Letter from Mariposa Landscape, Inc.
By Minute Motion:
1. Approve a one-year extension to Contract No. C33310 with Mariposa
Landscape, Inc., for Landscape Maintenance Area No. 9 in the amount
of $199,740.24;
2. Include repair work and services at the specified contract amount not
to exceed 20 percent of the contract, or $39,948; and
3. Authorize the Mayor to execute the contract.
Funds are available in the General Fund Account No. 1104614-4337001, R/M Medians.
Strateqic Plan Obiective
This is an on -going landscape maintenance function and contributes to our goal of
providing a uniquely beautiful desert environment in highly visible areas of the City.

Background
The subject contract was awarded to Mariposa Landscape, Inc., by City Council on April
24, 2014, for a term of two years, with an option for two, one-year extensions. The
contract, which is set to expire on June 30, 2016, includes the monthly maintenance
services for El Paseo Medians, Entrada del Paseo and Baja Park.
The construction of the free -right turn on southbound Portola and Fred Waring included
the installation of new landscape and parkway planters. Mariposa submitted a cost of
$480 per month to include the maintenance of the new planters to their schedule. They
also agreed to a one-year extension of contract commencing July 1, 2016; however,
due to the mandated minimum wage increase of $1.00 per hour that went into effect
January 1, 2016, they are requesting a 5.57% increase to help offset the additional
costs. Mariposa Landscape's performance has met City standards and staff finds the
request to be reasonable. The increase equals $878.02 per month ($10,536.24 per
year); raising the contract amount to $16,645.02 per month or $199,740.24 per year,
including the maintenance of the planters on Portola and Fred Waring.
Repair work and services covers unquantifiable activities necessary for landscape
maintenance, which are not part of the landscape maintenance contract. This repair
work and services includes, but is not limited to, repair and replacement of irrigation
equipment; emergency tree work; replacement of trees and shrubs; pest control; and
accident and vandalism repair and replacement.
Fiscal Analysis
This is an on -going maintenance activity with no fiscal impact beyond the contract
amount.

CONTRACT NO. C33311
FIRST AMENDMENT TO AGREEMENT
WHEREAS, the City of Palm Desert ("City") and Mariposa Landscape, ("Contractor"),
entered into an agreement, dated April 24, 2014, for Landscape Maintenance Area No. 9
("Agreement"), the parties wish to amend the Agreement effective July 1, 2016.
NOW, THEREFORE, the parties agree as follows:
A. Term is amended to add the following paragraph to the end of the existing section, as
amended.
"The term of this Agreement is extended, and shall include the time period from July 1,
2016, through June 30, 2017."
B. The Amount of the contract will increase by the sum of ten thousand five hundred
thirty-six dollars and 24/100 ($10,536.24) to help offset the costs of the mandated
hourly wage increase and to include the maintenance of the new planters on Portola
and Fred Waring; a total annual contract price of $199,740.24.
C. All other terms and conditions of the Agreement shall remain unchanged, and shall
remain in full force and effect.

Subject: LMA 6 & LMA 9 Contract #'s C33300 & C33310 Renewal for FY 2016 — 2017
Dear Mr. Chavez:
Mariposa Landscapes, Inc., hereby requests the extension of current contracts for LMA 9 and LMA 6
for an addition year ending June 30, 2017. However, due to the recent increases to the minimum wage,
the mandatory sick pay and other operating costs, we are requesting a modest increase to our current
contract price and unit prices. This much needed increase will help us offset some of the additional
costs we have incurred as a result of these government mandated laws.
As you know, the state minimum wage recently increased from $9.00 to $10.00 per hour, consequently
pushing wages up across the board. Furthermore, the implementation of the ACA (affordable care act),
the mandatory sick pay and soaring insurance premiums, have also impacted our bottom line. Please
know, we have made every effort to avoid any financial burden to our clients; unfortunately, the
amount is substantial and we have no other choice but to pass some of these costs to you. Please see
