Recommendation
By Minute Motion:
1. Authorize a payment to Southern California Gas Company (SoCal
Gas) in the amount of $98,403.43, from FY 15/16 account number
2424549-4351200; and,
2. Appropriate $98,403.43 from unobligated 242 funds to FY 15/16
account number 2424549-4351200.
Discussion
Staff received notification from SoCal Gas in October of 2015, that they had a significant
error in billing occurring at the Aquatic Center. The billing error began when the account
was setup and is no way the fault of the City. SoCal Gas has a pressure factor set by
them which dictates the billing amounts and was initially set at 0.340 when it should
have been 1.327. In accordance with SoCal Gas' CPUC authorized Tariff Rule 16 (copy
attached) they are requesting an adjustment of billing going back 36 months as allowed
in the tariff.

After receiving the notification, staff contacted SoCal Gas and our legal counsel in an
attempt to understand the CPUC process. We were hopeful that there might be an
appeals process or some way of entering into a negotiation on this item. However, legal
has indicated that the Tariff Rule 16 is appropriate and we should take this item before
the City Council for consideration of payment.
Fiscal Analysis
Staffs recommendation is to pay this amount owed from the appropriate utility account
for the Aquatic Center. However, this will leave our FY15/16 at a deficit which is why I
have also requested an appropriation to backfill the amount requested.
For the purposes of tracking cost recovery, staff will apply a prorated amount to our
FY15/16 expenses reflecting this payment.

A review of our records disclosed a billing error which resulted in a significant under -
billing of your gas account. The nature of the error is with the pressure factor that was
used to correct the as measured volumes of gas at the meter to the actual volume of gas
delivered. An incorrect pressure factor of 0.340 was applied to the volumes recorded on
the meter, for all bills issued since we established service at this facility. The correct
pressure factor for this service should have been 1.327.
We have corrected our records and recalculated your gas bills from August 20, 2012 to
August 18, 2015, using the monthly rates that were in effect for each of the billing
periods. This adjustment to your account has resulted in a debit of $93,899.14. This is in
accordance with SoCa1Gas' authorized Tariff Rule 16, Adjustment of Bills, on file with
the California Public Utilities Commission.

ADJUSTMENT OF BILLS
A. ESTIMATED USAGE
When regular, accurate meter readings are not available or the gas usage has not been accurately
measured, the Utility may estimate the customer's gas usage for billing purposes on the basis of
information including, but not limited to, the physical condition of the metering equipment, available
meter readings, records of historical use, and/or the general characteristics of the customer's load and
operation.
B. ADJUSTMENT OF BILLS FOR UNAUTHORIZED USE
Unauthorized use is the use of energy in noncompliance with the Utility's tariffs or applicable law. It
includes, but is not limited to, meter tampering, unauthorized connection or reconnection, theft, fraud,
and/or intentional or unintentional use of gas whereby the Utility is denied full compensation for service
provided.
Where the Utility determines that there has been unauthorized use of gas, the Utility may bill the person T
or entity, who benefited from such unauthorized use for the Utility's estimate of such unauthorized use. T
Such estimated billing shall indicate unauthorized use for the most recent three years and, separately,
unauthorized use beyond the three-year period for collection as provided by law. However, nothing in
this rule shall be interpreted as limiting the Utility's rights and/or remedies in any provisions of any
applicable law.
Utility shall bill and collect interest at a rate of ten percent (10%) per annum on unauthorized use
billings from the date the unauthorized use commenced, and/or Utility shall bill and collect at a rate of
ten percent (10%) per annum on amortized repayment agreements.
Utility shall bill and collect the associated costs resulting from the unauthorized use including, but not
limited to, investigative, repair and equipment damage costs.
C. ADJUSTMENT OF BILLS FOR BILLING ERROR
Billing error is an error by the Utility that results in incorrect billing charges to the customer. Billing
errors may include incorrect meter reads or clerical errors by a Utility representative such as applying
the wrong rate, wrong billing factor, or an incorrect calculation. Billing error shall also include failure N
to deliver a bill, actual or estimate, in a timely manner in accordance with Rule No. 14.A. N
Billing error does not include a meter error or unauthorized use, or any error in billing resulting from
meter dial over, switched or mismarked meters by other than the Utility; lack of access to the meter
consistent with Rule No. 14.C.2.; failure of the customer to notify the Utility of a change in operation; N
failure of the customer to take advantage of a rate or condition of service for which the customer is
eligible; or failure to issue a bill due to a natural or man-made disaster such as fire, earthquake, flood, or N
severe storms. N

Where the Utility overcharges or undercharges a customer as the result of a billing error, the Utility may
render an adjusted bill for the amount of the undercharge, without interest, and shall issue a refund or
credit to the customer for the amount of the overcharge, without interest, in accordance with the
procedures and limitations set forth below. Such adjusted bills shall be computed as follows:
1. Billing Error Resulting in Overcharges to the Customer
If either a residential or nonresidential service is found to have been overcharged due to a billing
error, the Utility shall calculate the amount of the overcharge, for refund to the customer, for a
period of three years. However, if it is known that the period of billing error was less than three
years, the overcharge shall be calculated for only those months during which the billing error
occurred.
2. Billing Errors Resulting in Undercharges to the Customer
If either a residential or nonresidential service is found to have been undercharged due to a billing
error, the Utility may bill the customer for the amount of the undercharge for a period of three
months for residential service or small nonresidential service, as defined in Rule No. 1, and three
years for all other nonresidential service. However, if it is known that the period of billing error
was less than three months for residential service or small nonresidential service, as defined in Rule
No. 1, and three years for all other nonresidential service, the undercharge shall be calculated for
only those months during which the billing error occurred.
D ADJUSTMENT OF BILLS FOR METER ERROR
A meter error is incorrect gas registration resulting from a malfunctioning or defective meter or pressure
correction device. A meter error does not include billing errors, unauthorized use, or errors in
registration caused by meter tampering by an unauthorized person. It also does not include conditions
such as incorrect meter readings, meter dial overs, accounting errors, meter configuration errors,
incorrect meter sizing, or switched meters.
Where as a result of a meter test, except for "Other Than Displacement Gas Meter" as described in
Section 4 below, a meter is found to be nonregistering or incorrectly registering, the Utility may render
an adjusted bill to the customer for the amount of the undercharge, without interest, and shall issue a
refund or credit to the customer for the amount of the overcharge, without interest, computed back to the
date that the Utility determines the meter error commenced. The period of adjustment for meter error
shall not exceed three years and shall be computed in accordance with the following:

1. Fast Meter: If a meter is found to be registering more than two percent (2%) fast, the Utility shall
refund to the customer the amount of the overcharge based on the corrected meter readings or the
Utility's estimate of the gas usage either for the known period of meter error or, if the period of error
is not known, for the period during which the meter was in use, not to exceed three years. T
Slow Meter: If a meter for residential service is found to be registering more than 25% slow, or a
meter for nonresidential service is found to be registering more than two percent (2%) slow, the
Utility may bill the customer for the amount of the undercharge based on the corrected meter
readings or the Utility's estimate of the gas energy usage either for the known period of meter error
or, if the period of meter error is not known, for the period the meter was in use, not exceeding three
months in the case of residential service or small nonresidential service, as defined in Rule No. 1, and
three years for all other nonresidential service.
3. Nonregistered Usage: The Utility may bill the customer for the Utility's estimate of the gas used but
not registered, not exceeding three months in the case of residential service or small nonresidential
service, as defined in Rule No. 1, and three years for all other nonresidential service,
4. Other Than Displacement Gas Meter: For other than displacement gas meters, if the customer or the
Utility shall at any time have reason to doubt the accuracy of any gauge, measuring device, other
appliance, data, or method used in measuring or computing the amount of gas delivered through
other than displacement meters, notification shall be given to the other party and, within a reasonable
time, the accuracy of such gauge, measuring device, appliance, data, or method shall be determined
(upon request, jointly in the presence of both parties) and if any of them shall be found inaccurate,
the proper correction in billing shall be made as follows:
In the case of computation errors or inaccurate data, where the date can be fixed or agreed upon, such
correction in billing shall begin, starting with the date of initial error.
In the case of a gauge, measuring device, or appliance found to be out of tolerance sufficient to cause
a volume error greater than plus or minus two percent (2%), such correction in billing shall begin on
a mutually acceptable date. In the absence of such mutual acceptance, the correction shall begin on a
date equivalent to 50% of the elapsed period since the last valid calibration or test.
In all cases where corrections are to be made, the amount of the gas delivered during the established
period of inaccuracy shall be recalculated and corrected. Thereafter, measurements shall be made in
accordance with correct data and any inaccurate devices shall be recalibrated within published
manufacturers tolerances.

Pipelines may be located anywhere, including under streets and sidewalks. Since you're a SoCalGas'$ customer,
there are most likely utility -owned pipelines underground on your property, possibly just inches below
the surface. That Is why it is important to know where they are before every digging project, from simple
landscaping projects like planting trees or shrubs, to building a deck or installing a mailbox.
1 Mark out your proposed excavation area in white
paint or with other suitable markings.
r. Call Underground Service Alert at 811 between
L 6 a.m. and 7 p.m., Monday through Friday (excluding
holidays), or submit a location request at caI1811.com
at least two working days prior to excavation.
3 Wait until SoCalGas either marks its natural gas
pipelines and indicates pipe material and diameter —
or advises you that the area is clear of its pipes.
Other utilities will do the same for their lines.
4 Once all lines are marked, and before using any
power excavation equipment in the area, use only
hand tools within 24 inches of each marked utility
line to determine the exact location of all lines.

Call before you dig.
5 Report any pipe damage by calling SoCalGas immediately at
1-800-427-2200. No damage is too small to report. Even a
slight gouge, scrape or dent to a pipeline, its coating or any
component attached to or running alongside the pipe, may
harm the integrity of the pipe or cause a dangerous leak in
the future.
6 Call 911 promptly after evacuating the area if the damage
results in a natural gas leak that may endanger life or cause
bodily harm or property.
Please be aware that SoCalGas does not mark customer -owned
natural gas lines, which typically run from the gas meter to the
customer's natural gas equipment and appliances. To have customer -
owned lines located and marked before a project, SoCalGas advises
customers to contact a qualified pipe -locating professional.

SoCalGas uses pipelines to deliver natural gas to residential and
business customers for heating, cooking, manufacturing and other
purposes. Because your safety is our top priority, we routinely
perform pipeline safety tasks — including patrolling, testing, repairing
and replacing pipelines — and have ongoing technical training and
testing for employees.
Our goal is to identify and resolve potential issues before a major
problem occurs. We have implemented a rigorous integrity
management program in densely populated areas. We use advanced
safety inspection tools to monitor pipe condition and to verify that
the pipelines are being maintained safely. In order to perform these
important inspections, the area around our pipelines must be clear of
shrubs, trees, fences and other structures.

Baseline - Amount of gas billed at the bvoest residential rote.
Billing Factor - Adjusts for differences in elevation, deh%y

zones receive more baselne allowance.
Customer Charge - Charge to recover costs of gas detvery
including reading meters, Preparing bills, and processing payments.
Gas Commodity Charge - Cost of gas purchased by The Gas
Company on behalf of its customers.
Payment Due Date - Payment due date shown on the front bottom
portion of the bill is for current charges any; it does not stop
collection activity on an unpaid previous balaiae.
Public Purpose Surcharge - Charge to fund Pubic Purpose
Programs such as Cafforria Alternate Rates for Energy (CARE),
Energy Savings Assistance Program (ESAP), energy efficiency and
research and development. CARE customers pay a reduced
surcharge with excludes CARE program costs.
Rate - Identifies the rate schedule used to calculate your bit. You
may review these rate schedules at a local office of The Gas
Company or at www.sw4as.com
State Regulatory Fee - A fie used to fund the Callomia Pubic
Willies Commission. Each customer's fee is determined by the
number of therms used.
Therms - Standard unit of measuring heat energy.
Utility Users' Tax - Tax charged by some cities and counties
based on the amount of the current mdnthTy gas bit These cities
and counties require The Gas Company to collect this U05es

Call 811 Before You Dig — It's Free
Pipelines may be located anywhere, including under streets and sidewalks. Since you're a SoCalGas� customer,
there are most likely utility -owned pipelines underground on your property, possibly Just inches below
the surface. That is why it is important to know where they are before every digging project, from simple
landscaping projects like planting trees or shrubs, to building a deck or installing a mailbox.
1 Mark out your proposed excavation area in white
paint or with other suitable markings.
2 Call Underground Service Alert at 811 between
6 a.m. and 7 p.m., Monday through Friday (excluding
holidays), or submit a location request at ca11811.com
at least two working days prior to excavation.
3 Wait until SoCalGas either marks its natural gas
pipelines and indicates pipe material and diameter —
or advises you that the area is clear of its pipes.
Other utilities will do the same for their lines.
4 Once all lines are marked, and before using any
power excavation equipment in the area, use only
hand tools within 24 inches of each marked utility
line to determine the exact location of all lines.

Locate Major Pipelines
Near You
Pipeline markers indicate only the approximate, not
exact, location of buried pipelines. Markers also do not
indicate the depth or number of pipelines in the area.
These yellow markers display the pipeline operator's
name and a phone number to call in case of
emergency.
To view maps and identify the approximate locations of
major natural gas pipelines in your area, visit
socalgas.com (search "MAPS") or the National Pipeline
Mapping System (NPMS) website at www.npms.phmsa.
dot.gov/PublicViewer. These maps only indicate the
general location of pipelines and should never be used as
a substitute for contacting Underground Service Alert —
by phone at 811 or online at ca11811.com — at least two

5 Report any pipe damage by calling SoCalGas immediately at
1-800-427-2200. No damage is too small to report. Even a
slight gouge, scrape or dent to a pipeline, its coating or any
component attached to. or running alongside the pipe, may
harm the integrity of the pipe or cause a dangerous leak in
the future.
6 Call 911 promptly after evacuating the area if the damage
results in a natural gas leak that may endanger life or cause
bodily harm or property.
Please be aware that SoCalGas does not mark customer -owned
natural gas lines, which typically run from the gas meter to the
customer's natural gas equipment and appliances. To have customer -
owned lines located and marked before a project, SoCalGas advises
customers to contact a qualified pipe -locating professional.
Even if you've hired a contractor, make sure the contractor calls
811 to have lines marked.

Your Safety
SoCalGas uses pipelines to deliver natural gas to residential and
business customers for heating, cooking, manufacturing and other
purposes. Because your safety is our top priority, we routinely
perform pipeline safety tasks — including patrolling, testing, repairing
and replacing pipelines — and have ongoing technical training and
testing for employees.
Our goal is to identify and resolve potential issues before a major
problem occurs. We have implemented a rigorous integrity
management program in densely populated areas. We use advanced
safety inspection tools to monitor pipe condition and to verify that
the pipelines are being maintained safely. In order to perform these
important inspections, the area around our pipelines must be clear of
shrubs, trees, fences and other structures.
