Approve Change Order No. 1 to Contract No. C28800E for a decrease in the contract price of $16,930.45, and a 12-day contract time extension for the Free Right Turn Lane at Fred Waring Drive and Highway 111; 2. Authorize the Mayor to execute said Change Order No. 1; and 3. Accept the work for the Free Right Turn Lane at Fred Waring and Highway 111 as complete, and authorize the City Clerk to file the Notice of Completion for Contract No. C28800E (Project No. 658-08). Strateqic Plan Obiective The project furthered the goals of the strategic plan by providing a safe and efficient transportation system for both residents and visitors. Backqround In March 2008, the City was awarded federal Congestion Mitigation and Air Quality (CMAQ) grants for eight projects. The Regional Transportation Improvement Program (RTIP) was approved, which allows the City to proceed with the development of the projects. One of these projects was the reconfiguration of the right turn lanes from westbound Fred Waring Staff Report NOC and CO# 1 for Contract No. C28800E All American Asphalt (Project No. 658-08) Page 2 of 2 October 27, 2016 Drive to northbound Highway 111. This project eliminated the dual right turn lanes and replaced them with a single, unrestricted free right turn lane. In December 2012, the City Council approved the appraisals and set just compensation for the property acquisition required to construct the free right turn. In September 2015, Caltrans authorized the construction phase of the project. Staff did not want to construct during the winter season and opted to wait until summer of 2016. On March 10, 2016, the City Council awarded Contract No. C28800E in the amount of $313,765.00 to All American Asphalt for the Free Right Turn Lane at Fred Waring Drive and Highway 111 Project. During construction of the project, the contractor experienced a few challenges with the construction of the monument sign. The design of the new footings delayed the final installation. The free right turn lane was opened on schedule, but the final monument sign construction was delayed approximately two weeks. Therefore, a twelve -day extension to the project is justified and is granted by this change order. The decreased amount in the contract price was due mainly to a decrease in the total amount of asphalt grinding required. The quantity of several construction items were also less than the estimated bid items. Staff has inspected the work performed by the contractor and has found said work to be complete and in accordance with the contract requirements. Fiscal Analvsis The initial contract amount was $313,765.00. Change Order No. 1 will decrease the contract amount to $296,834.55. The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Order items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner. Contract Time Extension 12 Days. Revised Contract Total $296,834.55 The undersigned Contractor approves the foregoing Change Order # 1 as to the changes, if any, in the contract price specified for each item including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said Change Order # 1 . The Contractor agrees to furnish all labor and materials and perform all other necessary work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that the Change Order shall be effective when approved by the Owner. Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as any and all consequential damages. This document will become a supplement to the Contract and all provisions will apply hereto, all items included above must have required signatures as per the purchase resolution.
