C36510 STAFF REPORT CITY OF PALM DESERT HOUSING DEPARTMENT MEETING DATE: November 16, 2017 REQUEST: Authorization to issue a Request for Proposals ("REP") for the construction of a for-sale affordable residential project consisting of fourteen (14) single-family detached self-help homes. Recommendation By Minute Motion, that the City Council, 1) Authorize staff to advertise and issue an RFP for the construction of a for-sale affordable residential project consisting of fourteen (14) single-family detached self-help homes; and 2) Appoint a City Council member to participate in the review of the RFP submittals; and 3) Authorize the City Manager and/or the Mayor to execute any documents necessary to facilitate the RFP and the actions taken herewith. Strategic Plan One of the priorities of the City of Palm Desert's ("City") Envision Palm Desert Strategic Plan as part of Land Use, Housing and Open Space is to facilitate development of high quality for people of all income levels. This request meets that objective by diversifying the City's housing stock and pursuing development of housing for low income households. Executive Summary Approval of staff recommendation will allow the City to solicit an RFP from qualified affordable housing developers for the construction of a for-sale affordable residential project ("Project") consisting of fourteen (14) single-family detached homes that will be made available to first-time homebuyers of lower income, through a Self-Help or Sweat Equity program. The Project site is owned by the City and is located on Merle Street, south of the Falcon Crest and La Rocca Villas developments. The City's financial participation in the Project will be limited to the land donation and deferred down payment assistance loans from the Housing Mitigation fund, if the required criteria are met, to secure an affordable housing cost. Background Analysis The 14 self-help lots are owned by the City and were acquired as part of a greater master- planned site which is inclusive of the Hovely Garden Apartments, Falcon Crest, and the La Rocca Villas. At this time the Project remains undeveloped. The former Palm Desert Redevelopment Agency ("former Agency") identified the need for self- help housing development and established that the Project would be restricted to households whose incomes do not exceed very low income based on the area median income for Riverside County at the time of sale. In July 2009, the Agency issued an RFP seeking qualified developer(s) to assist with the development of the 14 homes but received no response. Staff learned that the non- responsiveness was due to current market conditions and State Funding constraints. Staff intended to reissue a new RFP request in 2010, but after further discussion, it was determined that with the additional inventory of affordable homes that the former Agency owned for re-sale to qualified households that the interest in homes with affordable restrictions was very low and the Project was postponed. With the former inventory sold and in an effort to facilitate the Project in order to issue a new RFP notice, staff reevaluated the previous RFP and staff recommends amending the RFP to include a consideration of providing deferred down payment assistance loans, to ensure an affordable housing cost. The homebuyers will be required to sign an Affordable Housing Restriction and Lien Agreement for a covenant period of up to forty- five (45) years as prescribed therein. Staff recommends that the City Council approve advertising and issuing the Request for Proposals for the construction of a for-sale affordable residential project consisting of fourteen (14) single-family detached self-help homes for purposes of increasing the supply of affordable housing. Fiscal Analysis There is no fiscal impact at this time to issue the RFP, except the ancillary fees to publish the notice. At the time the RFP is awarded, the City's financial participation will be limited to the land donation and the potential down payment assistance loans that may be necessary to secure an affordable housing cost, estimated to be up to $30,000 per homebuyer. The fourteen (14) detached single family residential units will be a mix of three (3) or four (4) bedroom homes of approximately 1,200 and 1,400 square feet, respectively. The City's financial participation will be limited to the land donation and deferred down payment assistance loans from any monies that may be available at the time that the homes are completed and sold. The primary funding sources will include but is not limited to housing mitigation funds, may require that a household member be employed within the City's jurisdictional boundaries. There will be no additional public financial assistance provided by the City for the construction of the residential units. The City proposes to select the most qualified developer ("Developer") for the development, construction and sales of the Project based on the developer's ability to meet all criteria established in the RFP. The developer must demonstrate to the City their experience with similar projects and their ability to deliver an affordable housing development, at the subject site, that is consistent with both the quality and aesthetics of similar new construction in the City of Palm Desert. The Developer must be legally empowered to undertake and perform all actions in this RFP. All proposals must contain the requisite information outlined in this RFP. Only one proposal may be submitted by a Developer. PURPOSE OF THIS REQUEST FOR PROPOSALS The purpose of this Request for Proposals (RFP) is to identify a qualified affordable housing developer of self-help housing ("Developer") for the development of an affordable for-sale residential project ("Project") consisting of fourteen (14) self-help single-family detached three (3) or four (4) bedroom homes located in the City of Palm Desert ("City"). The Developer is expected to take the Project from its current stage of subdivided lots, through construction and ultimately to the sale of the homes to qualified first-time homebuyers. All responses to the RFP will be evaluated based on the criteria established in this RFP and only one proposal may be submitted by a Developer. This is the only document that will be issued by the City other than possible addenda for the purpose of correction, clarification, or the addition of new information to the RFP. II. DESCRIPTION OF LOCATION AND SITE AVAILABLE FOR DEVELOPMENT The site is owned by the City of Palm Desert and is located in the City of Palm Desert on Merle Street (Track No. 30795 APN No. 624-441-014 thru 624-441-022 and 624-440-032 thru 624-440-036) the "Site". The Site lies south of Hovley Drive and directly adjacent to the Falcon Crest single-family development. The Site is situated west of Cook Street, providing easy access to public transportation, recreational facilities, commercial business district, and schools. The Site is vacant and has been subdivided into fourteen (14) lots. Each lot is approximately 6,000 square feel. All lots are clear of debris and have been treated with a soil stabilizer. A parcel map is attached as Exhibit A. III. DESCRIPTION OF THE DEVELOPMENT The Project will consist of 14 self-help single-family detached three (3) and four (4) bedroom homes of approximately 1,200 and 1,400 square feet, respectively, which will ultimately be made available to first-time homebuyers of very low income and may require that a household member be employed within the City's jurisdictional boundaries. The 14 self- help homes will not exceed a maximum height of 18 feet (single story), shall follow minimum setbacks, and any other condition of approval set forth in the General Plan. The proposed Project should be consistent with the City's other affordable for-sale developments that have been constructed which include a high quality of construction, energy efficiencies, solar photovoltaic, design aesthetic and stick-built. The Project should have a unifying theme and identifiable character and be consistent with the neighboring affordable for-sale developments. Any alternative construction method that the respondent wishes to propose other than stick-build should be identified separately and submitted separately. Any alternative construction method should include the effectiveness and any other comparison analysis to stick built. The Project will be a `sweat equity' project where the homebuyers will be required to contribute at least forty percent (40°/0) of the labor used in constructing the homes. The Project will be restricted to households whose incomes do not exceed very low income based on the area median income for Riverside County at the time a purchase contract is signed and may require that a household member be employed within the City's jurisdictional boundaries. The Project will comply with the California Health and Safety Code sections as they pertain to very low income households and affordable housing cost as well as any other sections related to the development of affordable housing with low and moderate income housing funds. The Project will integrate building materials and methods that promote environmental quality and energy efficiency with special consideration given to renewable energy sources. The Project will be designed to exceed current California Code of Regulations Title 24 standards. IV. SCOPE AND CONDITIONS OF DEVELOPMEN11 The City has made a significant commitment to the provision of affordable housing in the City of Palm Desert. The City through a variety of means, has successfully developed affordable senior rental, multi-family rental, special needs or at-risk housing and single- family detached housing. In order to assist in the development of the Project the City will propose to donate the land (14 self-help lots) to the selected Developer provided the value of the land is recorded against the properties in the form of a Promissory Note secured by a Deed of Trust (partially reconveyed upon the sale of each home) and a forty-five year affordability restriction in favor of the Palm Desert Housing Authority for purposes of increasing the supply of affordable housing. The donation value of the land will be based on a market value land appraisal, prepared by a licensed real estate appraiser. The land appraisal will be performed during contract negotiations. Each subsequent homebuyer will be required to sign an affordable housing restriction of not less than 45 years and execute a Promissory Note secured by a Deed of Trust for the value of their respective lot irrespective of any additional funding for homebuyer subsidy. The only guaranteed assistance that will be provided to the successful Developer will be in the form of the land donation. There will be no additional funding provided to the Developer by the City for any construction related activities. The City may provide additional assistance to the homebuyer in the form of a deferred down payment assistance loan in an amount necessary to ensure an affordable housing cost (pursuant to California Code of Regulations, Title 25 and Health and Safety Code), if funds are available at the time of award of contract. With proper City approval, the City will negotiate a Disposition and Development Agreement "DDA" with the successful Developer and hold a public hearing to consider the DDA and the land donation. The successful Developer will be required to: 16 REQUEST FOR PROPOSALS-14 Self-Help Lots November 2017 • Perform all necessary due diligence required for the Project's approval process. This may include, but is not limited to: a general plan amendment, precise plan, and/or change of zone. • Creation and submission of any documents necessary to obtain approvals and permits for the Project as is contemplated in this RFP. • Prepare the design for infrastructure, including streets, curbs, water, sanitary sewer, storm sewer, sidewalks, and dry utilities. It is the developer's responsibility to verify and finalize the complete installation of both wet and dry utilities to each of the 14 lots. It is the developer's responsibility to prepare all necessary reports including but not limited to a water management plan, environmental, etc. • Prepare the design and specifications for grading, engineering, and landscape including all required approvals. • Prepare and determine the engineer's estimate based on the proposed project contemplated for submittal. • Prepare the design and specifications for 14 single-family homes which shall integrate building materials and methods that promote environmental quality and energy efficiency with special consideration to renewable energy sources, exceed current California Code of Regulations Title 24 standards. • Prepare a graphic representation of the design in scaled plans that are refined to a conceptual, schematic level, indicating parcel layouts, building footprints, placement, streets, pedestrian circulation, open space, and any other relevant features for approval by the City as applicable. • Present the Project to all necessary City Departments, City Committees, Commissions, Councils and Boards in order to obtain al! necessary approvals. • Prepare construction documents for the Project. • Include and pay all the costs associated with any permits or approvals for the Project. • Complete any geotechnical, soils and materials testing, compaction, grading, and pad certifications necessary for the Project. • Perform community outreach and informational sessions about the Project for residents living in surrounding neighborhoods. • Coordinate the homebuyers and their respective `sweat equity', • Construct the approved Project and infrastructure. • Prescreen and prequalify potential first-time homebuyers and provide training and counseling to qualified homebuyers. Explain the affordable restrictions, covenant requirements, and all other affordable guidelines to buyer. • Create a program for the marketing and sale of the homes to qualified homebuyers at an affordable housing cost (pursuant to California Code of Regulations, Title 25 and Health and Safety Code), including but not limited to obtaining escrow, mortgage loans, insurance, home inspections, and homebuyer counseling. • Be the point of contact and follow up after the close of escrow with homebuyers including ownership questions, affordability restrictions, maintenance and warranty complaints for at least one year or as is statutorily required. • The City requires Respondents to be an Equal Opportunity Employer and fully comply with ail government regulations regarding nondiscriminatory employment practices. • The resulting contract is subject to State of California law, whether substantive or procedural. Proposer shall comply with all federal, state, county and local laws P 3 g e 1 7 REQUEST FOR PROPOSALS—14 SeIf-Help Lots November 2017 concerning this type of Services. Additionally, the contract shall apply all statutory, charter and ordinance provisions applicable to public contracts within the City of Palm Desert. • The selected Developer shall be aware of the requirements of California Labor Code sections 1720 et seq., 1770 et seq., and California Code of Regulations, Title 8, Section 16000 et seq. ('Prevailing Wage Laws'') which require the payment of prevailing wage rates and the performance of other requirements on applicable "public works" and "maintenance" projects. If applicable, the selected Property Management Company shall fully comply with the Prevailing Wage Laws. V. PROPOSAL REQUIREMENTS It will be the Developer's responsibility to submit a comprehensive proposal for the development of the Project based on all of the components of this RFP including proposed materials and finishes. The following materials shall be submitted for proposals in the following format, identifying each item by number and letter: 1. Letter of introduction a) Provide a complete description of the Developer's Company (all joint venture partners and the respective ownership interest) including, but not limited to: the name, address, e-mail, and phone number of the contact person as well as a summary of the Developer's understanding of the project and overall approach to the scope of work. The Developer shall identify itself as a non-profit or a for-profit developer. The letter should be signed by an officer of the Developer's company authorized to bind the company to all commitments made in the proposal. b) Identify known team members and include a complete listing of all names and principals, names of companies, addresses, phone numbers, e-mail addresses and fax numbers for everyone listed. c) Identify the individual who will execute documents for the development entity and basis of authority d) Indentify joint ventures or other entities and their relationship to the development. 2. Developer Experience Describe relevant affordable self-help or sweat equity project experience, for residential development. Provide examples that demonstrate successful residential projects that are similar in size and quality to that identified in this RFP. Please note that project delivery and the ability to deliver against a proven schedule of performance are critical aspects of the evaluation. Please include the following information for each past project identified: a) Location and photographs of the reference projects including any in Palm Desert or the Coachella Valley and with a government agency or government assistance. General description of the project including the role of the developer, number of units, total project cost per unit, average size per unit, Page 18 REQUEST FOR PROPOSALS—14 Sell-Help Lots November 2017 average subsidy by income category, name of public entities involved and income demographics. b) Describe the Developer's ability to manage the proposed development project from the planning and design stage to construction and subsequent sale of the homes. c) Identify successful community outreach efforts. d) Provide the name, address and telephone number for any references from cities, government agencies or housing authorities in which the development entity has completed similar affordable housing projects. e) Explain the intended role of each development entity or partner and the responsible party of each entity. f) Qualifications of contractors or subcontractors if known. Please summarize their experience and capabilities, 3. Project Proposal and Business Terms a) Description of the proposed project in narrative and graphic format - Show a sample of the type of affordable housing development being proposed which includes, at minimum the criteria established in Section IV, an architectural concept, materials, equipment, landscaping, and a proposed color palette. b) A comprehensive break down of all costs associated with the affordable development and subsequent sale of the 14 single-family homes, this includes but is not limited to, the proposed bonding. c) Identify proposed sources of funds and Financial Capacity for the construction of the Project. DO NOT SUBMIT CONFIDENTIAL INFORMATION. d) An audited financial statement to show the Developer's financial capacity to implement the project. e) Identify all partners (including financial) for the proposed project. f) Identify development schedule of the proposed project. Identify critical milestones such as acquisition, design, construction, and marketing including qualifying homebuyers for the proposed financing. g) Identify outside firms such as general contractors, subcontractors, or management firms proposed for this Project. h) State the sales price of the proposed homes to be built. i) Identify proposed forms of financing for the homebuyers. If so, please explain (excluding "slip and falls" and employee issues). k) Indicate whether the Developer, or any of its principals, or any individuals or entities named above, have ever defaulted on their financial obligations, have had projects that have been foreclosed upon or deeded in lieu of foreclosure, or filed bankruptcy during the Firm's stewardship of a project. If so, please provide the dates and circumstances. 4. Required ❑ocumentation a) Certificate(s) of Insurance (include as Attachment). b) A letter of recommendation from the Developer's financial institution. c) Acknowledgment indicating receipt of any and all addendums to this RFP, d) Representation that the information provided in the RFP proposal documents is truthful, accurate and complete and that the firm and individual responsible for the submission shall be fully responsible for and bound by all information, data, certifications, disclosures and attachments included in the RFP proposal documents. 5. Proposal Format a) ❑evelopers desiring t❑ respond to the RFP shall submit an original and six (6) copies of the proposal. Proposals shall be no more than 13 pages double sided (or 26 pages single sided). Font size can be n❑ smaller than 12 pt. Pictures and Brochures count toward the submittal requirement. The cost ❑f preparing responses to this RFP shall be borne by the respondents and shall not be reimbursed by the City. VI. SELECTION CRITERIA AND SELECTION PROCESS A. EVALUATION AND SELECTION CRITERIA The City will review and evaluate all complete proposals received up to the deadline for submission. Selection of a Developer will include, but not be limited to, an evaluation of the following; 1) ❑eveloper's experience in constructing affordable self-help housing; 2) the Developer's experience with similar sized projects; 3) ❑eveloper's experience with energy efficient homes in a desert environment; 4) the Developer's financial capability and plan to finance the development; 5) the ❑eveloper's ability to present an economically viable proposal for the development of the Project and the quality of the proposal as it pertains to the components of the RFP; 6) the ❑eveloper's experience working with a public entity; 7) the Developer's experience in implementing similar first-time homebuyer programs; 8} the 10 REQUEST FOR PROPOSALS-14 Self-Help Lois November 2017 Developer's non-profit or for-profit status; 8) the Development timeline for project implementation; 10) and any other factors deemed relevant by the Ciy for the selection of the most qualified Developer. The City reserves the right to request clarification or additional information from a Developer. B. SELECTION PROCESS Depending on the number of proposals received, a short list of responsive Developers may be prepared. The City reserves the right to invite short list proposals to participate in an interview process. Upon completion of the evaluations and review of the submitted proposals, City staff shall then request authorization from the City Council to negotiate a Disposition and Development Agreement ("DDA") with the recommended successful Developer. There is no guarantee that the City will decide to move forward with any proposed project based on the RFP submittals. The City reserves the right to reject any or all proposals. The Developer waives all rights to seek legal remedies regarding any aspects of the RFP and the City's selection process, upon the submittal of a response to the RFP. C. The I 1 i REQUEST FOR PROPOSALS-14 Self-Help Lots November 2017 Developer waives all rights to seek legal remedies regarding any aspects of the RFP and the City's selection process, upon the submittal of a response to the RFP. Developer is required to carefully and fully investigate all of the requirements of this RFP. As part of the investigation, if Developer wishes to visit or inspect the development site related to this RFP, such visit or inspection (other than street visual) must be coordinated with the City. Developer is required to make all arrangements needed to fulfill the terms and preparation of the proposal. By submitting a proposal, the Developer represents and certifies to the City that such investigation has been completed and that it fully understands the Scope of Development and requirements. The Developer must be legally empowered to undertake and perform all work associated with the RFP and the Project. The Developer will be required to comply with all federal, state and local laws and ordinances. The Developer will be required to meet all environmental standards set forth by the California Environmental Quality Act, and the City of Palm Desert's Zoning Ordinance. The Developer must submit any and all documentation required by the City of Palm Desert, the State of California, or the Federal Government in relation to any environmental controls, regulations, or standards. This RFP, its addendums and answers to requests for information related to the RFP constitute the entire RFP.
