Glickman, Management Analyst DATE: April 28, 2016 CONTENTS: Images of Mesa by Luis Montoya Image of Pad Location Artwork Appraisal Luis Montoya's Biography Deed of Gift to City of Palm Desert Recommendation By Minute Motion: 1) Approve the donation of Mesa by Luis Montoya to the City's Permanent Public Art collection from Dr. Mark Greenberg; 2) authorize Mayor to sign Deed of Gift to City of Palm Desert Form; 3) authorize expenditures of up to $1,650 for transportation and installation. Funds are available in Account Number 4364650-4400100 in Fiscal Year 2016/2017. Commission Recommendation At its meeting of April 13, 2016, the Art in Public Places (AIPP) Commission recommended with a vote of 4-0-0, with Commissioner Bussing absent, to accept the donation of Mesa by Luis Montoya into the public art collection. Strateqic Plan Obiective Not applicable. Background Collector Dr. Mark Greenberg has offered to donate Mesa by Luis Montoya to the City of Palm Desert's permanent public art collection. The sculpture was originally purchased from Imago Galleries and has been located at the residence of Dr. Greenberg's father in Rancho Mirage for the past many years. Staff Report Donation of Mesa Page 2 April 28, 2016 Pending approval by City Council and an engineer, staff would like to install Mesa on the currently vacant art pad on the west end of Civic Center Park near the sculptures Desert Dessert and The Rose Garden Community Walk. The sculpture stands approximately ten (10) feet tall and is made of Corten steel and with a concrete base, which is easily maintained. Currently a conservator is working on cleaning up the sculpture as well as the bead -blasting and sealing the base before the artwork would come to the City. The current appraisal values the sculpture at $60,000. Fiscal Analvsis If the donation is approved, the City's fiscal responsibility would be the cost of relocating the sculpture to its new location at an estimated cost of $750 for a crane, signage at an estimated cost of $100, and the installation at an estimated cost of $800. Unless a new pad needs to be poured for the sculpture, the total cost of the project is estimated at $1,650. Minimal additional funds would be required on an annual basis for maintaining and insuring the artwork. Funds for relocation and installation of the Mesa are available in Account Number 4364650-4400100. No General Fund monies will be expended. Submitted By: a Deborah S. C35230 CITY OF PALM DESERT Deed of Gift to CITY OF PALM DESERT (City) This Deed of Gift between CITY OF PALM DESERT ("CITY') and ("DONOR") transfers ownership of, and legal rights to, the materials described herein to be donated to CITY. The signed Deed of Gift establishes and governs the legal relationship between the DONOR and CITY and the legal status of the materials. z. DONOR hereby donates to CITY materials entitled: 2. The following is a complete description of the donation: 3. This donation has been received by CITY as a gift. DONOR acknowledges that he/she is the owner of the above materials and hereby transfers physical custody and intellectual and literary property rights of said materials to CITY. This includes any copyright over the materials, as well as the right to reproduction and the right to republication of the materials in any format, except as specified below: 4. CITY recognizes and respects all forms of intellectual property and will make every effort to ensure credit and acknowledgement of the author and creator of such materials. S. Title to the Property shall pass to CITY upon delivery to the CITY. At any time thereafter, the DONOR shall be permitted to examine any of the Papers during the regular business hours of the Archives. 6. In consideration of mutual benefits, DONOR enters into this agreement with CITY for access, use, disposition, and ownership of these donated materials. CITY shall have ownership of these materials upon receipt, store these materials according to accepted standards, process them and maintain the artwork against the ravages of time, vandalism and elements. 1 72500.00001\8308098.1 CONTRACT NO. The following conditions apply to this gift(s) to CITY: • It is understood that this gift is outright and unconditional unless otherwise noted upon this Agreement. • The DONOR agrees that there are no restrictions on access and use of the artwork described unless otherwise noted upon this Agreement. • This Deed of Gift represents the entire agreement of the parties with regard to the matters set herein, and it may be amended only by written agreement accepted and signed by the DONOR (or legal representative) and a designated representative of CITY. • It is understood that artwork may be reprinted in whole or in part and may be used in whole or in part for any use determined by CITY in its sole discretion. • CITY makes no representation as to the value of the donated property and cannot and does not appraise or assign a value to the gift and provides only the description of the property donated as set forth in this Deed.
