Recommendation
Waive further reading and pass to second reading Ordinance No. 1330
approving the amendment of Section 9.24.070, Construction Activities.
Strategic Plan Objective
The proposed action has no impact on the strategic plan objectives.
Background
The current summer season work hours are six a.m. to seven p.m. These hours are in
effect May through September. The City regularly receives requests to begin work
earlier than six a.m. due to concerns for worker safety in the high temperatures of the
afternoon hours. In order to allow workers to maximize their work hours during in the
cooler morning hours, Staff is proposing to adjust the work hours accordingly. The sun
rises as early as five thirty-four a.m. in the summer months, so adjusting the work hours
to start thirty minutes earlier will allow workers the option to utilize all the morning light
during cooler temperatures.
Staff believes this change will have a minimal impact on residents. The first being that
this change is only effective during the summer months when more residents are out of
town, or on vacation. Also, during this time windows are likely to be closed due to the
high temperatures, minimizing the potential noise. Overall, staff believes this is a
positive adjustment to accommodate workers during the summer season.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA AMENDING PALM DESERT MUNICIPAL CODE
SECTION 9.24.070 RELATED TO WORK HOURS FOR CONSTRUCTION
ACTIVITIES
The City Council of the City of Palm Desert, California, does hereby ordain as follows:
SECTION 1: That section 9.24.070 Construction activities of the Palm Desert Municipal
Code is hereby amended to read as follows:
No person shall perform, nor shall any person be employed nor shall any person cause any
other person to be employed to work for which a building permit is required by the city in any
work of construction, erection, demolition, alteration, repair, addition to or improvement of any
building, structure, road or improvement to realty except between the hours as set forth as
follows:
October 1st through April 30th
Monday through Friday: Seven a.m. to five -thirty p.m.
Saturday: Eight a.m. to five p.m.
Sunday: None
Government code holidays: None
May lst through September 30th
Monday through Friday: Five -thirty Six a.m. to seven p.m.
Saturday: Eight a.m. to five p.m.
Sunday: None
Government code holidays: None
Emergency work and/or unusual conditions may cause work to be permitted with the consent
of the city manager upon recommendation of the building director or the city engineer. (Ord.
1170 § 1, 2008; Ord. 1169 § 1, 2008; Ord. 752 § 1, 1994; Ord. 420, 1985)
SECTION 2: That the City Clerk shall certify to the passage and adoption of this
ordinance, and shall cause the same to be published in the County of Riverside and circulated
within the City of Palm Desert, and shall be in full force and effective thirty (30) days after its
adoption.
