CALL TO ORDER Chairman Nethery called the meeting to order at 3:30 p.m. II. ORAL COMMUNICATIONS NONE Public Safety Commission Approved Minutes February 10, 2016 Page 2 IV. PRESENTATIONS A. Introduction of Division Chief Dan Talbot The new Division Chief of the Palm Desert Fire Department, Dan Talbot, was introduced to the Commission. He stated that he was honored to be in this position and has a long history with the City of Palm Desert. He originally worked in Indian Wells and later moved to Palm Desert where he ran the first on call Medic Unit. He was also on the trip to donate a fire engine to Palm Desert's Sister City, Ixtapa-Zihuatanejo, Mexico, along with former City Manager Carlos Ortega and former Councilmember Dick Kelly. The Commission welcomed Chief Talbot. B. Viewing of new Palm Desert Engine 71 and Medic Unit The new Palm Desert Engine 71 and a Medic Unit were parked outside City Hall for the Commission to view. Chief Talbot stated that they're automating maintenance and will be routinely moving engines around to make the system work better. Certain stations require higher mileage so they're rotating trucks. C. Pit Crew CPR Presentation Palm Desert Firefighter Scott Henderson showed a power -point presentation to the Commission outlining some of the services that the Palm Desert Fire Department provides. He spoke about the benefits of "Pit Crew CPR" and how effective it is. A live demonstration was given by a group of firefighters showing how they work as a team. V. CONSENT CALENDAR A. MINUTES of the Regular Public Safety Commission Meeting of October 14, 2015. B. PALM DESERT SPECIALIZED UNITS End of the Month Reports - November and December 2015 C. RIVERSIDE COUNTY FIRE DEPARTMENT/CAL FIRE End of the Month Reports - December 2015 and January 2016 Chair Nethery moved to, by Minute Motion, approve the Consent Calendar as presented. Motion was seconded by Commissioner Kirkwood and carried by a 6- 0-1 vote (AYES: Butzbach, Kirkwood, Kramer, Luhring, Taylor, and Nethery; NOES: None; ABSENT: Harkins). VI. CONSENT ITEMS HELD OVER NONE Public Safety Commission Approved Minutes February 10, 2016 Page 3 VII. NEW BUSINESS Add item to the agenda: ELECTION OF PUBLIC SAFETY COMMISSION OFFICERS. Chair Nethery moved to approve the addition of Election of Public Safety Commission Officers to the agenda. The motion was seconded by Commissioner Luhring and carried by a 6-0-1 vote (AYES: Butzbach, Kirkwood, Kramer, Luhring, Taylor, and Nethery; NOES: None; ABSENT: Harkins). Chair Nethery stated that Commissioner Kramer is currently the Vice Chair. The normal procedure is for the Vice Chair to become Chair and Commissioner Harkins is in line to become Vice Chair. Commissioner Butzbach moved to appoint Commissioner Kramer as Chairman and Commissioner Harkins as Vice Chairperson. The motion was seconded by Commissioner Kirkwood and carried by a 6-0-1 vote (AYES: Butzbach, Kirkwood, Kramer, Luhring, Taylor, and Nethery; NOES: None; ABSENT: Harkins). A. REQUEST FOR APPROVAL OF A MEMORANDUM OF UNDERSTANDING REGARDING FISCAL AGENT RESPONSIBILITIES TO THE PALM DESERT POLICE DEPARTMENT'S PARTICIPATION IN THE POST - RELEASE ACCOUNTABILITY AND COMPLIANCE TEAM (P.A.C.T.) PROGRAM. Stephen Aryan stated that this item was recommended for approval by the City Council last year. Previously, the City of Beaumont was selected to serve as the fiscal agent for Riverside County, but as of July 1, 2015, the Corona Police Department has agreed to be the new AB 109 PACT fiscal agent, assuming the duties of the Beaumont Police Department. A new MOU outlining this arrangement is required and will begin retroactively as of July 1, 2015. Staff anticipates an annual operating expenditure for FY 2015/16 of $2,000 as the City of Palm Desert's share. Commissioner Kirkwood moved to, by minute motion, recommend that the Palm Desert City Council authorize the Chief of Police to execute and enter into the attached Memorandum of Understanding regarding Fiscal Agent responsibilities for the AB 109 funded members of the Riverside County Post -Release Accountability and Compliance Team (P.A.C.T.). Seconded by Vice Chair Kramer and carried by a 6-0-1 vote (AYES: Butzbach, Kirkwood, Kramer, Luhring, Taylor, and Nethery; NOES: None; ABSENT: Harkins). B. APPROVAL OF A COOPERATIVE AGREEMENT (CONTRACT NO. C ) TO PROVIDE FIRE PROTECTION, FIRE PREVENTION, RESCUE AND MEDICAL EMERGENCY SERVICES FOR THE CITY OF PALM DESERT. Public Safety Commission Approved Minutes February 10, 2016 Page 4 Chair Nethery commented that the law has changed and the agreement has to renewed before the current agreement expires. Stephen Aryan stated that the current agreement is set to expire on June 30, 2016. Recent legislation makes it imperative that the agreement be renewed before the expiration date, otherwise the City would have to obtain approval from the Local Agency Formation Commission (LAFCO) to provide new or extended services under a fire protection contract. A new government code statute also prevents the City and County from terminating the agreement without voter approval. Staff will work with the City Attorney in finalizing the agreement before taking this item to the City Council. The term of the new agreement is from July 1, 2016 through June 30, 2019. As of today, the County has not provided the City with a "Schedule A" cost estimate exhibit. Staff will return to the Public Safety Commission with this document and budget presentation at a later date, once the FY 2016/17 budget session is scheduled. Mr. Aryan noted that staff is working with the City Attorney to resolve some issues with Section III (Payment for Services) and that they intend to change the language before it's brought before the City Council. A question was asked by a Commissioner about letter C under Section II regarding the reference to equipment and whether a vital piece of equipment may be allowed to be moved out of the City of Palm Desert. Chief Talbot commented that vital pieces of equipment stay with a specific truck company and would not be moved elsewhere. A Commissioner requested that if modifications are going to be made to the contract, then it should come back to the Commission, time permitting, for their review before being presented to the City Council. Commissioner Butzbach moved to, by Minute Motion, recommend that the Palm Desert City Council approve a Cooperative Agreement (Contract No. C ) to provide fire protection, fire prevention, rescue, and medical emergency services for the City of Palm Desert, as approved to final form by the City Attorney, and if possible, bring the final agreement back to the Public Safety Commission. Seconded by Commissioner Kirkwood and carried by a 6-0-1 (AYES: Butzbach, Kirkwood, Kramer, Luhring, Taylor, and Nethery; NOES: None; ABSENT: Harkins). C. APPROVAL OF AN AMENDED SCHEDULE A EXHIBIT, FOR THE FIRE COOPERATIVE AGREEMENT, TO CONTRACT FOR A FULL-TIME EMERGENCY SERVICES COORDINATOR. Stephen Aryan stated that in 2015 the cities of Palm Desert and Indian Wells entered into an agreement to proceed with contracting for a shared full-time Emergency Services Coordinator. The City of Rancho Mirage is currently well - staffed in this area, therefore, did not wish to participate in the partnership. The County has identified Eric Cadden to serve in this position. Mr. Cadden currently serves as an instructor in all Palm Desert sponsored Community Emergency Response Team (CERT) classes and is very familiar with the City. His extensive Public Safety Commission Approved Minutes February 10, 2016 Page 5 knowledge of not only emergency management, but our community, is a true asset. The estimated prorated salary for the remaining fiscal year is $48,000 and initial vehicle/equipment costs are $70,000. Palm Desert's share of these costs is $59,000, which includes any necessary overtime for incident response and public presentation. Commissioner Kirkwood moved to, by Minute Motion, recommend that the Palm Desert City Council (1) approve the attached amended Schedule A Exhibit, for the Fire Cooperative Agreement, to contract for a Full -Time Emergency Services Coordinator, in an amount not to exceed $59,000 and (2) approve the purchase of a vehicle and necessary equipment for the Emergency Services Coordinator, estimated at $35,000. Seconded by Commissioner Kramer and carried by a 6-0-1 vote (AYES: Butzbach, Kirkwood, Kramer, Luhring, Taylor, and Nethery; NOES: None; ABSENT: Harkins). VIII. CONTINUED BUSINESS NONE IX. OLD BUSINESS NONE X. REPORT ON CITY COUNCIL ACTION(S) NONE XI. REPORTS AND REMARKS A. Citizens on Patrol Proqram 1. Frankie Riddle stated that seven members of the Palm Desert Citizens on Patrol were honored with the President's Volunteer Service Awards' highest honor. This program recognizes United States adult citizens who have achieved 500 or more hours of service over a 12-month time period. Ms. Riddle stated that the recognition from the President has motivated other members of the COPS program to volunteer more hours. B. Legislative Update NONE Public Safety Commission Approved Minutes February 10, 2016 Page 6 C. Police and Fire Departments Sgt. Dave Adams stated that the "Shop with a Cop" event went very well with 36 kids participating. The Palm Desert Police Department was very appreciative for the support from the City of Palm Desert. Captain Susan Trevino stated that the Citizens on Patrol volunteers will be helping the Sheriff bring in additional vehicles when President Obama arrives this week. The Palm Desert Explorers participated in a series of competitions in Arizona and came in 5th place overall out of 88 teams. The Swing n' Hops event on El Paseo was a wonderful event. The weather was beautiful and everyone was well behaved. Fire Chief Dan Talbot invited the commissioners to their live fire training on Tuesday, March 1. It will take place from 10 a.m. — 5 p.m. at 75135 Shadow Valley Road, near Xavier High School. He stated that this exercise is a unique opportunity to see firefighters at work in a realistic setting. D. Staff Ryan Stendell, Director of Community Development, spoke to the Commission about the different aspects of the cannabis business; dispensaries, cultivation and distribution. The City Council has prohibited everything with the exception of deliveries, which is still under review. An ad hoc committee is being formed to allow further discussion before a ruling is made. Stephen Aryan commented that another CERT class was just completed with 35 people in attendance. Eric Cadden was the trainer and will be our new Emergency Services Coordinator. The Family Safety Festival is scheduled for Saturday, March 19th at Civic Center Park. E. Public Safetv Commissioner Comments Commissioner Butzbach inquired as to the timeline for the Police and Fire budgets and requested that the Commissioners receive the budget packet in advance of the next meeting so that they would have time to review them. Mr. Aryan agreed and stated that he would email the budget to the Commissioners as soon as it was available. Public Safety Commission Approved Minutes February 10, 2016 Page 7 XII.
