Aryan, Risk Manager January 28, 2016 Model Resolution & SB 1193 Poster By Minute Motion, adopt the Coachella Valley Association of Governments model resolution supporting the implementation of SB 1193 human trafficking public notices. Commission Action The Palm Desert Public Safety Commission did not meet in January 2016, but staff will inform them about this resolution at their next scheduled meeting. Background The Coachella Valley Association of Governments (CVAG) Public Safety Committee discussed Anti -Human Trafficking earlier this year and received a presentation from Attorney Michael Harrington. As their staff continued research, Attorney Harrington and the Riverside County Anti -Human Trafficking (RCAHT) Task Force, under the Riverside County Sheriff's Department, brought attention to SB 1193 legislation passed in September 2012. SB 1193 added section 52.6 to the California Civil Code, thus creating a legal requirement for certain types of business to display public notices on slavery and human trafficking. Pursuant to this new law, these human trafficking notices must now be displayed in a conspicuous place, either near the public entrance or in a location in plain view of both the public and employees. These posters are required at the following types of business establishments: • Adult or sexually oriented businesses • Emergency rooms within general acute care hospitals • Primary Airports • Businesses that offer massage or bodywork services • Intercity passenger rail or light rail • Privately operated job recruitment centers stations • Bus stations • Roadside rest areas • Truck stops • Farm labor contractors • Urgent Care Centers • On -sale general public premise licenses under the ABC Act Recognizing the specific legal requirements of SB 1193, RCAHT has created a poster that meets all the requirements (see attachment). As a public service, the Riverside County Sheriff's Department has made RCAHT's SB 1193 compliance poster available for download to the public. Businesses required to post this notice can now download, print, and then post this Staff Report: SIB 1193 Human Trafficking Resolution January 28, 2016 Page 2 of 2 notice to maintain legal compliance. To raise public awareness, RCAHT, partnering with SafeHouse, hosted a "Day of Action" on January 17, 2015 within Riverside County. Almost 500 volunteers were sent out into the community starting from three locations in Riverside County. In the Coachella Valley, SafeHouse of the Desert was able to reach 348 businesses. RCAHT continues to raise public awareness of Human Trafficking in the County. RCAHT and SafeHouse have the posters ready to be displayed and would like to have CVAG and its member agencies assist in public awareness. The CVAG Executive Committee also approved this resolution. Staff respectfully recommends City Council approval of this model resolution. FISCAL IMPACT There will be no fiscal impact to the City of Palm Desert General Fund by approving this resolution. Arya�, Risk Menage Wohlmuth, City Manager RESOLUTION NO. 2016- 15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT TO SUPPORT THE IMPLEMENTATION OF SB 1193 HUMAN TRAFFICKING PUBLIC NOTICES WHEREAS, in 2010, the United States Department of Justice recognized increased trafficking activity in the Inland Empire and the Coachella Valley and provided resources to form an Anti -Human Trafficking Task Force to search for trafficking activity and rescue victims; and WHEREAS, the Riverside County Anti -Human Trafficking Task Force (RCAHT) works to identify and rescue victims of human trafficking, proactively investigate, identify, apprehend, and prosecute those engaged in human trafficking, and promote greater public awareness through marketing, trainings, and understanding of the nature and scope of human trafficking within the County of Riverside; and WHEREAS, in September of 2012, California Governor Jerry Brown signed Senate Bill 1193 into law; and WHEREAS, SB 1193 created very specific legal requirement for certain types of businesses to display public notices on slavery and human trafficking; and WHEREAS, these human trafficking notices must now be displayed in a conspicuous place, either near the public entrance or in a location in plain view of both the public and employees; and WHEREAS, these posters are required at the following types of business establishments: adult or sexually oriented businesses, on -sale general public premise licenses under the Alcoholic Beverage Control Act, airports, passenger rail or light rail stations, bus stops, truck stops, emergency rooms within acute care hospitals. Urgent care centers, farm labor contractors, privately operated job recruitment centers, roadside rest areas, businesses that offer massage or bodywork services; and WHEREAS, recognizing this, the Riverside County Anti -Human Trafficking Task Force (RCAHT) has created a poster that meets all the legal requirements of this recent law; and RESOLUTION NO. 2016-15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY DECLARES THE PUBLIC SAFETY NEED TO SUPPORT THE IMPLEMENTATION OF SB 1193 HUMAN TRAFFICKING PUBLIC NOTICES.
