3. Waive further reading and adopt Resolution No. 2016- 68 , approving the new
adjusted rate schedule of fees (Exhibit 3 for residential, commercial, and roll -off)
as per approved option.

Executive Summary
The current franchise agreement between the City and Burrtec Waste and Recycling
Services stipulates that in 2016 the Recycle Fee and Vehicle Impact/Road Maintenance
Fee would be considered for implementation. Based on staff's review of the Recycle
Fund, there is approximately $2,645,892 remaining (including anticipated FY 2015/16
expenditures). Based on an average yearly expenditure of approximately $600,000, the
current funding would continue through 2020/2021 (roughly 4-5 years). However, if the

Vehicle Impact/Road Maintenance Fee is approved, based on street maintenance
expenditures of $160,000-$200,000, the Recycle Fund could last through 2022/2023
(roughly 6-7 years). Since the City continues to have funds available within the
Recycle Fund and implementation of the Vehicle Impact Fee would extend the life of the
available funds, staff recommends a phased in approach of the fees with approval of
Option C outlined below.
Discussion
In May 2015, the City of Palm Desert approved an amended franchise agreement with
Burrtec Waste and Recycling Services that expires on May 31, 2023. As part of the
amended agreement, the Recycle Fee and Vehicle Impact/Road Maintenance Fee were
to be considered for implementation in 2016. In addition, each year Burrtec must
submit in writing its request for consideration of an annual rate increase based on the
Producer Price Index (PPI), which the City has received for 2016.
Review of the current Recycle Fund balance reflects a total of $3,145,892, prior to FY
2015/16 expenditures adjustment. Based on the last three years expenditures of
approximately $500,000 to $700,000 for recycle related programs/projects and streets
maintenance, the estimated balance of funds after adjustment is approximately
$2,645,892. Based on an average annual expenditure of $600,000, the existing
Recycle Fund is estimated to continue to the year 2020/2021.
The below items were negotiated in 2015 as part of the current agreement with Burrtec:
• PRODUCER PRICE INDEX:
- Burrtec to hold Producer Price Index (PPI) Increase (does not include tipping
fee/disposal increase) for three (3) years for COMMERCIAL ONLY -

- New Vehicle Impact Fee Based on Road Maintenance & Refuse/Recycle

- Food Waste/Organics Recycle Program (AB 1826) - 2016
The PPI increase for commercial is to be exempt for the years 2015, 2016, and 2017.
Burrtec has also extended the PPI increase exemption to residential customers for
2016. However, the PPI does not include the County of Riverside's tipping/disposal fee
increase of $0.86 per ton for trash and $3.00 per ton for green waste. Since the above
fees are to be considered for possible implementation, staff directed Burrtec to prepare
separate rate sheets that reflect the various rate scenarios to customers with
implementation of the fees. Given that consideration for the contract extension was
also based on the purchase of new vehicles, attached is a list of purchases made from
2014-2016.

Attached for Council's information is a rate comparison of Palm Desert 2016 rates vs.
2016 rates of other local cities. The residential comparison rate reflects both the trash
and green waste as other cities have green waste included in the trash fee. Based on
the comparison, Palm Desert is at the lowest rate for 2016, excluding the recycle and
vehicle impact fees.
Outlined within the tables below are scenarios of the rate increases with the
implementation of the PPI (Tipping/Disposal) Fee, Recycle Fee, and/or Vehicle
Impact/Road Maintenance Fee:

with higher service demand will have a higher rate increase (e.g., customer with
three 3-yard trash and recycle bins serviced five times each week will have
increased costs of $233.70 per month).
Based on implementation of the Recycle Fee and/or the Vehicle Impact Fee, residential
customers will experience a monthly rate increase as follows:
• PPI and Vehicle Impact Fee: $0.77
PPI and Recycle Fee: $0.81
• PPI and Recycle and Vehicle Impact Fee: $1.50
However, the impact to commercial customers is significantly different. With the
implementation of one or both fees, the rate increase could range from $21.69 to $43.10
per month for smaller businesses, to $120.00 to $233.70 or more per month (dependent
upon service level) for medium to larger businesses/property management.
It should be noted that the revenue generated from the two fees is designed to offset
costs to the City for related expenditures. The revenue generated from both the Recycle

Fee and Vehicle Impact Fee is based on estimated costs determined within the
respective studies undertaken for each fee. The yearly revenue for recycle related
programs is $589,000 and $555,930 for street maintenance.
Burrtec and City staff are still working to develop a Food Waste/Organics Recycle
Program and associated fee(s) with the intent to bring forward the program and rate
structure in the later part of 2016.
Since the Recycle Fund still has several years of funding at the existing expenditure
rate, and there would be a significant impact to commercial customers if both fees were
to be implemented, staff is recommending City Council consider a phased in approach
with the approval of Option C — implementation of PPI/County Fee and Vehicle Impact
Fee. This option would extend the life of the Recycle Fund and phase in the fees to
lessen the impact to commercial customers. However, with the amount of remaining
funds, Option A is viable with a phased in approach in future year(s).
Fiscal Analvsis
Implementation of Option A or Option C will not negatively impact the City's General
Fund. Option A approves the PPI and County Tipping/Disposal rate increase that will
pass through to Burrtec customers. The Option C rate increase will also pass through
to Burrtec customers, except the Vehicle Impact/Road Maintenance Fee portion will be
collected by Burrtec and remitted to the City in the approximate amount of $555,930.

RESOLUTION NO. 2016-68
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING TAX
ROLL BILLING, THE NEW ADJUSTED RATE SCHEDULE
OF FEES (EXHIBIT 3A, 313, AND 3C) FOR RESIDENT,
COMMERCIAL, AND ROLL -OFF) FOR THE COLLECTION,
RECYCLING, AND DISPOSAL OF MUNICIPAL SOLID
WASTE AND RESIDENTIAL/ COMMERCIAL RECYCLING
AND NEW VEHICLE IMPACT/ROAD MAINTENANCE FEE
CONTAINED IN CONTRACT NO. C —
SOLID WASTE MANAGEMENT SERVICES
WHEREAS, on the 15' day of June 2015, the City approved its Amended
Franchise Agreement with Burrtec Waste and Recycling, LLC and approved the
Agreement at its meeting of May 28, 2015; and
WHEREAS, the term of the Franchise Agreement extends to May 31, 2023; and
WHEREAS, Burrtec now provides solid waste collection and residential and
commercial recycling services to the residents and businesses within Palm Desert; and
WHEREAS, the franchise agreement sets forth rates for solid waste collection
and recycling services within the City of Palm Desert as provided in Exhibits 3A, 3B,
and 3C and 4A, 4B, and 4C and commencing on the second year of said agreement
new rates may be applied at 100% of the PPI with a 5% cap unless otherwise approved
and to become effective July 1st of each year; and
WHEREAS, the Riverside County Waste Resources Management District
(RCWRMD) sets the landfill tipping fees and effective July 1, 1996, reduced the landfill
tipping fee from $38.50 to $30.00 per ton; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
SECTION 1: That the City Council of the City of Palm Desert, California,
rescinds all previous resolutions.
SECTION 2: The annual rate increase shall be 100% of PPI with a 5% cap.
SECTION 3: The Franchise Agreement now provides for Tax Roll Billing that
commenced with the November 2015 Tax Roll for the billing period of July 1, 2015 to
June 30, 2016 and shall continue until such time as rescinded.
RESOLUTION NO. 2016-68
SECTION 4: Burrtec will pay to the City $1.06 to be divided $.73 to the Recycle
and $.33 to the General Funds.
SECTIONS: That the City Council of the City of Palm Desert, California,
effective July 1, 2016, ratifies the 0% (December 2014 to December 2015) Producer
Price Index and 12.65% gate/disposal fee pass through increase for solid waste
collection and recycling service requested by Burrtec Waste and Recycling as provided
for in the Franchise Agreement for 2016.
SECTION 6: Burrtec to hold Producer Price Index (PPI) Increase (does not
include tipping fee/disposal increase) for three (3) years (2015, 2016, and 2017) for
commercial only commencing in July 1, 2015. Burrtec extended PPI exemption to
residential for the 2016 year only.
SECTION 7: That the County of Riverside has increased the per ton
gate/disposal fee at the transfer station/landfill from $44.24 to $45.11 an increase of
$0.87 for Disposal Tipping Fee per ton and from $28.00 to $31.00 and increase of $3.00
for Greenwaste Tipping Fee per ton.
SECTION 8: The City Council of the City of Palm Desert, California, approves
the new solid waste rate increases for 2016 as reflected in each Exhibit 3 to become
effective July 1, 2016.
SECTION 9: That the City Council of the City of Palm Desert, California,
approved in 2013 the utilization of the remaining AB939 fees of $1.87 (formerly $4.19)
per ton tipping fee plus an additional $.03 per ton so that residential and commercial
customers (excluding roll off and other special services) did not absorb the PPI and
gate/disposal fee increases for 2013.
SECTION 10: The additional $.03 per ton was absorbed by Burrtec in mid-2013.
SECTION 11: The City Council of the City of Palm Desert, California, approved
the commercial recycle rate structure established at 35% of the trash fee and includes
the 8% Franchise Fee. Rate reflected on Exhibit 3B became effective November 1,
2013.
SECTION 12: The City Council approved the implementation of the Vehicle
Impact/Road Maintenance Fee effective July 1, 2016, at the rate of 6.39%. See Exhibit
3A, 3B, and 3C for actual dollar amounts. (Section may be revised based on Council
action.)
SECTION 13: All other solid waste and commercial recycling rates, services, 8%
franchise fee, any other fees, reports, etc. shall be in accordance with the Agreement
currently in effect.

to replace eight (8) (or approximately 50%) of its route trucks with alternative fuel
sources

2017, THE CONSIDERATION BY THE CITY COUNCIL OF THE

COLLECT SUCH CHARGES ON THE TAX ROLL
NOTICE IS HEREBY GIVEN, pursuant to California Health and Safety Code section 5473 et
seq., that the City of Palm Desert (the "City") has caused a written report to be filed with the City
Clerk of the City describing each parcel of real property receiving City Solid Waste and
Recycling services and the amount of the Solid Waste and Recycling service charges to be
imposed on each parcel for Fiscal Year 2016 — 2017, computed in conformity with the charges
prescribed by resolution of the City, and any delinquencies due and owing for such charges for
each affected parcel. A copy of the written report is available at the City Office located at
73510 Fred Waring Drive, Palm Desert, California 92260, California, and may be reviewed there
by any interested person. NOTICE IS FURTHER GIVEN that a public hearing has been
scheduled for July 14, 2016, at 4:00 p.m., in the City Council Chambers in the Civic Center,
located at 73510 Fred Waring Drive, Palm Desert, California 92260. At the public hearing the
City Council will hear and consider all evidence, testimony, objections, or protests, if any, to the
written report by all interested persons, and may continue the hearing from time to time. If the
City Council finds that protest is made by the owners of a majority of separate parcels of
property described in the report then the report shall not be adopted and charges shall be
collected separately from the tax roll and shall not constitute a lien against any parcel or parcels
of land. Upon conclusion of the hearing, the City Council may: (1) adopt, revise, change,
reduce or modify any charge or overrule any or all objections and make its determination upon
each charge as described in said report which determination shall be final; (2) adopt the report
as presented or modified by the City Council; and (3) direct the City Manager to file a copy of
the report as presented or modified with the Auditor of the County of Riverside for the purpose
of placing the Fiscal Year 2016 — 2017 Solid Waste and Recycling service charges and any
delinquencies on the tax roll.
All interested agencies, groups, and persons wishing to comment are invited to attend the public
hearing. Interested parties should appear at the above set public hearing to provide oral
