By Minute Motion:
1. Authorize staff to solicit prequalifications from design-build entities, and
solicit design-build proposals from entities deemed to be qualified for the
design and construction of the San Pablo Avenue Corridor Improvements;
and
2. Appropriate $8.235 million from unobligated Capital Project Funds to
Account Number 4514342-4400100, SARDA Bond Project Funds.
Strategic Plan Objectives
The improvements to the San Pablo corridor fulfill priorities identified in the City's
Strategic Plan as follows:
• Land Use - Priority 4: Create a mixed-use city core integrating shopping, dining,
lodging, and housing.
• Tourism and Marketing — Priority 1: Improve access to Palm Desert and its
attractions to enhance the ease of lifestyle.
• Transportation — Priority 1: Create walkable neighborhoods and areas within
Palm Desert that would include residential, retail, services and employment
centers, and parks, recreation and open space to reduce the use of low
occupancy vehicles.
• Transportation — Priority 3: De-emphasize single/low-occupancy vehicles and
optimize modes of travel (bus, carpool, golf-cart, bicycle and pedestrian).

Background
On July 13, 2017, the City Council approved the preliminary design for the San Pablo
Avenue Corridor Improvements project prepared by Sargent Town Planning. The plan
represents the collective efforts of the San Pablo team, and has been vetted with the
City Manager, the Director of Public Works, and the Director of Community
Development. The City Council also directed staff to prepare final construction
drawings.
After careful consideration by the management team, a decision was made to explore
the possibilities of moving away from a standard design-bid-build contract to a more
inclusive, expeditious design-build contract.
Staff worked with legal counsel to vet the design-build contract process and asked for
guidance on the best method to use. Our legal counsel identified a two-step method
for proceeding with the design-build contract as the better alternative. The first step in
the process would be to issue a Request for Prequalification's (RFQ) to solicit qualified
design-build entities. The RFQ packages will be evaluated by staff and legal counsel to
short list up to five qualified firms. The second step in the process will be to issue a
Request for Proposals (RFP) to only those entities that have been pre-qualified and are
on the short list. The pre-qualified entities will be asked to submit design alternatives
along with their proposed design fees and construction costs. A copy of the complete
RFQ package has been included for your reference.
In addition, the management team identified a segment of the San Pablo Corridor that
overlaps the future CV Link project to be built by the Coachella Valley Association of
Governments (CVAG). The segment north of the College of the Desert entrance to
Magnesia Falls Drive is currently being designed by the CVAG CV Link team for future
construction. The management team made the decision to remove this segment from
the San Pablo Avenue Corridor Improvements project to provide a clear transition
between the two projects so that the CV Link team will be able to fully develop this
segment to ensure uniformity throughout the CV Link project. Staff will coordinate
design efforts to avoid conflicts, and provide for a smooth transition between the two
projects.
Fiscal Analysis
There is no fiscal impact associated with the RFQ phase of this project; however, the
cost of the project is currently estimated at $10 million. The Fiscal Year 2017/18 budget
includes $1.765 million in Account Number 4514342-4400100 for this project. Staff is
requesting an additional appropriation of $8.235 million to Account Number 4514342-
4400100 from unobligated Capital Project Funds pursuant to the Bond Proceeds
Funding Agreement with the Successor Agency to the Palm Desert Redevelopment
Agency. Once the project is complete, staff estimates the on-going maintenance and

utility costs to be approximately $48,000 per year. This is a conservative estimate
based on current labor and utility costs extrapolated from similar areas around the City.
As with most costs, they may rise in the future.

NOTICE REQUESTING
PREQUALIFICATION PACKAGES
FROM DESIGN-BUILD ENTITIES FOR THE
SAN PABLO AVENUE CORRIDOR IMPROVEMENTS, CITY PROJECT 691-16
Notice is hereby given that the City of Palm Desert ("City") intends to request competitive
proposals for Design-Build services for the San Pablo Avenue Corridor Improvements, City
Project 691-16 ("Project") and has determined that Design-Build Entities must be prequalified
prior to submitting a proposal. It is mandatory that all Design-Build Entities who intend to submit
proposals for this Project fully complete the prequalification application package
("Prequalification Package"), including but not limited to the Prequalification Questionnaire
("Questionnaire"), provide all materials requested herein, and be deemed prequalified by City to
be eligible to submit a proposal in response to the request for proposals (RFP).
The completed Prequalification Package must be delivered to and received by City no later than
2:00 p.m. on November 10, 2017. Prequalification Packages must be submitted in accordance
with the Instructions. A mandatory conference to discuss this Request for Prequalification
Packages and answer questions from prospective D-B Entities prior to prequalification submittal
will be held in open forum on October 19, 2017 at 1:00 p.m. at City of Palm Desert's
Administrative Conference Room (ACR).
It is the City's intent that all firms obtain the full content of this Prequalification Package and any
addenda via the City's website located at www.cityofpalmdesert.org. To view the
Prequalification Package, from the main menu under "Quick Links," click on "Projects Up For
Bid". An email must be sent to the project manager acknowledging receipt of the
Prequalification Package so that the City can add the firm to its notification list. Please include
the Contact Person, the name of the firm, address, phone number, and e-mail address.
City reserves the right to cancel this Notice or to reject any and all responses and
Prequalification Packages if it determines, in its sole discretion, that such cancellation or
rejection is in the best interest of City.
City anticipates, subject to change in City's sole discretion, that this Project requiring
prequalification shall generally consist of design-build services for the design and construction
of the following:
• San Pablo Avenue Corridor improvements including but not limited to the design and
construction of Traffic Circles, Asphaltic Concrete, Sidewalks, Bike Paths, Landscaping,
Decorative Hardscape, Irrigation, Storm Drain, Decorative Concrete, Electrical (Low and
High voltage), Signing and Striping, Retaining Walls and Decorative Wall Facades.
Teams should include but not be limited to Class "A" Contractors, Transportation Engineers,
Civil Engineers, Landscape Architects, Art in Public Places Consultant, Electrical Engineers,
Utility Coordinators and others as required.
The Project is located on San Pablo Avenue from Highway 111 to just south of Magnesia Falls
Drive.
In accordance with California Labor Code Sections 1770, 1773, 1773.1, 1773.6 and 1773.7 as
amended, the Director of the Department of Industrial Relations has determined the general

prevailing rate of per diem wages in accordance with the standards set forth in Section 1773 for
the locality in which the Work is to be performed. In accordance with City Ordinance No. 1276,
this project shall require prevailing wage payments. Any contract entered into pursuant to this
notice will incorporate the provisions of the State labor Code. A copy of said wage rates can be
obtained by accessing the Department of Industrial Relations website at:
www.dir.ca.gov/DLSR/statistics research.html or by contacting the District Office at 464 West
Fourth Street, San Bernardino, California 92401.
Answers to questions contained in the Prequalification Package, information about current
bonding capacity, a notarized statement from surety, the most recent reviewed or audited
financial statements, with accompanying notes and supplemental information, and proposed
costs, will be used by City in order to rate Design-Build Entities with respect to their
qualifications to submit a proposal on the Project. City reserves the right to check any other
sources available to verify a Design-Build Entities' statements, prior performance and veracity.
City's decision will be based on objective evaluation criteria.
City reserves the right to adjust, increase, limit, suspend or rescind the prequalification rating
based on subsequently learned information. Design-Build Entities whose rating changes
sufficient to disqualify them will be notified and given an opportunity for a hearing consistent with
the hearing procedures contained herein.
While the prequalification process is intended to assist City in determining respondent
responsibility prior to submission of proposals and aid City in selecting the Design-Build Entity
for this Project, neither the fact of prequalification, nor any prequalification rating, will preclude
City from a post-bid consideration and determination of whether a respondent has the quality,
fitness, capacity and experience to satisfactorily perform the proposed work, and has
demonstrated the requisite trustworthiness.
The submitted Prequalification Packages are not public records and are not open to public
inspection. All information provided will be kept confidential to the extent permitted by law.
However, the contents may be disclosed to third parties for purpose of verification or
investigation, or in the appeal hearing. State law requires that the names of Design-Build
Entities applying for prequalification status shall be public records subject to disclosure, and the
first page of the Questionnaire will be used for that purpose.
The Design-Build Entity shall provide only complete and accurate information. The Design-
Build Entity acknowledges that City is relying on the truth and accuracy of the responses
contained herein. Each Prequalification Package must include a signed affidavit, which shall be
signed under penalty of perjury in the manner designated and by an individual who has the legal
authority to bind the Design-Build Entity. If any information provided by a design-build entity
becomes inaccurate, the design-build entity must immediately notify City and provide updated
accurate information in writing, under penalty of perjury. Should a Design-Build Entity omit
requested information or falsify information, City may determine that Design-Build Entity not
prequalified.
City reserves the right to waive minor irregularities and omissions in the information contained in
a Prequalification Package submittal and to make all final determinations. City may refuse to
grant prequalification where the requested information and materials are not provided. There is

no appeal from City's decision not to prequalify a Design-Build Entity due to an incomplete or
late application.
Where a timely and completed prequalification application results in a rating below that
necessary to prequalify, an appeal can be made. To appeal, the Design-Build Entity must
deliver notice to City of its appeal of the decision with respect to its prequalification rating, no
later than five (5) calendar days after City staff issues its recommendation of the qualified
respondents list of Design-Build Entities for the Project. Without a timely appeal, the design-
build entity waives any and all rights to challenge the decision of City, whether by administrative
process, judicial process, or any other legal process or proceeding.
If a Design-Build Entity provides the required notice of appeal and requests a hearing, the
hearing shall be conducted so that it is concluded no later than ten (10) calendar days after
City's receipt of the notice of appeal. The hearing shall be an informal process conducted by
the City Manager or designee, who is delegated responsibility to hear such appeals (the "Project
Appeals Hearing Officer"). At or prior to the hearing, the Design-Build Entity will be advised of
the basis for City's prequalification determination. The Design-Build Entity will be given the
opportunity to present information and reasons opposing the rating. Within two (2) business
days after the conclusion of the hearing, the Project Appeals Hearing Officer shall render his or
her decision, which will be final and binding. It is the intention of City that the date for the
submission and opening of any bids will not be delayed or postponed to allow for completion of
an appeal process.
The Prequalification Package, its completion and submission by the Design-Build Entity, and its
use by City, shall not give rise to any liability on the part of City to the Design-Build Entity or any
third party or person. This is not a request for proposals. No guarantees are made or implied
that any projects will be constructed, either in part or whole. The Design-Build Entity accepts all
risk and cost associated with the completion of the Prequalification Package without financial
guarantee.

1. GENERAL DESCRIPTION OF THE PROJECT
The purpose of the Project is to design and construct approximately one mile of San Pablo
Avenue between Highway 111 and Magnesia Falls Drive. The design will reduce street widths,
introduce new landscaping, introduce new parking, beautify existing community gardens, and
enhance the commercial corridor between Highway 111 and San Gorgonio Way. The Project
budget is estimated to be approximately $10 million dollars.
The Project is divided into the following three (3) distinct zones along the corridor:
Zone 1- Commercial Core between Highway 111 and San Gorgonio Way includes

2 to this document.
2. GENERAL STATEMENT OF PREQUALIFICATION CRITERIA AND PRIORITIES
Design-Build Entities should include members with the following qualifications:
■ For Design:
— Ability to create project schedules using Microsoft Project
— Ability to generate appropriate maps of the Project site in AutoCAD and GIS format
— Ability to identify, recommend and incorporate art in public places
— Design-build experience with projects similar in size, scope, type, complexity and
cost to the Project
— Experience designing projects subject to the jurisdiction of the regulatory agencies
with authority over this Project
— Experience working with the Contractor included in the Design-Build Entity
— Experience obtaining the permits and regulatory approvals required for the Project
■ For Construction:
— California Class A General Engineering Contractor License
— Design-build experience with projects similar in size, scope, type, complexity and
cost to the Project
— Experience constructing projects subject to the jurisdiction of the regulatory agencies
with authority over this Project
— Experience working with the other parties included in the Design-Build Entity
3. A DESIGN-BUILD ENTITY DEFINED
A Design-Build Entity ("D-B Entity") is defined as "a partnership, corporation, or other legal entity
that is able to provide appropriately licensed contracting, architectural, and engineering services
as needed pursuant to a design-build contract."
City will consider teams consisting of a general contractor with contractual relationships with
entities providing the other required licenses and capable of providing all services required for
the Project.
For purposes of prequalification, each D-B Entity must identify and provide information for
certain Core Organizations, which include the General Contractor and Architect/Engineer of
Record. These Core Organizations must individually complete the appropriate scored-question
portions of the Prequalification Questionnaire and obtain a passing score in order for the D-B
Entity as a whole to be qualified. Failure to provide the appropriate completed portions of the

questionnaire from all required Core Organizations may result in determination of not
prequalified.
If the D-B Entity chooses to use an entity with the capability of performing both design and
construction services (e.g., a subcontractor with a licensed engineer and design staff), then that
member must submit the applicable Prequalification Questionnaire for each Core Organization
and successfully qualify for the relevant disciplines.
City reserves the right to specify additional requirements for subcontractors or sub-consultants
in the Request for Proposals for the Project.
4. COMPETITIVE SELECTION PROCESS
City envisions respondents to consist of teams of consultants, design professionals and
contractors that collectively possess all of the experience required to perform the entire Project.
City plans to select a D-B Entity for the Project through a two-step competitive selection
process:
■ Step 1: Prequalification Phase of responsible and qualified D-B Entities
— Mandatory Pre-Submittal Conference
— Interested D-B Entities submit Prequalification Package by the date listed in the
Notice Requesting Prequalification Packages
— City determines the list of Prequalified D-B Entities
Only the D-B Entities that are listed in the Prequalified Proposers List at the
conclusion of Step 1 (meet the minimum requirements and ranked as one of the top
five in total score)will be allowed to participate in Step 2.
• Step 2: Proposal Phase during which City will consider proposals and pricing submitted by
prequalified D-B Entities. City will pay a stipend to each D-B Entity deemed responsive that
is not selected for the Project as partial compensation for the cost of its proposal.
5. PROJECT PHASES & CONTRACT STRUCTURE
City anticipates the following phased approach for the Project:
• Phase 1: Design
— The successful D-B Entity will prepare complete design documents and
specifications for the Project (with agreed upon milestones and approvals)
— Final design documents and specifications approved by City and regulatory agencies
with authority.
• Phase 2: Construction
— D-B Entity Identifies Utility Conflicts,

— D-B Entity Designs, Coordinates and Constructs Utility Relocations
— D-B Entity constructs the Project within the Guaranteed Completion Date and for the
Guaranteed Maximum Price.
6. PREQUALIFICATION REQUIREMENTS
It is mandatory that all interested D-B Entities submit a complete Prequalification Package,
including a completed Prequalification Questionnaire, Price Proposal, and ALL additional
requested materials, for City's review and evaluation. In order to be deemed prequalified by
City and be listed on the final Prequalified Proposers List for the Project, a D-B Entity must pass
each section/subpart and be ranked as one of the top five (5) in total score. Only D-B Entities
that are listed on the Prequalified Proposers List will be eligible to submit a Proposal.
One part of the Prequalification Questionnaire includes a cost component that will be used for
both the purpose of scoring each D-B Entity for prequalification and binding the D-B Entity
chosen to design and build the Project.
Prequalification Packages that fail to include ALL of the requested information, present
false or misleading information, or are not submitted in the format requested may be
considered nonresponsive and rejected on that basis.
While the Prequalification Questionnaire and required attachments are intended to assist City in
determining qualification and responsibility prior to submittal of proposals, City reserves the right
to utilize information from other sources in its prequalification evaluation of D-B Entities. City's
prequalification determinations will be based on objective evaluation criteria.
However, neither the determination that a D-B Entity is prequalified, nor any prequalification
rating, will preclude City from additional post-proposal consideration and determination of
whether a proposer has demonstrated the requisite trustworthiness, quality, fitness, capacity
and experience to be eligible for award of the design build contract.
7. PREQUALIFICATION PROCEDURE
City has based the Prequalification Questionnaire on model prequalification documents
prepared by the California Department of Industrial Relations. Accordingly, the prequalification
procedure described herein: (1) requires a standardized Prequalification Questionnaire, (2)
adopts and applies a uniform system for rating D-B Entities on objective criteria, and (3) creates
an appeals procedure by which a D-B Entity that is found to be not prequalified may dispute that
determination.
Except for the Contact Information section (subpart I.A) of the Prequalification Questionnaire,
which will be considered a public record, completed Prequalification Questionnaires and all
required attachments submitted by D-B Entities during the prequalification phase shall not be
open to public inspection pursuant to Public Contract Code sections 20121 and 20133. City will
keep all such information confidential to the extent permitted by federal and state law. However,
City reserves the right to disclose submitted prequalification information to third parties for
purpose of verification, investigation, or in an appeal hearing.

8. MANDATORY PREQUALIFICATION CONFERENCE
A mandatory conference to discuss this Request for Prequalification Packages and answer
questions from prospective D-B Entities prior to prequalification submittal will be held in open
forum on October 19, 2017 at 1:00 p.m. at City of Palm Desert's Administrative
Conference Room (ACR).
Attendance at the meeting by a representative of the D-B Entity is a prerequisite for submitting a
Prequalification Statement.
9. PREQUALIFICATION REVIEW AND NOTIFICATION PROCESS
The completed Prequalification Package with required attachments must be submitted by the
deadline specified. Once received, City will review and notify the D-B Entities as follows:
Receipt: The original Prequalification Package will be stamped upon receipt with an official date
and time of receipt.
Completeness Review: Each prequalification submission will be reviewed for completeness by
City staff within five (5) business days from the deadline date. The D-B Entity will then be
notified as to completeness (by telephone, facsimile, or electronic mail, at City's discretion).
City staff may request additional information and if such request is made, the D-B entity will
have three (3) business days from such notification to submit the requested information and the
time limits for Staff Review and Qualification Notification shall be adjusted accordingly.
Staff Review: Each complete Prequalification Package will be reviewed by City staff within
fifteen (15) business days from the submission deadline date.
Qualification Notification: Each D-B Entity will be notified of its qualification rating by certified
mail within twenty (20) business days from the submission deadline date.
A D-B Entity must meet the minimum requirements for prequalification for consideration.
In addition, all D-B Entities meeting the minimum requirements will be ranked according
to the Total Score rating. The five D-B Entities receiving the highest ratings will be listed
on the Prequalified Proposers List and will be eligible to submit a proposal for the
Project. All D-B Entities listed on the Prequalified Proposers List will be notified when
the Request for Proposal documents are issued.
If the D-B Entity is rated as "Not Prequalified" for the Project, it may appeal the determination in
accordance with the appeal procedure set forth herein.
10. APPEAL PROCESS
A D-B Entity may appeal the rating of a timely and complete Prequalification Package. Upon
written request, City will provide to the non-qualifying D-B Entity in writing the basis for the
determination that the Proposer is not prequalified, and copies of any supporting evidence that
has been received from others or adduced as a result of City's own investigation.
In order to appeal, a D-B Entity must deliver to City written notice of its appeal of City's
determination with respect to that Entity's prequalification rating no later than 5:00 p.m. on the

fifth (5th) business day after City issues notice of non-qualification (not the date the D-B entity
receives such notification of non-qualification). The notice of appeal must be submitted to Mark
Greenwood, Director of Public Works. Failure to timely appeal a non-qualified prequalification
determination waives any and all rights of a D-B Entity to further challenge City's prequalification
determination.
The notice of appeal must include a complete statement of the reasons and facts for the appeal;
must refer to the specific portions of all documents that form the basis for the appeal; and must
include the name, address, email address, facsimile number and telephone number of the
person representing the D-B Entity appellant.
If a D-B Entity gives the required notice of appeal and requests a hearing, a hearing shall be
conducted no later than ten (10) business days after City's receipt of the notice of appeal. The
hearing shall be an informal process conducted by Mark Greenwood, Director of Public Works
(the "Project Appeals Hearing Officer"). During the hearing, the D-B Entity will be given the
opportunity to rebut any evidence used as a basis for the non-qualified determination and to
present evidence to City as to why it should be found prequalified.
The Project Appeals Hearing Officer will render his decision in writing to the D-B Entity. The
written decision of the Project Appeals Hearing Officer shall be final. It is the intention of City
that the date for the submission of Proposals in response to the Request for Proposals will not
be delayed or postponed to allow for completion of an appeal process.
The appeal procedures and time limits set forth in this section are mandatory and constitute
each D-B Entity's sole and exclusive remedy in the event of an Appeal. A D-B Entity's failure to
timely complete both the appeal and appeal procedures shall be deemed a failure to exhaust
administrative remedies. Failure to exhaust administrative remedies, or failure to comply
otherwise with these procedures, shall constitute waiver of any right to further pursue the
appeal, including filing a Government Code claim or legal proceedings.
11. REQUESTS FOR CLARIFICATIONS
Any questions and requests for clarifications regarding the Project and the prequalification
process must be in writing and submitted directly to: Joel Montalvo at
jmontalvo@cityofpalmdesert.org by the date listed in the Notice Requesting Prequalification
Packages.
Please be advised that City will not respond to questions received after the time
specified.
12. ANTICIPATED PREQUALIFICATION SCHEDULE
Refer to the Notice Requesting Prequalification Packages for the schedule of events for this
Prequalification process.
City reserves the right to extend the deadline for submittal of Prequalification Packages and
related materials. If it chooses to exercise this right, it will do so through an addendum sent by
e-mail to all persons or entities that requested prequalification materials.

13. CONFLICTS OF INTEREST
No architect or engineer retained by City who assists in the development of pre-proposal
Project-specific documents such as the conceptual plans may participate in any D-B Entity in
the preparation of a proposal for the Project.

14. RIGHTS RESERVED BY CITY
City may deny prequalification where the requested information and materials are not provided,
or not provided by the date specified. There is no appeal from a denial due to an incomplete or
late submittal.
City reserves the right to accept Prequalification Packages despite minor irregularities and
omissions in the information that could disqualify a D-B Entity. City reserves the right to make
all final prequalification determinations and to determine at any time that the prequalification
procedures will not be applied to the Project.
City reserves the right to adjust, increase, limit, suspend or rescind a D-B Entity's
prequalification rating based on subsequently-acquired information. D-B Entities whose rating
changes sufficient to disqualify them will be notified and given an opportunity for an appeals
process consistent with the procedures for appealing an initial prequalification determination.
City reserves the right to modify, suspend, or cancel this Project, including the prequalification
phase, in whole or in part, at any time and at its sole discretion. The D-B Entity will be solely
responsible for the costs of preparing the prequalification materials and participating in the
prequalification process.

INSTRUCTIONS FOR PREPARATION AND SUBMISSION
OF PREQUALIFICATION PACKAGES
Each D-B Entity wishing to submit a proposal for design-build services for the San Pablo
Avenue Corridor Improvements, City Project 691-16 ("Project") must fully complete the
Prequalification Package and provide all information and materials requested and satisfy the
prequalification criteria.
As provided in Public Contract Code Section 20101, completed Prequalification Packages and
financial information are not public records except as noted in Attachment 1 and will not be open
to public inspection. All information provided will be kept confidential to the extent permitted by
law. City reserves the right to reject any and all submittals and to waive any irregularities in the
information contained herein.
Each Prequalification Package must be completed with all information requested and be signed
under penalty of perjury by an individual who has the legal authority to bind the D-B Entity on
whose behalf that person is signing. City must receive all Prequalification Packages and
materials requested therein by the date and time stated in the Notice Requesting
Prequalification Packages. Prequalification Packages that are incomplete, unsigned or received
after the specified time will be returned unopened, and the contractor will not be eligible to
participate in the submission of proposals for this Project.
Except where information related to former entities is expressly required herein, for purposes of
evaluation, scoring and prequalification, all required contractor's information, including but not
limited to experience, personnel and finances, must be provided for the entity holding the
contractor's license. Information related to parent companies, subsidiaries, and any other
related entity or proposed subcontractors will not be considered.
Requested information must be provided on the Prequalification Questionnaire forms
provided. To the extent that additional space is required in order to fully and completely
answer any question the submitting firm should note in the Questionnaire that additional
information is being submitted. Submit such information on the company letterhead of
the firm submitting the Questionnaire with reference to: (a) the Project, (b) the relevant
subpart and question, and (c) the Questionnaire page number for which the information
is being provided.
Prequalification Packages must be submitted in 3-ring binders with tabs indicating all subparts.
Attachments and additional information must be placed behind the appropriate tabs for the
subpart for which they are required. The front of the binders must be marked "CONFIDENTIAL"
and must indicate the D-B Entity's name and address using the following format:

Respondents shall assume full responsibility for timely delivery at the location designated for
receipt of Prequalification Packages. ORAL, TELEPHONIC, FACSIMILE, TELEGRAPHIC, OR
E-MAILED PREQUALIFICATION PACKAGES ARE INVALID AND WILL NOT BE
ACCEPTED. NO PREQUALIFICATION PACKAGES WILL BE ACCEPTED AFTER THE DUE
DATE AND TIME unless City determines that it is in its best interest to reopen the
prequalification process. All submittals, whether delivered by contractor, U.S. Postal Service,
courier or package delivery service, must be received and time stamped at the stated address
no later than the time designated. City's timestamp shall be considered the official timepiece for
the purpose of establishing the actual receipt of submissions.
The prequalification of D-B Entities will be determined by evaluation of the information submitted
by D-B Entities. City may verify any or all information provided in completed Prequalification
Package, consider information provided by sources other than the D-B Entity, and conduct such
investigations as City deems appropriate to assist in the evaluation of D-B Entity's responsibility,
qualifications, and financial capacity.
If a D-B Entity seeking prequalification has not been in business for the time period for which
information is requested, it shall submit information on predecessor entities covering that time
period.
City reserves the right to reject any or all Prequalification Packages and to waive any
irregularities in any Prequalification Package submittal. City reserves the right to determine that
any D-B Entity is not qualified at any time before or after the Prequalification Packages are
received and evaluated if it finds that information provided in the response to the Notice is
materially inaccurate or false, or upon evidence of collusion or other illegal practices on the part
of a D-B Entity.
If any information provided by a D-B Entity or Core Organization becomes inaccurate, the D-B
Entity must immediately notify City and provide updated accurate information in writing and
under penalty of perjury.
City will notify all respondents of the result of the prequalification process in writing.
Any question or objection to the prequalification materials, or explanation regarding the meaning or
interpretation of the Prequalification Package and related materials, must be requested in writing by
overnight mail, e-mail or facsimile, before 2:00 p.m.(PST), on the date listed in the Notice Requesting
Prequalification Packages. Oral explanations or instructions will not be binding unless issued as a

formal addendum to the Prequalification Package. Any information provided to any contractor
concerning a solicitation will be furnished to all D-B Entities who requested a Prequalification Package.

required with each addendum. By submitting a completed Prequalification Package, the D-B
Entity waives any and all objections to the form and content of the Prequalification Package, or
the evaluation criteria.

PART V PRICE PROPOSAL
The Price Proposal Form is comprised of four Price Components. Two are expressed as
percentages, Overhead and Profit and Bonds, one is expressed as a lump sum fixed price, Design
Fee, and one is expressed as a monthly price, General Conditions. Using an Assumed
Construction Cost, for comparison purposes only, the four Price Components will be totaled to yield
a Total Basis for Comparison amount. This amount will be used to rank the price proposals. The
Total Basis for Comparison amount is purely for the purpose of scoring the Price Proposals and is
not binding on the parties.

EXPLANATION OF SCORING FRAMEWORK
The prequalification determination for a D-B Entity will result from consideration of the scores
attained in all parts of the Prequalification Questionnaire.
In addition to attaining scores at or above the specified minimums for each Section
and/or subpart, the scores for each subpart in Part III and Part IV will be combined to
calculate a weighted score worth 75%. This will be added to a Part V weighted score
worth 25%. These will be combined for a "Total Score." All D-B Entities receiving a pass
rating will be ranked according to the Total Score and the top five scores will be included
on the Prequalified Proposers List.
PART I: INFORMATION ABOUT THE D-B ENTITY AND EACH OF ITS CORE
ORGANIZATIONS
Part I applies to the D-B Entity as a whole and to each of its Core Organizations, and is for
identification purposes only. There is no scoring value to this portion of the Prequalification
Questionnaire.
Note: Subpart I.A is the only public record portion of the Prequalification Questionnaire.
PART II: ESSENTIAL REQUIREMENTS FOR THE DESIGN-BUILD ENTITY AS A
WHOLE
Part II applies to the D-B Entity as a whole and to each of its Core Organizations, and consists
of a series of pass/fail qualification questions. All questions must receive a "Pass" or the D-B
Entity may be disqualified with no consideration given to the remainder of the Prequalification
Questionnaire.
PART III: SCORED QUESTIONS FOR MEMBERS OF THE D-B ENTITY AND
CORE ORGANIZATIONS
Part III includes a series of questions that must be answered, each of which has an established
numerical score (as indicated in the Scoring Worksheet provided herein). The D-B Entity must
attain scores at or above the specified minimums for each subpart in order for the D-B Entity to
be deemed prequalified.
Subpart III.A: Scored Questions for the General Contractor
Subpart III.A applies to the General Contractor. A minimum score of 125 must be attained for
the General Contractor or the D-B Entity will not be deemed prequalified.
Subpart III.B: Scored Questions for the Architect/Engineer of Record
Subpart 111.13 applies to the Architect/Engineer of Record. A minimum score of 49 must be
attained for the Architect/Engineer of Record or the D-B Entity will not be deemed prequalified.

Part IV requires the D-B Entity to submit information regarding recently-completed projects that
are of similar size, type, and complexity. City will have sole discretion to determine which
projects are similar to the Project in size, type, and complexity. The responses will be scored
(as indicated in the sample Scoring Worksheet provided herein). The D-B Entity must attain
scores at or above the specified minimums for each subpart in order for the D-B Entity to be
deemed prequalified.
Subpart IV.A: Relevant Experience of the General Contractor
Subpart IV.A applies to the General Contractor. A Minimum score of 16 must be attained for the
General Contractor or the D-B Entity will not be deemed prequalified.
Subpart IV.B: Relevant Experience of the Architect/Engineer of Record
Subpart IV.B applies to the Architect/Engineer of Record. A Minimum score of 13 must be
attained for the Architect/Engineer of Record or the D-B Entity will not be deemed prequalified.
