DISTRICT, SUSPENDING ENFORCEMENT OF A-FRAME AND PEDESTAL
SIGNS ON PRIVATE PROPERTY.
Rec : By Minute Motion : 1) Temporarily waive Chapter 25 .56 -Signs ,
Section 25 .56.080(G), allowing retail businesses along El Paseo to display
pedestal and A-frame signs on private property from March 25-May 31,
2016 ; 2) provide direction to staff regarding the use of balloons as
advertising devices for commercial uses.

Consideration of approval to temporarily waive Chapter 25 .56 Signs ,
Section 25 .56 .080 G Pedestrian Oriented Signs , (from March 25
through May 31 , 2016) to allow businesses along El Paseo to place
a pedestrian-oriented A-frame or pedestal mounted sign in front of
their business on private property , and provide direction to staff
regarding the use of balloons as advertising devices for commercial
uses .

Recommendation
By Minute Motion:
1. Temporarily waive Chapter 25.56 Signs , Section 25 .56 .080 G ,
allowing retail businesses along El Paseo to display pedestal and
A-frame signs on private property from March 25 through May 31,
2016 .
2. Provide direction to staff regarding the use of balloons as
advertising devices for commercial uses.
Discussion
The current Sign Ordinance prohibits businesses along El Paseo to display pedestrian-
oriented signs during the non-summer months. Those types of signs are allowed
between June 1 and October 1. Over the years , the Code Enforcement Division has
cited multiple businesses during the non-summer months . Some local merchants have
expressed concerns that the economy has still not recovered and their businesses are
suffering and that pedestrian-oriented signage year round helps their business. Other
business owners find them distracting and have stated that the signage ruins the
upscale ambience of El Paseo. Below please find a timeline of actions relating to El
Paseo :
• On February 11 , 2016 , the City Council directed staff to discuss pedestrian-oriented
signage and advertising devices with the El Paseo Merchants Association and
business owners .

• On February 18 , 2016 , staff met with the El Paseo Merchants Association and
agreed to send a survey to all businesses requesting their feedback. After the
meeting , staff worked with FG Creative and decided upon a survey , which
included three questions.
• On March 7, 2016 , the survey was distributed to business owners along El Paseo
via email and US mail. The survey included a deadline of March 25 , 2016 for the
businesses to complete. After March 25 , 2016 , staff and FG Creative will compile
the results, and determine which businesses completed the survey . For the
businesses that d id not, staff was going to distribute the survey by hand and
report the results to the City Council at the April 28 , 2016 meeting .
Staff is proposing to suspend Section 25 .56 .080 G from March 25 through May 31 ,
2016 to allow retail businesses along El Paseo to place pedestrian-oriented signs in
front of their business. All signage will be proh i bited within the public right-of-way. At
any time the Director of Community Development can revoke the temporary signage if
the signs are found to be a nuisance or a danger to public health and safety.
The current Sign Ordinance prohibits the use of balloons as an advertising device within
any zone in the City. We have received one complaint from a business along El Paseo
who wishes to utilize balloons as an advertising device. Staff is somewhat concerned
that balloons do not reflect the vision of El Paseo , however is seeking direction
regard ing allowing balloons as advertising devices for all commercial uses.
