Recommendation:
By Minute Motion, Staff requests that the City Council refund Building Permit Fees in
the amount of $46,158.33 to Comstock Crosser & Associates.
Executive Summary:
Building Permit Fees of $46,158.33 were paid by Comstock Crosser & Associates. The
City received two separate refund requests. One dated September 23, 2015, and one
on February 11, 2016. The first refund was delayed due to a W-9/Business License
issue that was finally resolved by Comstock Crosser & Associates in February, 2016.
Discussion:
Mr. Robert W. Comstock of Comstock Homes requested in a meeting with the City
Manager that Comstock Homes be allowed to enter into a "Third Party Inspection
Agreement." This agreement allowed a full time inspector on the site at all times in
hopes of accelerating their project (Villa Portofino).
The City entered into an agreement with Comstock Homes on March 21, 2014, which
allowed Comstock Homes to acquire the services of Willdan Engineering to provide
third party inspection services for the Villa Portofino project.

INSPECTION AGREEMENT

THIS AGREEMENT is made and entered into this 210 day off. 2014 by, between and
among Wilidan Engineering, a California corporation ("Inspector"), the City of Palm Desert,
California and Comstock Homes ("AppiicanC).
RECITALS
Whereas, City of Palm Desert is agreeable that Applicant may contract directly with a qualified
third party engineering firm to perform Inspection services on behalf of the City.
Whereas, Applicant desires to enter into a third party agreement with Inspector to perform such
services;
Whereas, Inspectors are experienced in providing such services for municipal corporations and
is able to provide experienced personnel to carry out the duties involved;
NOW, THEREFORE, in consideration of the covenants and premises herein stated, it is agreed
as follows:
A. Applicant intends to construct Housing Tract (hereinafter the "ProjecC). Inspector agrees to
perform the following services for Applicant with respect to the project: Inspection in
accordance wtth JCC Building Standards Codes. City of Palm Desert Ordinances and
other applicable Stan4gWL.
B. Inspector shall be compensated for such services by direct payment from Applicant.
Notwithstanding that Applicant Is to compensate Inspector directly, it is agreed that Inspector's
duties with respect to this project are to State and City requirements and not to Applicant. The
compensation shall be as follows: H mrly rate �522. Such compensation to Inspector shall
not be in lieu of other fees as may be charged by City.
IN WITNESS WHEREOF, the parties execute this agreement upon the terms and conditions
stated above and the "PROVISIONS OF AGREEMENT" following the signatures below.
