 � fi thraugh �a'! ���42�}.
This IVlanagement Qistrict Plan ("Plan"� descri�es the District, impro�ements and
activiti�s, mefhad vf appartionment, the propased assessments fvr the curr�nt
fiscal year, and the maximum assessment propased fvr the five-year durafion af
#he re-farmed District. The prvposed assessm�nts are based an fhe es#imated
�ost ta pro�ide t�e impro�ements, activities, and aperations that pra�id� a direct
and special benefit to praperties wifhin the District. The �asts vf impravements,
acti�ities, and aperatians inciude all expenditures, deficits, surpluses, r�venues,
and reserves.
Tha word "property," fvr the purposes af tt�is Plan, refers ta real praperty siivated
within the Districf, and iclentifed as an individual praperty or parcel assigned i#s
awn Assessar'S Pares[ Number 4APN) by th� �vunty af Ri�erside Assessvr's
�ffice. The County of Ri�erside AuditarlCantroller uses APNs tv identify on the
tax ro[I parcels and properties assessed for tax�s, special assessments, and fees

Pursuant tv the �ode, the renewal vf the ❑isfri�t requires similar praceedings tv
tnat of the initial District fvrmation. A written petitian af the �rvperty awn�rs within
the District, representing more than 5a percent (5fl°/o} vf the proposed
ass�ssment ta be levied was su�mitfed to the Palm Desert City Council. The City
Council initiated proceedings fvr fhe fvrmation ot the ❑istrict �y ada�ting a
resolutian expressing its intention to farm the Disfrict. The resolution af intentian
cantained the Managemen# District Pfan and th� time and place af a public
hearing on the establishment of the District and levy of assessments.
WitFiin 90 days ❑f adopting the resviut+on of intentian, the City Cvuncil held a
public hearing vn the matt�r, and caused notice tv fhe praperty owners pursuanf
ta Sectian 54954.6 af fhe G�vernment Code. Assessmenf ballvts �praperty
owner protesf balfo#s} inrere mailed ta each property awner af [east 45 days priar
to fhe public hsaring pursuant t❑ the California Gonstitutivn. Pursuant ta the
Cade, the City Council alsa caused the publi�atian af the res�lufion of infention in
a newspap�r of general circulafion; mailed the resaiutivn af intenti�n by first-
c[ass mai[ ta each prvp�rty awner in the District and to each [ocal �hamber af
cvmmerce and business argani�ation lacated within the District.
At the public hearing the City Caun�il pro�ided fhe public and property vwn�rs an
apportunity to provid� vra! profests and written protests priar to the adap#ion of
the Management ❑istricf Plan. Pursuant tv the California �onstitution, the City
Cauncif tabulat�� property owner assessment �allots recei��d fram prapsrty
owners fv determine whetY�er a majority protest exisfed. It was defermined and
de�lared by resolution that majvri#y prvt�st �id r�ot exist and the praper�y owners
canfirmed and approved the assessmenis.
Pursuant ta the C�de, the City Cauncil appointed an Advisory Baar� for the
District. This Advisory Board shall make yearly recommendatians ta the City
Coun�il vn tY�e exp�nditures of revenue derived from t�e levy af assessmsnts
a�d on the �fassification of properties as a�plica�le. At least one m�mber vf the
Ad�isvey Baard sha�l be a business licensee wit�in the District wha f5 nat a
prap�rty awner witliin the Distri�t. Tnis Ad�isory Baard shall cause to be
prepared a plan each fiscal year fvr whi�h assessments are fv be fevied and
�a!lected. Said annual plan shall be� fi[ed with the City C1erk and shall cantain:
any �rv�ased changes tv the district haundary; the improvements and a�tivities
ta be provided that year; the esfimated CD5t5 for that year; the methvd af
assessment; tne amaunt of any surplus or cleficit; and cantfibufians fram ather
sources. The City Cauncil may a�prave the plan as submitted ar as modifed.

The ❑isfrict consis#s vf a�l parcels lo�afed in the commercia[ business ar�a
known as the President's Plaza within the City af Palm Desert, Caunty vf
Riuerside. The ❑istrict includes forty-two �42) assessed c�mmercial parcels and
three �3} nor�-configuous.and non-assessed parking !ot parcels and one ('f) nvn-
assessed easementlwalkway parce[.
The baundary of the District and fhe parcels therein are laca#�d South of Palm
❑eserf Ori�e at Highway 1'11; Nvrth �f E[ Pasev; West vf Pvrfola Avenue; and
East of Larkspur Lane. President's PEaza is cammon�y referred t❑ as President's
Plaza East {fhe area east ot 5an Luis Rey Avenue}; and President's Plaza Vllest
(the area west of 5an LL1i5 Rey Avenue] fvcated within the �oundaries vf the
District.
fmpravernents and �I�t�vities
In an effort t� enY�ance and impra�e busin�ss oppartunifies and the ap�earan�e
of the area knawn as the President's Pla�a, the City provided funds for fhe
renovafi�n and capita! impro�ement of fhe �arKing Iot and lan�scaped areas
related to this cammer�ial business center. In canjunction with this renavation,
President's Plaza Pro�erty and 8usiness [mprovem�nf ❑istrict was fvrmed in
1998 tv pra�ide and ensure the c�ntinued mair�t�nance af the im�arovements
after the renavations had been c�mplet�d. Ir� ZO'i 5, the praperty awners renewed
tF�e ❑istric# fvr a fv� (5j year term and the assessments that are Ie�ied cantinue
to pro�ide fun�ing far this maintenan�e. The assessments gen�rate� will
cantinu� to �ro�ide th� necessary revenue far th� maintenance, and an incr�ase
in assessment will be added effe�tive fiscal year 24� T1��� 8 based on anticipated
increases in costs for #he District's a�ti�ities and far parking !ot mainter�ance.
It has �een d�termined that the properties within fhe District an� fhe businesses
associated with those pro�erties recei�e special and distinct henefits frc�m the
impTvvements and activities to be funded tt�raugh the assessme�fs. The
im�rovements include the necessary activities, services, aperatian,
administratian, and maintenance reqiaired ta keep the improvements in
satisfactary conditivn including fabflr, material, and equipment. The servicss r-�ay
include but are no# limited ta regufar maintenance, repair, remvva[ ar
re�lacem�r�i af al� ar any part of the imprvvements including patching vf asphalt,
slurry sealing, and stri�ing �f the parking Iot areas; remv�a[ �f trimmings,
rubb�sh, dek�ris and ather sofid waste; the �leaning, sandblasting, and repainting
of walfs and other improv�ments ta remave ❑r cover graffiti; praviding for the
grawth, health and �eauty of ]andscaping and lighfing incfuding cultivatian,

All assessed praperties within the District recei�e special benefts from on� or
more of the im�ro�ements and activities funded t�rvugh the District
ass�ssments. 5�ecificaUy, lighting and landscaping .amenities within the parking
Ivts, regular swee�ing and main#enance of the parking lots, and refuse collectian
services and facilities.
The special henefits af lighting (parking Iot ligh#sj are the �vnvenience, safety,
and security �f �roperty, impra�emen#s, and goads. Spec�fically:
1. Enhanced deferrence af �rime and the aid ta police prote�tivn;
�. Increased n�ghttime safety for patrons and empl�yees; I
3. Imprvved visihflity for pedestrians and motvris#s;
4. Imprvved ingress and egress to pro�erty;
5. Reduced �andalism and other criminal acts and damage ta

6. Enhanced aesthetic appeal vf the parking areas and the pra�erties that

lots are specifically:

environmenf;
4. Imp�o�e� traffic circulativn;
5. A positiv� r�pr�sentatian vf the businesses within the Distri�t;
6. Centralized locafivns for refus� cvllectian fa�ilities; and,
7. The speciaf econamic enhancement ta the �roper#ies and theiT abifity
tQ attra�t and sustain business and commercia! activity as a resu[t af
#he benefifs �denti�ed aba�e.
❑ebris remvval �parking lat swee�ing� and refus� cvllection are esser�tia[ an�
necessary activities far all pro�erties—particularly commercial properties. These
activities and services are praposed to he funded thraugh the assessments
salely for tfi� special beneft vf properties within the District. The benefits
assaciated wifh these services are:
'1. Enhanced aesthetic a�peal nf the parking areas and fhe pro�erties that
are assQ�iat�d with the parking areas;
�. Impra�ed dust canfral;
3. A� pasiti�e re�resentatian vf the businesses within the District; and
4. A cenfralized focation vf refuse cvllectian facilities and availability af
#he service that would Qtherwise require ind�vidual fa�ilities that cauld

Parking Iot maintenance is an essential and n�cessary acti�ity far all properties,
and in particular, far commercial prvperti�s. Th�s im�rvvement is funded through
ihe assessments solely far the special �enefit ot properties witnin the District.
The benefits assv�iated with this servi�e are:

Pardcing Lat lmpro�emen�s and Servi�es
Assessed parcels within President's Pfaza are adjacent to centralized �arking
facili#ies �lais} that provide access, parking, and d�livery areas for ti�e husir�esses
and parce[s within t1�e DEstri�t. Each parce� d�rives special benefi# fram #he
parking lot improvements and the services and activities necessary to maintain
the parking lot. The improvements and activities incfude maintenance of several
lands�aped islands ancf rnedians, maintenance and aperation af iighting facilities,
par[ti�g Ivf maintenance, and sweeping services. Each assessed parcel within
the District re�eiv�s a direct and spec�al �enefi# fram th�se imprvv�ments and
will share praportionate{y in the cost of maintaining the parking Iots. The parking
areas cansists of the three parcels #hat are entirely parking !ot area and pvrtivns
�f many af the assessed parcels wi#hin th� Qistrict. The three parcels that are
entirely parking lot area parcels �627-�92-416; 627-22'I-��1; and fi27-2��-043j,
and ane easementlwalkway parcel {627-222-042} receive na special �en�fit fram
#he impro�ements and will nat be assessed.
In determining the mefhvd of apportionment fvr these iinprvvements, each
parcel's benefit is based ❑n the �arking arEa adjacent to, and assacia#ed with,
each parcel. Therefore, it has been determined that a fair and reasonable
re�lect�an of each parcel's henefit far #he parking lat imprvvements shal[ be based
on t�� appraximate frant footage adjacant to the parking areas. Most parcels
within the District front fhe parking lvfs on anly one side. To ensure a reasonable
and equitable appvrti�nmenf af spec�al benefit, parcels that front the parking Iaf
vn m�re than one side �corner praperties}, are an�y assessed for #heir frvnt
footage alang #he side of their property adjacent to the parking Ivt.
5v�id Waste (R��use} Co!lection 5ervices
Es#ablishing separate refuse rec�ptacles far ea�h parcel vr �usiness within
President's P{aza, and thereby allawing far separate charges and agreemenfs for
this service, is na# prac#ical due to �imited space and a�cessibility. Therefore,
severa� cvmman refuse �antainers have been placed within the parking lot area
for use by al� the properties and businesses, and patrans af these businesses,
within the District. Histori�alfy, al! developed pro�erti�s wit�in Presid�nf's Plaza
have shared proportionatefy in the �osts associated with refus� calle�tivn based
vn the building square footage vf the strucfures on each parce[.,
In determining the methad _af appartionment fvr refuse cal[ectian services, the
passi�ility of fact�ring in business t7rpes as wel� as buiiding square faatage was

cansidered. Hawever, the inclusian af business fypes in fhe calculatian af an
annual assessment poses se�eral �rablems. First, many af the parcels assessed
include multiple busir�ess types, which �could r�quire a camplex �alcula#ian to
identify pat�ntiai use af the service. 5ec�nd, businesses aften change fram year
to year or even month ta month, maKing spe�ific business relafed assessments
difficult t❑ #rack and time-consuming and expensive to administer. Third,
establishing a method vf appartivnm�nt that is business-spec�fc rather than
parcef-specifrc wauid likely resuEt in annual changes for each �ar�ePs
assessment even if ih� cvst of the service was unchanged. Finally, tY�e level of
servic� (number af pick-u�s and re�eptacles} has change� very litt�e ��er t�e last
several yeaTs. AI#hough many of the �usinesses and business #ypes have
changed within the ❑istrict, the tatal cast af providing fnis service has remained
fairly cvnstant.
ln cantrast tv the total cost, it is nvt reasvna�le to assume that a11 deuelv�ed
parcels Ut�lize ar require the same le�el of refuse senrice—typica[ly the largeT the
bu�lding, the greater amaunt af refuse that is gensrated, T�erefore, it has be�n
determined that a fair and reasvnable estimate vf each pa�cePs benefit for refuse
cvllectian is fhe bui[ding square fvatage determ9ned for each parcel.
As noted previvusly, due tv limited space and accessi�ility, it is nvt practica! for
each parcel ar business within Presiden#'s Plaza ta ha�e separate cantainers or
agreements with the waste hauler. Hawever, it is re�agni2ed that th� baseline
[e�el of service �i.e., number of bins, si�e of the �ins ar�d frequency of service}
established far t�e ❑istrict may nof be adequate or appropriate[y reflect the
nee�s of changing business within the District. Therefare, the follawing
consideratians and �riteria shal! be fa[lowed wher� #he [evel a� servi�e pra�ided
requires modi�icativns:
1. If the le�el vf service is redu�ed, the it��rementaf cost savings �if any} will �e
reviewed and a�plied as fvilaws:
a. R�serve Fund Accaunt — The City staff and the vwners' assaciativn wi11
e�afuate the existing availahle Reserve Funds to ensure an acceptable
amount of maney is k�eing retained fQr narmai annua[ aperatian of the District.
Based vn this evalua�ivn, the owners' assaciatian wi[I modify fh� annuaf plan
�recammendatian to the Gity Cvuncil} ta apply all ar a portian of the CDSt
sa�ings ta #he Reserve Ac�aunt. A fully funded R�senre is an amvunt equal
ta approximately one ha� f of al� annual aperating expenses. However, most
operating resenres are typically less t�an 50°/0, but greater than 25°/0 of all
annua! v�erating exp�nses.
b. Reduced Assessmenfs — Rffer reviewi�g the Reserve Account, any cvst
sa�ings nof applied to the Reserve Accaunt (Reserve Fund Co�fecfi�n} will he
passed on ta each parcel wifhin the District �y reducing th�ir annua]
assessment for the next fiscal year, in proparti�n to tneir est�mated henefit
�frvm th� methvd af apportianm�ntj. �

2. If the le�el af service is increased, the incremenfa! .cbst increase �it any} wifl

a. Increased service District-wide --- VlThen th� current Dist�ict was
renewedlfvrmed, an assessment range f�rmula was ap�aro�ed. Th�s farmula
pravided fvr anficipated cast vf li�ing increases, but also allowe�i svme
f�exibility far increased �vsts due ta increasec! [eveis af service. If an
increased ievel af service is required for the entire District, the increase is
reflec#ed in the annual huc�get. This budget increase wil[ typically cause a
prap�rtianal increase of the annual assessment. lf #he increased cost resuits
in an assessment rate that exceeds the maximum assessment aflowed, th�n
r�serve funds wiil be used to reduce the annual assessmer�t to the maximum
assessment al[awed. If the reserve fund is nvf sufficient ta caver th� cos#
increase, the City Cvur�cil may pra�ide a tempvrary �aan to the District or
conduct a property owner baliot proceeding fvr an assessmenf increase.
b. �ncreased service fvr ane parcel — When fhe current District was
renewedJformed, a baseline assessment rate and level of service was
established far alI prv�art«s within the ❑istri�t. As businesses within th�
District change or continue ta graw, these businesses may generate a need
for an increased le�el of service, huf if is nof fair ❑r equitable to s�rea� the
cvst vf fhis increased senri�� ta ather prvperti�s within the Distri�t. Th�r�fvr�,
- if a�usiness requir�s an inc�eased leve! af service, t�at particular business
�wner ar tFte owner vf the property on whi�h the business is lacated, mtast
pay the resulting cvst increas� as a surcharge. Eith�r the City or the prop�rty
owner may initiate the need for an in�reased service level. The City �oun�il
