REQUEST: REAPPOINTMENT OF DOUG WALKER AS CITY OF PALM DESERT'S
REPRESENTATIVE TO THE COACHELLA VALLEY MOSQUITO AND

Recommendation
By Minute Motion:
1) Reappoint Douglas J. Walker as the City of Palm Desert's representative to the Coachella
Valley Mosquito and Vector Control District (CVMVCD) Board of Trustees for a full
four-year term, January 2017 to January 2021.
OR
2) Reappoint Douglas J. Walker as the City of Palm Desert's representative to the CVMVCD
on an interim basis until such time as City Council can complete an interview for this
position.
Strateaic Plan Obiective
This request represents routine conduct of the City's municipal affairs; additionally, it supports
citizen involvement in the City's governance and, in this case, that of the entire Coachella Valley
and Southern California Region.
Backaround
Doug Walker was first appointed as the City's representative to the CVMVCD on January 11,
2007, and has been reappointed twice, with current term expiring on January 1, 2017.
CVMVCD's Clerk of the Board notified the City that it is time to either reappoint Mr. Walker, or
appoint a Councilmember or other eligible City resident to the position, for a term that
commences January 2, 2017 (first Monday of January).
Staff Report -
January 2021
December 8,
Page No. 2
Reappointment of Doug Walker to the CVMVCD, January 2017 -
Staff spoke with Mr. Walker and inquired of his continued interest in serving the City in this
capacity, and the response was a very resounding, "Yes;" providing, of course, that the City
would like him to do so. He is currently serving as President of CVMVCD, also the greater area
as Southern California Region Council Trustee to the Mosquito and Vector Control Association
of California, and is scheduled to take over as Chairman of the Council in January 2017. His
representation in this capacity would be contingent upon reappointment to the local Board. As
a retired Professor of Natural Resources and Entomology, Dean, and Division Chair at College
of the Desert, he is ideally qualified for the appointment and serves both Palm Desert and the
region well.
However, staff further advised Mr. Walker that there was a three-part timing concern in this
instance. First, it involved City Council's earlier 2016 action directing interviews be conducted
for all incumbent City Committee/Commission Members and related appointees (e.g. CVMVCD)
prior to reappointment consideration. Secondly, there was reorganization of the City Council
occurring at the first regular meeting in December. Thirdly, CVMVCD's bylaws require that the
Member Appointee be in place prior to the first Monday in January for the term being filled.
Doug offered to make himself available to meet with Councilmembers prior to December 8 if it
would be of help in this process.
The aforementioned notwithstanding, staff recommends approval of a full -term reappointment
of Doug Walker to the CVMVCD but stands ready to respond to your action and/or further
direction in this matter.
Fiscal Analvsis
There is no fiscal impact to the City with approval of this reappointment.

I am writing to inform you that Trustee Walker's term, on the Coachella Valley
Mosquito and Vector Control District ("District") Board of Trustees, will expire
at noon on January 5, 2013. (Health and Safety Code § 2023(c))
A Trustee appointed by a City Council must be a voter in that City and a resident
of that portion of the City that is within the District. (Health and Safety Code
§2022(b)). Incidentally, a member of the City Council may be appointed to serve
on the Board without violating the prohibition on holding incompatible offices.
(Health and Safety Code §2022(c)).
Trustees appointed to the Board should have "experience, training, and education
in fields that will assist them in the governance" of the District (Health and
Safety Code §2022(d)) and the term of the new appointment may be for either two
years or four years, at the discretion of the appointing authority. (Health and
Safety Code §2024(a)).
Once a Trustee is appointed, he or she shall exercise their independent judgment
of the interests of the public as a whole and not solely the interests of the City
Council. (Health and Safety Code §2022(d)) In addition, once appointed, the
Trustee may not be removed or replaced by the City Council prior to the
expiration of the Trustee's term, with limited exceptions. (Attorney General
Opinion No. 09-502).
In light of the foregoing, the District respectfully requests that your City Council
either appoint a new Trustee or reappoint Mr. Walker, on or before the expiration
of his term, as set forth above.
Please do not hesitate to contact me at (760) 342-8287 if you have any questions or comments
regarding this matter.

Re: Request that Future Appointments be Based on Calendar Year
Dear Carlos:
I am writing to ask for your assistance regarding the future
appointment of Trustees from your agency to our Board. It has
recently been brought to my attention that the terms of office for
certain Trustees from member agencies are not in conformity with
Section 2024 of the Health and Safety Code. This Code Section
requires that terms of office for appointees be for either two or four
years, at the appointing authority's discretion, and must commence
at noon on the first Monday in January, and follow the calendar
year.
The terms of office for several Trustees are set to expire in the near
future. In light of this fact, I request that the appropriate appointing
bodies take action to conform these new terms to the
aforementioned requirement.
Thank you in advance for your help in this matter. Please feel free
to contact me if you have any questions.

Re: Volunteer Service for Palm Desert
Dear Councilman Kelly:
This letter is a follow-up to a conversation we had late last fall. Having recently retired
from College of the Desert after serving thirty-four years at that institution, I am hoping
to use my expertise and experience to serve our community. It has come to my attention
that the City of Palm Desert appoints a representative to sit on the governing board for
the Coachella Valley Mosquito and Vector Control District. Apparently, you have a very
capable individual currently serving in that role, and I am not interested in displacing that
. person. However, if and when he decides to step aside, I would appreciate being
considered for filling the vacancy.
Attached, you will find a resume that includes some of my qualifications for serving as
the Palm Desert representative on the CV Mosquito and Vector Control District board. It
appears that my academic background in entomology, and career in education, including
management experience, would provide an excellent fit for this particular board position.
Please let me know if you would like to meet and discuss my interest and background.
Also, it would be appreciated if you could keep my request on file for future
consideration when a vacancy occurs.
Since ly,
