Recommendation
By Minute Motion:
1. Ratify the City Manager's authorization for additional costs and
approve Change Order No. 2 to Contract C33860 with Creative
Contractors, Corp. in the amount of $4,250.00;
2. Authorize the transfer of $1,266.92 from contingency to base; and
3. Authorize the Mayor to execute Change Order No. 2.
The difference between the amount of Change Order No. 2 and the available
contingency is $2,983.08. No additional appropriation is required for this amount as the
funds are already available in Account No. 233-4674-454-4001, Civic Center Park Fund.
Background
On August 28, 2014, Council awarded Contract No. C33860 to Creative Contractors,
Corp. for the Civic Center Shade Structure Replacement Project in the amount of
$70,885.00.

On December 11, 2014, City Council approved Change Order No. 1 in the amount of
$5,821.58 for additional poured -in -place rubber surfacing and lighting for the tot lot,
increasing the contract amount to $76,706.58.
During demolition of the area it was discovered that the footings originally poured for the
shade structure were well beyond the known area and much deeper than typical
industry standards. The additional cost to remove the footings is $4,250.00. On
February 10, 2015, City Manager authorized the Change Order in an effort to keep the
job moving forward. This increases the contract amount to $80,956.58.
Fiscal Analysis
There is no fiscal impact beyond the contract change order amount.

Contract C33860 Change Order No. 2 Continued from front
This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish
equipment and materials, and perform all work as necessary or required to complete the Change Order items for a
lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner.
Contract Time Extension -0- Days.
Revised Contract Total $80,956.58.
The undersigned Contractor approves the foregoing Change Order No. 2 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Change Order No. 2. The Contractor agrees to furnish all labor and materials and perform all other necessary work,
inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order
items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood
that the Change Order shall be effective when approved by the Owner.
Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies,
waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of
or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and
indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as
any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.

Subject: Change Order No 4 for Civic Center Playground Shade Structure
Replacement- Project 725-15
On August 28, 2014, Council awarded Contract No. C33860 to Creative Contractors Corp for
the Civic Center Shade Structure Replacement Project. On December 11, 2014, City Council
approved Change Order No. 1 for Creative Contractors, Inc., in the amount of $5,821.58, for
additional safety lighting for the tot lot area.
Fabrication of the material is complete and installation of the replacement shade structure
began on January 26, 2015. In beginning the demolition, it was discovered that the footings
originally poured for the shade structure were well beyond the known area and much deeper
than typical industry standards, as well as discovering footings left in place from previously
removed play equipment. A field meeting with the contractor was held to discuss the best
course of action. In order to property install the shade structure, without encroaching into the
playground use zones, all of the old footings must be removed and new ones installed where
appropriate.
The amount of Change Order No. 2 is $4,250.00. Funds are available for this change order in
account number 233- 4674-454-4001. Staff will take this item to City Council for ratification.
A copy of the proposal is attached for your reference.

TERMS:

CONDITIONS:
$4,250.00
1) Customer will mark, cap and/or relocate all underground utilities/irrigation prior to start of job. Contractor will not
be responsible for damage to utilities, irrigation, etc marked incorrectly.
2) Unless noted, Contractor will not be responsible for repairing landscape if damage occurs due to
inadequate access.
3) Unless noted, dirt removed for footing holes will be dumped & spread on -site. If off -site dumping is required,
additional fees will apply.
4) ASTM and CPSC Guidelines will be met or Contractor has the right to refuse installation of playground
equipment. Additional charges may apply if changes are necessary to comply with these guidelines.
5) Completion date could incur unavoidable delays due to weather and/or missing/incorrect parts for
playground equipment.
