QUALIFICATIONS/PROPOSALS FOR THE MAINTENANCE AND
OPERATIONS OF THE DESERT WILLOW GOLF RESORT
SUBMITTED BY: Justin McCarthy, Interim City Manager
Rudy P. Acosta, Assistant City Manager
DATE: September 22, 2016
CONTENTS: Market Analysis of Golf Course Operations (May 2016)
'Draft' RFQ/RFP for Maintenance and Operation of Desert Willow Golf
Resort
Recommendation
By Minute Motion, that the City Council grant authorization for staff to:
1. Provide proper notification to Kemper Sports Management (prior to
January 1, 2017), of the City's intent to release a 'Request for
Qualifications/Proposals for the Maintenance and Management
Operations of the Desert Willow Golf Resort'.
2. Advertise and solicit a Request for Qualifications/Proposals (RFQ/RFP)
from qualified golf course management companies for the maintenance
and operations of the City's Desert Willow Golf Resort.
3. Establish the formation of an Evaluation Committee for the purpose of
conducting the interview and evaluation process of the proposals
submitted by qualified golf course operation firms.
Envision Palm Desert
The continued development and operation of Desert Willow Golf Resort aligns with multiple
objectives of the City's Strategic Plan. Desert Willow's golf courses and hospitality
components provide Palm Desert residents and guests a premier resort -recreational
experience within an environmentally responsible and sustainable environment.
Additionally, Desert Willow's Hospitality properties provide; a variety of employment
opportunities and, a continued revenue source for the property's maintenance costs and an
opportunity to increase the City's transient occupancy tax revenue through expanded
development of the remaining undeveloped sites.
Background
On November 15, 2012 the City Council approved the current management agreement
between the City of Palm Desert (the City), the Palm Desert Recreational Facilities

Corporation (PDRFC), and Kemper Sports, Inc. (Kemper) to operate and manage the
Desert Willow Golf Resort. The agreement term (for three years) commenced on July 1,
2013 and included two one-year options to extend the contract services at the City's
discretion.
On December 10, 2015, the City Council approved, in accordance with management
agreement Section 2.1 (6), a one year extension of the agreement with Kemper to continue
as operator of Desert Willow Golf Resort. Said extension, became effective on July 1, 2016
and will expire on June 30, 2017. Note: If Council desires to exercise the final one year
extension to Kemper's contract, authorization and notification must be acted upon by
January 1, 2017.
In addition to authorization of the contract extension, Council authorized staff to act on the
following; one, work with Kemper to perform a Market Analysis of Golf Course
Operations/Management and two, prepare and release a RFQ/RFP for Golf Course
Management/Maintenance Operations of the Desert Willow Golf Resort in a timely manner
and for an operations contract award beginning with the 2017-2018 fiscal year.
At the Council Study Session in May 2016, City and Kemper staff successfully presented
the Market Analysis to the apparent satisfaction of Council. Specifically, the study
highlighted the more popular agreement formats employed by the golf operator industry and
provided a comparison matrix of similar regional golf resorts. A copy of the Market Analysis
presentation is attached to this report as Exhibit A for the Council's review and reference.
Over the twenty plus years of Desert Willow's operation, Kemper Sports Management has
served as the golf resort's only operator. Testimony to Council's general satisfaction of
Kemper's performance, are the multiple contract renewals and extensions granted to
Kemper over this time period. However, given the duration, Council has expressed concern
about the broader responsibility to its residents by ensuring that the city was receiving the
best deal for golf course operations at Desert Willow. Therefore and in accordance with
Council direction of December 10, 2015, staff has prepared a 'Draft' RFQ/RFP for the
Operations and Maintenance of Desert Willow Golf Resort. A copy of the RFQ/RFP
document is attached as Exhibit B for the Council's review and discussion prior to issuance.
Discussion
The current Desert Willow operations agreement has evolved over the years to adapt to
various changes in the Resort, the economy and/or the industry. In any case, the contract
format and specifications have served the property, the City and guests of Desert Willow
well. Desert Willow's performance as a 'business enterprise' has been financially
successful and has allowed the City to essentially mitigate any burden on the General Fund.
Additionally, the standard and quality of the maintenance, programs and services offered at
Desert Willow continue to generate positive reviews and the highest customer rankings
amongst similar resort properties. Therefore, programmatically, staff recommends that
current Desert Willow operations performance specifications and quality standards remain
as an essential criterion in the evaluation and ultimate determination of the most qualified
firm. Specifically, the preservation of Desert Willow's character, amenities, services and
programs shall be reflected as the highest priority in the interview and evaluation process.

In addition, there are four (4) key and critical components, within the current Operations
Agreement, that are exclusive to Desert Willow Golf Resort operations. Those key
components are:
1) The Operator and its affiliates agree not to manage, own, or operate any other golf
course property within a 20 mile radius of Desert Willow without the City's approval.
2) The Operator guarantees and ensures sufficient cash flow by agreeing to maintain a
minimum cash reserve of $500,000 at the sole cost of the operator. Cash flow
needs in excess of operational revenues, if needed, is funded by the operator at the
end of each month. The guarantee curbs the enterprise fund from seeking potential
short term operational cash flow from the City's General Fund at any time the
property is managed by the operator.
3) The City retains the option to decide whether to continue the Learning Center (the
Academy at Desert Willow). This right allows the City to make a real-time budget
decision at Desert Willow without harming the Desert Willow Operator or any other
amenity of the golf resort.
4) Corporate administrative costs borne by the Operator remain with Operator. The
Operator shall not allocate or pass through the costs of their corporate or regional
staff that have oversight responsibility of Desert Willow.
Again, the aforementioned key components of the agreement are exclusive to Desert
Willow and its Operator. At the writing of this report, there are no other known golf course
operations agreements within the Coachella Valley and State of California that employ the
same exclusive components. It is important to note that other local municipal golf course
properties have historically demonstrated a need for subsidies from the general fund
accounts of their respective cities to maintain operations. Fortunately, this has not been the
case at Desert Willow Golf Resort and may largely be attributed to the agreement
requirements listed above. Therefore, staff recommends that Council maintain the same as
programmatic requirements within the RFQ/RFP.
The RFQ/RFP process will require a fair and comprehensive evaluation of the proposing
teams and their respective submittals. Due to the broad requirements and multiple
complexities of Desert Willow's operation, staff is recommending that a RFQ/RFP
Evaluation Committee be assembled to interview the teams and evaluate the submittals of
those firms who submit qualified proposals. Staff recommends that key staff members who
serve on the Desert Willow President's Committee and, two City Council members and, one
member each from the Palm Desert Recreational Facilities Corporation Board and Hotel
and Signature Events Committee be assigned to serve on the Evaluation Committee. Prior,
staff will prepare proposal evaluation criteria for the committee members to utilize during the
interview and evaluation process. Upon completion of the evaluations, staff will provide the
Committee's recommendation of the most qualified firm to operate Desert Willow Golf
Resort and for the Council's appropriate action.
Lastly, upon City Council direction, it is anticipated that the RFQ/RFP process may be
completed by the end of the calendar year. The timing will be critical in order to allow
sufficient time to develop a successful transition of any potential new operator to Desert

Willow Golf Resort. Therefore staff recommends the following milestones be employed for
the RFQ/RFP process:
October 3, 2016
RFQ/RFP Advertisement and Solicitation
October 10, 2016
Mandatory Pre-Proposal/Site Walk Meeting
October 31, 2016
RFQ/RFP Submittal Due Date
November 7-11, 2016
RFQ/RFP Submittal Evaluations and Interviews
December 8, 2016
Recommendation to City Council
Note: The above schedule represents a 'best case scenario' but allows for minimum slip
time if any of the listed milestones are not met.
Fiscal Analvsis:
The current annual Desert Willow Golf Resort Management and Operations fee is $789,000
which is paid directly from the operations of the golf resort operating accounts. This fee also
includes the costs of three key employees whose salaries are not paid through operations.
The current 'key employees' are listed as the golf course Superintendent, the golf resort
General Manager, and the Clubhouse Manager.
Although staff cannot anticipate the operations fee amount that will be submitted by the
proposing teams, it is important to note that Desert Willow Golf Resort has operated
efficiently by its current operator of twenty years, Kemper Sports Management, Inc. Since
inception, the golf resort has utilized its own cash flows to sustain the annual operations
which encompass paying for all of its costs directly related to the day-to-day operations,
including the payment of 100% of the management fee, without any subsidy from the City's
General Fund.
