Approve an exception to Palm Desert Municipal Code Section 9.58.010 (Consumption of Alcoholic Beverages on Public Property) for Desert Theatreworks to allow the sale and consumption of alcoholic beverages at the attached list of productions at The Joslyn Center's Arthur Newman Theatre, located at 73-750 Catalina Way. 2. As a condition of approval, require Desert Theaterworks submit proof of liquor liability coverage, including naming the City of Palm Desert as an additional insured party to such coverage. 3. Authorize the City Manager or her designee to sign the Daily License Application from the California Department of Alcoholic Beverage Control for these events. Strateqic Plan Obiective Approving this municipal code exception to serve alcohol does not directly tie into the strategic results portion identified in the Palm Desert Strategic Plan. However, the theatre productions at the Joslyn Center are geared toward a wide audience, providing a cultural and lifestyle entertainment enrichment for all ages. Background Since 2013, the Joslyn Center has allowed Desert Theatreworks (DTW), a theatre company serving the Coachella Valley, to produce various plays and musicals at the Staff Report: Municipal Code Exception October 27, 2016 Page 2 of 2 a resource for both the residents and visitors to the Coachella Valley, to enrich the cultural depth and education of the community at large. In 2016 & 2017, DTW will again produce various plays and musicals, including Agatha Christie's A Murder is Announced, Christmas My Way (A Sinatra Holiday Bash), and numerous other productions totaling 38 shows (see attached list). As part of these events, alcohol will be sold and consumed consisting of beer, wine, and pre -mixed hard liquor (e.g. bottled margaritas, etc.). As DTW is serving alcohol at a City owned property, an exception to Palm Desert Municipal Code Section 9.58.010 is required. DTW is also required to complete a daily license application from the California Department of Alcoholic Beverage Control (ABC) and obtain the property owner's signature. The City's Risk Manager also recommends that DTW maintain liquor liability coverage, naming the City of Palm Desert as an additionally insured party. Staff recommends approval of the exception and authorization of the City Manager, or her designee, to sign the ABC application, as long as the appropriate insurance coverage is maintained. Before and during performances they sell alcoholic beverages to their patrons. In the past they have obtained and produced to the Joslyn Staff proof of Daily Licenses from the local ABC. As you shared with me, the owner of the property is the City of Palm Desert and thus each Daily License Application must go before City Council for approval and authorization for the City Manager's signature.
